CONSULTATIO VETERIS CUIUSDAM IURISCONSULTI. - This is a carefully composed opinion, delivered under pre-Justinian Roman law by a jurist of the fifth century, concerning an inheritance division between brother and sister, the latter being represented, in the transaction and in the litigation arising from it, by her husband.
The opinion resolves the various issues of substantive and procedural law, citing doctrine and legislation, the latter drawn from the Gregorian, Hermogenian, and Theodosian Codes.
The jurist appears to have held Christian sentiments, as is shown by the phrases: « In Dei nomine quid tractari debeat » (V, 1); « Iuvante Deo quid tractari debeat » (VI, 1).
The C. was first published by Cujacio from an apograph codex now lost, given to him by A. Loisel. Noteworthy are the subsequent editions by P. Krueger, in Coll. lib. riv. ant., III (Berlin 1890), and by G. Baviera, in Fontes iuris romani anteiustinianei (Florence 1940).
