SACRED CONGREGATION
FOR THE DISCIPLINE OF THE SACRAMENTS
INSTRUCTION
ON THE NORMS TO BE OBSERVED BY THE PASTOR IN CONDUCTING CANONICAL INVESTIGATIONS BEFORE ADMITTING THOSE ABOUT TO BE MARRIED TO THE CELEBRATION OF MATRIMONY (CAN. 1020).

1 1. The most holy institution of matrimony, divinely established from the beginning of mankind, elevated by Christ the Lord under the New Law to the dignity of a sacrament, has at all times been the object of the Church's careful solicitude lest it be exposed to any irreverence or danger of nullity, with suitable precautions established and adapted to its sanctity. How much the holiness and dignity of Christian marriage shine forth has moreover been recalled by the Encyclical Letters of Pius, of happy memory, Pope Pius XI, Casti connubii, issued on 31 December in the year 1930, which strove excellently to recall the true nature of conjugal partnership, its most noble prerogatives, and its illustrious ends.

2 2. It is not hidden from anyone that those about to be married who approach matrimony without observing the precepts diligently established by the Church commit a grave injury to the sacrament, and thus are not free from serious fault, in order that Christian marriages may be entered into licitly and especially validly, and may moreover be suited to obtain the abundant fruits of the sacrament. And indeed this injury and guilt are shared also by the ministers of the Church, who admit those about to be married, even if only thoughtlessly, to the celebration of forbidden unions, gravely neglecting the duty committed to them of carefully investigating lest they be contracted contrary to the statutes of the Sacred Canons. The Church has entrusted to the Bishops, the shepherds of souls, the burden of imparting to their subject pastors suitable norms for conducting investigations diligently and at an opportune time, lest anything stand in the way of the marriage being contracted; and likewise that, if impediments are truly present, they may actively strive to remove them or otherwise dismiss those about to be married from entering into an invalid union. Such a precept is contained also in can. 1020 of the Code of Canon Law, whose words it is fitting to set forth: "§ 1. The pastor to whom the right belongs to assist at a marriage shall, at an opportune time beforehand, diligently investigate whether anything stands in the way of the marriage being contracted. § 2. He shall interrogate both the bridegroom and the bride, also separately and cautiously, whether they are detained by any impediment, whether they give their consent freely, especially the woman, and whether they are sufficiently instructed in Christian doctrine, unless this last interrogation should appear unnecessary on account of the condition of the persons. § 3. It is for the Ordinary of the place to give particular norms for such investigation by the pastor."

3 3. Moreover, no one is ignorant that the causes from which the invalid or illicit celebration of contracted marriages proceeds are reduced to three heads, namely: a) a matrimonial impediment properly so called; b) a defect of consent; c) a defect of canonical form. Therefore, this Sacred Congregation, to which by the statute of can. 249 is entrusted all legislation concerning the discipline of the seven Sacraments, and which has already published an Instruction on the proof of the status of freedom and the denunciation of a contracted marriage, on 4 July 1921, judged it most opportune to prepare another Instruction, by which, offering a helping hand to the Reverend Ordinaries, upon whom this burden falls from § 3 of the cited can. 1020, it might furnish them with suitable norms for conducting the examination of those about to be married rightly and diligently. The questions to be proposed separately to those about to be married are found in the Appendix (Annex I) of this Instruction, saving to the Ordinary the faculty of varying them, removing or adding articles for the more usual reasons of nullity or illicitness of marriages which he may have found to occur in his diocese, having regard to the circumstances of persons and times.

4 4. But certain matters are to be noted above all concerning the elements of the inquiry prescribed by the aforesaid can. 1020. a) As regards the pastor: he who has the right and duty of inquiring is the one to whom the assistance at the marriage belongs, and this person, unless a just cause excuses him, is the pastor of the bride (can. 1097 § 2). Nevertheless, the pastor of the bridegroom also, either of his own accord or at the instance of the bridegroom himself or of the bride's pastor, shall conduct the examination to place the freedom of the bridegroom in safety, and shall send the document of this completed inquiry to the bride's pastor as soon as possible, together with the other necessary documents (testimony of baptism, etc.) which may happen to exist in his parochial archive. But, when the pastors are of different dioceses, the transmission of these parochial documents shall always be made through the channel of the chancellery of the Episcopal Curia of the diocese of the bridegroom — which moreover shall give testimonial letters concerning the freedom of the status of the bridegroom — to the bride's pastor, whenever he, as is customary, assists at the marriage: conversely, this shall be done through the chancellery of the Episcopal Curia of the diocese of the bride, if it should happen at any time that the pastor of the bridegroom assists at the marriage.

