Mandate concerning the reduction of the number of writers of the sacred Penitentiary to twelve (\).
SUMMARY
1 Reasons for establishing the number of such writers. — Mandate (of which in the rubric). Clement, bishop, servant of the servants of God, to his venerable brother Berengarius, bishop of Tusculum, greeting and apostolic blessing. It is fitting that in the offices of the Apostolic See there be a determined number of ministers or officials; lest a superfluous multitude lack provision, or from a scarcity the fitting service be withdrawn from that same See. Indeed, it has frequently been represented to us by part of our beloved sons, the writers of our Penitentiary, that on account of the importunate insistence of many, to whom the aforesaid See has shown itself liberal, their number is said to have been so increased, that they themselves, who are known to be at present twenty-one or thereabouts, according to their dignity and the laudable ancient custom of the Roman Curia, cannot be comfortably sustained from the emoluments of their office. Wherefore on their behalf it was humbly supplicated to us, that since in the times of other Roman Pontiffs, our predecessors, these same writers were not in such a multitude, but their office had been moderated in a decent number of persons, as the quality and utility of the matters incumbent upon them required, we would deign to provide concerning this matter from apostolic benignity; and finally that we would command the office to be reduced to the number of twelve writers. Since therefore it is our intention that the chosen writers, who are our officials, should not be burdened on account of a superfluous multitude; but rather, reduced to the said twelve or another fitting number, according to the dignity and custom aforesaid, may be comfortably sustained; considering that both the manifold qualities and burdens of matters, which the continued necessity of various things produces, and the superfluous multitude of the said writers are not hidden from you, but your own long experience in such matters has already taught you, that in such things, according to the dignity of the said See, there should be observed what is fitting; we commit and command to your fraternity, in whom we bear special confidence in the Lord, by these apostolic letters, that you, if you shall find the office of these same writers, all circumstances being considered which ought to be attended to in this matter, to be heavily burdened by such a multitude, shall proceed to reduce that office to the said twelve or another certain number of writers competent, according to the prudence given you by God, as you shall judge expedient after considering the foregoing, by our authority: decreeing and ordaining, by the aforesaid authority, that the said office shall henceforth be content with the aforesaid number; nor shall anyone henceforth be admitted to it until it shall be reduced to the aforesaid number to be determined by you, and someone shall have departed from the same; unless perhaps the necessity of manifold matters or another cause should require that something else be done and ordained concerning these things in the future by the providence of the same See.
