Decretal on betrothal followed by carnal union (Liber Extra 4.1.30)

Decretal of Pope Gregory IX ·

Liber Extra (X) 4.1.30
CAP. XXX. 1
Betrothals for the future pass into matrimony through carnal copulation subsequently occurring, but not through mere attempt at carnal copulation alone. H. d. cum c. fln.
infra eodem.
The same to the Bishop of Le Mans.

1 He who gave his faith to M., a woman, concerning the contracting of matrimony, with carnal copulation subsequently occurring, even if he leads another woman to the face of the Church and knows her, is bound to return to the first, because, although the first matrimony may appear presumed, nevertheless against such presumption no proof is to be admitted. From which it follows that neither a true matrimony, nor any matrimony whatsoever, is deemed to be that which in fact subsequently occurred.

Liber Extra (X) 4.1.30
CAP. XXX. 1
infra eodem.
Idem Episcopo Cenomanensi.
