Bull on the reform of the College of Cardinals

Bull of Pope Sixtus V ·

1 After that true and eternal Pastor and Bishop of souls, Christ the Lord, in order to govern the universal Church, which He acquired by His precious blood, entrusted to the Prince of the Apostles, Blessed Peter, both heavenly and earthly fullness of power, and committed His vicarship on earth to him, just as the Roman Pontiff, successor in the chair of Peter himself and true Vicar of Christ, by divine foreordination holds the pinnacle of that same supreme Apostolic dignity and place on earth, so also the cardinals of the Most Holy Roman Church, representing the persons of the holy Apostles, while they ministered to Christ the Saviour preaching the kingdom of God and working the mystery of human salvation, stand as counsellors and helpers to that same Pontiff in the execution of priestly office and in directing the Catholic Church itself over which he presides, as eyes and ears, and the most noble parts of the sacred head, and principal members constituted by the Holy Spirit, who in this very ecclesiastical hierarchy ordered by divine disposition, in the manner of that heavenly hierarchy to which it corresponds on the other hand, raised to the highest degree together with the Roman Pontiff as common father and shepherd, to whom from all peoples and nations everywhere, in the gravest and most arduous matters, the faithful of all kinds, of all ranks, daily flock, bearing such a weight and burden of peoples, and for the salvation of souls, for the faith, for justice, for unity they watch and labour unceasingly, serving the universal Church around him, devoting themselves to the welfare of individual Churches, by whose counsel that same Pontiff arranges what is to be done, whose work, both necessary and most fruitful to the whole Christian commonwealth, may be an ornament and advantage in prosperous affairs, a protection and aid in doubtful ones. Who finally for the exaltation of the Catholic religion, for the peace and tranquility of the Christian people, for the increase and honour of the holy Apostolic See, shed blood and spirit steadfastly, if the matter so require.

2 § 1. Since therefore they themselves are the true hinges and most brilliant lights of the Church, bases of the temple of God, foundations and pillars of the Christian commonwealth, they ought to abound in singular piety and learning, not common or mediocre, but distinguished and eminent virtue, so that they may be able to sustain worthily and honourably the person which they bear. And just as it is the principal duty of the supreme Roman Pontiff in selecting them to employ careful diligence and accurate foresight to provide that the best and most choice men are assumed, and especially in this to consult the necessity and utility of the whole Church committed to him, so also prelates and other ecclesiastical persons to be promoted to such sublime dignity must shine forth before others by the praise of their past life and by some excellent and proven commendation of their merits, in order that they may be deemed worthy of this most ample honour. For their life and conduct ought to be an example to others, their words and answers are esteemed as oracles, their admonitions and precepts by all Christians as the rule and norm of living rightly and thinking rightly, from them as from the wisest masters the form of ecclesiastical discipline is received, which, spread far and wide, is propagated to compose the conduct and life of all the faithful. They themselves truly are the salt of the earth and lamps set upon a candlestick, so that they may distinguish between blood and blood, cause and cause, leprosy and leprosy, and by the fitness and truth of doctrine confirm the weak, console the broken, convert the depraved, shine upon all who dwell in the house of the Lord, and assisting this first See, while all pastors consult that See in graver matters and implore its aid, cease not to instruct, direct, and teach them by their judgment, counsel, and authority. Moreover, since it belongs not only to them to know many and most weighty matters and causes which are committed to them daily with distinguished faith and prudence, and to perform legations in governing provinces and in graver affairs, often to kings and emperors.

3 § 2. But what is the chief matter and the sum of all, from their body, number, and college, he himself, who is to be set over all pastors and is to have the care of the whole flock of the Lord, the Supreme Pontiff is to be chosen, and these same men are to create him by their votes, who then indeed for the public good of the Christian people will be best without any doubt, if he is chosen from the number and votes of the good, in this sacred election are to be considered true interpreters and intermediaries of the will of God, by whose spirit as the whole body of the Church is sanctified and governed, so most certainly is this whole work of such an election to be accomplished by his breath and instinct, and it is certain and known to all, so that from this very thing it can be perceived how great purity and sincerity is required in them, alien from all affection of the flesh, care for private advantage, and zeal for factions, whose hearts and voices, temples and organs are to be of the Holy Spirit, and from whom as from seeds he is to come forth, into whom the fullness of all apostolic power is to be merited conferred by God's will.

