In supremo
1 2 3 Esordio.
3 litur, come vediamo, nel Signore salutarmente conviene.
4 § 1. Poiché dunque la causa tra i diletti nostri figli frati dell'Ordine dei Minori di san Francesco detti Conventuali da una parte, e i frati dello stesso Ordine della più stretta Osservanza dall'altra parte, circa la riassunzione di calepodi e la distinzione dell'abito secondo quanto prescritto dalle bolle emanate per diversi nostri predecessori Romani Pontefici, a lungo agitata, e per nostro mandato nella congregazione dei venerabili nostri fratelli cardinali della Santa Romana Chiesa preposti agli affari dei regolari di nuovo proposta, da questi stessi cardinali, ascoltate le parti, esaminate le scritture, maturamente e diligentissimamente considerata e esaminata sia stata;

Testo inglese
1 the taking up of calpacs, the laying aside of sandals, and the adoption of a round hood and a broader mozzetta and a meadow-coloured mantle, to be worn by the brothers of the Order of St. Francis of the stricter Observance.
Urban, Pope VIII, for perpetual remembrance of the matter.
2 Placed in the supreme seat of the apostolate, though by unequal merits, by divine disposition, we continually direct the gaze of our mind towards the prosperous direction of the state of the religious Orders of whatever kind fighting in the Church of God, and we establish and ordain those things by which their prosperous and happy state and direction may be consulted, as we perceive it to be wholesomely expedient in the Lord.
3 § 1. Since therefore the cause between our beloved sons, the brothers of the Order of Minors of St. Francis, called Conventuals on the one part, and the brothers of the same Order of stricter Observance on the other part, concerning and regarding the resumption of calpacs and the distinction of habit according to the prescription of bulls emanated through various Roman Pontiffs, our predecessors, has been long agitated, and by our mandate proposed again in a congregation of our venerable brothers, the cardinals of the Holy Roman Church, placed over the affairs of regulars, and by those same cardinals, the parties having been heard and the writings having been examined, has been maturely and most diligently weighed and examined;
4 § 2. We, desiring to provide for the peace and quiet of those same religious and for their happy and prosperous direction, by the counsel of those same cardinals, of our own motion and from certain knowledge and mature deliberation of our own, and from the fullness of apostolic power, to those same brothers of stricter Observance, inasmuch as they ought to resume calpacs and lay aside sandals everywhere throughout all Italy, nor receive them henceforth, under the penalties of excommunication latae sententiae and deprivation of active and passive voice, and moreover, as regards superiors, also suspension from offices incurred ipso facto, we enjoin by the tenor of these presents: and moreover we command the Ordinaries of places, that in case of transgression they compel and force the regulars of the aforesaid stricter Observance to do so.
5 § 3. But as regards the brothers of the same Order called Recollects in France, who do not wear sandals but calpacs, since it is established that they wear a hood somewhat pointed, to our venerable brother Bernardino, archbishop of Damietta, our nuncio and that of the Apostolic See in the kingdom of France for the present and for the time being, we similarly command by these presents, that he take opportune care that they altogether assume a round hood and a broader mozzetta
6 Wishing to provide, insofar as it lies within us, for the observance of the Rule of St. Francis in so far as it concerns the same cardinals' Council, the calepodia in Italy are to be taken up by deliberation. And by Our own motion and from certain knowledge and mature deliberation, and from the fullness of apostolic power, We enjoin upon the same brothers of the stricter Observance, that they ought to resume the calepodia and lay aside them everywhere throughout all Italy, nor receive them hereafter, under the penalty of excommunication latae sententiae, and deprivation of active and passive voice, and moreover, as regards superiors, also suspension from offices incurred ipso facto, by the tenor of these presents: and furthermore We command the Ordinaries of places that in case of transgression they compel and force the aforesaid regulars of the stricter Observance to do so.
7 § 4. Moreover, for fuller and more certain provision, adhering especially to the letters of Clement VIII and Gregory XIII, Roman Pontiffs, also our predecessors, by these same presents we likewise command that the aforesaid brothers of stricter Observance be not molested, provided they use baser and worn cloths and of despised colour; but we will that under the same penalties, their form of habit as regards a round hood, a broad mozzetta and a mantle to be perpetually worn, shall be and ought to be altogether conformable to the brothers of the Observance, and they ought to adapt and wear it within two months.
8 § 5. And thus by whatsoever ordinary judges and delegates, even auditors of the causes of the apostolic palace, it ought to be judged and determined, and we decree and declare that if anything contrary to these things shall happen to be attempted by anyone whatsoever, by whatever authority, knowingly or unknowingly, it shall be null and void.
9 § 6. Notwithstanding apostolic constitutions and ordinances, and, insofar as it be necessary, the statutes and customs of the said Order (and also those confirmed by apostolic oath, apostolic confirmation, or any other firmness), privileges also, indults and apostolic letters, granted, confirmed and renewed to those same brothers of stricter Observance, their superiors, and to whosoever else, under whatsoever tenor and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious and unusual clauses, and irritant and other decrees, in general or in special, and otherwise in contravention of the aforesaid in whatsoever manner. All and singular of which, having their full tenor present in these for fully and sufficiently expressed and inserted word for word, we otherwise derogate from them in their force
10 § 4. Furthermore, for fuller and more certain provision, adhering especially to the letters of Clement VIII and Gregory XIII, of happy memory, Roman Pontiffs and also our predecessors, by these same presents we likewise command that the aforesaid brothers of the Stricter Observance be not troubled, so that they may use coarser and repeated cloth and despised color; but we will that under the same penalties, the form of their habit as to the round capucium, the broad mozzetta and the mantle perpetually extended, be and ought to be altogether conformable to the brothers of the Observance, and they ought to adapt and wear it within two months.
11 § 7. We will moreover that these presents be believed when transcribed
12 § 6. Notwithstanding the apostolic constitutions and ordinances, and, insofar as it may be necessary, the statutes and customs of the said Order (and also those strengthened by oath, apostolic confirmation, or any other firmness), as well as privileges, indults and apostolic letters granted to the same brothers of the Stricter Observance, their superiors, and any others whatsoever, under whatsoever tenor and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious and unusual clauses, and irritant and other decrees, in general or in particular, and otherwise in contravention of the foregoing in any manner whatsoever granted, confirmed and renewed. All and each of which, holding the tenor of all of them as fully and sufficiently expressed and inserted word for word in the present, we otherwise derogate from in their force, to the contrary.
13 we derogate from them, in this instance only, specially and expressly, and from all other things whatsoever that are contrary.
14 We will, however, that credit be given to the present [document] in his hand . . .
15 transcripts, even printed ones, subscribed by the hand of some public notary and furnished with the seal of some person constituted in ecclesiastical dignity, the same faith shall be given to them as would be given to the same documents if they were presented or shown. Given at Rome, at St. Peter's, under the Fisherman's Ring, on 10 January 1624, in the first year of our pontificate.
16 Given on 10 January 1624, pontificate year 1.
