Bull erecting new archbishoprics and bishoprics in the Low Countries

Bull of Pope Paul IV ·

1 of Jectina and Medilina in archiepiscopates and metropolitanates, as well as other churches in Belgium in cathedrals and bishoprics subject to the aforesaid. Paul, bishop, servant of the servants of God, for perpetual remembrance of the matter.

2 Over all the churches of the world, with Him disposing who rules all things and to whom all things obey, we, constituted without merits of our own, lift the eyes of our mind in the circuit of the Lord's field, after the manner of a vigilant shepherd, to inspect what is fitting for the state and dignity of provinces and places of any kind, and what is conducive to the salvation of the souls of their inhabitants, and especially at this time, when the enemy of mankind applies all his effort to the destruction of those very souls and the overthrow of the Catholic faith, it should be disposed; and fortified by divine protection, we judge it worthy, or rather due, to plant new archiepiscopal and episcopal sees and churches in the fertile field of the militant Church, so that through such new plantations popular devotion may be increased, divine worship may flourish, and the salvation of those very souls may follow, and places of note, especially those whose inhabitants, with the Lord blessing, are known to multiply, may be illustrated with more worthy titles and fitting favors, so that, by the propagation of new sees and the assistance of venerable prelates, supported by their governance and teaching, with the amplification of apostolic authority and the increase of orthodox faith, those peoples may always make progress in the Lord, and what they have obtained in temporal matters may not lack increase in spiritual matters, especially since the devotion of Catholic kings and princes demands it.

3 IV pp. 559 An. C. 1559

4 § 1. When therefore we had turned the gaze of our mind to that part of the lower regions of which our most beloved son in Christ Philip, the Catholic King of Spain, holds dominion by hereditary right, knowing that indeed the harvest there is great, but the laborers are few; for which reason, since that region was at the time of the erection of its cathedral churches inhabited sparsely and very infrequently; it is now inhabited by so many and such great peoples and nations that, in proportion to the frequency of the most celebrated cities with which it is indeed filled, and the multitude of castles and villages, there are very few cathedral churches there, with the result that so few bishops cannot govern so great a multitude of souls with the diligence that would be necessary: which is also more difficult for some of them because their diocesans differ in language and customs, and some of them have such privileges that it is not permitted to summon them to the episcopal see: so that they can neither be conveniently instructed in the doctrine of faith and the precepts of pious living, nor, if they should offend in anything, be easily corrected by their bishops.

5 § 2. As for visiting those bishops themselves and also admonishing them and keeping them in their office, there is indeed one metropolitan church in all that so celebrated and so widely extended region: but those to which they are subject are outside the boundaries of King Philip's realm, and their archbishops, on account of many and various impediments, have been of no use to any of their suffragans for a long time.

6 § 3. To which so many inconveniences this also is added, that, since that region is on almost every side surrounded and besieged by heretical and schismatic peoples, on account of the constant snares of heretics, their deceits and pernicious frauds and doctrines, the Catholic faith and the salvation of souls there are in the greatest danger and peril.

7 § 3. To which so many disadvantages, when this also is added to them, that, since that region is surrounded and besieged on almost every side by heretical and schismatical peoples, on account of the constant snares of heretics, their deceits and frauds and pestilential doctrines, the Catholic faith and the salvation of souls there are in the greatest peril and danger.

8 An. C. 1559 560 BULLARIUM

9 § 4. Moved by these causes and others which have impelled our mind, being willing to accede to the prayers and requests and also the earnest entreaties of that most pious King Philip, who, for his piety and zeal for the Catholic faith, has dealt with us on this matter very diligently and often by letters and nuncios, having held, as the magnitude of the matter demanded, mature deliberation with our venerable brothers the cardinals of the Holy Roman Church, we have judged it to be the most fitting remedy for the orthodox faith so gravely endangered in those parts and for the salvation of souls, if we should divide the ancient dioceses of the churches situated in that region for the sake of more convenient governance, and should place over the newly erected cathedral churches bishops of such a kind that both by example and by word they may feed the sheep committed to them, and furnished with an abundance of good and learned men, aided by the work of suitable ministers, they may defend and guard them against the rage of the wolves lying in wait; and that several metropolitan churches should be erected in suitable places of that region, to which access may be conveniently had; to which those who are to preside may keep their suffragans in their office.

