CLXII.
Renewal of the office of summator of apostolic letters, to be conferred soon upon one of the cardinals of the Holy Roman Church, with the grant of indults, favours and jurisdiction over his officials. Pius, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 It is fitting for the Pontiff and the prerogative of the Roman See to increase and enrich its offices, so that their nobility and the splendour of most illustrious men undertaking them may make the dignity of the Roman Church greater.
2 § 1. Considering this in our mind, we have observed one office of great importance, namely the office of summator of apostolic letters, which was made perpetual by our predecessor of happy memory, Pope Alexander VI, and which, by the assumption of our beloved son Peter Donati, cardinal of the title of St. Vitalis in the Holy Roman Church, called Caesius, we have decreed shall soon become vacant, to be governed by the will of one person alone; in directing which, the authority of one outstanding man, supported by the aid of experts, would be greatly expedient. For this reason we have decided to introduce a new form into this same office, one that is more excellent and more useful, and at the same time to promote and enlarge it in such a way that it may justly be equal to the other offices and duties which befit men of the highest rank.
3 § 2. Since therefore in the aforesaid perpetual grant the same Pope Alexander, among other things, established that whoever should hold it should dispose of it in the same manner as the writers of the aforesaid letters dispose of the office of the scriptorium, etc. The same person should also enjoy all the privileges, exemptions, prerogatives, immunities, faculties, favours and indults of the college of the said writers at all times.
4 § 3. To these matters, certain others who afterwards held the said office have been granted, among other things, that they could govern and exercise the office itself, even through another or others, on each day of the apostolic chancery, and whenever it seemed to them expedient to make an extraordinary dispatch of the said letters, and for that reason the bullator should come to the summator daily, who should seal the letters taken by him. Moreover, no other person should be constituted by the Roman Pontiff, directly or indirectly, for the exercise, governance, sub-revision or superintendence of the said office, even for the sake of the public good or any other greater and more considerable cause, nor could anyone interpose themselves in it in any way, nor should any letters whatsoever, however secret, unless first examined by the summator, be dispatched; and no secretary, whether domestic or of the number of those participating or any other person, should register letters sealed with lead unless dispatched in the aforesaid office; otherwise the person so acting would incur the crime of forgery, and would lose the emoluments of his offices, which would pertain to the aforesaid summator. For the rest, for all letters to be dispatched through the said Chamber, the ordinary fee customarily given in the said office of the summator should be paid in full, except only for those letters which concerned the state of the Roman Church or the Catholic faith. From which no secretary of the Pope, even if domestic or a writer or any other person, even of greater condition and relying on any privilege whatsoever, should be considered exempt. Moreover, the summator himself should receive, exact and collect whatever salaries, recognitions and rights customarily paid by any officials of the Roman Curia and their colleges; and he should be able freely and lawfully to compel the officials and colleges to pay these, notwithstanding any reform made and to be made. Finally, the same summator, or one substituted by him in the said office, should have a dwelling or chamber otherwise customary in the Apostolic Palace, as well as food for himself and one servant in the refectory; and moreover for the summator himself bread and small portions, on each day, after the manner of domestic prelates. The office itself and what pertains to it should be exempt for the said summator from every burden, even of papal tithes, even on account of faith and dispatch against infidels, or on account of the laying out and repairing of roads, nor could he be compelled to their contribution, as is more fully contained in various apostolic letters drawn up concerning this matter.
5 § 4. We, wishing to constitute the state of this office more perfect and more distinguished for the ornament of the said See and for the more wholesome dispatch of the aforesaid letters, by our own motion and from certain knowledge and from the fullness of apostolic power, in the same office one president, who shall perform the duties of the summator for the time being existing, to be taken and removed at the nod and discretion of the summator himself.
6 § 5. Likewise, we erect and institute four other perpetual offices of recognitors of the aforesaid letters, to be endowed by the next summator, in perpetuity.