5 This Sacred Congregation, however, greatly desires that, before the pastor proceeds to assist at a marriage, he obtain a license from his Curia, which they call a nihil obstat: but he prescribes this when the pastors of the parties to be married are of different dioceses. In order that the matter be handled more carefully in so grave an affair, the Episcopal Curia should entirely require that the pastor, to whom the license (nihil obstat) is to be given, send to the Curia itself at an opportune time beforehand all the prematrimonial documents together with a copy, of which a specimen is found in the Appendix (Alleg. V), furnished with all the information required therein. This copy, as is provided in the same document, should be used both by the Curia in granting the nihil obstat and by the pastor in granting to the priest, otherwise legitimately endowed with faculty, permission to assist at a marriage perhaps to be contracted outside the parish; and it should then be carefully preserved in the parochial archive of the place where the marriage was solemnized. The duty of inquiry clearly rests upon the pastor under grave obligation from the gravity of the matter; nor is he excused from such a burden, even though he be morally certain that nothing can impede the valid and licit celebration of the marriage.

6 The examination should be conducted personally by the pastor, unless a just cause excuses him. b) As to the time of the inquiry: this is prescribed to be conducted "at an opportune time before the celebration of the marriage" or, as the matter itself demands, before the publication of the banns, or while these are being published. c) As to the object of this inquiry: through it all things are to be explored which in any way can impede the contracting of marriage. Therefore, besides those things which are specifically set forth in § 2 of the respective can. 1020, concerning which more fully below, inquiry must be made first of all: a) concerning the reception of baptism and confirmation, with legitimate documents of the same compared. The certificate of baptism, however, should be recent and not drawn up more than six months before the marriage is contracted; and there should be found noted therein all things which are to be recorded according to the statute of can. 470 § 2 and art. 225 of the Instruction of this Sacred Congregation, which is entitled Instructio servanda a tribunalibus dioecesanis etc., of 10 August 1986 (Acta Ap. Sedis, vol. XXVIII, pag. 313 seq.). The pastor should not easily believe even the sworn assertion of the parties to be married that they have not been baptized unless it is otherwise certain to him, but, to prevent frauds in the matter, let him require from the pastor of the place of origin whether it appears from the baptismal register that this sacrament was conferred upon them; in which case let him also request the certificate from him; β) concerning the parish or parishes to which the marriage should be notified; γ) whether the parties to be married are of age or minors; δ) whether both are Catholic or one or both are non-Catholic, bound however to the canonical form by virtue of can. 1099; ε) if the case warrants, inquiry should finally be made concerning the death of a former spouse; concerning a sentence of nullity of marriage and indeed one that is executive according to the norm of law (cfr. art. 220, 221 § 3 of the aforesaid Instruction), even in excepted cases (cfr. ibid., art. 226 seq.); concerning a dispensation over a ratified and non-consummated marriage: with all legitimate documents compared for the matter; ζ) as to what pertains to establishing the freedom of status of the parties to be married see below n. 6. d) As to finally the manner of conducting the examination: in the respective can. 1020 § 2 it is prescribed that the pastor question the spouses separately and carefully, namely, as the Doctors say, distinctly, separately and chastely, with due prudence and circumspection, especially when he inquires concerning impediments and other circumstances which can bring infamy or shame.

7 5. The examination of the parties to be married, according to the norm of § 2 of the respective can. 1020, should regard three things chiefly: a) the absence of impediments; b) the freedom of consent; c) sufficient knowledge of Christian doctrine. As to the first: the pastor should ask the spouses whether they are bound by any impediment, both impedient (cc. 1058-1066) and especially diriment (cc. 1067-1080), whether public (of ligamen, consanguinity, affinity, etc.) or occult, indeed this especially, which is rarely made known (of vow, crime, etc.) (Alleg. I). a) The principal cases of marriages, referred to this Sacred Congregation for simple convalidation or for sanation in radice, concern marriages celebrated with an impediment in the second degree of consanguinity or affinity in the collateral line, or more often consanguinity in the third simple degree or in the third degree touching the same line, with canonical dispensation neglected. This most often happens on account of an impediment unknown and therefore not reported by the parties to be married, which is often to be attributed to ignorance arising from the different statute of canon law and civil law, the latter of which most often ignores the impediments enumerated in canon law.

