Romanus Pontifex
Bull on the reform of the Apostolic Penitentiary and the office of the Major Penitentiary
XXXI.
The limits of the faculties of the Major Penitentiary are confirmed. Innocent, Bishop, servant of the servants of God, for perpetual memory of the matter.
1 The Roman Pontiff, father and pastor of all the faithful, holding the place of Him who, in order to make safe those redeemed by the outpouring of His precious blood, emptied Himself, ought to apply himself with principal and unwearied zeal to those things by which the salvation of the flock committed to him in heaven is more abundantly provided for, and to exercise through himself, and respectively through others, by provident dispensation, that power which is attributed to him in Peter the prince of the Apostles, by which, with the infallible testimony of Christ the Lord, whatsoever he shall loose on earth shall be loosed also in heaven. With this consideration in view, the Roman Pontiffs, our predecessors, granted to the office of the Apostolic Penitentiary and to the Major Penitentiary many and ample faculties, and these they sometimes reformed, especially in those matters which did not concern the internal forum, and sometimes enlarged and changed, as the circumstances of things and times required. The faculty of the Major Penitentiary was not always the same, as is evident from the constitutions cited below, namely those of Pius IV, Pius V, Gregory XIV, Urban VIII and other Pontiffs. In this Pontiff's constitution issued in 1691, on the 7th of May, pontificate 1, the faculty of judges concerning the return of homicides was reformed, and by the constitution issued in 1692, on the 18th of November, pontificate 2, the faculty of particular tribunals was revoked.
INNOCENT XII, POPE
2 451 An. C. 1692 opportunities and vicissitudes carefully weighed, they judged it to be wholesomely expedient in the Lord.
3 § 1. Indeed, at another time, after the more ancient establishment of such an office, our predecessor of blessed memory, Pius IV, intent upon the pastoral care of the reform of the offices and tribunals of the Roman Curia, directed the eyes of his consideration to the office of the same Penitentiary, in which the censure of morals and the salvation of souls chiefly turn; and having taken counsel thereupon with the Cardinals of the Holy Roman Church then existing with mature deliberation, and having heard the Major Penitentiary himself and his officials, and having maturely considered all things, by the counsel of the same Cardinals, which for the future in perpetual times to come the Major Penitentiary then existing, the regent, the correctors, the superiors and procurators, and all whosoever his officials and ministers might be, ought entirely to cease and abstain from all those things which were contained in the chapters and prohibitions then drawn up and which did not for the most part regard the internal or penitential forum, by certain letters expedited in the year of the Lord's Incarnation 1562, on the 5th of May, in the 3rd year of his pontificate, he established and ordained by apostolic authority.
4 § 2. Subsequently, our predecessor also of revered memory, Pius V, perceiving that the time and necessity and the nature of the office of the Minor Penitentiaries demanded that in many matters of the Roman Curia he should henceforth propose a new form, and this care especially pressing upon him that he should apply himself in the first place to those things which regarded the salvation and danger of souls, and wishing to begin with the aforesaid office of the Penitentiary and to establish for it a new facility for the future, from the fullness of apostolic power, he revoked, suppressed and abolished all and every authority, jurisdiction and ordinary and delegated power of the same office and Major Penitentiary, and all and whatsoever privileges, faculties and indults, granted to those and all other colleges and persons of the said Penitentiary then existing from the institution of the office itself through whatsoever Roman Pontiffs his predecessors and himself and the Apostolic See, even by motu proprio and his certain knowledge, and from the aforesaid fullness of power, both in general and in particular, and by special and express mandate, even issued by word of mouth, and from whatsoever causes, confirmed, and also previously by the aforesaid Pius IV his predecessor reformed, restricted and moderated, in whatsoever formulas conceived, and also restrictive, with derogations of derogations, and other stronger and more efficacious and also clauses carrying the force of a contract, as well as irritant and other decrees supported, the tenors of all of which he wished to be held as expressed, whatsoever were (the power of his Minor Penitentiaries and the ordinances concerning them and their status previously issued by letters remaining safe and intact), and otherwise, as is more fully contained in the letters of the same Pius V his predecessor expedited on the 4th of May in the year aforesaid of the Incarnation 1569 and the 4th year of his pontificate thereupon.
