Sacrosancti apostolatus
Bull granting the Patriarch of Lisbon the faculty to consecrate kings
1 in the Kingdoms of Castile, Leon, and Galicia: &c,
CLEMENT POPE XI.
2 to perpetual memory.
3 The office of the Apostolic ministry, imposed upon Us by the disposition of divine providence, though without the support of our merits, We endeavor to execute faithfully with the aid of the Lord, constantly striving to settle by appropriate means the dissensions of spirit that have arisen among Religious Men, to whom it is fitting to render their vows to the Most High in holiness, justice, and fraternal peace; and We strive to cut off at the root any occasion that they might be stirred up again at any time, as We judge it to be expedient in the Lord for the glory of Almighty God and the salvation of souls, with prudent deliberation having preceded.
4 § 1. Indeed, formerly when Dionysius Mantilla, a Monk of the Congregation of St. Bernard of Spain of the Cistercian Order, who was then living among men, had recourse to our Predecessor Pope Clement IX on account of grave controversies that had arisen among the Monks of the same Congregation, that Clement, Our Predecessor, referred the cause of such controversies to a certain Congregation then existing of Cardinals of the Holy Roman Church and Prelates of the Roman Curia specially deputed for the Reform of the said Order, to which, when the same Dionysius had set forth certain grievances inflicted upon the Monks of other Nations by certain Monks of Manchego and Alcarreno, newly called Castilian Monks, the said particular Congregation then existing committed the matter to the Bishop of Valladolid, that he should preside over the said Congregation at its next celebration, and should endeavor to reconcile the parties at variance and to extinguish the differences that had arisen; and the Bishop himself, having executed this commission, attended the general Chapter of the said Order: but when he had applied diligent effort for reconciling the parties and removing the discords, he was able to bring nothing to effect, because none of the discordant parties was willing to yield to the claims of the others, and thus, with the Chapter concluded, the aforesaid Bishop was forced to depart with the matter unfinished.
5 § 2. Moreover, after a year had passed from the celebration of such a Chapter, the General Reformer and six Definitors then likewise present formed a certain transaction, or agreement, and transmitted it to a certain Hyacinth of Albengozar, a Monk of their Congregation, then serving as Procurator General of the same Congregation in the Roman Curia, so that he might obtain its confirmation from the Apostolic See. And when the aforesaid Agreement had been confirmed by certain letters of the same Clement, Our Predecessor, issued on the 14th day of October 1669 in the form of a Brief, the late Pope Clement X, likewise Our Predecessor, concerning the aforesaid letters of Clement IX, Our Predecessor, by other two letters of his issued on the 14th day of February and the 24th day of December 1671 in the same form of a Brief, issued various declarations and ordinances concerning equality and the offices of Abbot and others among the Monks originating respectively from places on this side and beyond the Mountains separating old Castellan from new, to be observed, and he established certain matters concerning Abbots not to be immediately reelected, and their elections no longer to be made by Conventual Monks, but in the Definitorio by the General Reformer and Definitors and six Electors in a certain form as to the General Chapter, except in the case of death, resignation, or deprivation, and otherwise as is more fully contained in the aforesaid letters of both Clement, Our Predecessors, whose tenor We wish to be held as expressed in these presents. But because the aforesaid transaction, or agreement, was recognized as insufficient for producing peace and quiet in the aforesaid Congregation of Monks; indeed, rather experience had shown that discords, contentions, and persecutions had emanated from it in the said Congregation, and therefore the beloved Sons, Monks of the Kingdom of Galicia and of the Fields, and of the lands bordering the Kingdom of León, desiring that the tares suffocating the fruits of good works should at last be eradicated, and peace and mutual charity should be restored to their Religion, likewise constituted as their Procurators the beloved Sons Paul Freyria and Dionysius Ximenez, Monks expressly professed of the same Congregation, and sent them to the Roman Curia so that they might obtain from the Apostolic See an appropriate remedy for such evils. And when the same Paul and Dionysius, Procurators, in the year 1700, presented a supplicant petition to the late Pope Innocent XII, likewise Our Predecessor, concerning the aforesaid matters, the same Innocent, Our Predecessor, committed their cause to the Congregation of Cardinals then existing of the Holy Roman Church, placed in charge of the affairs of Bishops and Regulars. The Congregation of Cardinals itself, on the 20th day of April of the last-mentioned year, considering the impediment of the aforesaid letters, decreed that they should have recourse to Us for the opening