8 To the matter, therefore, let the pastor inquire diligently, considering, besides what he shall have believed ought to be appealed, the right belongs to the spouses, ten days having elapsed from the pronouncement of the sentence, to contract new nuptials (can. 3987) ». Art. 221 § 3. «"In the case, however, of desertion (on the part of the defender of the bond, an appeal having been interposed to the third instance after a second sentence for the nullity of matrimony), the right belongs to the parties to proceed to new nuptials, having obtained notification of the decree by which the college shall have determined the appeal to be deserted (cfr. can. 1886), or perempted (cfr. cann. 1736, 1737) ». the rest, the surnames of the contracting parties and their parents, whence consanguinity is often gathered, and testimonies of the reception of baptism; let him recall to the parties the degrees of consanguinity and affinity standing in the way of matrimony by canon law, and, if he should suspect their silence on the matter, according to the procedure of can. 1031 § 1 n. I, let him employ trustworthy and sworn witnesses for such more careful investigation (Alleg. II). ß) To prevent, however, errors, which sometimes creep in for obtaining a dispensation from the Apostolic See in the computation of the degree of impediments of consanguinity and affinity, let a genealogical tree be added to the petition. y) Let equivocal description of impediments be avoided, therefore, in the same petitions, as would be the case if the spouses, detained by a twofold impediment, for example, of consanguinity in the second (greater) and in the third (lesser) collateral line degree, were to be denounced as bound by the impediment of consanguinity "second-third" or "second and third" without added explanation: for that formula can signify the impediment "of the second degree mixed with the third" a single one, namely, and of the lesser degree: and therefore a dispensation perhaps thus obtained would be burdened with nullity. δ) Furthermore, as is evident, for the validity of a dispensation from impediments of greater degree there is required a canonical or just cause, proportionate to the gravity of the impediment, actually existing in the case: to the matter, therefore, let especially two Instructions be kept before the eyes, one of 9 May 1877 of the S. O. de Propaganda Fide, the other of 1 August 1931 of this S. C., and let approved authors be consulted. This cause, therefore, is to be expressed in the petitions for dispensation to be implored either from the Apostolic See or from the Ordinary endowed with such faculty, and then, the dispensation having been obtained, concerning the existence of the same cause (which is to be carefully noted) certain proof must be established before the execution of the rescript, under the penalty of an invalid dispensation (can. 38 and 41). e) It is moreover worthy of note, that for the age of advanced adulthood, which is not seldom adduced for a woman who is not a widow, the completion of the twenty-fourth year is required. For the rest, let the age of those about to marry always be expressed in the testimonial letters, to be derived from the record of baptism. ζ) Finally, this S. Congregation for its office exhorts pastors that at suitable times in the catechesis to be delivered to the people (can. 1018) they rightly instruct the faithful concerning matrimonial impediments both those that impede and those that, especially, diriment.

9 And let them endeavor to turn away the same, especially if they are detained by closer impediments of consanguinity or affinity, from nuptials to be reconciled among themselves, or at least earnestly, parents especially, let them induce to the impediments themselves being denounced to the authority of the Church for dispensation, when peculiar circumstances nevertheless suggest matrimony: and let them explain to them that not excessive are the taxes urged, which by way of amendment or penalty are imposed according to the economic means of those about to marry, and that they are altogether small for the poor.

