Ut animarum pastores

Bull erecting the Diocese of Trapani

Bull of Pope Gregory XVI ·

GREGORY BISHOP
servant of the servants of God
for perpetual memory of the matter.

1 In order that the pastors of the Lord's flock, entrusted with the care of their faith, may be able to guard it with the vigilance that is fitting, and to lead the sheep to the pastures of eternal salvation, it must be guarded against above all that the number of the entrusted sheep should exceed the care and strength of any diligent pastor. When our predecessor of happy memory Pius VII perceived that dioceses in the Sicilian island beyond the Pharos were subject to this inconvenience, he determined that they should be redrawn and new episcopal churches established there in the convention which he entered into and confirmed in the year one thousand eight hundred and eighteen with Ferdinand I of blessed memory, King of the Sicilies. Since therefore we have learned that the opportune time has arrived for bringing such a most salutary plan to completion, and with the wishes and petitions of our most beloved son in Christ Ferdinand II, the illustrious King of both Sicilies, concurring, by similar apostolic letters given on the fifteenth of May, the thirteenth day before the Kalends of June, and the eighth day before the Kalends of June of the current year, we have redrawn the aforesaid dioceses and elevated the church of Syracuse to the rank of an archbishopric, and by apostolic authority have erected and established the episcopal churches of Noto and Calatanissetta. Nevertheless, to settle completely a matter of such importance, the same most serene king earnestly requested of us that from the very large diocese of Mazara we should not only separate those nine towns which we attributed to the church of the archbishopric of Monreale by the apostolic letters mentioned above, but that we should also adjudicate to the new bishopric, to be erected as below, six other towns or parishes separated from the same church of Mazara itself, indeed for the spiritual benefit of those faithful. For such is the extent of the diocese of Mazara, and the abundance of the flock spread throughout its vast territory, and some of those towns are at such a long and often inconvenient distance from the episcopal seat, that the faithful dwelling there can neither easily approach their pastor, nor within the time prescribed by the sacred canons be refreshed by his presence and admonitions, and therefore some of them lack the sacrament of Confirmation for a long time. Wherefore, in order that we may remedy these inconveniences, we have determined that a new bishopric should be erected and its seat established at Drepana. For Drepana, which is said to have been held in former times by the Phoenicians, Teucrians, Greeks and Carthaginians, situated in the extreme part of Trinacria on the shore of the Mediterranean, excels the other towns of the Drepanese province. It indeed contains many and elegant buildings and public institutions both for the cultivation of letters and learning, and for receiving and caring for the poor and infirm. Moreover, it is fortified by the garrison of many soldiers and surrounded by walls, and has courts both for settling civil disputes and for judging crimes. Besides this, it enjoys very fertile soil, and enriched by a port, it flourishes especially in commerce and comprises nearly twenty-three thousand people, of whom most are commended by nobility of birth, the glory of their ancestors, and the cultivation of their talents. There are also several monasteries and many sacred buildings; among which stands out the parochial and collegiate church dedicated to God in honor of St. Lawrence, which appears to us illustrious in size and elegance, enriched with a college of canons and celebrated with the relics of many martyrs, and is altogether worthy to be elevated to the dignity of a cathedral church. Now indeed, since it is necessary for endowing this new episcopal seat that necessary income be derived from stable goods, therefore, having taken counsel with the most serene king, we have determined that the abbey or priory called the Most Holy Trinity of Delia should be suppressed, in which the same most serene king enjoys the right of patronage either from foundation, or from endowment, or from apostolic privilege, which has not hitherto been revoked, whose revenues, with burdens deducted, amount yearly to one thousand five hundred ounces, or to three thousand seven hundred and forty-four Roman scudi, which sum of money appears to be sufficient for endowing the aforesaid church with the necessary income. Moved by these and other most weighty considerations of affairs, and most willingly complying with the pious petitions and wishes of our most illustrious son in Christ Ferdinand II, King of both Sicilies, notwithstanding anything to the contrary, although not unworthy of special mention, and supplying, insofar as it is necessary, the consent of all who have any interest whatsoever, by Motu-Proprio, with certain knowledge and the fullness of apostolic power, besides those nine towns which we have separated from the diocese of Mazara and adjudicated to the archbishopric of Monreale, we further separate and completely sever from the same diocese of Mazara six other of those towns which remain and which are said to contain approximately one hundred and eighty thousand inhabitants, namely these which are commonly called: Trapani, Monte S. Giuliano, Paceco, Città Favignana, Isola, Pantelleria Isola: and their territories together and all the churches which exist there, whether parochial, subsidiary, or simple, monasteries, convents, and all ecclesiastical institutions as well as secular ones, and benefices of whatever orders regular which are found in the aforesaid towns or parishes and territories, as well as individual persons of both sexes, inhabitants and sojourners, both lay and clerical, priests, beneficiaries, religious of whatever degree, order and condition, we exempt in perpetuity from the ordinary jurisdiction, power and superiority of the bishop of the church of Mazara and withdraw them completely. Now indeed, since it has been ascertained that besides the tithes which are said to be distributed by the bishop of Mazara to increase the adequate stipend of some parish priests, other tithes are found in the aforesaid town, commonly called Monte S. Giuliano, as is aforesaid, in the dismembering and adjudicating to the diocese of the new bishopric below, instituted of old for the adequate endowment of five canonries of the cathedral of Mazara, therefore in order that those who enjoy such tithes may suffer no detriment in the future, we will and decree that those same tithes destined for the aforesaid use may be exacted and received in perpetuity by each one to whom the title belongs, with the same right indeed as before, the royal power also protecting and caring for it, as has been promised.