7 § 6. And to the office of summator one position of the Apostolic Secretariat from among the participants, which Marcellus Augustine held, and one office of president of the annona, which Anastasia Pozzuti held, and another similar one, which Jerome Lippomanus held, and two offices of portions of the Ripa, which Marcus Cornelius held while living, through the free resignation of our beloved son Master Antimus Marchesanus, our datary, made voluntarily into our hands and admitted by us, or otherwise in whatever manner and from whatever persons becoming vacant, as well as whatsoever, howsoever many and of whatsoever kind other offices of the said Curia, similar or dissimilar and howsoever qualified, pertaining to the disposition of the Roman Pontiff existing for the time being, customarily granted for a price, which all the aforesaid together make up the value of seventy thousand ducats of gold in gold, to be sought out and acquired by the same next summator, from now, as from then and conversely, we perpetually unite and attach and incorporate. So that each summator, who shall be for the time being, likewise secretary, president, portioner and titulary of all other such future offices, may freely apprehend the corporeal possession of all of them through himself or another or others, by his own authority.
8 In this manner the Pontiff in instituting the inferior stallini of the said office establishes one president, Recognizer four. Certain offices here enumerated, of the value of seventy thousand scudi, are attached to the said office of summator.
9 § 7. Truly to each of the four offices of recognizers of the cogniti, for their dowry, ten or more places or portions of whatsoever mount or mounts constituted in the City or in the temporal dominion of the holy Roman Church, non-vacable, whose fruits are paid here, to be made and exhibited at the expense of the same next summator, we perpetually apply and appropriate. Declaring that, if to the said office of summator so many others as do not ascend to the aforesaid value of seventy thousand scudi, as aforesaid, are not united, or if none other than the aforesaid, which have already become vacant, are united, nevertheless the present [letters] ought to be valid and to obtain full effect.
10 § 8. Moreover, from the aforesaid and others, which pertain to the said office of summator in any manner whatsoever and have been customarily observed in it, nothing whatsoever to be taken away, but all and whatsoever privileges, faculties and authorities, exemptions and indults to the same office and to its persons in whatsoever manner granted, confirmed and extended, which, as if inserted word for word in the present [letters], we hold as expressed, intending [them] to be perpetually stable and inviolate, and all future summators and persons of the said office, both jointly and severally, to enjoy in all of them; and also all and whatsoever rights, salaries, regalia, recognitions and emoluments aforesaid and others customary and accustomed to be rendered by the officials and colleges aforesaid, in the same manner, right and title as the aforesaid Peter Donatus cardinal and whosoever before him summators most amply obtained, to have and to possess; indeed, all and whatsoever rights, jurisdictions, faculties, customs and indults of the said office, and concerning it as well as the expedition of the said letters, usurped by whatsoever others, of whatsoever quality and condition, persons and offices, and for howsoever long a time used, recalling to the right and property of the same, we perpetually establish and ordain that to the said office one of the cardinals of the holy Roman Church be assumed, and the said four offices of recognizers be compatible with whatsoever other offices of the said Curia, and pertain entirely to the free disposition of the summator existing for the time being; who also at this first time and thereafter perpetually those, whether by death or by whatsoever other manner they become vacant, may freely and lawfully grant, sell, transfer, and with whatsoever [persons] concerning them and upon them agree, covenant and decree; just as is customary to be done with other offices of his Curia, for a price they shall be granted; let him admit worthy and skilled men to them, who through their own [efforts], and otherwise according to the quality of matters and the exigency of things, by his or the president's judgment, may apply themselves to the expedition.
11 and for howsoever long a time used, recalling to the right and property of the same, we perpetually establish and ordain that to the said office one of the cardinals of the holy Roman Church be assumed, and the said four offices of recognizers be compatible with whatsoever other offices of the said Curia, and pertain entirely to the free disposition of the summator existing for the time being; who also at this first time and thereafter perpetually those, whether by death or by whatsoever other manner they become vacant, may freely and lawfully grant, sell, transfer, and with whatsoever [persons] concerning them and upon them agree, covenant and decree; just as is customary to be done with other offices of his Curia, for a price they shall be granted; let him admit worthy and skilled men to them, who through their own [efforts], and otherwise according to the quality of matters and the exigency of things, by his or the president's judgment, may apply themselves to the expedition.