10 6. On account of the importance of the matter, special attention must be given to the impediment of a prior bond. Let parish priests be vigilant lest, contrary to law, in good faith or bad faith, new matrimonial bonds be entered into by those bound by the tie of a previous marriage, even if the validity of this be not rashly called into question, indeed even if the nullity itself be manifest. d) Let them know well the prescription of can. 1069 § 2, namely that the nullity of a marriage is to be established by canonical proof alone, that is, by observing judicial procedure up to a second sentence in conformity against the validity of the marriage, from which no appeal has been made by the defender of the bond; or, in the excepted cases (can. 1990-1992) with the rules set forth in the aforesaid Instruction of this S. O. of 15 August 1936 art. 226 seq. ß) Matrimonial proclamations shall be made also in places where the parties to be married have resided for at least six months after reaching puberty, if the Ordinary prudently judges this to be fitting (can. 1023 § 2), nor shall dispensation from them be granted except upon proof of legitimate cause (can. 1028), nor shall one easily proceed, neglecting other proofs (Alleg. II and III), to the supplementary oath (Alleg. IV) to be administered to the parties (cc. 1829-1830). According to the prescription of n. 3 of the aforesaid Instruction of 4 July 1921, the difficulty which sometimes arises, namely of collecting in due time the necessary documents for proving free status, is for the most part resolved by requiring the documents themselves through the diocesan chanceries of the parties to be married (as under n. 4), which shall not fail to reduce also the fees to be paid, according to the norm of can. 1507 § 1, if from this another difficulty should arise.8 7) More cautious procedure must be followed regarding the proof of free status of vagrants, namely those who have domicile or quasi-domicile nowhere (can. 91), and of those who have migrated from their place of origin to distant regions after reaching puberty, and there wish to contract marriage. For this matter let the aforesaid Instruction of this S. Congregation of 4 July 1921 be observed with the utmost precision.

11 7. Regarding the freedom of consent: let the parish priest ask the parties whether they intend to enter into marriage freely and willingly, or whether rather they are being compelled to do so by force or fear or importunate prayers or persuasions of someone. Let him inquire this especially of the bride, since it is established that she is more subject to fear. Nor let him acquiesce if they perhaps give negative responses, but let him also conduct other investigations to establish the freedom of consent more fully and securely. This is to be explored more carefully when the parties to be married are induced to enter into marriage in order to remedy some arising difficulty, especially to avoid penalties otherwise to be incurred under civil law. Let parish priests carefully consider that one of the principal grounds of nullity of marriages which are brought to ecclesiastical tribunals consists in force or fear having been brought to bear (All. I, n. 10. 1.1).

12 8. Let the parish priest further inquire, unless the quality of the persons renders this inquiry useless, whether the parties to be married sufficiently understand Christian doctrine, and, above all, whether they know well the sanctity and indissolubility of Christian marriage and the obligations of the married state. But if he finds them ignorant of Christian doctrine, let him at least diligently teach them the first elements; and if they refuse, there is nevertheless no ground for rejecting them from marriage according to the norm of can. 1066.9

13 9. The examination of the parties shall further aim at preventing that grave abuse which today especially on account of the dishonesty of men attaches to canonical marriages in certain places. For there are not wanting in some places, especially in large cities, those who, disregarding canonical law, presume to enter into marriage with some condition or intention attached, either suspensive or irritant of the bond, which might provide a way out to cast off the yoke afterwards, for the sake of contracting new marriages. Therefore in places where the Bishop judges this to be expedient, in the examination of the parties the parish priest shall deliberately inquire and conduct suitable investigations, employing for this purpose the questions set forth in Alleg. I n. 15, 16, and others more suitable, which the circumstances of the place and the condition of the persons may require. The parish priest shall endeavor with all diligence, if the case warrants, to turn the parties away from the aforesaid intentions and conditions to be added to marriage and to induce them to retract any that may have already been added. Regarding, however, the legitimate addition of some lawful condition concerning the future, the present, or the past, let the parish priest consult the Ordinary and obey his mandates (All. I n. 17).

14 10. Finally, as regards the nullity of marriages on account of failure to observe canonical form, the principal cases brought to this Sacred Congregation are reduced to a defect either of witnesses or of legitimate delegation in the assisting priest: of which the first is for the most part to be attributed to inadvertence, the latter also to incompetence, certainly culpable. Let priests therefore learn well, before they assist at marriages, the statutes of canons 1094-1103, which pertain to the valid and licit assistance at the same, as well as the responses of the Pont. Comm. for the authentic interpretation of the Canons of the Code of 14 July 1922, 20 May 1923, and 28 December 1927.10

15 11. As a conclusion, this Sacred Congregation moreover specially commends to the Most Reverend Ordinaries the following: a) In places where this is provided for by concordatary law, for example in Italy and in the Portuguese Republic, let them take care that the parish priests send to the office of civil status a document concerning the marriages contracted within the prescribed time for its transcription in its registers. In general, however, let them command that all things which are to be observed by concordatary law in matrimonial matters be observed with the utmost exactness.11 b) Whenever a marriage is contracted by those about to be married, of whom one or both belong to another parish, the parish priest who assisted at the marriage, besides the entry of the same in his marriage register, and, if the spouse was baptized there, also at the end of the baptismal record, shall as soon as possible notify the parish priests or the parish priest of the place of baptism of both spouses or of one of them concerning the same marriage celebrated. These, moreover, shall transcribe the notices received according to the norm of can. 470 § 2 in their registers of the reborn (can. 1103 § 2) and shall send written notice of the transcription completed to the parish priest who assisted at the marriage.