2 Then, since from the causes set forth above it is altogether preferable to raise the aforesaid church of St. Lawrence to the honor of a cathedral, and since for this it is necessary that the collegiate title be first suppressed, for this reason we remove from the same temple of St. Lawrence as well as from its chapter the collegiate title, and we abolish it in perpetuity with all indeed the favors, graces, prerogatives and privileges whatsoever hitherto obtained or legitimately acquired and employed. We leave, however, and we preserve to it, as before, the parochial status with the same ancient rights and privileges and burdens.

3 Moreover, since the town of Drepana is worthy beyond others of its province to be decorated with a more splendid title, we erect and constitute the same into an episcopal city to enjoy all and singular the honors, rights, privileges and prerogatives with which other cities in the kingdom of Sicily beyond the Strait decorated with episcopal title, and their citizens use and enjoy.

4 Forthwith indeed the temple itself, retaining its former title of St. Lawrence, and the care of souls being preserved to it, we erect and perpetually constitute into a new cathedral church of Drepana to be named henceforth, and there we will that a seat or episcopal chair be erected, for one bishop henceforth, to be named similarly of Drepana, who shall preside over the same church, city and diocese of Drepana, to be assigned below, convoke the diocesan synod, and likewise possess and exercise all and singular the rights, offices and duties of a bishop, with the cathedral chapter to be constituted hereafter, and likewise with the treasury, seal, episcopal table and court, and other cathedral and pontifical insignia, rights and jurisdictions, preeminences, prerogatives, privileges and real, personal and mixed indults, with which other cathedral churches existing in the aforesaid kingdom of both Sicilies beyond the Strait and their prelates enjoy, provided they have not been attributed to them by special privilege. Wherefore we command that the same sacred church be also furnished with sacred furnishings for the exercise of pontifical functions, as has been promised from the piety and care of the most serene King of the Sicilies.

5 But in order that the church of Drepana, elevated to a cathedral, may have its own diocese, the aforesaid city of Drepana and all other places, towns or parishes individually enumerated above, and exempted and severed from the bishopric of Mazara and its ordinary jurisdiction, and likewise the benefices respectively existing and subsisting therein, churches, monasteries, pious institutions, and persons of either sex, not however exempted, both clerics and presbyters and any beneficiaries whatsoever, dwelling there, we perpetually assign to the new aforesaid episcopal church of Drepana and to its future prelate for his city, diocese, clergy and people, and we subject and adjudge to its ordinary jurisdiction, power and superiority. Henceforth, in order that in the aforesaid church of St. Lawrence, increased with the distinguished honor of a cathedral, divine worship be exercised with that celebration and splendor which is fitting, we will and command that therein a cathedral chapter be erected with all the rights, honors and burdens of this kind granted and attributed to such cathedral chapters and persons by the sacred canons; and we command that it consist meanwhile of the same dignities and canonical prebends which it enjoyed before in the state of collegiality. We command therefore that not only those canonical prebends which were provided for the precentor or Cantor and for the dean, but also the other eighteen prebends which are found to have been founded for as many canons, be forthwith granted with the more distinguished title of cathedral canonicates. We declare indeed and decree that the prebend which was assigned for the precentor or Cantor shall carry the first dignity after the pontifical, and the other which was assigned for the dean the second dignity and preeminence of its chapter with it in perpetuity, so that the care of souls which formerly inhered to the same prebend in the state of collegiality shall likewise in the future inhere to it with the same rights and burdens as before, to be sustained and exercised by its rector for the time being. Moreover we grant and indulge that the same twenty canonical prebends without the expedition of bulls for this occasion only be retained and possessed by their respective present rectors with the same burdens entirely annexed before.