5 § 3. And so that the aforesaid Pius V, our predecessor, having explained in a new form the quality, number, functions and offices of the ministers of Penance, might be able to prescribe anew for the future a complete form, by which the office of the Penitentiary itself, relieved and freed of certain faculties which were more suited to other offices, might thereafter pursue with more attentive study those matters which chiefly concerned the salvation of souls, on the fifteenth day before the Kalends of July of the same year 1569 he issued two constitutions, in the first of which, which begins In omnibus rebus, he ordained for the future the quality, number, functions and offices of the ministers; and in the other, which begins Vi bonus paterfamilias, he entrusted to the Penitentiary office only those faculties therein mentioned, which he judged to be most proper to the penitential function and suited to the remedy of needy Christian faithful.
6 § 4. Then nevertheless the same Pius V, our predecessor, and his successors, the Roman Pontiffs, by very many declarations of the living voice and pious memory, and Gregory, Pope XIV, likewise our predecessor, even by his letters in the form of a Brief issued on the tenth day of April of the year 1591, reformed and as aforesaid extended the faculties of the aforesaid office many times over. § 5. But when such faculties, as aforesaid, were multiplied and increased very many times, Urban, Pope VIII, likewise our predecessor, following in the footsteps of the aforesaid Pius IV and Pius V, our predecessors, by his letters likewise issued in the form of a Brief on the seventeenth day of September of the year 1634, the twelfth of his pontificate (with the revocation, as to the chapters therein described, of whatever faculties or indults and declarations of the living voice granted thereupon and otherwise emanated, which would be contrary to those letters), by his own motion, from certain knowledge and mature deliberation, and from the fullness of apostolic power, decreed and ordained that henceforth for perpetual future times the greater penitentiary, and the regent of the same Penitentiary, and the other officials and ministers thereof for the time being, should entirely cease and abstain from the granting, commission and expedition of particular cases and matters therein expressed, which otherwise would be null.
7 § 6. Yet even after such particular reformation, other declarations of the living voice of the Roman Pontiffs down to these times have supervened, amplifying and respectively moderating these faculties.
8 § 7. Hence we, desiring to consult for the salvation of souls and for the order and distinction of faculties competent to each office and tribunal, as much as is granted to us from on high, and therefore weighing with careful meditation the multiplicity, variety and changes of the aforesaid apostolic letters and declarations of the living voice, have decreed to select the faculties of our Penitentiary and greater penitentiary, and to compile and reduce into one those which are approved, all others excluded, so that as far as these faculties extend, and how and in what cases they can and ought to be exercised, it may be known with certainty, promptly and distinctly under one comprehensive sanction for all.
9 § 8. All and singular therefore the tenor of such letters and declarations, and of others and other things, whatever they are and if any there are, having the force of being fully and sufficiently expressed and inserted, and saving and remaining in their force and status those things which were ordained in the other of the aforesaid constitutions of the same Pius V, our predecessor, beginning In omnibus, concerning the quality, number, functions and offices of the ministers of the aforesaid Penitentiary (and also always saving the faculty of the greater penitentiary to consult in particular cases, even though not granted by these our letters, indeed prohibited, so that to the greater penitentiary asserting that he proceeds from a special mandate of the Roman Pontiff made to him by declaration of the living voice, undoubted faith ought to be given), by our own motion, from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, we have by this our constitution, to endure perpetually, decreed and determined that henceforth only the underwritten faculties shall belong to the same Penitentiary and greater penitentiary, and in it and by him may be exercised in the manner which follows.
10 § 9. To Our Major Penitentiary, therefore, and for the time being to his successor, We grant full power that he may absolve all and each person, of whatever ecclesiastical status, dignity and rank, in certain cases; others who are secular, and of whatever Order, congregation, society and regular institute; laypeople of either sex, both present and absent, from all and whatsoever faults, crimes and excesses, however grave and enormous, both public and secret, whenever and however committed and perpetrated, as well as from all excommunication, suspension and interdict, and other ecclesiastical censures and penalties incurred on account of the aforesaid and through them, even in cases not only reserved to superiors regular and ordinary, but also to Us and the Holy See specially, and also by letters which are promulgated on the day of the Lord's Supper each year, with salutary penance always enjoined upon the same persons according to the measure of their fault, and other things which shall be enjoined by law, to absolve and to command absolution; namely, regulars from the aforesaid faults and censures in both forums, and secular ecclesiastics as well as laypeople, from the aforesaid faults and censures in the forum of conscience only; Other conditions. but those same secular ecclesiastics as well as laypeople, he may absolve in both forums and command absolution when it concerns those excommunicated and suspended by a general or special sentence of delegates and other judges whose jurisdiction has expired, or also those whose absolution by those same judges or others has been remitted to the Roman Pontiff and to the said Holy See, or likewise those who, detained by legitimate impediment, have not been able to approach the judges, or those who excommunicated or suspended them, or another or others.