of the mouth. § 3. We, however, so that in a matter of this kind, which appeared grave enough, We might proceed with due maturity, wrote to our beloved Son Francis, Cardinal of the Holy Roman Church, called Acquaviva, then Nuncio of Us and the Apostolic See in the Kingdoms of Spain, that he should transmit to Us his relation concerning the matters set forth in the said petition. He, Francis the Cardinal, then Nuncio, having heard the parties and their Procurators existing in the town of Madrid, especially the beloved Son Christopher Osorio, General of the aforesaid Paul and Dionysius, Procurators, on the one part, and likewise the beloved Son Angelo Ramirez, Procurator General of the said Congregation, on the other part, on the 22nd day of April 1702, transmitted his relation concerning the state of the Religion together with the points or articles agreed upon before him between the said parties to Us, from which it appeared that what had been set forth by the same Paul and Dionysius, Procurators, had great foundation. Whence thereafter, namely on the 28th day of November of this year, the aforesaid cause, having been presented in Our Signature of Grace before Us, and with the contradiction on the part of the Monks of New Castellan, Rivogie, Asturians, and Montancarans of Burgos, likewise the beloved Son John Guerrero, Monk of the same Congregation, who had been sent as their Procurator to the aforesaid Curia by mandate of procuration exhibited by him, We decreed by the vote of the same Signature for the opening of the mouth at the discretion of the same Congregation of Cardinals.
6 5.4. And when that Congregation of Cardinals had proceeded in its decrees upon the said arbitration which had been issued, We committed to the same Congregation of Cardinals the matter, namely concerning the opening of the mouth with the vote of the Auditor of the Apostolic Palace, with the suffrage of all the Chaplains of the same Auditory and Our Auditors, who, moved by the reasons adduced by the said Paul and Dionysius, on the nineteenth day of November in the year seventeen hundred and three, published their vote together with the decision for the opening of the mouth and the arbitration, and subsequently, namely on the twenty-second day of September in the year seventeen hundred and four, the same case in the same Signature of Grace came before Us
7 Vote of the Congregation in particular appointed by the Pontiff,
CLEMENT THE ELEVENTH 75
8 When the matter had been presented anew to Us, We committed it to the same Congregation of Cardinals, so that it might also proceed with a vote regarding the nullity, validity, or invalidity of the Bipartite arrangement established by transaction or agreement made by the aforesaid General and General Definitors, and inserted in the aforesaid letters of Our Predecessor Clement IX; the said Chaplains and Auditors on 12 January 1705, demonstrating by many reasons that the said Bipartite, or Agreement, was a transaction that was null, unjust, unequal, and enormously injurious, on 4 February of the same year issued another decision and vote, in which they denied the compulsory letters requested by the aforesaid John, Procurator of the Monks of New Castle and those adhering to him. Afterwards, however, when the said Bipartite had been declared null and unjust, the aforesaid Paul and Dionysius, Procurators, in the same Signature of Grace on 22 September 1705, having likewise been heard before Us, insisted that We commit to the same Congregation of Cardinals, so that they might proceed for establishing a new arrangement with the vote of the same Auditors and Our Chaplains; the vote of the aforesaid Signature, however, was that the aforesaid case should be committed to a particular Congregation to be appointed by Us. When the aforesaid case had been presented on 4 February 1707 in a Congregation of certain of Our Venerable Brethren of the same Holy Roman Church, Cardinals specially appointed by Us, a rescript was issued not without division of votes; We were to be petitioned for the expedition of other Apostolic letters in similar form of a Brief with sanation of the nullities of the Bipartite and other defects, if any there were, reducing the Capitular votes to equality, also by means of substitution of those next in line in place of those who had graduated; But because the defects to be healed, detected and published in the decisions of the aforesaid Auditors and Our Chaplains, showed an enormous injury and injustice, the sanation of which, especially after so long a litigation, seemed consonant with reason and equity; for this reason the aforesaid Paul and Dionysius, Procurators, again petitioned to be heard by Us concerning the said resolution of the particular Congregation. The same particular Congregation of Cardinals, however, on 26 June of the said year 1707, responded: "Let it be decided according to the manner": The manner, however, was that the Bipartite should also be preserved as to three Presidencies; and that in the three next Chapters from that moiety belonging to the Monks of the Nation of the Ports, so called, seven Abbacies should be conferred upon the Campestrian Monks, of which four should be mother houses, and six upon the Galician Monks; of