12 § 9. All letters, which according to the common form in the said office course have been accustomed to be expedited without difficulty, especially apostolic ones, shall be examined diligently and accurately by their examiner, who shall then hold that office, in the presence of the summator or president, and they shall be reported to him, so that he may then subscribe to them and order them to be expedited in the customary manner. § 10. Moreover, to resolve those doubts which happen to occur in the letters themselves, let the summator establish a certain day in each week on which the examiners or his president shall convene together; and besides, if it shall seem good to the summator himself, let several other distinguished men, having experience in these matters, be employed by the same summator, so that the doubts proposed to all may be decided with mature judgment of them all; nevertheless, for the more serious and difficult doubts, on account of which the Roman Pontiff shall rightly be consulted, 1 and henceforth in perpetuity those, either by resignation or by death (n.t.).
13 our declaration and that of our successors notwithstanding being reserved.
14 § 11. To these things, every summator, whether present in the said Curia or at any time absent from it, shall be able to exercise all the aforesaid offices united, present and future, however many and of whatever kind, and the authority of one and the same colleague, through a substitute or substitutes, entirely; who shall attend all monthly and other congregations, have votes, voice and suffrage both actively and passively. They shall be admitted to the offices of defenders, treasurers and all other duties, functions and business, public and private, even for the individual offices of the same college, even at the same time and as it were principals; they shall subscribe to apostolic letters and other writings and instruments; they shall proceed and sit in the vestments and insignia of officials of any college, in the Apostolic Palace, in processions, ceremonies and all other acts, public and private, and shall take precedence according to seniority, and shall do and execute all things entirely as principals, for the individual offices, even of one and the same college, however many there may be in it, whose plurality and multitude shall make no impediment whatsoever to one another nor any incompatibility; they shall receive all emoluments and salaries of all congregations and duties, ordinary and extraordinary, and otherwise shall do as the summator himself would do and could do, if, possessing the same offices as not united, he were present there. We create and institute these same, for the purpose of all the aforesaid things only, as secretaries, scribes and other officials and titularies of all such colleges.
15 § 12. Moreover, every summator, with no intermission whatsoever of months, days or other space of time, by customs and statutes, even sworn and confirmed, or by privileges and indults of apostolic secretaries and other colleges prescribed, but immediately from the beginning, shall receive entirely the fruits, emoluments, congregations, salaries and all rights of the individual offices of this kind, present and absent.
16 § 13. To all things to be observed in his office, the summator may make whatever rules concerning the prosperous state of the office; having made them, correct and change them, and again issue others and as often as it shall seem good to him.
17 § 14. Prelates and any other officials having jurisdiction in them, persons participating in the said expedition, whoever they may be, insofar as those things declared which concern the expedition itself, he may punish, correct and chastise, and proceed against them civilly and criminally, and freely and lawfully delegate his powers, both in these and in all and singular the aforesaid matters, to another or to others.
18 § 15. Likewise, with all and whatsoever privileges and exemptions, even of the clergy of the Ripa and Ripetta and of the customs of the City, which our camerlengo, the clerks presiding and other camerals have, they shall freely enjoy and possess by the same right.
19 § 16. Moreover, the president and all the examiners aforesaid shall expedite apostolic letters, even of monasteries and cathedral churches, for themselves gratis everywhere, as the writers of apostolic letters expedite them. And for this reason, with all and whatsoever other privileges, faculties, exemptions and indults granted to the same writers and their college, they shall enjoy in the same manner as those, and each one for himself may expedite apostolic letters on these matters, both jointly and severally.