11 § 10. Yet so that the aforesaid persons absolved from censures imposed or declared by man in both forums as aforesaid shall in their appropriate cases respectively have obeyed and satisfied the party, or as soon as they are able (otherwise they shall relapse into the same censures), let them satisfy. But the same party having unreasonably refused the offered suitable satisfaction, which however has not been specified in the sentences or decrees, the Major Penitentiary may remit to the conscience of the judge before whom the cause of censures is pending, so that he may determine suitable satisfaction, and that being offered by the accused and unreasonably refused by the other party, he may still proceed to absolution, this offering remaining firm.
12 § 11. Also those coming to Rome from all places by whatever judge or otherwise in any way, not however in the censures promulgated by the Roman Curia or elsewhere promulgated and notorious in the same Curia (for the purpose only that those who piously and religiously visit the sacred places of the City may freely and lawfully obtain the indulgences granted to them, so that, as soon as they shall have obtained the aforesaid indulgences, they shall be bound by the same censures as before) he may absolve and command absolution. But if they shall have come to Rome bound by censures imposed by man specifically for absolution, but for obtaining it shall have been remitted to their judges, and shall have feared probable danger of death in the journey, the Major Penitentiary may, for a suitable time determined by himself for undertaking such a journey, under the condition that such danger be imminent, and with reincidence if the aforesaid persons shall have escaped that danger, in the forum of conscience only absolve and command absolution. § 12. Yet he may not in any public cases, which are contained in the aforesaid letters customarily read on the day of the Lord's Supper, even if the Apostolic See were vacant, or the Roman Pontiff were so impeded by infirmity or another cause that he could not be consulted quickly, absolve and command absolution of princes and others having the right of empire, even in the name of a vicar, and dominions and republics, or persons having or accustomed to have their administration, as well as bishops and other superior prelates.
13 § 13. Nor can he likewise in secret matters, even in the forum of conscience as
14 cardinals of the Holy Roman Church, and others, of whatever quality, status, rank, condition, dignity and preeminence they may be, who, while the Roman Pontiff was living, have treated concerning the election or exclusion of someone, cast votes, made canvassing or pacts, or, the Apostolic See being vacant, in the censures or penalties in the happy memory of Pope Gregory XV and the aforesaid Urban VIII, even our predecessors, concerning the election of the Roman Pontiff to be made for the time, 17 August in the year of the Incarnation 1625
15 respective emanated letters1 contained in any way whatsoever, to absolve and to mandate absolution.
16 § II. Nor likewise can he in cases of astrology, even in the forum of conscience only, absolve them, of whatsoever quality, status, dignity, preeminence and condition they may be, who, by judicial astrology, or otherwise, by themselves or through others, inquiring concerning the state of Christian commonwealth or concerning the life or death of the Roman Pontiff existing for the time being, have contravened the letters issued against them by the same Urban, predecessor of his, on the day before the Kalends of April in the year of the same Incarnation 1631, to absolve and to mandate absolution.
17 § 15. Nor likewise can he validly in cases of violation of public ecclesiastical immunity or liberty, even not brought to judgment, in any way whatsoever absolve or mandate absolution.
18 § 46. Let him absolve or mandate absolution in the forum of conscience only of those heretics alone, without any other abjuration to be made before the Ordinary or Inquisitor, who have spoken with no one concerning their heresies, and are altogether hidden, even if they have performed some external acts by which they could have been argued to be heretics; provided however that to those same acts, although of their nature knowable or capable of being brought to knowledge, as far as they themselves know and as they believe, no one has taken notice. Apostates also from the Catholic faith and heretics in the same forum of conscience only let him absolve, or mandate absolution, in those cases alone in which it is not necessary to denounce accomplices; namely when the same accomplices are dead, or are from openly infected regions, and dwell in those regions; not however when accomplices were Italian or Spanish, or from those regions in which the authority of the Holy Office of the Inquisition is in force: all other facility from 1 The date of the letters of Gregory XV is lacking (R. t.).
