BRASILIA. BENEDICT, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR THE PERPETUAL MEMORY OF THE MATTER

1 Since the city of Recife in Brazil is easily the foremost both in the number of its inhabitants and in commercial affairs, and in the political authority by which it is the supreme seat of the civil government of Pernambuco in that State and in the Olinda archdiocese, and for these reasons the venerable brethren, Archbishops of Olinda, have for a long time deemed it opportune and necessary to establish their residence in that city, which hereafter lies closest to the city of Olinda, and that also the greater part of the canons might dwell there: it has seemed expedient that this condition of affairs, which obtains in fact, be sanctioned by some canonical provision and held as ratified.

2 Wherefore, adhering to the wishes of our venerable brother Sebastian Lerne da Silveira Cintra, the present Archbishop of Olinda, to which was added also the suffrage of the venerable brother, the Apostolic Nuncio in Brazil, by the deliberation of the Sacred Consistorial Congregation, We establish and decree that the church of St. Peter in the city of Recife be elevated to the honor and dignity of a Concathedral, namely so that the Archbishop of Olinda may be able to perform the sacred pontifical functions therein as opportunity permits, equally as in the Metropolitan Church of Olinda, and also to reside there together with the canons of Olinda, who in the Concathedral of St. Peter, just as in the old Metropolitan Church of Olinda, according to the opportunity of the times, shall be able and ought to gather and perform the sacred functions, according to the manner to be determined by the consent of the present archbishop. The archdiocese henceforth shall assume the name of Olinda and Recife.

3 Which things also by these letters, by apostolic authority, are decreed by Us, with the consent of those to whom it pertains, or who presume that it pertains to them, being supplied, it shall be lawful for no person, at any time whatsoever, to infringe, or to oppose these things or to act contrary to them in any way. If anyone, which God forbid, shall presume to attempt this, let him know that he will incur the penalties established by the sacred canons against those who resist the exercise of ecclesiastical jurisdiction.

4 For the execution of all these things, We appoint the venerable brother Hyacinth Angel Scapardini, archbishop with the title of Damascus and Apostolic Nuncio in the Brazilian Republic, and We grant to him the necessary and opportune faculties, even of subdelegating, for the effect of which the matter is concerned, another man constituted in ecclesiastical dignity, especially the Archbishop of Olinda himself, and at the same time of pronouncing definitively upon any difficulty or opposition arising in any way in the act of execution, with the burden of transmitting to the Sacred Consistorial Congregation within six months, a record, drawn up in authentic form, of the absolute execution of this Our mandate, so that it may be preserved in the archive of the same Sacred Congregation.

5 We decree finally that these present Letters shall be valid notwithstanding any contrary provisions whatsoever, even those worthy of particular and express mention.

6 Given at Rome at St. Peter's, in the year of Our Lord one thousand nine hundred and eighteen, on the twenty-sixth day of the month of July, in the fourth year of Our Pontificate.

Si quis, quod Deus avertat, hoc attentare praesumpserit, sciat obnoxium se evasurum esse poenis a sacris canonibus contra obsistentes exercitio ecclesiasticae iurisdictionis statutis.

4 Ad haec autem omnia exsequenda deputamus venerabilem fratrem Hyacinthum Angelum Scapardini, archiepiscopum titularem Damascenum et in Brasiliana Republica Apostolicum Nuntium, eique tribuimus necessarias et opportunas facultates, etiam subdelegandi, ad effectum de quo agitur, alium virum in ecclesiastica dignitate constitutum, imprimis ipsum Olindensem Archiepiscopum, simulque definitive pronuntiandi super quavis difficultate vel oppositione in exsecutionis actu quomodolibet oritura, cum onere ad Sacram Congregationem Consistorialem intra sex menses, fidem, authentica forma exaratam, absolutae exsecutionis huius Nostri mandati transmittendi, ut in eiusdem S. 1 Poiché la città di Recife in Brasilia sia per il numero degli abitanti e per le cose commerciali, sia per l'autorità politica, essendo sede suprema del governo civile del Pernambuco, in quello Stato e nell'arcidiocesi Olindensi facilmente principale, e per queste ragioni i venerabili fratelli Arcivescovi Olindensi da molto tempo già abbiano ritenuto opportuno e necessario costituire in quella città, che d'altronde è prossima alla città Olindensi, la loro dimora, e ivi pure la massima parte dei canonici abiti: è parso conveniente che questa condizione delle cose, che di fatto vigora, sia sanzionata da qualche provvedimento canonico e sia ratificata.

2 Perciò, aderendo ai voti del venerabile fratello Sebastiano Lerne da Silveira Cintra, odierno Arcivescovo Olindensi, ai quali si è aggiunto il suffragio del venerabile fratello anche del Nunzio Apostolico in Brasilia, di concerto con la Sacra Congregazione Concistoriale, Noi stabiliamo e decerniamo di elevare la chiesa di S. Pietro nella città Recifense all'onore e dignità di Concattedrale, in modo cioè che l'Arcivescovo Olindensi possa compiere le sacre funzioni pontificali ivi secondo l'opportunità Acta Apostolicae Sedis - Commentarium Officiale allo stesso modo che nella Chiesa Metropolitana Olindensi, e ivi pure risiedere insieme con i canonici Olindensi, i quali nella Concattedrale di S. Pietro, come nella vecchia Chiesa Metropolitana Olindensi, secondo l'opportunità dei tempi, potranno e dovranno convenire e compiere le sacre funzioni, secondo il modo da determinarsi di concerto con l'odierno arcivescovo. L'Arcidiocesi invece in seguito assumerà il nome di Olindensi e Recifense.

3 Queste cose inoltre, che sono state decretate da Noi con queste lettere, per autorità apostolica, supplito il consenso di coloro a cui spetta, o che presumono che spetti loro, a nessun uomo, in nessun tempo mai, sia lecito infrangere, o opporsi ad esse o contrariarle in alcun modo. Se qualcuno, che Dio non voglia, avrà osato tentare questo, sappia che si sarà reso obnossio alle pene stabilite dai sacri canoni contro coloro che si oppongono all'esercizio della giurisdizione ecclesiastica.

4 Per l'esecuzione di tutte queste cose deputiamo il venerabile fratello Giacinto Angelo Scapardini, arcivescovo titolare di Damasco e nella Repubblica Brasiliana Nunzio Apostolico, e gli attribuiamo le facoltà necessarie e opportune, anche di subdelegare, per l'effetto di cui si tratta, un altro uomo costituito in dignità ecclesiastica, in primo luogo lo stesso Arcivescovo Olindensi, e insieme di pronunciare definitivamente su qualsiasi difficoltà o opposizione che sorga in qualunque modo nell'atto dell'esecuzione, con l'obbligo di trasmettere alla Sacra Congregazione Concistoriale entro sei mesi, la fede, redatta in forma autentica, dell'assoluta esecuzione di questo Nostro mandato, affinché sia conservata nell'archivio della medesima S. Congregazione.

5 Decerniamo infine che queste presenti Lettere varranno nonostante qualsiasi cosa contraria, anche degna di particolare e espressa menzione.

6 Dato a Roma presso S. Pietro, nell'anno del Signore millenovecentodiciotto, il ventiseiesimo giorno del mese di luglio, nel quarto anno del Nostro Pontificato.