4 § 3. Wherefore, that the amplitude of so great a charge may be honored with that observance and admiration which is fitting among all mortals, and in those upon whom on account of the height of their rank all eyes, all mouths are turned, there may shine forth a brightness and splendor equal to the highest dignity, and in them God may be glorified, the priestly ministry honored, and the souls of the faithful gladdened, certainly those alone seem to be worthy to be adorned with the most ample sacred insignia of this honor, who by eminent learning, innocence, and holiness, and by every kind of virtue have been illuminated by God, the true giver of solid goods, above others. Wherefore we, after it pleased divine goodness to call our weakness to the summit of the highest Apostolate, among the other cares and thoughts which we undertake day and night for the good of the universal Church in these especially turbulent times, have judged this very matter most worthy of our pontifical solicitude, that for the common salvation and advancement of the Christian people entrusted to our care, and for the honor and ornament of the Holy Roman Church itself, concerning the election and assumption of cardinals, we should examine both the sanctions and decrees issued by our predecessors and by us hitherto; in which although many things have been disposed and ordained salutarily and prudently, yet because human affairs easily fall into worse condition unless there be one who continually renews and preserves them, we have deemed it right to promulgate this our constitution, which shall endure perpetually, partly innovating those same sanctions and decrees, partly declaring them, partly supplying and reforming them for the exigency of things and times, having taken mature deliberation upon these matters with our venerable brothers the cardinals of the same Holy Roman Church, by the counsel and unanimous consent of those same brothers, by which we also admonish ourselves in so grave a matter of our charge and impose upon ourselves this law, and we indicate the same to our successors, whom we trust will not be unmindful of their office, and will one day render account of their stewardship in the strict and terrible judgment of God, the Apostle saying: We shall all stand before the tribunal of Christ, and every one of us shall give account of himself to God.

5 § 4. First therefore, since the quality of affairs and the circumstances of the times have required a departure from that ancient custom of admitting very few men into the sacred college, and now in our age more cardinals have been co-opted into the same college than was customary in antiquity, then in order that according to the decree of the general Council of Trent account may be taken of all the nations of Christendom, and because in the same college many, which is the infirmity of the human body, are frequently burdened by old age or diseases, and are not able to sustain so great a burden continuously with ease, it is necessary that fitting moderation be applied in this matter, and certain limits be prescribed, lest we reduce them to that ancient fewness, and again their honor be diminished by excessive and superfluous numbers, which we ourselves sometimes saw and experienced when we were in lesser positions. And wishing to follow the figure of the ancient synagogue corresponding to the truth of the Holy and Apostolic Church, following the command of the Lord made to Moses concerning the gathering together of seventy men from the elders of Israel, whom he knew to be elders of the people and teachers, that they might bear with him the burden of the people, and he himself should not be burdened alone, upon whom when brought to the door of the tabernacle, the Spirit rested as the Lord spoke: by the counsel of the aforesaid brothers of ours, we perpetually establish and ordain that henceforth, counting all cardinals of each order, bishops, priests, and deacons, who now are and who shall be created in the future, all together shall never at any time exceed the number of seventy, and this number shall by no means be increased under any pretext, occasion, or cause, even the most urgent. But if it should happen that one or more are elected by us, or by the Roman Pontiff existing for the time being in the future beyond the said number as cardinal, or created, or pronounced, we decree that such election, creation, and pronouncement shall be null, void, and empty, and shall be deemed so, and no right or title shall be acquired by the one or ones so elected or pronounced, nor can or should any of them be held or reputed as cardinal, nor shall the said election, creation, pronouncement made from the beginning invalid and beyond the number, if afterwards the college itself be reduced to the prescribed number by the death of one or more cardinals, on that account be validated by subsequent fact, but as it was from the beginning so thereafter in perpetuity it shall be of no force or moment.

6 § 5. Since moreover from the most ancient times even of the Apostles the order of deacons is known to have been instituted by great providence for serving and ministering in the Church of God, and according to the variety of times there has been customarily now a greater, now a smaller number, so that sometimes there were seven, sometimes fourteen, and sometimes eighteen deacons, and yet at this time both on account of their small number and on account of the absence of some from the Roman Curia, so few are found that they cannot fulfill their office, indeed more often priest cardinals are forced to assist and minister to the Pontiff in place of deacons, contrary to the institution of the Fathers. For this reason we establish that from the aforesaid number of cardinals, fourteen shall be deacons, all the rest except six bishops shall be priests, and ought to be.

7 § 6. Nor henceforth can anyone be assumed as a deacon cardinal unless he shall have been constituted at least in the twenty-second year of his age, so that he may and ought to be promoted to the sacred order of the diaconate entirely within a year, otherwise if after the year has elapsed he shall not have been promoted to the order of the diaconate itself, by that very fact both in consistorial and all other acts and matters of the cardinalate, and also according to the constitution of Pius, Pope of happy memory, our predecessor, issued on the reform of the conclave, in the election of the Roman Pontiff he shall entirely lack active and passive voice and shall be deprived.