16 He, however, shall not acquiesce until he has received this notice; having received it, he shall attach it to the bundle of documents of the celebrated marriage. c) Let them strive with all diligence that an executive sentence of nullity of marriage or an apostolic dispensation from a marriage ratified and not consummated be announced as quickly as possible, with the prohibitions against passing to other marriages perhaps established there, to the rector of the parish where the celebration of the marriage is recorded in the parochial registers, so that by him written mention be made of the same sentence or dispensation as well as of the prohibitions perhaps attached both in the marriage register and in the baptismal register, if in that parish one or both spouses were baptized; if one or both were baptized elsewhere, the same rector of the parish is bound to notify the parish priest or parish priests of the place where baptism was conferred of the executive sentence of nullity pronounced or of the dispensation granted with the prohibitions perhaps established, so that these may note these things in the register of the baptized.

17 He himself, the rector, shall inform his Ordinary as soon as possible of those things accomplished by him. d) Let them take care that baptism perhaps conferred outside the parish of origin, besides being recorded in the register of the baptized of the parish or church with a baptismal font lawfully endowed also with cumulative right according to the norm of can. 774 § 1, where someone actually received it, be likewise recorded in writing in the registers of the parish of origin. For this purpose, written notice is to be delivered as soon as possible by the parish priest or rector of the church where baptism was conferred to the rector of the parish of origin, which shall faithfully comprise all and each of the elements which are required by law for the baptismal record to be properly completed (can. 777). e) Finally, let the parish priests be commanded to prepare and record the marriage and baptismal registers most carefully: namely in the former let them immediately draw up the canonical record of each marriage celebrated in their own parish; in the latter, namely in the register of the baptized, let them record in writing all things which can. 470 § 2 commands, and let them take action against the negligent also with penalties according to the norm of can. 2383. f) Let the Ordinaries carefully inspect through frequent visitations to be made within each semester, if it can be done, and at least not beyond a year, as is desired, personally or through suitable ecclesiastical persons, whether the rectors of parishes prepare the parochial registers of marriages and of the baptized especially according to the norm of law, as under letter e), and having prepared them keep them properly in the archive; let them examine each individual records of celebrated marriages and conferred baptisms and let them mark each individual one with a certain appropriate special sign, whence it may be evident that the inspection has been completed.

18 Whenever a priest who lacked the delegation required by canon law has assisted at a marriage (can. 1094), let the Ordinaries themselves diligently inquire whether this necessary delegation has intervened in each case, and whether it was granted according to the norm of law.

19 12. This Sacred Congregation, having before its eyes the most serious inconveniences which arise from illicit and invalid marriages, entreats the local Ordinaries that, in accordance with their pastoral solicitude, they communicate the precautions entrusted to them with the parish priests and with all care watch over that they be carried out, and do not omit to inflict canonical penalties on the negligent according to the norm of can. 2222 § 1, not excluding suspension from the divine offices, especially in recidivists, so that safer provision may be made for the correct celebration of marriages, with the danger of any offense removed, as befits the dignity and sanctity of the sacrament of matrimony. Concerning the diligent observance of the canonical discipline of marriages set forth in this Instruction and especially concerning the visitations carried out [as above n. 11], the same local Ordinaries shall inform this Sacred Congregation annually by means of a special Report to be appended to the report "on the handling of matrimonial cases" to be transmitted to it by virtue of the letter of 1 July 1932. 12 Moreover, the Ordinaries of Italy, who are no longer bound to transmit the report on the handling of matrimonial cases on account of the recently established matrimonial tribunals by Apostolic Letters given Motu Proprio by Pius, of happy memory, Pope XI on 8 December 1938, shall report to this Sacred Congregation concerning the observance of this Instruction and the visitations carried out at the beginning of each year.

20 His Holiness Our Lord Pius, by Divine Providence Pope XII, in the Audience granted to the Excellent Secretary of the H. S. C. on 1 June 1941, deigned benignly to approve the aforesaid Instruction, already subjected to mature and careful examination by the Eminent Fathers in Plenary Assemblies. Given at Rome, from the offices of the Sacred Congregation for the Discipline of the Sacraments, on the 29th day of the month of June, on the feast of the Ss. Apostles Peter and Paul, in the year 1941.