which three likewise should be mother houses, and further between themselves every three years one Presidency should alternate; And that the Capitular Offices, as well as three Capitular Votes out of four parts of the said moiety should be conferred upon the said Galician and Campestrian Monks, with equal distribution made between them, and preference given to the said Campestrian Monks in case of unequal number, yet with this law added, that in every Chapter both the Abbacy and such Offices should be varied; The remaining Abbacies, Presidencies, Capitular Offices, and Capitular Votes should be distributed among the Monks of all the remaining Nations of the Ports, so called; Yet so that as to Abbacies the Asturian, Rioxan, and Montane Monks should have only six; The Office of General, however, should be conferred in the second next Chapter upon a Galician or Campestrian Monk. Since, however, this mode of tempering the injury seemed to the aforesaid Paul and Dionysius, Procurators, to temper the injury in no way, and to remove or take away no burden from the same Campestrian and Galician Monks, but rather to confirm the predominance of the adverse faction; the same Paul and Dionysius, Procurators, with the aforesaid John, Procurator of the aforesaid Monks of New Castle, Rioja, Asturias, and Montane regions, contradicting on the other side, again protested; Whence the case having been presented again in the same Signature of Grace on 14 May 1709, likewise heard before Us, with the Referendary in both Our Signatures, Our Beloved Son in the flesh, Master Annibale Albano, Our Nephew by germane brother, as Relator, a commission was granted for the avocation to Us of the said case from the said particular Congregation of Cardinals; and thereupon, both upon the merits of the case and upon the last subsequent Decree of the same particular Congregation of Cardinals issued, mature consideration being given; the Decree thus last emanated was judged injurious to the aforesaid Galician and Campestrian Monks, and insufficient for allaying factions and establishing peace in their Religion; and accordingly there emanated from the same Signature a rescript for the avocation of the same case to Us, and that a resolution should be given in the Chamber. Hence it is that We, desiring to consult benignly, as much as We can with the Lord, the tranquility of the said Congregation of Monks in the aforesaid matters, by Our own motion, and from certain knowledge, and mature deliberation of Ours, and from the fullness of Apostolic power, the same case, and suits, and controversies whatsoever pending between the aforesaid Parties in any manner whatsoever, and in whatever instance, as well in the Sacred Palatine Apostolic Auditory as in any other tribunal whatsoever, and before any Judge whatsoever, of all and each of which the state and merits, and names and surnames, and qualities of the judges and litigants, and whatever else even requiring specific and individual mention and expression, We will to be held as fully and sufficiently expressed and most exactly specified in these presents, in the state and terms in which they are at present found, from the aforesaid and any other tribunals and judges, by the tenor of these letters We avoke to Us, and all and each of them We suppress, terminate, extinguish, and abolish, and We impose perpetual silence thereupon upon each party, and We close their mouths.
9 § 6. Furthermore, by the tenor of these present letters, we establish and ordain. First, that in the four next proximate Chapters, the Congregation of Cistercians of Spain, which consists of forty-two Monasteries; namely seventeen in the Province of Campos and the adjacent Lands of the Kingdom of León, thirteen in the Kingdom of Galicia, six in New Castile, and precisely in the Kingdom of Toledo, three in the Asturias, and two in the Province of Rioja, and one in the Mountains of Burgos, shall be divided into two parts, one namely to be made by the Galicians and those originating from the Province of Campos and the said adjacent Lands of the Kingdom of León, the other truly by those originating from New Castile, the Asturias, Rioja, and the Mountains of Burgos. Secondly, that among the Monks, Galicians on one part, and those from Campos and the adjacent Lands of the Kingdom of León on the other part, a subdivision into two parts shall be made, it being observed that he shall be deemed and reputed to originate from the aforesaid Lands thus divided and subdivided, who was born in any one of them at a time when his parents, or any one of them, had permanent domicile in the aforesaid Lands. Thirdly, that all Capitular Offices, whose elections are celebrated every three years; both within and outside the General Chapter, shall be distributed equally among the Monks originating from the Lands, as above:

Sixth, that the thirty-eight Abbacies, which are in the Religion (excluding the Palatine, whose Abbot is always the General Reformator) shall be distinguished into three Classes, of which the first shall be of Colleges, which are six; the Second shall be of Abbacies, which are called Matrices, or Monasteries, in which Novices are received and educated, and are twenty; the Third of Monasteries, in which Novices are not educated, and are twelve, which all by their Classes, as above, shall be divided into two entirely equal parts, of which the first shall contain three Colleges, ten Matrix Monasteries, and six non-Matrix Monasteries. Seventh, that the aforesaid thirty-eight Abbacies from each of the designated Classes shall be divided for equal distribution, and one part, namely nineteen, shall be conferred on Monks originating from New Castile, Asturias, Rioja, and the Mountainous regions; the other truly on Monks originating from Galicia, Campos, and adjacent lands of the same Kingdom of León. Eighth, that nineteen of the aforesaid Abbacies to be conferred on the said Galician, Campestrian Monks, and adjacent lands of the aforesaid Kingdom of León shall be subdivided into two equal parts, placing in each as many Abbacies of each Class for each part, and one part thus subdivided shall be conferred on the Galicians; the other truly on the Campestrians and those originating from adjacent lands of the aforesaid Kingdom of León, the unequal Monastery truly between them shall alternate. Tenth, that from two General Preachers with perpetual vote in the Chapter, one from Monks originating from New Castile, Asturias, Rioja, and the Mountaineers, another truly from Galicia, Campos, and adjacent lands of the said Kingdom of León shall be elected; Yet so that if on one occasion a Monk originating from Galicia shall have been elected, on another occasion a Monk originating from Campos and adjacent lands of the aforesaid Kingdom of León shall be elected. Eleventh, that twelve retired Master Monks of greater seniority, and four retired Preacher Monks of greater seniority, who have perpetual voice in the general Chapter shall be divided into two equal parts, namely six Masters and two Preachers for each part, and let the Monks originating from Castile have one part, the other part let the Monks originating from Galicia, Campos, and adjacent lands of the same Kingdom have; the part concerning the Campestrians and Galicians shall be divided equally between the Galicians and Campestrians; namely three retired Masters and one retired Preacher for Galicia, and the other three Masters and one Preacher for Campos and adjacent lands of the aforesaid Kingdom of León; yet under this condition, that if any of the aforesaid Parts divided and subdivided does not have a retired Master or retired Preacher through reading or Preaching of twelve years, it shall have the faculty of substituting the nearest in the exercise of Reading or Preaching; Twelfth, as to the Chapter and General Reformator, let him provide and attend that Monks be elected from every Nation according to the division and subdivision, so that also among them after retirement and attainment of the prescribed Chairs equality shall be preserved. We will, however, that in all other matters not repugnant to these our ordinances the Constitutions of the Order, Decrees of the Sacred Congregations, and Apostolic Constitutions shall be observed, and that this mode of observing the Bipartite shall be inserted among the sworn Constitutions of the said Congregation of Monks, and together with them shall be read at the times customarily read in the Monasteries of the said Congregation, and in all General Chapters, and shall be sworn by all Capitulars the observance of all the aforesaid before proceeding to elections; Which if perchance anyone

36 Nullity of Primary Petitions; expedited by the Vicars or Imperial Provisors during the vacancy of the Holy Roman Empire; and of any provisions made or to be made by virtue of those Petitions.
37 CLEMENT POPE XI
38 "For future memory.
39 Since, as we have learned, during the present vacancy of the Holy Roman Empire, certain petitions, which are called primary, have been directed in the name of the Vicars or Imperial Provisors, so called, and under the pretext of rights claimed to belong to them, to the Prelates, Chapters, and Canons of very many Collegiate Churches, and perhaps also Cathedral and Metropolitan Churches, and to other Collators or Collatrices of various ecclesiastical benefices, both secular and regular, situated in various parts of the same Holy Roman Empire and especially of Lower Germany, for Canonicates and Prebends of such Churches and other aforesaid benefices, to be conferred by them upon certain persons only commended by virtue of those same petitions, to those to whom it pertains; and such petitions have been granted, expedited, and presented, and perhaps have even obtained their effect; whereas it is established law that it is not lawful for anyone without an indult of this Holy See to compel anyone to confer Canonicates and Prebends and other such benefices thus commended: and moreover it should be known to all how earnestly, both formerly and repeatedly, both by Us through various of Our letters in similar form of Brief, and otherwise, and by Our Nuncios and those of the same See at Our command, the petitions which were presented or expedited by the late Joseph, while he lived, elected King of the Romans and Emperor, as being to be sent to the Apostolic See, have been utterly and entirely rejected and repelled, and We have ordered and declared them to be rejected and repelled.