8 § 7. But the number of deacons thus fixed beforehand shall be perpetually retained, and deacons shall always remain in the same order, and if any of them shall have been promoted to the order of the priesthood from fervor of devotion, they shall nevertheless always minister in the same order and office of the diaconate, and shall hold their place among the cardinal deacons, until from the Cardinals to be newly created or elected, other Deacons shall supply the aforesaid number and be substituted and appointed in their place. In which case the more senior deacons promoted to the order of the priesthood may and shall be able to pass over to the cardinal priests, and sit among them, and be numbered.

9 § 8. But in order that We may honor with greater distinctions those deacon cardinals who shall have remained in their vocation and persevered in the ministry of their order, We will that whenever any one of the six cathedral churches over which cardinal bishops preside shall become vacant for the first, second, and third time through death, transfer of the matter, or otherwise as time may require, the senior cardinal priest who is present shall indeed be promoted, saving to each cardinal bishop the right of passing to it, having relinquished the former one which he presided over, as is customary; but when after three vacancies three of these same cardinal priests shall have been appointed bishops, then if a fourth vacancy of any one of these churches shall occur, the senior priest being excluded on that occasion only, the first of the deacon cardinals who shall be present and constituted in lawful age shall be promoted to it; and if he shall be unwilling or unable to be assumed, the next deacon with the same qualifications shall be promoted to it, and thus henceforth in such vacancies of the six aforesaid churches this shall be perpetually observed, so that after three promotions of priests to the said churches, when a fourth vacancy occurs, the first of the deacons, or the next, as aforesaid, shall be appointed bishop.

10 § 9. Among these seventy cardinals, besides distinguished doctors of both laws or of decrees, there shall not be lacking some eminent men who are masters in sacred theology, especially from the regular orders and the Mendicant Orders to be assumed, at least four, but not fewer.

11 § 10. Wishing to follow the ancient custom of Clement, Anacletus, Evaristus, Alexander, and other holy Pontiffs our predecessors, observed in an unbroken series for more than six hundred years, and renewing a decree otherwise issued by Us in Our consistory, We perpetually ordain that the time for creating cardinals, or for making promotion to the honor of the cardinalate, ought to be in the month of December only, in those very times or days of fasting, and at no other time.

12 § 11. But in order that the cardinals themselves may be able to assist Us usefully in the government of the universal Church, and for the Roman Pontiff existing at any time, and that certain knowledge may be had from them promptly and faithfully concerning the customs, affairs, and business of all Christian kingdoms and provinces, for the opportunity of emerging matters, adhering to the decree of the aforesaid Council of Trent, We ordain that suitable men be assumed from all the nations of Christendom, as conveniently as possible.

13 § 12. Furthermore, those who are to be created cardinals shall be born of legitimate and honorable parentage, and shall labor under no stain whatsoever, or suspicion of illegitimate birth in any way, but shall be free from every blemish and impurity; otherwise they shall be entirely unfit and incapable of so eminent a degree of dignity, and shall be so deemed. Wherefore, considering that although the power and efficacy of the Sacrament of Matrimony is so great that, as the Apostle testifies, it is a great mystery in Christ and in the Church, so that those who were previously born of an unmarried man and unmarried woman, between whom a valid marriage could be contracted, after it is contracted are held to be legitimate, yet in certain provinces and dominions they do not enjoy the privileges of nobility, nor are they admitted to secular offices, honors, and dignities, nor to the succession of noble fiefs and estates; and that it would appear much more unseemly and alien from the dignity of the Apostolic See if such illegitimates, legitimated by a subsequent marriage as aforesaid, were to be assumed as cardinals, and the loftiness and splendor of the cardinalate, which is compared to royal dignity, could easily be diminished, defiled, or in some way obscured. Therefore, in order that purer birth may correspond to purer dignity, We decree and declare that all those born illegitimately, whosoever they may be, even the sons of great princes, even those shining with ducal or greater, even royal and imperial authority, endowed with any degree, dignity, and preeminence, even those born of an unmarried man and unmarried woman, between whom a marriage could then be contracted, and afterwards legitimated by a subsequent marriage, even if rightly and solemnly contracted in the face of the Church, or otherwise legitimated and in any way made capable and restored in birth, and made capable of any goods, even if with them, so that they may be able to obtain this very dignity, there shall have been expressly and specifically dispensed in any way by apostolic authority concerning the defect of birth, nevertheless We decree and declare them to be wholly incapable of the aforesaid dignity of the cardinalate, and perpetually unfit to obtain it.