21 D. Card. JORIO, Prefect. L. $ S. F. Bracci, Secretary.

APPENDIX

ATTACHMENT I (cfr. n. 3, 5, 7, 9 of the Instruction) Examination of those about to marry to be conducted at an opportune time before the celebration of marriage by the parish priest.

22 Having recalled to mind the bridegroom (bride) the sanctity of the oath and the gravity of the penalties to which perjurers are subject, as well as the solemnity of the act to be performed, the parish priest addresses the bridegroom (bride): Do you wish to invoke the Name of God as witness to the truth, touching the holy Gospels, with the following formula: "I ... swear that I shall tell the whole and sole truth concerning all matters about which I shall be asked". Then let him put to them questions separately, namely to the bridegroom in the absence of the bride, and conversely to the bride in the absence of the bridegroom:1

Art. 225 § 1. «The Ordinary of the place... is bound by the obligation of enjoining as soon as possible upon the rector of the parish where the celebration of matrimony has been recorded in the parochial registers, that he make mention of the sentence of nullity and of any prohibitions perhaps imposed, for example in cases of impotence, in those registers as well as in the register of the baptized, if in that parish either or both of the spouses were baptized. § 2. The rector of the parish is bound to note the sentence of nullity and any prohibitions perhaps imposed immediately in the aforesaid registers and, if either or both of the spouses were baptized elsewhere, to notify the pastor or pastors of the place of baptism of the pronounced sentence of nullity, and of any prohibitions perhaps imposed, so that these may be noted by them in the book of the reborn, as well as to inform his own Ordinary as soon as possible of those things accomplished by him».

  14. To these questions shall be added those which are prescribed by particular law, for example, Concordats.
  15. Let the pastor not easily believe the response given that he has not received baptism, unless it is otherwise certain to him, but let him require from the pastor of the place of origin whether it appears from the book of the reborn that baptism was conferred: in which case let him seek the faith of this [cfr. n. 4 c), a) of the Instruction].
  16. Let an authentic document be required of the death of the prior spouse, or of the executive sentence of nullity of matrimony [cfr. n. 4 o) e) and ç) and n. 6 of the Instruction], or of dispensation over a ratified and non-consummated matrimony together with mention of any prohibition perhaps imposed [cfr. n. 11 c) of the Instruction]. If it be a matter of the privilege of the faith, let the statutes of cc. 1069 § 1 and 1120-1127 as well as the prescriptions of the S. C. of the Holy Office be observed.
  17. In the case of affirmed residence the pastor shall collect proofs of free status (can. 1023 § 2: cfr. n. 6 instr.). In the case however of which in § 3 of the same canon, let him consult the Ordinary.
  18. Although the person about to be married has validly contracted espousals with another person, and no just cause excuses him from fulfilling them, no action is given to demand the celebration of matrimony, but only for the reparation of damages, if any is owed (can. 1017 § 3).
  19. If a so-called civil matrimony with another person, even if only one of them attempted it, and has been definitively dissolved, let an authentic document of such definitive dissolution be required; if however it still subsists, let the Ordinary be consulted. (For Italy cfr. Instr. of the H. S. C. 2 April 1909).
  20. In these cases, if an affirmative answer is given, let the pastor conduct himself according to the norm of can. 1065 and can. 1066.
  21. Regarding mixed matrimonies, the prescriptions of the Code of Canon Law and the decrees of the Holy Office are to be followed.
  22. Let inquiry be made more carefully, though prudently, into the existence of the impediment of crime when it is established that those about to be married have undertaken illegitimate offspring; or that they are held by the impediment of affinity; or that there is another reason for suspicion.
  23. Let the pastor not acquiesce even in the response given concerning the absence of any coercion, but let him inquire from elsewhere whether the matter is truly thus; and if there are present special circumstances, of which under n. 7 of this Instruction, let him investigate most carefully, even through witnesses, if it be necessary (Alleg. II and III).
  24. Let the pastor seriously exhort minor children of the family not to enter into matrimony without the knowledge or reasonable consent of their parents; and if they refuse, let him not assist at their matrimony unless he has first consulted the Ordinary of the place (can. 1034) (Alleg. III).
  25. This holds good for places where a civil act is prescribed by public authority: in which case the pastor, without consulting the Ordinary, shall not assist at the marriage if anything hinders the performance of the civil act, or if there is otherwise suspicion of the omission of the same civil act.
  26. Namely, if either or both parties by a positive act of the will exclude matrimony itself, or all right to the conjugal act or some essential property of matrimony (can. 1086 § 2).
  27. These are especially conditions for the future contrary to the substance of matrimony, namely contrary to the three goods of marriage: faith, offspring, and sacrament (can. 1092).
  28. If the person about to marry cannot write or is unable to write, let him affix the sign of a cross and let this be noted in the records.
  29. Let it be carefully observed that this question is to be regarded as of very great importance so that nullity of marriage, especially on the ground of force and fear, may be prevented. Let the pastor have regard to the reason for the response given in the examination of the parties: and if he has already conducted it, let him call the same parties again for the same purpose.
  30. As is evident, this permission, as is provided in can. 1097 § 1 n. 3, is granted for liceity only by the pastor to whom it would be the right to assist at the marriage.

