Bolla sulla riforma della Segnatura di Giustizia
LXXII.

Reform of the referendaries of the Signature of Justice of the Roman Pontiff and ordinances to be observed by the judges of the Roman Curia. Pius, bishop, servant of the servants of God, for perpetual memory of the matter.
1 Since recently we have undertaken a general reform of the offices and courts of the Roman Curia for the purpose of rooting out abuses and providing universal convenience to litigants, and have made provision accordingly, desiring to consult entirely for the protection of those same litigants and to provide that suits be terminated more speedily, we have deemed it very opportune, indeed necessary, also to reform the Signature of Justice, from which frequently those who seek to prolong suits and to exhaust others with longer and more serious expenses obtain through cavils and tricks various rescripts, either superfluous or inducing delay. Therefore, for the reform of that office, having examined and also carefully discussed certain matters noted by our beloved sons the referendaries and proposed before us, even in the presence of some of the venerable brothers of the holy Roman Church, the cardinals, by the counsel of those same and of our other brothers, we enact by this constitution, to be valid in perpetuity.
2 and we have provided, desiring to consult entirely for the indemnity of those same litigants, and to provide that suits be terminated more speedily, we have deemed it very opportune, indeed necessary, also to reform the Signature of Justice, from which very often those who seek to protract suits for a long time and to exhaust others with longer and more serious expenses, by cavils and subterfuges extort various rescripts, either superfluous or inducing delay. Therefore for the reform of that office, having examined and also maturely discussed certain matters noted by our beloved sons the Referendaries and proposed before us, even in the presence of some of the venerable brethren Cardinals of the Holy Roman Church, by the counsel of those same and of our other brethren, we enact and establish by this constitution, to be valid in perpetuity.
3 § 2. Nor in ancient and difficult matters, in which several commissions have been expedited on both sides, and in avocations from prior judges and in any way prejudicial, shall he put his hand, unless the party having an interest has first been cited and is present.
4 § 3. And when it is a matter of revocation or moderation of some prescript, similarly he shall not put his hand unless the name of the referendary who put his hand to it has been set down in the prescript, so that he may render an account and justify it. Nor shall the reform or moderation of that same prescript by one having the Signature of Justice be signed in any way, unless the name of the referendary, as aforesaid, has been set down in the prescript itself.
5 § 4. Less in commissions of appeals from interlocutory decrees, unless there be an express relevant grievance. Nor when appeal is made from a definitive sentence with a clause or having the force of a definitive sentence, unless the matter be so expressed that the referendary may see whether such be a grievance that cannot be repaired by a definitive sentence. And if in the commission there has been added a clause with the whole principal matter, then let it be added, justified however by the said grievance.
6 § 5. Let the referendaries henceforth refrain from putting their hands to commissions of nullities and attempted acts, unless the nullities be expressed from defect of jurisdiction, citation or mandate, and the attempted acts themselves. And likewise in those in which it is narrated that judgment has been pronounced, as in the schedule.
7 § 6. Nor shall they put their hand to commissions of prorogation of time limits, unless in those in which, for the first time, that prorogation itself is sought; but those commissions in which supplication is made for further prorogation, let them propose in our Signature of Grace.
8 § 7. Criminal and matrimonial cases shall not be committed to inferior bishops; and in the lands of the Church, criminal cases of clerics in sacred orders to the ordinary; but those of other clerics and laypeople to the governors of the places.
9 § 8. And in order that suits may be expedited as quickly as possible and with less expense to the parties, we decree that any judge to whom cases of restitution in full, nullity and attempted acts shall henceforth be committed, may, without special commission, set a time limit for proving concerning cases of restitution and concerning the nullities or attempted acts themselves, and, that time having elapsed and nothing having been proved, proceed to the expedition of the principal matter.
10 § 8. And in order that lawsuits may be dispatched as quickly as possible and with less expense to the parties, we decree that any judge to whom cases of restitution in full, nullity, and attempted acts shall henceforth be committed may, without special commission, fix a term for presenting proofs concerning cases of restitution and concerning the nullities or attempted acts themselves, and, when that term has elapsed and proofs have not been presented, may proceed to the expedition of the principal matter.
11 reiterate all substantial time limits in virtue of a commission from the happy memory of Pope Innocent VII, our predecessor, which we extend by the tenor of these presents to all judges and also auditors in the aforesaid cases, without any other special commission.
12 § 10. And that from excessive taxation of expenses, appeal shall be made only once, which sentence shall have the force of three.
13 Prorogation of Powers, in Criminal and Matrimonial Cases.
14 Reformation in the matter of the restitution.
15 in leg., nullitatis et alienationis, Terminorumque reiteratione, An. c. i. vira 226 bullarium all substantial terms, by virtue of the commission from our predecessor of happy memory, Pope Innocent VII, which we by the tenor of these presents extend to all judges and also auditors in the aforesaid cases, to reiterate without any other special commission.
16 § 10. And that from excessive taxation of expenses an appeal may be made only once, which appeal shall be committed to [the tribunal] whose sentence shall have the force of a final judgment.
17 § 11. Cases of disputes between creditors and the heirs of the deceased or of another debtor, concerning the distribution of his goods among the creditors themselves, shall be expedited within three months for those present; for the absent, however, on this side of the mountains, within six months; but beyond the mountains, within nine months, and in no way, unless from great cause and by our letter of grace, shall the aforesaid proceeding be extended.
18 § 12. And from the day of the death of the debtor, within two months the heirs present; the absent, however, on this side of the mountains, within four, but beyond the mountains, within six, shall be bound to make an inventory and to deliberate whether they wish to enter upon the inheritance.
19 § 13. And meanwhile the judges, before whom it shall happen that such cases of dispute are brought, shall order and cause the goods of the said debtor or bankrupt to be consigned to the creditors having their claims liquidated.
20 Meanwhile, having received suitable security for restitution to those having prior and superior rights, and for contribution to those having equal rights, shall order and cause them to be consigned.
21 § 14. If anyone shall in any way contravene this constitution of ours, he shall by that very fact incur the penalties of our displeasure and otherwise of our will. And nevertheless commissions signed contrary to the tenor of these presents shall be of no force or effect, and shall be deemed to have been extorted by preoccupation, and judges to whom they shall happen to be presented shall in no way be bound to obey them. And thus by whatever judges and commissioners, exercising any authority whatsoever, having been removed from them and from each of them any faculty and authority of judging and interpreting otherwise, it ought to be judged and determined; we also decree that it shall be null and void if otherwise anything concerning these matters shall by anyone, with whatever authority, knowingly or unknowingly, happen to be attempted.
22 § 15. Notwithstanding apostolic constitutions and ordinances to the contrary, whatsoever.
23 § 16. Let no one whatsoever presume to infringe this page of our sanction and decree, or to contravene it with rash presumption. If anyone however, etc.
24 Given at Rome at St. Peter's, in the year of our Lord's Incarnation one thousand five hundred sixty-two, on the Kalends of July, in the second year of our pontificate.
