Sacrosancta Romana Ecclesia
Bull on the union of the dioceses of Sutri and Nepi
— 3. Certain things are prescribed to be performed by the bishop in one or the other Church. — Concerning the form of electing a bishop.
Eugenius, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 The most holy Roman Church, which holds by divine institution the primacy over all the Churches of the world, if concerning the statutes of all Churches, especially cathedral churches, and their advancement, as a devoted mother more solicitous for the necessity of her children, vigilantly devises and prudently attends; and sometimes through the ministry of salutary and convenient union also, as the quality of places and times demands, and as the utility of those churches persuades, strives to provide efficaciously for the stability of the Churches themselves. § 1. Recently indeed, observing that the causes of these Sutrian and Nepesine Churches, which while they were formerly wealthy in their own resources, have become, through various calamities and the adverse events of succeeding times, by which those regions, alas! were afflicted, so reduced and diminished in their revenues and resources 1 that, on account of the scarcity and servitude 1 of such revenues and income, the prelates in those places cannot sustain themselves conveniently; on which account the pontifical authority in the same is debased, nor is the reverence due to episcopal dignity shown, and the prelates themselves are rendered very powerless in the preservation of their rights, even regal ones, and in the defense of the same; when in truth to guard those things there is needed not only the industry of circumspection and the fruit of pastoral care, but rather the sufficiency of resources.
2 § 2. For this reason, desiring to relieve the indigence of those poor Churches, and to reform the state of both through the ministry of union, in a better manner, while both those Churches, reduced under the rule and care of one and the same prelate, may happily from their united power and mutual resources, the prelate may preside in them more decently, resist the attempts of the wicked, defend his rights more conveniently, and govern the committed peoples more easily. Wherefore, for the evident utility of those Churches, considering such union to be not only profitable, but also most necessary, indeed praiseworthy and also opportune, the foregoing considerations and other reasonable causes moving our mind, after the deliberation which we have held diligently with our brothers concerning the uniting of the aforesaid Sutrian and Nepesine Churches to one another, the Nepesine and Sutrian, and the Sutrian and Nepesine Churches aforesaid, by the counsel of our brothers and the fullness of apostolic power, by the tenor of these presents we perpetually unite, annex and incorporate; and in such manner that, when one of the prelates of those Churches, who now are, shall have yielded or died, or shall have abandoned one of those Churches in any way, from then both those Churches shall be governed by a single prelate, who shall be called bishop of Sutrian and Nepesine, or of Nepesine and Sutrian, more suitably and happily, and it shall be lawful for the surviving one of those prelates, by himself or through another, when the other Church is thus vacant, and of its city and diocese, to apprehend and perpetually retain corporeal possession in spiritual matters and, as far as pertains to the right and property of that Church, in temporal matters, and to receive and have the fruits, as well as the revenues and income, emoluments, perquisites and all rights whatsoever pertaining to the episcopal table of that other Church, and to convert them to his own and that Church's uses and utility, no license from anyone being required in this matter.
3 § 2. Therefore, desiring to relieve the needs of those poor Churches themselves, and to reform the state of both through the mystery of this union in a better manner, while both these Churches, being reduced under the rule and care of one and the same prelate, might happily, from their united power and mutual faculties, have a prelate presiding over them more fittingly, resisting the attempts of the wicked, defending their rights more conveniently, and governing the peoples committed to them more easily. Wherefore, for the evident utility of these Churches themselves, considering such a union not only to be profitable, but also most necessary, indeed praiseworthy and also opportune, the foregoing considerations and other reasonable causes moving our mind, after the careful deliberation which we have held with our brethren concerning the uniting of the aforesaid Sulrinian and Nepesian Churches to one another, by the counsel of our brethren and the fullness of apostolic power, by the tenor of these presents we perpetually unite, annex and incorporate the Nepesian to the Sulrinian, and the Sulrinian to the Nepesian Churches aforesaid; and in such manner that, when one of the prelates of these Churches, who now are, shall have ceded or deceased, or shall have abandoned one of these Churches in any way whatsoever, from that time both these Churches shall be governed by a single prelate, who shall be called bishop of Sulrina and Nepesia, or of Nepesia and Sulrina, with due safety; and it shall be lawful for the surviving one of these prelates, by himself or through another, to apprehend and perpetually retain corporeal possession of the other Church thus vacant, and of its city and diocese, in spiritual matters and, as far as pertains to the right and property of this Church, in temporal matters, and to receive and have the fruits, as well as the revenues and income, emoluments, perquisites and all rights whatsoever pertaining to the episcopal table of this other Church, and to convert them to his own uses and to the utility of this Church, no license whatsoever being required in this matter.
4 § 5. Willing and by apostolic authority We decree that one bishop from the bishops who preside over these same Churches for the time being shall, in one year in one Church and in another year in the remaining Churches of the same, in alternating turns, be bound to confect chrism; and at the time of ordinations, he shall distribute the celebrations in turns to these same Churches and their cities and dioceses, assigning an equal portion to each; and that in each of these dioceses, for its subjects, he shall celebrate a synod each year, as is customary to be done; and in each of these cities and dioceses he shall hold a curia for exercising episcopal jurisdiction therein, with the customary vicars and officials; and when the same prelate shall be present in the Sutrina (1) and Nepesina cities and dioceses, he shall be called bishop of Nepesina and Sutrina, and thus henceforth these Churches themselves shall be governed by a single pastor and chief, with the aforesaid titles, in perpetual times; and that, with the bishop ceding or dying, or being translated, or the Churches themselves otherwise becoming vacant, the canons of these same Churches and both chapters, with those called to be summoned being called together, ought to be gathered, for celebrating the election of a future bishop, in the place where the bishop shall have died, if these Churches happen to become vacant through death; but if these Churches happen to become vacant through causes other than (1) The words Sutrinus and Nepesinus are missing, through death, such elections shall be made, at the times of their vacancies, in alternating turns in the aforesaid cities and dioceses, and that, on account of the union, annexation, etc. (1).