SACRA CONGREGATIO
DE DISCIPLINA SACRAMENTORUM
INSTRUCTIO
DE NORMIS A PAROCHO SERVANDIS IN PERAGENDIS CANONICIS INVESTIGATIONIBUS ANTEQUAM NUPTURIENTES AD MATRIMONIUM INEUNDUM ADMITTAT (CAN. 1020).

Canonum statuta eadem nectantur. Ad rem Ecclesia onus commisit animarum Praesulibus impertiendi parochis sibi subiectis idoneas normas pro investigationibus sedulo et opportuno tempore peragendis, ne matrimonio ineundo aliquid obstet ; itemque ut, si reapse impedimenta adsint, actuose studeant ea auferre aut secus nupturientes infecto coniugio dimittant. Tale praeceptum continetur et in can. 1020 Codicis I. C, cuius verba praestat referre : « § 1. Parochus cui ius est assistendi matrimonio, opportuno antea tempore, diligenter investiget num matrimonio contrahendo aliquid obstet. § 2. Tum sponsum tum sponsam etiam seorsum et caute interroget num aliquo detineantur impedimento, an consensum libere, praesertim mulier, praestent, et an in doctrina christiana sufficienter instructi sint, nisi ob personarum qualitatem haec ultima interrogatio inutilis appareat . § 3.

3 3. Porro nemo ignorat causas, unde initarum nuptiarum invalida aut illicita celebratio dimanat, ad tria capita reduci, nempe : a) impedimentum matrimoniale proprie sumptum; b) vitium consensus; c) defectum formae canonicae. Gravia igitur incommoda contra sanctitatem christiani connubii praecavere studens, haec Sacra Congregatio, cui, ex statuto can. 249, proposita est universa legislatio circa disciplinam septem Sacramentorum, quaeque iam vulgavit Instructionem super probatione status liberi ac denuntiatione initi matrimonii, die 4 iulii 1921, apprime opportunum censuit alteram conficere Instructionem, qua adiutricem praebendo manum Revmis Ordinariis, quibus hoc onus ex § 3 relati can. 1020 incumbit, eis suppeditaret idoneas normas ad nupturientium examen rite diligenterque explendum. Quaestiones, nupturientibus seorsum proponendae, confectae reperiuntur in Appendice {Alleg. I) huius Instructionis, salva Ordinario variandi facultate, articulos demendo vel addendo pro matrimoniorum nullitatis aut illiceitatis usitatioribus rationibus, quas in sua dioecesi contingere compererit, spectatis personarum ac temporum adiunctis.

4 4. At quaedam sunt prae primis adnotanda circa elementa inquisitionis a rei. can. 1020 praeceptae. a) Quod ad parochum attinet : qui habet ius et onus inquirendi, is est cui competit assistentia matrimonio, et hic, nisi iusta causa excuset, est parochus sponsae (can. 1097 § 2).

V) invenitur, omnibus notitiis ibi requisitis praedito.

225 Instructionis huius S. Congregationis, quae inscribitur Instructio servanda a tribunalibus dioecesanis etc., diei Io aug. 1986 (Acta Ap. Sedis, vol. XXVIII, pag. 313 seq.).