14 § 13. But We further prohibit that those whom, on account of defects, vices, or any impediments whatsoever, it is not lawful to promote to sacred orders according to canonical sanctions, even if dispensation with them shall have been made by the said apostolic authority, nor any who are marked with the note of any crime or infamy, shall ever at any time be assumed as cardinals.

15 § 14. Moreover, in order that the cardinals may be not only in honour, but also in reality the hinges upon which the doors of the universal Church may safely rest, and that they may more usefully execute the divine and human ministries committed to them, we decree that most select and excellent men shall be admitted into this college, and that their proven integrity of life, purity of morals, outstanding learning and erudition, eminent piety, and ardent zeal for the salvation of souls, sincere faith in giving counsel, and integrity, singular prudence in conducting affairs, constancy and authority, and other qualities required by law, shall be known and approved both by the pontiff himself and by the whole college.

16 § 15. And therefore, lest men wholly ignorant and unlearned in sacred matters, and unacquainted with ecclesiastical functions, be forthwith placed in charge of such an office as if they were guests and strangers in the Church of God, according to a decree already sanctioned by us in the aforesaid consistory of ours, which we likewise renew by this present document, we strictly forbid that anyone whatsoever be able to be assumed to the honour of the cardinalate, unless he has previously been marked with the clerical character and constituted in the four minor orders, and has worn the clerical habit and tonsure for at least one year.

17 § 16. Since those who are to be promoted to so sublime an honour ought to excel above all others especially in the praise of all virtues and chastity, yet whoever is known to have begotten sons, even legitimate ones, from his wife, cannot certainly give testimony of his continence, and a father is carried toward his own sons by natural affection with a certain excessive inclination, and it is to be feared lest on this account, distracted by various matters of his own household and the manifold care of children, he may treat the affairs of the Church entrusted to him negligently, or may protect the rights of that same Church less carefully and faithfully than is fitting, we prohibit that anyone who has a son or sons of either sex, even from legitimate matrimony, or a grandson or grandsons from them, be able in any way to be assumed or promoted to cardinal.

18 § 17. Furthermore, in order that we may cut away, as much as we can with the Lord, the kindling of factions and the occasion of quarrels from this sacred assembly, approving and declaring the decree of Julius III of pious memory, our predecessor, formerly issued in the sacred consistory, we likewise perpetually forbid that anyone henceforth be assumed at any time into the cardinalate of the same Holy Roman Church who is the brother, whether from both parents or from one parent, of another living cardinal, so that at the same time two brothers german may in no way be in the same college. Moreover, extending and enlarging the same decree, we also prohibit that when a cardinal cousin, or cousin on the father's side, or cousin german is living, another cousin of his, or cousin on the father's side, or cousin german be able to be promoted to the cardinalate.

19 § 18. But we likewise decree by the same reasoning that when a paternal uncle or maternal uncle cardinal is living, his nephew from a brother or sister, nor again when a nephew from a brother or sister is a cardinal, his paternal uncle or maternal uncle, nor finally anyone else who is connected to a living cardinal by the first or second degree of consanguinity alone, so long as he lives, be able to be assumed into the cardinalate. So that all and each of the aforesaid, both the father having sons or grandsons, and brothers german, cousins, cousins on the father's side, cousins german, paternal uncle, maternal uncle, nephew from a brother or sister, and anyone connected as aforesaid by the first or second degree, one to another while a cardinal is living, shall be unfit for and incapable of the cardinalate, and shall be so considered, and none of them may be created cardinal, nor may dispensation be granted to them against this prohibition from any cause whatsoever, however urgent. And nevertheless the election, creation, and pronouncement of cardinals made and attempted against the present prohibition or interdict shall be null, void, and of no effect in itself, and together with all that follows from it shall have no force or weight.

