Antiquae concertationi
Declaring that Sacred Orders Do Not Dissolve an Unconsummated Marriage
1 Desiring to put an end to the ancient contention, and to provide salutarily for the dangers to souls arising therefrom, by the counsel of our brethren we declare by the present edict that, although a solemn vow made by reception of sacred orders, as far as concerns preventing the contracting of matrimony and dissolving it if it has been contracted, is to be reckoned efficacious according to the statutes of the canons, nevertheless for dissolving a previously contracted marriage, even if it has not been consummated by carnal copulation, since we find this statute neither in divine law nor in the sacred canons, it is to be deemed invalid. By apostolic authority we strictly forbid that anyone, while matrimony remains, not yet even consummated, presume to receive any of the sacred orders, unless as he shall know it to be fitting according to the sacred canons. But if perchance this shall have been attempted otherwise by anyone, we ordain that he shall neither minister in the sacred order thus received after the marriage is dissolved, nor be promoted to higher orders, nor be advanced to any ecclesiastical benefice or office, unless it shall have happened that he canonically enters one of the approved religious orders (whose profession binds its professed members to the custody of chastity, and the renunciation of temporal things, and obedience to their superior), and expressly or tacitly profess its rule. In which case the diocesan may dispense with him concerning the aforesaid matters and each of them, unless there be some other canonical impediment. For entrance into such an order, thus ordained, if the matrimony shall not have been consummated, he is to be earnestly admonished by the diocesan and induced. But if perchance he shall refuse to comply, we decree that he himself, if his spouse shall have insisted, is to be compelled by ecclesiastical censure to consummate the contracted matrimony. Let no one infringe our declaration, prohibition, ordinance, precept and constitution. Given at Avignon on the kalends of December in the year