7 5. Nupturientium examen, ad normam § 2 rei. can. 1020, tria potissimum respiciat oportet : a) absentiam impedimentorum; b) libertatem consensus; c) sufficientem scientiam doctrinae christianae. Quoad primum : parochus a sponsis percontetur num aliquo detineantur impedimento tum impediente (cc. 1058-1066), tum praesertim dirimente (cc. 1067-1080), sive publico (ligaminis, consanguinitatis, affinitatis etc.), sive occulto, immo hoc potissimum, quod rarius innotescere solet (voti, criminis etc.) (Alleg.

3987) ». Art. 221 § 3. 1031 § 1 n. I , testes fide dignos et iuratos adhibeat pro huiusmodi accura o tiore exploratione (Alleg. II). Ceterum semper exprimatur in litteris testimonialibus aetas nupturientium a fide baptismi desumenda.

Pervigilent parochi ne contra ius, bona vel mala fide, nova coniugalia foedera ineant qui praecedentis matrimonii vinculo vinciantur, etsi de huius valore haud temere ambigatur, immo nullitas ipsa sit in aperto. d) Praescriptum can. 1069 § 2 optime norint, matrimonii nempe nullitatem canonica dumtaxat probatione esse evincendam, id est ordine iudiciali servato usque ad alteram sententiam conformem contra matrimonii valorem a qua appellatum non fuerit a vinculi defensore; vel, in casibus exceptis (can. 1990-1992) expletis regulis traditis in supra memorata Instructione huius S. O. diei 15 augusti 1936 art. 226 seq. Ad rem servetur adamussim memorata Instructio huius S. Congregationis diei 4 iulii 1921.

I, n. 10. 1.1).

12 8. Ulterius exploret parochus, nisi personarum qualitas hanc explorationem inutilem reddat, utrum nupturientes christianam doctrinam satis calleant, et, prae ceteris, utrum probe noscant sanctitatem et indissolubilitatem christiani connubii obligationesque status matrimonialis. At, si christianae doctrinae eos ignaros repererit, prima saltem elementa sedulo ipsos edoceat; quod si renuant, non est tamen locus eosdem respuendi a matrimonio ad normam can. 1066.9

I n. 15,16 exaratis, aliisque aptioribus, quas locorum adiuncta et personarum conditiones postulent. I n. 17).

470 § 2 in suis renatorum regestis (can.

774 § 1 praeditae, ubi quis reapse eum suscepit, scripto item consignetur libris paroeciae originis. 2383. . • f) Attente inspiciant Ordinarii per crebras visitationes intra singula semestria, si fieri potest, et saltem non ultra annum, faciendas, uti exoptatur, personaliter, vel per idoneas ecclesiasticas personas, utrum paroeciarum rectores regesta paroecialia matrimoniorum et baptizatorum praesertim, ad normam iuris, prouti sub littera e), conficiant confectaque in archivo rite asservent ; singulos vero actus expendant celebratorum matrimoniorum et collatorum baptismatum eosdemque singulos quodam apposito speciali signo communiant, unde de peracta recognitione constet.

18 Quoties véro matrimonio adstiterit sacerdos, qui indiguerit delegatione a iure canonico requisita (can. 1094), Ordinarii ipsi diligenter inquirant utrum necessaria haec in singulis casibus intercesserit delegatio, eaque ad normam iuris impertita.

2222 § 1, haud exclusa suspensione a divinis, praesertim in recidivos, quo tutius nuptiarum rectae celebrationi prospiciatur, cuius- vis offensionis periculo remoto, prout sacramenti matrimonii dignitatem et sanctitatem decet.

20 Ssmus Dominus Noster Pius divina Providentia Pp. XII, in Audientia Excmo Secretario H. S. C. die 1^ iunii 19!fl concessa, praefatam Instructionem, ab EE. PP. in Plenariis Conventibus maturo ac diligenti examini iam subiectam benigne approbare dignatus est. Datum Romae, ex aedibus Sacrae Congregationis de disciplina Sacramentorum, die 29 mensis iunii, in festo Ss. Apostolorum Petri et Pauli, anno 1941.

SACRA CONGREGAZIONE
DELLA DISCIPLINA DEI SACRAMENTI
ISTRUZIONE
SULLE NORME DA OSSERVARSI DAL PARROCO NELLO SVOLGIMENTO DELLE CANONICHE INCHIESTE PRIMA DI AMMETTERE I NUBENDI AL MATRIMONIO (CAN. 1020).

I, n. 10. 1.1).

1065 e del can. 1066.