10 § 4. Moved by these causes and others which have impelled our mind, willing to accede also to his prayers and the intercessions of those approaching us, and thus to satisfy the pious desire of King Philip himself, who, out of his piety and zeal for the Catholic faith, has dealt with us most diligently and repeatedly on this matter both by letters and by nuncios, having held, as the magnitude of the matter demanded, mature deliberation with our venerable brothers the cardinals of the Holy Roman Church, we have judged it to be a remedy most apt for the orthodox faith, which was in such grave peril in those parts, and for the salvation of souls, if we should divide the ancient dioceses of the churches situated in that region for the sake of more convenient governance, and should place over such newly erected cathedral churches bishops who by both example and word may feed the sheep committed to them, and, furnished with an abundance of good and learned men and aided by the work of suitable ministers, may defend and guard them against the rage of wolves lying in wait; and that certain metropolitan churches should be erected in suitable places of that region, to which access may be conveniently had; and that those who are to preside over them may keep their suffragans in their duty.

11 § 5. From certain knowledge of our own, therefore, and by the counsel of our aforesaid brethren, and from the fullness of apostolic power, for the honour of Almighty God and the utility of the holy Church itself, we separate the Camera, the Tournai, Utrecht, Arras and Cambrai dioceses and cities from the Reims and Cologne provinces, to which they are subject by metropolitan right.

12 § 6. And Mechlin, Antwerp, Haarlem, Daventer, Leeuwarden, Groningen, Middelburg, Roermond, Xanten, Saint-Omer, Ypres, Ghent and Bruges, the most celebrated dioceses of Cambrai, Utrecht, Liège, Therouanne and Tournai, respectively, from their own dioceses and provinces.