20 § 17. Finally, every summator, whenever it shall seem good to him, may resign the office itself of summator into the hands of the Pontiff for the time being in favor of the holy Roman Church, to a cardinal or to any other person whatsoever to be approved by us, even by agreement for a price, and may otherwise dispose of it freely and lawfully, just as is permitted to each one concerning the other offices of the said Curia received for a price.
21 § 18. Decreeing that all the aforesaid things shall remain firm and inviolate in perpetuity, and shall have the force and validity of a valid and efficacious contract between us and the Apostolic See and Chamber, and all summators hereafter; and that whatever shall be attempted otherwise concerning these things by anyone whomsoever, knowingly or unknowingly, shall be null and void.
22 § 19. We therefore command all the colleges, officials and offices aforesaid, the defenders of offices, the monthly officials, the depositaries, as well as the tax farmers and all others to whom it pertains, that each one for himself, awaiting no other command from us or declaration of our mind, shall receive and admit the aforesaid summator and the one to be substituted by him and those to be substituted, as well as the president and all the auditors, both jointly and severally, for all the aforesaid things, and shall respond to them fully concerning all these things, and shall cause others to respond. Those who act contrary to this, we suspend from the exercise of office for so long, and deprive of the receipt of emoluments, until, satisfaction having been made first, they shall have merited to obtain the benefit of restoration from the Roman Pontiff.
23 § 20. Notwithstanding our right of not derogating acquired right and other apostolic constitutions and ordinances to the contrary; and the statutes, customs, uses and natures of the secretariat, scriptoria, archives and other offices and colleges, as well as the Camera of the City and the aforesaid taxes, confirmed by oath, apostolic confirmation or any other firmness; privileges also, indults and apostolic letters, granted to these and their presidents, ministers and persons by whatever Roman Pontiffs, our predecessors and ourselves and the aforesaid See, even by way of perpetual statute and initiated and stipulated contract, and otherwise, under whatever tenors and forms, and with whatever restorative, preservative, derogatory clauses of derogations and other more efficacious, most efficacious and unusual clauses, as well as irritant and other decrees, and by our motion, knowledge and fullness of power similar, as well as consistorially, and from causes, however burdensome, granted, confirmed, renewed, extended and moderated. All of which, even if, for their sufficient derogation, special, specific, express and individual mention of them and their whole tenors, word for word and not by general clauses importing the same, or any other exquisite form to be observed for this purpose, should be required, these tenors, as if inserted word for word in the present, we hold as expressed, otherwise remaining in their force, on this occasion only, we specially and expressly derogate. And whatever has been indulged to some, commonly or severally, by the aforesaid See, that they cannot be interdicted, suspended or excommunicated by apostolic letters not making full and express mention word for word of this indult, and other things contrary whatsoever.
24 § 21. To no one therefore, etc.

CLXII.
10 § 8. Del resto, dai predetti e da altri, che in qualunque modo pertengono e in esso sono soliti osservarsi al detto ufficio di sommatore, nulla assolutamente detrarre intendendo, bensì tutti e qualunque privilegi, facoltà e autorità, esenzioni e indulti al medesimo ufficio e alle sue persone in qualunque modo concessi, confermati ed estesi, che, come se di verbo a verbo si inserissero nei presenti, abbiamo per espressi, perpetuamente stabili e inviolati essere intendenti, e i futuri tutti sommatori e le persone del detto ufficio, tanto congiuntamente quanto divisamente, in tutti questi potere; e anche tutti e qualunque diritti, salari, regalìe, riconoscimenti ed emolumenti predetti e altri consueti e dai detti ufficiali e collegi prestarsi soliti, come il predetto Pietro Donato cardinale e chiunque prima di lui sommatore ampiamente ottenne, nel medesimo modo, diritto e titolo avere e possedere volendo; anzi, tutti e qualunque diritti, giurisdizioni, facoltà, consuetudini e indulti del detto ufficio, e quello nonché la spedizione delle dette lettere concernenti, da qualunque altri, di qualunque qualità e condizione, persone e uffici usurpati, provati;
24 § 21. A nessuno dunque ecc.