19 An. C. 1602 INNOCENT heresy or apostasy of this kind of absolving in the rest, except in cases in which the Holy Office of the Inquisition would remit those to be absolved to the Major Penitentiary, is forbidden. § 17. Gifts from regulars against the immunity of the same, of blessed memory Clement VIII likewise our predecessor in the year of the Incarnation aforesaid 1594, on the thirteenth day before the Kalends of July, issued constitution, receiving beyond the value of ten scudi of money, excepted gifts of medicinal things or of devotion, before restitution made let him not absolve, nor mandate absolution; within however the aforesaid value, only after an alms at the discretion of the same Major Penitentiary or by him chosen confessor, which is to be expended for the benefit of the religion or convent to which restitution ought to be made by right, if it can be done cautiously, let him absolve or mandate absolution.
20 § 18. Nuns and whatsoever persons who in public cases have violated the enclosure of the same nuns to an evil end, and respectively have dared to violate, let him not absolve, nor mandate absolution, except in cases in which the bishops themselves or Ordinaries have interceded for the same delinquents, and the case has not been brought before the Congregation of the S.R.E. cardinals appointed for the business and consultations of bishops and regulars. § 49. Let him grant confessors to nuns in no way, and let him not appoint Capuchins, in those regions in which the same are not accustomed to apply themselves to hearing confessions, as confessors.
21 § 20. Moreover concerning any irregularity and inability from whatsoever crime, even voluntary homicide, and from whatsoever defect arising...
22 in cases however hidden and in the forum of conscience only, after mature discussion made in the more serious cases in the Signature of the Penitentiary, to dispense or to mandate dispensation, both with ecclesiastical seculars and with laymen respectively, with whom it shall seem expedient, so that they may be initiated into orders, and having received even sacred orders and the order of priesthood to minister and to ascend to higher orders, and to dignities even cathedral and metropolitan, and whatsoever ecclesiastical benefices, whenever before dispensation, otherwise canonically, obtained or obtained, to retain, and likewise such benefices and dignities (excepted, when it is a matter of voluntary homicide or other most grave excess, cathedral and metropolitan churches), even after the crime, to be able to obtain1.
23 § 21. With heretics and apostates from the Catholic faith, when heresy and apostasy of this kind is in no way propagated, and the gravity of the case does not suggest that penitents ought to be remitted to the Holy Inquisition, concerning whatsoever irregularity, inability and infamy contracted therefrom, both as to orders whether received or to be received, as to benefices, to dispense and to mandate dispensation he can and is able.
24 § 21. With heretics and apostates from the faith, when heresy and apostasy of such a kind has in no way been made public, and the gravity of the case does not suggest that penitents ought to be referred to the holy Inquisition, he may dispense and command that dispensation be granted over any irregularity, incapacity and infamy contracted therefrom, both as regards orders whether already received or to be received, and as regards benefices.
25 § 22. With those poorly promoted in secret, notwithstanding the constitution of the same memory of Pope Sixtus V, also our predecessor, issued in the aforesaid year of the Incarnation 1589 on the ninth of January, and especially with those promoted by a leap, even under the pretext of licenses to promote outside the prescribed times, or with the intervals not observed, or without dimissorial letters from their own Ordinary, he shall not dispense, except in the forum of conscience, when the danger of grave scandals should be present; then indeed he may dispense in the customary form of the Penitentiary, namely that the omitted orders received by a leap.
26 An. C. 1592 may be received in secret from any Catholic bishop having grace and communion with the Apostolic See, and then, and outside the prescribed times, and with the intervals not observed, and without the aforesaid dimissorial letters. § 23. With those promoted to sacred orders ordained. . . .
27 who shall have committed simony with the promoting bishops, he may dispense and command dispensation to be given in secret only and in the forum of conscience alone, with the clause of those warned to be warned, and with grave penance enjoined, and the matter especially discussed in the Signature.