6 We will also and command that as soon as possible to one of the aforesaid canonicates, those however excepted which may be subject to private right of patronage, the office and obligations of a canon theologian be imposed, and to another the office and obligations of a canon penitentiary in perpetuity, and that henceforth, according to the prescription of the sacred canons, they be conferred only after previous competition.

7 Since, however, from the revenues of the aforesaid abbey of royal patronage, as commemorated above, a certain sum of money, to be designated below, shall accrue to supplement the canonical prebends of the cathedral church of Noto, we therefore declare and ordain that, with the collation of the first dignity reserved to this Apostolic See by way of rule, and likewise with the free collations remaining, as is right, of the prebends of theology, penance, and cure of souls, it shall be the right of the same most serene king to nominate to that number of prebends which either actually have, or may be considered as if they had, complete endowment in that part of revenues which shall be assigned to the same chapter. Moreover, since hitherto no choral benefices have been found established in that chapter of St. Lawrence, and since in this especially new order of things there is need for residential benefices, whose holders are bound to exercise the lower ecclesiastical duties, we command and order that from the aforesaid canonicates of the same chapter (those excepted, however, which are for the precentor, or cantor, for the dean, for the parish priest, for the canon theologian and penitentiary, those excepted, however, which perchance are affected by right of patronage) six canonical prebends shall forthwith, or now for then whenever they first become vacant, be suppressed, with this further condition added, that from them six residential benefices shall be constituted for the same cathedral, and such beneficial prebends, having regard namely to the lower grade and the lesser offices to be exercised by each of their rectors thereafter, shall obtain a suitable portion of the former endowment in the manner of the other cathedral benefices, but whatever goods and revenues shall perchance remain therefrom, all of that shall be assigned and shall accrue in perpetuity to the goods and revenues for the fabric and sacristy of the same cathedral church.

8 In order, however, that divine offices and all ecclesiastical duties may be carried out more diligently, we will and command that unless daily distributions have been in use at the aforesaid chapter, they shall be instituted as soon as possible from a third part of the prebends, or otherwise an equal amount shall be constituted for this purpose; and so that such distributions shall be received by those present according to the prescription of ecclesiastical law.

9 In order that the splendor and dignity of divine worship may be increased, and in order that more splendid insignia and choral vestments may correspond to the more eminent title of cathedral status, with which we have distinguished the church of St. Lawrence, we grant the faculty that those two dignitaries and all other canons, likewise the beneficiaries (as soon as they shall have been instituted), may lawfully, freely and perpetually wear, bear and use the same choral vestments and insignia which the canons and beneficiaries of the other cathedral chapters existing in Sicily beyond the Strait, not obtained, however, by special grace and privilege, respectively use, both in the said cathedral of Drepana and outside it, whenever they themselves, whether for public supplications or for solemn sacred rites or for other ecclesiastical acts, shall have convened in chapter.

10 Likewise to such a chapter, as erected and ordained above, we grant the faculty in full also of drawing up capitular statutes, ordinances and decrees, consonant, however, with the sacred canons, apostolic constitutions and the decrees of the Council of Trent, to be examined and approved by the ordinary bishop, so that they may have the force and full validity of law, and we will that the same chapter enjoy all and singular graces, honors and privileges which the other cathedral church chapters existing in Sicily beyond the Strait enjoy, provided they are in use and have not been acquired by special indult or by burdensome title.

11 [17] Since it is especially close to Our heart that young clerics be properly instructed in religion and letters, and become accustomed from their earliest years, far from the allurements of the world and near the sanctuary of ecclesiastical service to which they ought to minister, We will and command that according to the prescription of the Council of Trent a diocesan seminary be erected as soon as possible in a sufficiently spacious building and equipped with suitable resources. With all these matters thus arranged and decreed, since it is altogether necessary that suitable endowments be assigned for the table of the new bishopric of Drepana, for the diocesan seminary, for the supplement to be added to the prebends of the cathedral church, for preserving the building itself intact, for the sacristy, for acquiring the furnishings necessary for divine worship; and since at present there is nothing else, either easier or more suitable, that can be applied to these purposes, for this reason We entirely suppress and utterly abolish in perpetuity the vacant abbey or priory under the title of the Most Holy Trinity of Delia, which abbey, as stated above, is accustomed to yield annually, with all charges deducted, one thousand five hundred and sixty ounces, or three thousand seven hundred and forty-four Roman scudi, together with all original rights whatsoever, honors, prerogatives, favors and graces in any way hitherto attributed and even acquired, to the end namely that the revenues thereof be forthwith expended in various endowments to be decreed as necessary for the new diocese of Mazzara, in that measure which responds to the desires and requests of the most serene king, its patron. And first, providing for the table of the Drepana bishopric, so that its bishops may be able to maintain their own dignity and sustain the expenses necessary for the governance of the diocese, We constitute and adjudge that same table by perpetual assignment from the goods and revenues of the aforesaid abbey under the title of the Most Holy Trinity in an annual income not less than one thousand ounces, or two thousand four hundred Roman scudi. Moreover We enjoin that the donation of goods which they say was made by the blessed memory of the canon Ciantro De Luca of Drepana for the erection of the bishopric of Drepani be henceforth vindicated and applied to that purpose.