40 § 1. Hence it is that We, who are constituted on earth as defenders of ecclesiastical rights by the Lord, and therefore cannot dissimulate so grave an abuse of lay power, desiring to preserve safe, protected, and inviolate the liberty, immunity, and ecclesiastical jurisdiction, insofar as it is granted to Us from on high, and considering all and singular things which in the foregoing matters or on their occasion have been done and transacted in any way, the tenors and dates and whatever circumstances thereof; and the qualities, dignities, names, and surnames of the persons from whom those things or any of them respectively emanated, and whatever else, even those requiring specific and individual mention and expression, as fully and sufficiently expressed and exactly specified in these presents: By Our own motion, and from certain knowledge, and mature deliberation; and from the fullness of Apostolic Power: We declare all and singular the aforesaid primary petitions, under the pretext of such asserted Vicarial rights of the Holy Roman Empire, for whatever Canonicates and Prebends, to be null petitions, and wherever to be repelled, and We

49 § 2. We decree also that these same present letters, and all things contained in them, shall be firm, valid, and efficacious, and shall obtain their full and complete effect, and shall be inviolably and immovably observed by those to whom it pertains, and shall pertain for the time being, notwithstanding that whosoever having an interest in the foregoing matters, or pretending to have one in any manner whatsoever, of whatever decree, state, grade, order, preeminence, and dignity they may be, or otherwise worthy of specific and individual mention and expression, have not consented to them, or, being called, cited, and heard, the causes on account of which these present letters have been issued have not been sufficiently adduced, verified, and justified, or from any other cause whatsoever, even however juridical and privileged in colour, pretext, and head, even in the body of the law closed, even of enormous, most enormous, and total lesion, at no time shall they be noted, impugned, infringed, retracted, brought into controversy, or reduced to the terms of law, or against them shall the opening of the mouth, restitution in full, or any other whatsoever remedy of law, fact, or grace be attempted or obtained, or obtained even by our motion, knowledge, and fullness of power alike granted or emanated, to exist in judgment or outside it, and to obtain and secure their full and complete effects, and to be inviolably and immovably observed by those to whom it pertains, and shall pertain for the time being. Thus, and not otherwise in the foregoing matters by whatsoever Judges, Ordinaries, and Delegates; even Auditors of the causes of the Apostolic Palace, and Cardinals of the Holy Roman Church, even Legates a latere, and Nuncios of the aforesaid See; or any others whatsoever exercising and about to exercise any preeminence and power, with the faculty and authority of judging and interpreting otherwise taken from them and from each of them, and the power to use it or avail themselves of it in any way being removed, but these present letters themselves always firm, valid, and efficacious, and if otherwise should happen to be attempted upon these by anyone whatsoever, by whatever authority, knowingly or unknowingly, notwithstanding the foregoing, and insofar as it is necessary, our and the Apostolic Chancery's Rule of acquired right not being taken away; and other Apostolic Constitutions and Ordinances; nor any statutes and customs, uses and styles, even immemorial, fortified even by oath, Apostolic confirmation, or any other firmness; Privileges also, Indults, and Apostolic letters to any persons whatsoever, even those shining with whatever ecclesiastical or worldly dignity, and otherwise qualified in any manner whatsoever, and requiring special expression, under whatsoever tenor of words and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious, most efficacious, and unusual clauses, irritant and other decrees, even by our motion, knowledge, and fullness of power similar, and in consistorial and other manner whatsoever granted, issued, made, and repeatedly iterated, and approved, confirmed and renewed however many times, § 3. All and singular of which, even if for their sufficient derogation special, specific, express, and individual mention, or word for word, and not by general clauses importing the same, mention or any other expression should be had, or any other exquisite form should be observed for this, the tenors of which kind, as if word for word, nothing whatsoever omitted, and the form delivered in them being observed, should be expressed and inserted; these present letters having for fully and sufficiently expressed and inserted, otherwise remaining in their force, to the effect of the foregoing this time only specially and expressly we derogate, and we will it to be derogated, and all other things to the contrary whatsoever. We will moreover that transcripts or copies of these same present letters, even printed, subscribed by the hand of some public Notary, and furnished with the seal of a Person constituted in ecclesiastical dignity, shall be given the same force in judgment as well as outside it, everywhere, which would be given to these same present letters, if they were exhibited or shown. CLEMENTE PAPA XI.