28 On dispensations from dispensations or validations of titles. § 24. From dispensations or validations of titles, even in the forum of conscience alone, even in secret cases, let him abstain, when it is a matter of real simony knowingly contracted, and of benefices over which the same simony was contracted; but, if that had been contracted in ignorance, even in ignorance of law not culpable, the greater penitentiary may in secret and in the forum of conscience alone dispense, and validate the titles of benefices obtained after simony, provided the petitioner, having been made certain of the same simony, shall have sought dispensation as soon as conveniently he could, all other faculty being forbidden in the remaining cases of simony and especially public ones.
29 § 25. He may validate the titles of benefices obtained in competition in the forum of conscience alone in secret cases, provided however that the inability arises from some censure, or because the petitioner, ensnared by it, administered.
30 § 26. From the validation of titles and condonation of fruits let him abstain as to those who, provided to cathedral churches, did not undertake the office of consecration within the prescribed time.
31 § 27. From composition likewise and condonation of the fruits of benefices and episcopal churches, and also of any distributions whatsoever, in any manner
32 ROMANUM An. C. 1592 badly perceived, in cases not secret let him abstain; but in secret cases he may with the French, Belgians, Germans, Poles and those beyond compose or even condon, with the enjoining to the same penitents of the giving of alms, to be limited by the discretion of the greater penitentiary himself or of the confessor appointed by him; but with the rest, namely Italians, Spaniards, Portuguese and persons of the adjacent islands, let him discreetly grant composition, and by means of it condon the fruits, with the monies exacted therefrom being consigned in full to the receiver of the emoluments of our Palace; to the poor, however, whose poverty does not admit of composition, he may condon, with alms enjoined in the manner aforesaid: which nevertheless without prejudice to those to whom distributions ought to accrue or not to decrease, shall be and shall be deemed ordained.
33 § 28. With regulars moreover concerning irregularity and regularity, of whatever crimes whenever perpetrated or incurrence in censures on occasion, or because the same, bound by their orders, did not however in contemplation of the keys exercise their orders, or immersed themselves in them, or otherwise in any manner whatsoever contracted, so that, the same irregularity and whatever other defects notwithstanding, having received orders and their privileges to use, and in them also in the ministry of the altar to minister, and to receive orders not received, and in the same likewise also in the ministry of the altar to minister; as also whatsoever, howsoever and of whatsoever kind of their Orders and congregations otherwise canonically obtained offices, benefices regular, duties, preeminences, dignities and prelatures, even greater and principal, to retain and exercise, as also the same or the same (not however the generalate) to which or to which in the future canonically, and according to the regular institutes of the same Orders and congregations they shall be elected or otherwise assumed, to receive, obtain, hold and freely exercise even licitly may, dispense, and them to their former, and to that in which before the aforesaid in any manner they were, state, and to the active and passive voice restore, replace and fully reinstate, and to remit and condon to them the penalties graciously, as also, for the greater firmness of the aforesaid absolutions and dispensations, with whatsoever constitutions, ordinances, statutes and privileges in any manner whatsoever standing in the way sufficiently to derogate, the aforesaid greater penitentiary may and is able.
34 § 29. We wish, however, that in such hidden cases, in the forum of conscience only, but in public cases, in both forums, having heard also the superiors making supplication and bearing good testimony concerning the same regulars, with the conscience of those same superiors burdened, and mature circumspection always being employed, he may be able to dispense with the same regulars, as aforesaid, and to mandate that dispensation be granted.
35 § 30. With homicides, the banned, and other delinquents, who, in the year of the Incarnation of Our Lord 1587, on the 24th day of November, by letters expedited under our aforesaid predecessor Sixtus, are rendered incapable of entering religion and of making profession therein, if it shall seem expedient, he may be able to render capable and to mandate that they be rendered capable, and with those who have committed voluntary homicides, so that they may also, as clerics, enter some one of the approved religions, and make profession therein, in both forums, when it shall seem expedient thus to do, he may dispense and mandate that dispensation be granted, under this condition, however, that those to be rendered capable or dispensed shall first have made agreement with the treasury and the injured party, and shall make profession, nor may they minister in the orders received before such profession, nor ascend to higher orders.