12 [18] Furthermore, since the aforesaid cathedral prebends, as the most serene King of Sicily himself has carefully examined, are seen to yield revenues somewhat less than those which seem fitting to their new title and the nature of their attached duties, for this reason We command that for the supplement of these cathedral prebends there be expended from the revenues of the aforesaid abbey a sum not less than one hundred ounces annually, or two hundred and forty Roman scudi, by which We perpetually assign to their possessors that they may be able to maintain their own dignity more worthily and be more earnestly stirred to diligently fulfill the parts of choral office. Moreover with this further intention, that provision may be made for the necessary expenses both for preserving the integrity of the cathedral fabric and for acquiring sacred furnishings, besides those revenues which perhaps may at some time remain after the erection of the beneficial prebends of which mention was made above, We moreover perpetually assign and constitute from the goods and revenues of the aforesaid abbey an annual sum not less than one hundred ounces, or two hundred and forty Roman scudi for the endowment of that cathedral, its fabric and sacristy, and We further declare that all and singular goods and whatever rents, if any perhaps existed before for this purpose, shall remain intact and unimpaired, and We accept as ratified and approved the promise which the most serene king asserted would be fulfilled, that the same cathedral church be furnished on this first occasion with the necessary furnishings for decently celebrating the pontifical offices.

13 [19] Likewise, for the endowment of an ecclesiastical seminary, to be established as soon as possible, as has been stated above, We wish to assign and establish in perpetuity a sum of money not less than two hundred ounces annually, or four hundred and eighty Roman scudi, to be drawn from the goods and revenues of the aforesaid abbey of the Holy Trinity of Delia. Since it is not sufficiently clear at present whether it would be better to divide the revenues of the aforesaid abbey called the Holy Trinity and assign them individually to each of the aforementioned endowments, or rather to grant and adjudicate all the goods and revenues of the same abbey entirely to the episcopal table of Drepana, with the burden and obligation added that there be paid annually from the same table that sum of money which has been designated above for each endowment, We therefore entrust it to the executor of the bull, to be appointed below in this matter, that he may choose whichever course, as shall seem more convenient and useful according to the circumstances of affairs. Yet in such a way that free and peaceful possession may be taken over all such abbatial goods, or over their part, immediately and by whomever it shall pertain to according to whichever of the aforesaid courses shall result. Since, however, a certain part of the annual revenues of the aforesaid abbey of the Holy Trinity of Delia is consumed in paying certain ecclesiastical pensions, We hold firm and ratified the purpose of the most serene king, that while those same pensions shall endure, the sum of money shall be drawn from the treasury of spoils and vacant sees in Sicily and the same shall be expended on the aforesaid pensions. And so that the bishop of the church of Drepana for the time being may have his own residence and one befitting his dignity, for his habitation and the residence of his episcopal curia, as near to the church as possible, the most serene King of Sicily has promised that it shall be ready immediately upon the same church being provided with a pastor; and likewise We perpetually designate and assign a sufficiently spacious building for the diocesan seminary to be established according to the prescription of the sacred canons, just as the most serene king himself has pledged that he will diligently bring this about.

14 Lest, however, anything be lacking which is required for the proper administration of the diocese of Drepana, We command and enjoin that all and singular writings, instruments, foundations of benefices and legacies, testaments and all other documents and records which pertain to or concern the things and persons of the towns or parishes and places to be dismembered as stated above, be searched out as soon as possible, separated, and extracted from the former episcopal chancery, and immediately inserted and preserved in the chancery of the Drepanan episcopate, to whose ordinary jurisdiction, government and power the same towns individually with their territories and other appurtenances shall henceforth be subject from the pre-established dismemberment. Then from Our full power We grant to the king of both Sicilies for the time being and to his successors permission or the right of nominating within the time prescribed by law a suitable person to be appointed by Us or Our successors the Roman Pontiffs as bishop of Drepana (which person, if indeed he must come to the City to obtain apostolic provision in the customary manner), and We thereupon declare that the aforesaid right may be exercised both at this first instance and in future vacancies of the Drepanan episcopate, however they may henceforth occur.

