Bull on the protection of witnesses and the inquisitor of Avignon

Bull of Pope Pius IV ·

1 are to be published the testimony of witnesses examined against schismatics or heretics, nor shall account be rendered concerning the proceedings to any other than the Roman Pontiff or the supreme inquisitors of our City.

2 Pius, Pope IV, for the perpetual memory of the matter. Since, as we have learned not without great sorrow of heart, by the instigation of the enemy of mankind, the number of schismatics and other heretics has so prevailed in the province, state and diocese of our city of Avignon, and, on account of their power and malice or that of some of them, no one dares to testify against them or to reveal and accuse their crimes, with the result that these schismatics and heretics remain unpunished, to no small offense of the Divine Majesty and grave scandal to Catholic persons.

3 § 1. We, lest in the future anyone, from fear of these heretics and schismatics, should fear to reveal their crimes, wishing to provide opportunely in the aforesaid matters; by our own motion and from certain knowledge, to our beloved son brother Bernard, the present inquisitor of Avignon, or to the inquisitor of heretical depravity existing in that province for the time being, that persons who shall have revealed such schismatics or heretics, or shall have testified and borne witness against them, are not to be required to publish or reveal themselves. And if any testimony of these witnesses should happen to be published by the same inquisitor, it shall be so truncated and kept secret that knowledge of the names and surnames of these witnesses cannot come to any notice.

4 Or the supreme inquisitors of the City.

5 Prohibition against those molesting the inquisitor concerning the aforesaid.

6 are to be published so truncated and secret that knowledge of the names and surnames of these witnesses cannot come to any notice.

7 § 2. And that the same inquisitor cannot be called to account by anyone; and that he is not bound to render account of the proceedings formed by him against the said heretics and schismatics to anyone except us or to the Roman Pontiff existing for the time being and the supreme inquisitors of our City, we grant and concede likewise by apostolic authority, by the tenor of these presents.

8 § 3. Strictly forbidding all and each of our venerable brothers the archbishops, bishops and other prelates, and their vicars in spiritual and temporal matters or general officials, and our beloved sons all and each of the judges and persons, both ecclesiastical and secular, of whatsoever dignity, status, degree and order or condition existing, that they dare or presume to compel the same present and future inquisitor to the revelation and publication of the names and surnames of the said witnesses, or to the rendering of account concerning the proceedings formed by the same present inquisitor against these heretics and schismatics, or to be formed by him and other inquisitors for the time being in the future, nor on the aforesaid matters or on occasion thereof, under any pretext whatsoever, to molest, disturb or disquiet him; declaring nonetheless null and void, if otherwise should happen to be attempted in these matters by anyone, under whatsoever authority, knowingly or unknowingly.

9 § 4. Notwithstanding apostolic constitutions and ordinances and those issued in provincial and synodal councils, general or special, and statutes and customs, even those strengthened by oath, apostolic confirmation or any other firmness whatsoever, and also privileges, indults and apostolic letters granted, confirmed and renewed in any way to the contrary. All of which, even if special, specific and express mention of them and their entire tenors ought to be made, their tenors being held by us as sufficiently expressed in these presents, otherwise remaining in their force, on this occasion only, for the effect of these presents, we specially and expressly and most broadly derogate, and to all other things whatsoever to the contrary.

10 Given at Rome at St. Peter's, under the Fisherman's Ring, on 1 November, 1561, in the second year of our pontificate.

11 Dated 1 Nov. 1561, pontificate year 2.

4 o dai supremi inquisitori dell'Urbe.
