Brief on the irrigation works of Aragon and Navarre

Brief of Pope Clement VIII ·

made by the emperor, is owed to the same king from apostolic concession, and when it shall have been found useful to the same archbishop and to the ecclesiastical authorities, We confirm it by apostolic authority. To Our beloved son and nuncio of the Apostolic See in the kingdoms of Spain, Clement Pope VIII.
Beloved son, We greet you and impart the apostolic blessing.

1 § 1. It was recently set forth to Us by our most dear son in Christ Philip, king of Spain the Catholic, and the venerable brother archbishop of Caesaraugusta, and others having interest in the concordance written below, that formerly to the blessed memory of Clement VII and Paul III, and successively also to Julius III, Our Roman Pontiff predecessors, on behalf of the late Charles V, Emperor of the Romans, who was also king of Aragon and Navarre the Catholic, it was set forth that, considering providently on account of the scarcity of waters and the barrenness of lands which resulted therefrom, the inhabitants of the kingdoms of Aragon and certain parts of Navarre were suffering the greatest want in their sustenance and in other things necessary for human life; and as the best protector of his subjects, wishing to provide for such want, he ordered that waters be drawn from two notable rivers, namely the Ibero and the Xalone, flowing through the said kingdom of Aragon, for the irrigation of the said lands, and since from the aforesaid matters, both on account of the roughness of the channels of the said rivers and the length of the ditches and streams for the courses of the waters, very great expenses would be necessary, and to relieve these the aid and authority of the Apostolic See, as was customary in similar matters, would be greatly required; the same Clement, Paul and Julius, his predecessors, at the supplication of the said Charles the emperor and king, through various letters of theirs gave orders to certain worthy men in those parts, and to each of them successively, that, having made by them or by one of them a diligent inquiry, as much as in any year, from then the three years next past, with fertile compensated by sterile, for tithes and first fruits from the fruits collected in the lands of the said kingdoms, had been paid to churches, monasteries and other pious places, or to their or their rectors, or to beneficiaries of the cities and dioceses of Caesaraugusta and Tarazona, and these being paid perpetually in all future times each year, the increase of tithes and first fruits, which would be made both from the superabundance of fruits on account of the irrigation of lands in this manner, and from new lands which would arise from the derivation and irrigation of waters in this manner, or on account thereof would be brought to cultivation and more abundant produce, for the time being, to the same Charles the emperor and king, and to his successors in the said kingdom of Aragon, as soon as the water of the river in this manner should be led through ditches or streams to the lands to be irrigated, even if it had not been led to the end, and also to be paid each year, they decreed, as is more fully contained in each of the aforesaid letters.

2 § 2. When, however, as the same exposition of the causes of the concordance subjoined from the beginning, the information