13 Roman, in the year 1589, dioceses, towns, each from its own diocese and province.

14 § 7. Furthermore, from the church of Cambrai, we have recently separated and freed from all power and jurisdiction of the Archbishop of Reims, whose suffragans they were, that part of the diocese of Cambrai itself which exists in the duchy of Brabant and the county of Flanders; likewise from the church and diocese of Liège that part of the diocese of Liège itself which is in the counties of Namur and Horne and the duchies of Brabant and Gelderland under the dominion of King Philip himself; likewise from the church and diocese of Tournai that part of the diocese of Tournai itself which extends from the village of Roesbeke and the town of Oudenarde to the ocean, with that village and town included; likewise from the church and diocese of Utrecht that part of the diocese of Utrecht itself which exists in the county of Flanders, and the islands of Zeeland and all of aquatic Holland and that part of Holland which is called firmer, up to the towns of Leiden exclusive and Amsterdam inclusive, and the islands of Urk and Texel and Wieringen, and the entire region beyond the Ijssel and Groningen and Frisia, with a great part of the duchy of Gelderland which is called lower, up to the towns of Harderwijk and Schermberg inclusive and up to the towns of Arnhem and Wageningen, those towns themselves however excluded, as well as the parts which it has beyond the Valk river, pertaining to the duchy of Gelderland itself, and the great water of Tournai towards Brabant; from our beloved 1 sons the chapter of the church of Utrecht itself or its capitular table all jurisdiction and all episcopal rights of that chapter, which it has in the region called Westphalia; from the churches and dioceses of Osnabrück and Münster and Cologne and Paderborn, and from the province of Cologne those parts of the dioceses of Osnabrück and Münster and Cologne and Paderborn which exist within the boundaries of King Philip, with all and singular their boundaries and territories, and clergy, peoples and persons, monasteries, churches and pious places and ecclesiastical benefices, with cure and without cure, secular and of whatever Orders regular; from the church of Moreuil itself, through the pious memory of Francis of Créquy, formerly bishop of Moreuil, deceased now about seven years ago, deprived of pastoral solace, that part of the diocese of Moreuil itself which exists in the counties of Artois and Flanders under the dominion of King Philip himself, with its boundaries, territory, castles, villages and places, clergy, people and persons, monasteries, churches and pious places and ecclesiastical benefices, with cure and without cure, secular or of whatever Orders regular; and the fruits, revenues, proceeds, tithes, rights and emoluments which the bishop of Moreuil, and also the rights which the Archbishop of Reims, in the part of the diocese of Moreuil and in the boundaries, territory, castles, villages and places aforesaid, either by reason of visitation or by any other right and cause, were accustomed to receive, from the archiepiscopal table of Reims and the episcopal table of Moreuil, by apostolic authority, by the tenor of these presents, we perpetually exempt, segregate, divide and separate, and from all jurisdiction, power and subjection of the Archbishops of Reims and Cologne, and the Bishops of Cambrai, Utrecht, Liège, Moreuil, Tournai, Osnabrück, Münster 2 and Paderborn for the time being existing, and of our beloved sons the chapters of the churches of Reims, Cologne, Cambrai, Utrecht, Liège, Moreuil, Tournai, Osnabrück, Münster and Paderborn, and from the payment of tithes and of whatever other rights owed to those same Archbishops, Bishops and chapters and clergy and others aforesaid, by reason of jurisdiction, subjection and diocesan and metropolitan law, so that henceforth the bishop of Moreuil shall have no jurisdiction whatsoever in the part separated from the diocese, and its territory, castles, villages and places and clergy, people and persons and monasteries, churches and pious places and benefices, and shall exercise no authority, and benefices comprehended under this separation and division, whatever, however many and of whatever kind they may be, which formerly pertained to his collation, he shall confer, or fruits, revenues, proceeds, rights, perquisites and emoluments from him in the part separated from the diocese in the boundaries, territory, castles, villages and places aforesaid, accustomed to be received for the purpose of support or for any other reason whatsoever, and the bishop of Moreuil and the Archbishop of Reims aforesaid in the part of his diocese taken away, and in the boundaries, territories, castles, villages and places aforesaid concerning those things which pertained to them by reason of the visitation of bishops and diocesan and metropolitan law, shall in no way be able to intermeddle, we exempt and entirely free.

15 § 8. We have moreover elevated the churches of Cambrai and the collegiate church of St. Rumold of the town of Mechlin and the church of Utrecht to metropolitan churches, making the sees of Cambrai and Utrecht metropolitan sees.

16 episcopal, into archiepiscopal, and that same church of St. Rumold as the seats of metropolitans and capitals of provinces, with similar knowledge, counsel and fullness of power, authority and 1 Ray., et. 2 Ed. Lux., Traiectensem ad Mosam. 3Ead. Ed., Traiectensem ad Wienum (r. t.).

17 In the year 1559, by the tenor of the foregoing, we also establish and institute. § 9. From which archbishops to be assigned to each, the Archbishop of Cambrai indeed for his diocese shall have twenty-eight towns, with castles, villages and monasteries interspersed within a space of seventy-two thousand Italian paces in length, sixty in width, to be bounded by our nuncio, to be sent by us shortly. The Archbishop of Utrecht moreover for his diocese shall obtain the territory of Utrecht and the greater part of Holland, and a great part of Gelderland, with the domains of Buren, of Culemburg, of Vianen, Emond, Isselstein, thirty towns, besides villages, in length ninety, in width forty thousand paces of similar measure to be bounded, as has been said.

18 § 10. To these same two, and to a third to be named Archbishop of Mechlin, we grant the right and power of bearing the pallium and cross, as is the custom, and of using all other insignia, honors, ornaments, privileges and prerogatives of metropolitan churches and sees.

