Dat. die 7 octobris 1340, pontif. an. vi.

XVIII1
Reform of the Advocates and Procurators of the Roman Curia. Benedict, Bishop, Servant of the Servants of God, for the perpetual memory of the matter.
1 We deem it fitting and necessary that patrons of cases, who undertake the office of advocacy in the Roman Curia, be henceforth directed in a discreet and most excellent order. § 1. Let therefore the patron of a case be effective in presenting it, reciting only those matters pertaining to the business under discussion, admitting nothing superfluous and impertinent, nor let him rashly break forth into the license of reviling and cursing beyond what the utility of the case demands.
2 § 2. Let advocates, however, beware that in the cases of the poor (which we wish to be presented gratis through those who wish to present them) they receive absolutely nothing whatsoever, even if freely offered at the ready instance of the poor themselves. 1 But those who shall have received anything from them shall by no means acquire ownership thereof, but we will that they be held and bound to the restitution of double that which they have received, in such manner that nothing can be remitted to them through the said poor; and to this restitution they shall be compelled by the Vice-Chancellor of the Holy Roman Church, who shall be in office at the time, through ecclesiastical censure.
3 § 3. But lest (God forbid) the desire for gain should incite the advocate to undertake an immoderate multitude of cases, seeking profit without sufficient care, to the detriment of the cases themselves and the irreparable prejudice and loss of his clients, we strictly forbid all advocates of the same Roman Curia, both present and future, that any one of them undertake so many cases that he cannot exhibit to them the opportunity of necessary study and the diligence owed in pursuing or directing the same; since it is better to attend well to few matters than to undertake many dangerously. And if perchance they have received so many cases contrary to this prohibition that they cannot apply the owed study and customary necessity to each of them, and on this account it should happen that the said cases or some of them perish or are delayed too expensively, they shall be held entirely responsible for the restoration of the expenses, damages and interest of the party, if it be such a case as admits of valuation, or of which the interest of the party can be satisfied; otherwise, beyond these expenses, they shall be punished at the discretion of the same Vice-Chancellor in consistorial cases, and in other cases which happen to be conducted before the Apostolic See, at the discretion of the auditors of those cases, whether the auditors themselves be cardinals of the Holy Roman Church or others who shall have heard such cases before the aforesaid See.
4 § 4. Again, any advocate, before undertaking a case to be presented and directed, shall examine the deed of his client whose business it is with the principal if he can, or with the procurator or promoter of the case itself, and what documents and what proofs the client has and can have concerning the said business, diligently. And if from such information he finds his case to be just, reasonable and probable (since he shall have the information reduced to writing and exhibited to him), he can assume the case to be aided by his patronage. But if he finds it to be unjust and improper from the said information, let him not assume it, but reject it from his patronage, and advise the rejected party that he abandon the said case, nor vex himself and the other party in its prosecution with labors and expenses.
5 while a case is pending, let them receive nothing whatsoever freely offered, nor let them undertake anything for themselves with clients or others, nor let them make any agreement; otherwise they shall be bound to restitution of double that which they have received, beyond the said agreement, no remission of part being of any avail in this matter. And such contracts shall not stand in law, and otherwise by the same vice-chancellor in consistorial cases, and in other cases by the auditors thereof, as shall seem fit, let them be punished. Unfaithful or negligent advocates or procurators in conducting cases, we see to it that, if the said advocates or procurators shall be found to have undertaken or directed the assumed cases less faithfully or negligently, or knowingly to have assumed a bad or improper case, 2 by the aforesaid vice-chancellor in cases of the consistory, and by the auditors in cases which they shall hear, to the making good of damages and expenses, which the parties shall incur for this purpose, all appeal ceasing, they shall be bound by similar censure. And if it shall perhaps seem to the same vice-chancellor or auditors, from the quality or frequency of the said excesses or defects, that the said advocates or procurators ought to be punished more severely, they may forbid them the aforesaid offices for a time or in perpetuity.
6 § 7. Finally, because it could be dangerous for the parties in need if the advocates of cases, whom either skill or long experience has made more capable, should stand for one side only, and thus the other side should necessarily be sustained by inexperienced and untrained men, we decree that, if the parties request it, the distribution of advocates shall be made as well as it can be done, and each shall render assistance to the parties, and such fair division in cases which are handled in the consistory shall be made through the vice-chancellor, but in others through the auditors of those cases themselves, and let each party be content with two advocates only, nor shall it be able to obtain more.
7 § 8. Let no one whatsoever presume to infringe this page of our decrees, statutes, reforms, mandates, prohibition and will, or to contravene it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.

- 1 This Constitution of Benedict XII, which was omitted from the Roman Main edition through oversight, we have taken from Cherubinio, where it is cited under no. il (r. t.).
- 1 Read Forcati quorum vel quam (n. t.).
- 2 Many pontiffs have issued various other reforms of the same and also of notaries of the same curia, according to the condition of the times, but I was content to insert this one as the more ancient, and another of Paul V as the most recent and containing all things most fully, below in his Const. lxxi and following (in this edition cxciv and cxcv, which see in vol. xu, pag. 58 and in this work, together with the annotations there placed severally in the apostils (Cherub.).