20 § 19. Finally, considering that it is the proper duty of these same cardinals to assist, as aforesaid, the Vicar of Christ on earth, and to provide him with counsel and labor constantly in governing the Catholic Church, and to provide for the needs of the Church with him, and that they are bound to this both by the obligation of their office itself and by the decrees of the holy Fathers, and therefore it is absurd that cardinals should live far from the Pontiff himself, and should neglect and abandon their place and dwelling in the Church of God, so exalted, contrary to the obligation of such office and to the ruin of their own souls, adhering likewise to a decree similarly promulgated by us in our consistory some time ago on this matter, by the counsel of these same brothers we have decreed and ordained that henceforth no cardinal shall be created or proclaimed absent from the Roman Curia unless this condition be added, that he shall be bound to come to the Roman Curia within a year and to visit the threshold of the Apostles, and moreover, before the red biretta, which is customarily blessed by the Roman Pontiff and sent by a certain nuncio, shall be delivered to him or placed upon his head, he shall swear in the hands of some person constituted in ecclesiastical dignity, to whom this matter shall have been entrusted, that within a year from the day of the oath taken, all delay set aside and impediment removed, he will personally come to the City, or elsewhere where the Roman Curia shall be at that time, so that he may present himself to us, or to the Roman Pontiff existing at that time, and to the Holy Apostolic See to whose service he shall be enrolled, and for so long as it shall seem good to that Pontiff, he shall apply himself to his office: and thus he shall be fully instructed in the laws, customs, practices, and the whole state of that See, and shall receive from the paternal charity, wisdom, and vigilance of that Pontiff fitting and salutary counsels for relieving the needs of the church or province which he shall perhaps govern, for removing abuses, for reforming morals, for restoring ecclesiastical discipline, if it shall have been weakened in any respect, and shall carry them out to the best of his ability.

21 After this oath shall have been taken by him, a public instrument thereof shall be drawn up, and in authentic form shall be transmitted to us, or to our successor at that time, without any delay interposed. But if perchance he shall refuse to swear this oath, we will that the red biretta be altogether denied to him and in no wise delivered, but by that very fact, without any other declaration or decree, he shall be deprived of the honor of the cardinalate and shall be held as such in all respects and entirely, just as if he had never been assumed or promoted to the cardinalate. He shall also be rendered incapable of obtaining that dignity thereafter, and shall be made incapable of it. But if he shall swear and receive the red biretta, yet afterwards shall not appear at the City and Roman Curia, as aforesaid, within a year from the day of the oath taken, then likewise without any other declaration he shall lack the dignity, office, title, designation, and all and every insignia, faculties, privileges, or authorities of the cardinalate by that very fact, and shall be perpetually deprived and shall be held as deprived, just as if he had never been co-opted among the cardinals, nor had received the red biretta.

22 Which red biretta after that time he shall be altogether bound to lay down.

23 § 20. Decreeing thus in all and each of the foregoing matters by whatsoever judges and commissioners, even auditors of causes of the Apostolic Palace, and the cardinals of the Holy Roman Church themselves, in any cause and instance, having taken away from them and from each of them any other faculty and authority of judging and interpreting, that judgment and definition ought to be made; and moreover that whatever shall be attempted otherwise concerning these matters by anyone whatsoever with any authority, knowingly or unknowingly, shall be null and void.

24 § 21. Notwithstanding apostolic constitutions and ordinances issued in general councils, even those prescribing a certain other number of these same cardinals, or otherwise disposing concerning the foregoing matters, all of which, insofar as they are contrary in any way to the present constitution, we having their tenor as fully and sufficiently expressed, even if special, specific, express and individual mention word for word, and not through general clauses importing the same, ought to have been made thereof, we do altogether abrogate, abolish and annul, and all other things contrary whatsoever.

25 § 22. Moreover, so that these present letters may become known to all, we command that they be published and affixed in the customary manner at the doors of the Lateran and of the Prince of the Apostles basilicas of the City, and at the Apostolic Chancery and in the open space of the Campus Florae, and for some space of time be kept there; and after their removal, copies of them be left in that place. And we will that transcripts thereof, subscribed by the hand of some public notary and furnished with the seal of a prelate or person constituted in ecclesiastical dignity, shall receive in court and outside it, wherever it shall be necessary, the same faith entirely as would be given to the originals themselves, if they were exhibited or shown.

26 § 23. Let it be lawful for no man whatsoever to alter this page, etc. But if anyone shall presume to attempt this, let him incur the indignation of Almighty God and of the blessed, etc. Given at Rome at St. Peter's, in the year of Our Lord's Incarnation one thousand five hundred and eighty-six, on the third day before the Kalends of December, in the second year of Our pontificate.

16 § 15. Ac proinde ne homines sacrarum rerum plane imperiti, et rudes atque ecclesiasticarum functionum ignari, quasi in Ecclesia Dei hospites, et peregrini statim huiusmodi muneri praeficiantur, iuxta decretum iam pridem a nobis in praedicto consistorio nostro sancitum, quod pariter harum serie innovamus, districte interdicimus, ne quis ullatenus ad cardinalatus honorem assumi queat, nisi qui antea clericali charactere insignitus, et in quatuor minoribus ordinibus constitutus, per annum saltem habitum, et tonsuram gestaverit clericalem.