36 § 31. Concerning apostates and the transfer of regulars from one religion to another, without any innovation being made in the meantime, what faculties ought to remain with the Major Penitentiary, be reformed, or be granted, we shall determine by the counsel of a Congregation of certain Cardinals of the Holy Roman Church appointed by us for this purpose, in their proper time and place.
37 § 32. In the contracting of marriages, the same Major Penitentiary may dispense in the forum of conscience only concerning hidden impediments which do not dissolve marriage, or mandate that dispensation be granted. But let him abstain from dispensations concerning any impediment arising from any degree either of consanguinity or of affinity proceeding from lawful intercourse or from spiritual relationship, even in the forum of conscience only, although the impediment be hidden and danger of scandal threaten, in the same marriages being contracted.
38 § 33. In marriages already contracted, let him likewise abstain from dispensation, or revalidation of marriage in the first and second degrees, or in the second degree only of consanguinity or affinity from lawful intercourse, except if in such second degree only the impediment shall have remained hidden for at least ten years, and the petitioners shall have publicly contracted and joined themselves together and shall have been reputed as legitimate spouses. In the third and fourth hidden degrees, however, he may dispense, and also in the same third and fourth public degrees he may invalidate marriages nullly contracted by reason of subreptiousness or obreption of hidden apostolic letters, except if the falsity consist in the narration of the preceding intercourse, which, however, had not previously taken place.
39 § 34. If the petitioners, who shall have obtained from our Dataria a dispensation concerning marriage in a prohibited degree, both in the first and second, and in the second only, and also in the third or fourth with secret intercourse having followed between them, which they cannot reveal without detriment to honour, and by reason of such silence seek dispensation for contracting marriage, or revalidation of marriage contracted, the same Major Penitentiary may, if the intercourse be still secret, grant it in the forum of conscience only, a composition having been made, when it is a matter of the first and second or second degree only, of fifty gold ducats of the Camera to be transmitted to the Dataria, for the purpose of distributing alms, as is the custom of the incorruptible, unless the prior favour had been expedited in the form of the poor, in which case this favour also shall be similarly expedited without any composition.
40 § 35. If, however, the petitioners, who, having obtained a dispensation from the Dataria concerning an impediment of the first and second, or of the second degree only of consanguinity or affinity, with an expression indeed of carnal intercourse, but with hidden, occult and malicious intention in the same intercourse, suited to obtaining dispensation more easily, shall have recourse to the said Penitentiary for revalidation of such dispensation, the same Major Penitentiary may dispense thereupon with miserable persons explicitly affirming themselves to be such and under that express quality and form of the miserable to have obtained dispensations from the Dataria; with those, however, who, not as paupers, but as from honest families, or as nobles, or as illustrious, shall have been similarly dispensed by the same Dataria, the same Major Penitentiary shall not dispense, unless payment shall first have been made to the Dataria, for the purpose likewise of distributing in alms, the tax to be agreed upon with the Datary for the time being. If the supplicants be poor, so that they truly and really cannot pay the sum taxed or any part thereof, the aforesaid Major Penitentiary together with the same Datary shall provide appropriately.
41 § 36. Concerning the hidden impediment of affinity arising from illicit intercourse or from an act of fornication, whenever there is a reasonable cause, even if the danger of revelation or scandal should not be imminent or present, in matrimonies both contracted and to be contracted, in the forum of conscience only; but whenever such affinity has supervened after the marriage has been contracted, so that the debt can be demanded, in the same forum of conscience he may dispense and mandate that dispensation be granted and is able to do so.
42 § 37. Concerning the hidden impediment of crime of adultery, if it was committed with good faith on the part of the one unaware, provided neither party schemed, he may dispense in both marriages to be contracted and contracted; but if such a crime was perpetrated with both or one party scheming, he may grant dispensation, yet rarely, and when necessity demands on account of some grave imminent danger, which shall be determined by the prudence of the Major Penitentiary, the matter being especially discussed in the Congregation or Signature.