15 We decree and determine that the episcopal church of Drepana shall be considered and shall be perpetually subject to the metropolitan authority of the Archbishop of Palermo for the time being, and shall enjoy all those faculties, exemptions, prerogatives and rights which legitimately pertain to the other suffragan churches of the archbishopric of Palermo.

16 Lest the episcopal church of Drepana lack a suitable administrator, for so long as its pastor has not been provided in consistory, We grant and entrust that its cathedral chapter may, within eight days from the execution of the bull to be commanded below, validly hold a capitular assembly for the purpose of properly conducting the election of a vicar capitular.

17 Furthermore, We command that the fruits of the aforesaid church of Drepana in its future provision be taxed at two hundred fifty-three florins of camera gold with one third part of the same florin, and that such taxation be inscribed in the books of the apostolic camera and the sacred college.

18 ANNO MDCCCXLIV.

19 Finally, as executor of all those matters which have been sanctioned by Us above, We appoint Celestine Cocle, archbishop of the church of Patras in the lands of the infidels, with the necessary and appropriate faculties, so that he himself, either personally or through another suitable person constituted in ecclesiastical dignity, to be subdelegated by him, may be able to establish and decree all things, so that all things ordained above and all things constituted may be duly and properly brought to a happy conclusion; and also with the faculty to the same executor or his subdelegator to pronounce definitively upon any opposition arising against the aforesaid in any manner whatsoever; with the obligation imposed upon him to describe diligently in the executive decree the boundaries of the entire diocese of Drepana, as constituted above, and to send hither within six months from the completion of the execution of the apostolic letters, an authentic exemplar drawn up in proper form, of all the decrees which he shall issue in the aforesaid execution of the letters, so that they may be preserved in the archive of the sacred Consistorial Congregation in the customary manner.

20 Moreover, these letters and whatever is contained in them, even from the fact that any persons having or pretending to have an interest have not been called and heard, and have not consented to the premises, even if worthy of express, specific and individual mention, shall at no time ever be noted, impugned, or called into question by the vice of subreptiousness or obreption or nullity, or of Our intention or any other defect, however substantial and contrived; but they shall exist and be perpetually valid and efficacious as having been made and emanated from certain knowledge and fullness of power, and shall obtain and secure their full and complete effects, and ought to be inviolably observed by all to whom it pertains and shall pertain in any manner in the future; and if it should happen that anything contrary to these be attempted by anyone whatsoever with any authority, knowingly or unknowingly, We will and decree that it be entirely null and void and shall be.

21 Notwithstanding acquired right not to be taken away, suppressions to be committed to the parties, with those interested being called, and Our other rules and those of the apostolic chancery, as well as the statutes and customs of the aforesaid churches, even if sworn to, confirmed by apostolic authority, or strengthened in any other way, and also immemorial privileges, indults and concessions, any worthy of individual mention, and all and singular apostolic constitutions and ordinances issued in synodal, provincial, and universal councils, whether special or general. All and singular of which, and their entire tenors and forms, even if special mention or any expression thereof ought to be made or some other exquisite form observed, their tenors being held as expressed in the present, for the effect of all and singular of the premises, We derogate most broadly and fully, and specially and expressly, and to all other things contrary whatsoever.

22 Furthermore also We will that to the transcripts of these letters, even if printed, subscribed however by the hand of some public notary, and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith be given everywhere as would be given to these presents if they were exhibited or shown.

23 Let no man whatsoever be permitted to infringe this page of Our suppression, dismemberment, erection, annulment, distinction, separation, application, circumscription, concession, assignment, subjection, attribution, statute, indult, declaration, deputation, commission, mandate, decree, derogation and will, or to act against it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of God and of the blessed Apostles Peter and Paul. Given at Rome at St. Peter's in the year of Our Lord's incarnation one thousand eight hundred and forty-four, on the day before the Kalends of June, in the fourteenth year of Our pontificate.

GREGORIUS EPISCOPUS
servus servorum Dei

Siciliarum rege iniit sancivitque.

4 Mox vero templum ipsum, retento pristino s.