19 § 11. The cities of Mechlin, Antwerp, Haarlem, Daventer, Leeuwarden, Cologne, 's-Hertogenbosch, Roermond, Namur, Saint-Omer, Ypres, Ghent, Middelburg and Bruges we erect into cities, and in those thus erected we establish as collegiate churches St. Alban of Namur, St. Omer of the same city, St. Omer, the Blessed Virgin Mary of Antwerp, St. John of Ghent, St. Donatian of Bruges, St. Lebuin of Daventer, St. John the Evangelist of 's-Hertogenbosch and the Holy Spirit of Roermond, and as parish churches St. Bavo of Haarlem, St. Vitus of Leeuwarden and St. Martin of Groningen, as well as the Blessed Mary of Prémontré, Middelburg, 1 Ray., seventy. 2 Ed. 20 ROME, In the year 1559 monastery of St. Martin, St. Augustine of Canons Regular of the Order, Ypres, under the same invocations, with knowledge, counsel, power and authority and by the tenor of the foregoing, we erect into cathedrals for the creation of bishops of each of those cities, who shall each preside over their own and increase their buildings and reduce them to the form of cathedral churches, and exercise episcopal jurisdiction and all other things singular which pertain to order and jurisdiction and the episcopal office, in the cities, towns, boundaries, territories, islands, borders and parts of the dioceses to be divided, after they shall have been bounded, respectively, and in the same metropolitan archiepiscopal, but in the cathedral churches thus erected episcopal dignities, with archiepiscopal and episcopal seats and tables, and other insignia of metropolitan and cathedral churches, tables, chests, seals and other capitular insignia, honors and privileges, which other metropolitan and cathedral churches use or may use by right or custom, we similarly erect and establish. § 12. To the churches aforementioned, thus erected into cathedrals, and to the same cities we concede and assign in perpetuity for their dioceses: to Namur the county of Namur and part of French Brabant, in length forty, in width thirty thousand Italian paces; to Saint-Omer the district containing ten towns, in length forty-two, in width twenty-nine thousand paces of similar measure; to Mechlin the district of seventeen towns, with villages interspersed, in length sixty-nine, in width thirty thousand paces of similar measure; to Antwerp the territory of seven towns, with villages interspersed, in length fifty-six, in width thirty thousand paces 1 Ed. 21 In the year one thousand five hundred and twenty, the territory of Ghent with four cities and the intervening villages, of a length of forty-six and a width of twenty-four miles of similar paces; the territory of Bruges with nine cities and intervening villages, of a length of fifty-four, of a width of twenty-five miles of similar paces; the territory of Ypres with ten cities and intervening villages, of a length of forty-two, of a width of thirty miles of similar paces; the territory of Bois-le-Duc with ten cities and intervening villages, of a length of sixty, of a width of thirty miles of similar paces; the territory of Roermond with ten cities and intervening villages, of a length of fifty, of a width of thirty miles of similar paces, with the county of Horn included in them; the territory of Harlem with twelve cities, besides intervening villages, of a length of ninety, of a width of thirty miles of similar paces; the territory of Deventer with twenty-five cities, besides intervening villages, of a length of sixty-four, of a width of forty-six miles of similar paces; the territory of Leeuwarden with ten cities, besides intervening villages, of a length of sixty-two, of a width of forty miles of similar paces; the territory of Groningen of the Province of Groningen and Drenthe, and of the islands of Rottum and Borkum; the territory of Middelburg with ten cities, besides adjacent villages, of a length of fifty-six, of a width of thirty miles of similar paces, to be assigned to each of their bishops for his diocese, as has been said; and the ecclesiastical persons for the clergy, and the lay people dwelling in them for the peoples of the same.

22 § 13. Furthermore to the Church of Cambrai the Archbishopric, the Church of Tournai, the Church of Saint-Omer and the Church of Namur; and to the Church of Mechlin the Church of Antwerp,