3 as much as in any year, from the three years then most recently past, with fertile compensated by sterile, for the tithes and first-fruits aforesaid to the churches, monasteries and pious places paid, according to the form of those same letters, had not been made, but after the waters for irrigating lands of this kind through ditches and streams with great expenses the said Charles emperor and king had caused to be conducted, and thence to the inhabitants of those same parts no small utility and advantage had come forth; the superabundance of tithes and first-fruits and new lands to Charles the emperor and king, and successively to the same Philip king, his successor, not according to the form of the aforesaid letters, but according to estimation, as much as in individual years the tithes and first-fruits, having regard to rains, on account of these irrigations had increased, was made; and because this form is very inconvenient and costly, and beyond the form of the aforesaid apostolic letters existing on account of not having been made, as is aforesaid, from the beginning to the churches, monasteries and other places aforesaid an assignment, according to the form of those same apostolic letters. Which all things by Philip the king, and the archbishop of Caesaraugusta, and those having interest, maturely considered, and heard the opinion of experts in the aforesaid matters, and having regard to how much annually, by the said later form by them, as is aforesaid, served, to the churches, monasteries and places aforesaid came, from the year 1547 to the year 1593, from which time the lands of the underwritten places are irrigated, as appears from the processes, of those same experts counsel being employed, and all things rightly and correctly and maturely examined between Philip the king and the said archbishop and others having interest, to this agreement, by word or in writing, it was come, namely: that to the churches, monasteries and other beneficed by agreement of . . . , . . , , . which in the rubric. this agreement once shall be assigned that which they ought to have and obtain, not however at discretion, and as in each year it rains and otherwise the fields are irrigated, but thence Manuel, namely five out of six, and thence Cortes, two out of three, as also thence Mollette, three out of five parts to the same Philip king, the remaining parts to the Ordinary, and others having interest, and thence Galluc places or towns of the Caesaraugusta diocese, the half to Philip king, and the other half of the fruits of tithes and first-fruits of lands from ancient time accustomed to be cultivated to the same Ordinary and those having interest aforesaid should be given, saving in other respects the rights of the said Philip king over the tithes and first-fruits of the said lands, which from the year 1547 have been cultivated, and anew are cultivated and irrigated, and before were not cultivated, which all belong to the same Philip king. Which indeed from the stream or ditch Zequie cannot be irrigated, all belong to the same Ordinary and those having interest, nor under any division are comprehended. This agreement however ought to be understood and to last, insofar as the lands are irrigated, or water is given for this, and until the ditch or stream Zequie of this kind is wholly completed, so that the boundaries, or territories of Caesaraugusta, and the plain of Fuentes by it are irrigated and otherwise, and in another manner, as in the said agreement and writings made thereupon more fully is contained.

4 § 3. And whereas the aforesaid in the commission of those same parts, and especially of the churches by apostolic nuncio . . .

5 lic so that it may be said to conduce to common advantage and utility and the said Philip king, as well as the archbishop of Caesaraugusta and others having interest, should wish this agreement, for its observance and firmer subsistence, to be strengthened by our and the Apostolic See's patronage; they caused humbly to beseech us, that in the aforesaid we should deign to provide opportunely with apostolic benignity. We therefore, inclined to these supplications and holding the tenors of individual predecessors and other letters, and what followed thence, as expressed, to your fraternity by these presents commit and command, that having considered by you or another, or others, whom you shall have deemed suitable to be appointed for this, having considered, if you shall find this agreement to be for the advantage of the same archbishop and those having interest, you confirm and approve it, as it has been made, by our authority, and moreover all and singular both of right, and of fact, and whatsoever other defects, if any both in the agreement, and other aforesaid matters, and what followed thence in any manner whatsoever intervened, you supply, and to it add the strength of perpetual firmness, and cause it to be inviolably observed by all those having interest, even under ecclesiastical sentences, censures and penalties, invoking also for this, if it shall be necessary, the aid of the secular arm.

6 are said, and the said King Philip, whom the Archbishop of Caesaraugusta and others having an interest therein desired such an agreement, for its observance and more firm subsistence, to be strengthened by our and the Apostolic See's patronage; they caused us to be humbly supplicated, that in the aforesaid matters we should deign to provide opportunely with apostolic benignity. We therefore, inclined to such supplications and holding the tenors of the individual predecessors and other letters, and what followed therefrom, as expressed, commit and command to your fraternity by these presents, that, having considered by yourself or another, or others, whom you shall have deemed suitable to be appointed for this purpose, if you shall find such an agreement to be for the advantage of the same archbishop and those having an interest therein, you confirm and approve it as it has been made by our authority, and likewise supply all and singular defects both of law and of fact, and whatsoever other defects, if any have intervened in any way both in the agreement and in the other aforesaid matters and what followed therefrom, add to it the strength of perpetual firmness, and take care that it be inviolably observed by all those having an interest therein, even under ecclesiastical sentences, censures and penalties, invoking also for this purpose, if it shall be necessary, the aid of the secular arm.

7 Notwithstanding the aforesaid, and contrary . . . , . . , . derogation. whatsoever constitutions and ordinances apostolic, as well as statutes, laws and customs, and the aforesaid and other apostolic letters, and whatsoever other things contrary.

Brevium. VIII PP. z<3a An.