43 § 38. We declare, however, that the faculties aforesaid granted by us to the Major Penitentiary and to the office of the same Penitentiary concerning matrimonial dispensations shall have force, even if the degrees and impediments are manifold in any and every multiplicity, wishing that in the letters of such matrimonial dispensations offspring, where it shall be necessary, whether already born or to be born, yet not conceived in adultery, may be declared legitimate in the forum of conscience only, and likewise
44 An. C. 1692 INNOCENT XII, POPE.
45 § 39. Any simple vows whatsoever made in any manner, even if confirmed by private oath, even of chastity, of religion, of visiting the thresholds of Sts. Peter and Paul of the City, of the Lord's Sepulchre and of St. James of Compostella, the same Major Penitentiary may commute into other works of piety, absolve from their transgression, and with those who in contracting matrimony have transgressed a vow of chastity, dispense to licitly demand the conjugal debt, and respectively mandate that they be commuted, deferred, absolved and dispensed, always in the forum of conscience only, and is able and has power to do so, considering the causes of such commutations, deferrals, absolutions and dispensations, and with the clauses which he may add, and with the injunctions which he may impose, as the Penitentiary has laudably been accustomed to do heretofore. § 40. Concerning the recitation of the divine office or canonical hours on account of some impossibility or moral difficulty, with commutation into other prayers or orations or their enjoining, he shall have the faculty of dispensing. § 41. Any oaths whatsoever, in which it shall be ascertained that no prejudice to anyone is at stake, he shall have the faculty of releasing in the forum of conscience only. § 42. Concerning goods badly taken or retained, when the owners are uncertain and the cases are hidden, he may remit or forgive to some of the delinquents a portion of the poor, if, their condition and necessity being weighed, it shall so appear, or mandate that it be remitted or forgiven; the remainder, however, he may mandate to be distributed to the poor or converted into pious works in places, if it can be done, where such goods were taken, extorted or usurped.
46 or usurped, to be distributed or converted.
47 § 43. With girls who are not virgins and seek or have obtained dowries from confraternities or other places or pious dispensers, to whom it has been enjoined that they give or distribute them to virgins only, in hidden matters and in the forum of conscience only, insofar as those girls shall live honestly hereafter, he shall have the faculty of dispensing.
48 § 44. Doubts in the matter of sins, or concerning the penitential forum in any other manner whatsoever, he may declare with the counsel of his doctors and theologians.
49 § 45. Commissions of the Major Penitentiary, even if the one committing them, before they are presented, ceases in any way to be penitentiary with the matter still intact, shall not expire.
50 § 46. The Apostolic See being vacant, the Major Penitentiary and his officials may do and expedite only those things which pertain to the forum of conscience; in other matters their office shall rest, and they shall wholly abstain from any matrimonial and other dispensations and absolutions and declarations, as well as from any other expeditions concerning the forum in any manner whatsoever, whether mixed or separate.
51 § 46. The Apostolic See being vacant,
52 the Major Penitentiary and his officials may do and expedite only those things which pertain to the forum of conscience; in other matters their office shall rest, and they shall wholly abstain from any matrimonial and other dispensations and absolutions and declarations, as well as from any other expeditions concerning the forum in any manner whatsoever, whether mixed or separate.
53 § 47. Whenever the procurators and scribes of the Secret Penitentiary are detained by ill health, or from some legitimate cause the Major Penitentiary deems it expedient, he may substitute or appoint others in their place, during the infirmity or cause, with only an oath being taken, and with the same obligations by which other titled procurators and scribes are bound. § 48. No minor penitentiary of the three basilicas of the City may be admitted or received to office, unless he shall first have been examined and approved by the Major Penitentiary and the Penitentiary congregation or signature; and, after he has been admitted, he cannot depart or be dismissed without his license; and the same shall be observed regarding the minor penitentiaries of Loreto, to whom and to the others aforesaid the Major Penitentiary may grant and restrict faculties at his pleasure, and whose examination he may commit even in absence to a bishop in those parts well-disposed to him.
54 § 49. To all the Christian faithful who, from the old and praiseworthy custom of penitentiaries, shall piously and reverently approach the Major Penitentiary performing his office on the appointed days in Holy Week with solemn rite, and shall submit themselves to be touched with the penitential rod, we confirm to that same Major Penitentiary a perpetual faculty of remitting one hundred days of the penances imposed upon them or otherwise in any way due in the customary form of the Church, and, insofar as it is necessary, we grant it anew. § 50. XXXI.
INNOCENZO XII PP.
2 451 An.
3 a Pio IV rif. 8 1.
4 a Pio V rif. 2.