23 the Church of Ghent, the Church of Bruges, the Church of Ypres, the Church of Bois-le-Duc and the Church of Roermond; and to the Church of Utrecht the aforesaid cities and dioceses of Harlem, Deventer, Leeuwarden, Groningen and Middelburg, with the same knowledge, counsel and fullness of power, and by apostolic authority, by the tenor of these presents, we have assigned, and we have decreed to be the metropolitan provinces of each of them; and these cathedral churches thus erected, and those who shall be for the time being their bishops, as suffragans of those who shall be for the time being the Archbishops of Cambrai, Mechlin and Utrecht, so that, as members to the head, they shall be subject to the same archbishops by metropolitan right; and the clergy and peoples of the provinces of Cambrai, Mechlin and Utrecht, for the provincial churches of each of them, whose individual cases shall be referred to the archbishop of each of them, according to the sacred canons, we likewise grant and assign in perpetuity. And as regards the rights that pertain to archiepiscopal, metropolitan and provincial authority, we subject the aforesaid cities, dioceses, clergy and peoples to the same prelates who shall be for the time being, just as we decree that the same cities, dioceses, clergy and peoples, as regards ordinary episcopal jurisdiction and power, shall be subject to their own bishops who shall be for the time being.

24 § 14. To the Archbishopric of Mechlin five thousand, and to each of the episcopal sees of this kind three thousand ducats of the Camera annually to be assigned from certain tithes and goods and fruits, revenues and ecclesiastical proceeds, to be specified and distributed by the said nuncio, from now, as from then and conversely, after they shall have been specified and distributed; and in the meantime until such specification and

25 distribution shall have been made and shall have taken effect, and not beyond, to Mechlin three thousand, and to each of the aforesaid episcopal sees fifteen hundred ducats of similar kind in annual revenues, to be assigned by King Philip himself from the revenues and proceeds which he receives from that region, and to be paid in full and proportionately to the Archbishop of Mechlin and to each of the aforesaid bishops existing for the time being, each year, so long as the aforesaid specification and distribution, and only for that part which shall not have achieved its full effect, and not beyond, we also apply and appropriate in perpetuity by equal counsel and the same authority for their endowment.

26 § 15. To the same King Philip and his successors, who shall hold the rule of that kingdom in temporal matters, We grant the right of nominating suitable persons, promoted in theology as masters, or in decretals as doctors or licentiates, after diligent examination according to the custom of noble universities, to the aforesaid churches of Mechlin, Antwerp, Utrecht, Arras, Tournai, Haarlem, Deventer, Leeuwarden, Groningen, Middelburg, 's-Hertogenbosch, Roermond, Namur, Saint-Omer, Ypres, Ghent and Bruges, both at this first time and whenever it shall happen that they fall vacant in the future, which right We and the Roman Pontiff, who shall be at that time, through Us and the same Pontiff, do reserve and grant in perpetuity for the institution of archbishops and bishops of the same by such nomination, with the same Council, knowledge and authority aforesaid.

27 § 16. And We decree that if anything contrary to these matters shall be attempted by anyone whatsoever, of whatever authority, knowingly or unknowingly, it shall be null and void.

28 An. C. 1559

29 knowingly or unknowingly, it shall be attempted, We decree it to be null and void.

30 § 17. Notwithstanding the constitutions and apostolic ordinances and decrees of the aforesaid and any other churches whatsoever, as well as of monasteries and Orders of this kind, even those strengthened by oath, apostolic confirmation or any other firmness, statutes and customs, privileges also, indults and apostolic letters, granted to churches, monasteries, Orders, archbishops, bishops, chapters and others aforesaid and to any others whatsoever, under whatsoever tenors and forms and with whatsoever, even derogatory clauses of derogations, and other more efficacious, most efficacious and unusual clauses, irritant and other decrees, even by Our own motion and from certain knowledge and consistorially granted, and also confirmed and renewed repeatedly. All of which, even if, for their sufficient derogation, special, specific and express mention of them and of their whole tenors should be made, or some other exquisite form should be observed for this purpose, We, having these tenors as if they were inserted word for word, do hold them as sufficiently expressed and inserted in the present document, and while they would otherwise remain in their force, at this time only, by this series We specially and expressly derogate from them, and We decree that they can and ought in no way avail against the aforesaid, and against all other things contrary whatsoever.

31 § 18. Let no one whatsoever be permitted to infringe this page of Our exemption, segregation, division, separation, liberation, erections, institutions, concessions, assignments, attribution, statute, subjection, decrees, application, appropriation, reservation and derogation, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
