Bull on the authority and letters of the Major Penitentiary

Bull of Pope Sixtus IV ·

And to approve and support his letters in both forums, — 7. And he imposes penalties on the disobedient. — 8. Executors of this constitution are appointed. — 9. He abolishes contrary provisions.

1 Sixtus, bishop, servant of the servants of God, for perpetual remembrance of the matter.

2 Since certain children of iniquity, having assumed the spirit of exaltation and obstinacy, presume to call into question the power of our Major Penitentiary, known throughout the whole world for the longest time and inviolably observed by all the faithful, and to oppose contumaciously and to detract from letters issued under his name through the office of our Penitentiary from time to time, it is fitting that we apply remedies against such things by which, their rashness being checked, the authority and power of the same Penitentiary may be preserved unharmed, and his letters, together with the persons obtaining them from time to time, may achieve their desired effect with peace and tranquility of conscience, all obstacles being removed.

3 § 1. Indeed, having received word some time ago, which, although it became known to almost the whole world, that among the other offices of the Roman Curia there had been the office of the sacred Penitentiary, instituted long ago and under the authority of the Pope; and in some of the letters of the Major Penitentiary holding office at that time, which emanated from him by reason of that office from time to time, it was contained thus, namely (By the Authority of Our Lord the Pope, whose Penitentiary we manage), and in others (By the Authority of Our Lord the Pope and by his special mandate made to him on this matter by word of mouth); in the remaining ones (by the said authority of Our Lord the Pope and his special and express mandate); and such letters and assertion of the same Penitentiary, both in court and outside, without the faculty granted to the same Penitentiary by the Apostolic See being inserted in them, were accustomed to receive undoubted credence; and from that time until now the Major Penitentiary existing from time to time, from the style of his office, when he was a cardinal bishop, was accustomed to name himself bishop only, not however cardinal, as also the other cardinal bishops did in their letters; and the aforesaid letters, with the ancient seal, used by the Major Penitentiaries who had been from time to time, an oblong seal impressed in red wax and a case of white wax hanging, according to the ancient style of the said office, were sealed; and thus dispatched, were accustomed to be committed to due execution, without any contradiction and exception, and to be held by all in due obedience.

4 § 2. Since, however, certain men of law, desiring to know more than they ought, were not ashamed to affirm and to call into question, on behalf of diverse parties, whether faith should be given to the letters of the said office, with the aforesaid words and seal, according to its approved style and observed uniformly by all, and whether they ought to obey them, asserting that credence should not be given to the assertion of the aforesaid Major Penitentiary concerning the authority of his office and the special and express mandate of the Pope aforesaid: and because our venerable brother Julian, of Ostia, formerly bishop of Sabina, our Major Penitentiary, after his promotion to the church of Sabina and translation to the church of Ostia made by us from his person, formerly cardinal priest of the title of St. Peter in Chains, named himself not cardinal but bishop of Sabina first and, after the aforesaid translation, bishop of Ostia, the letters of the said office sealed with the said seal exist of moderate authority, in contempt of the said office and its Penitentiary, or rather truly of apostolic authority and scandal to many.

5 § 3. We, being mindful that the Major Penitentiary ordinarily exercises jurisdiction and authority through other means, and that he does not have full authority to insert the authorities of his office in his letters, as other ordinaries do; and that the style of apostolic letters and others emanating from it, especially in the Roman Curia, was observed as law to such an extent that letters expedited outside this style were not free from suspicion of falsity; and wishing to prevent such insolent and rash presumptions, and to consult the peace and tranquility of the consciences of those whom the aforesaid letters concerned, and the honor and immunity of the said office, by our other letters, by our own motion and from certain knowledge, we decreed and declared that full faith ought to be given to the letters aforesaid of the Penitentiary then expedited, even as regards the authority and mandate of which mention was made in them, without any insertion of such authority and mandate in them; and that no other proof is required to establish this. Commanding all and singular of both sexes, the faithful of Christ, holding whatever dignity and authority, under excommunication and other censures and penalties then expressed, that they should believe and obey the aforesaid letters of the Penitentiary, according to the aforesaid style of the said office then expedited, and which might be expedited in perpetuity for the time being, and should comply in all things and through all things, just as if in them the faculty and power of the Major Penitentiary for the time being, granted to him by us and our successors the Roman Pontiffs for the time being and by the aforesaid See, as regards those things which were contained in the same letters of the Penitentiary, had been sufficiently inserted, and by apostolic letters concerning the authority of the said Major Penitentiary, and a special and express mandate made to him by the oracle of the living voice, this were evident, as is more fully contained in the same our letters.

6 § 4. Since, however, as recently, not without great distress of our mind, we have also learned that the aforesaid interpreters of law and other presumptuous and stiff-necked persons, not only do they contumaciously despise the letters of the Penitentiary of the said Penitentiary and our decree, declaration and mandate aforesaid; and do not fear to say and allege publicly and sacrilegiously that the letters of the Penitentiary of this kind ought to be admitted only and solely in the forum of conscience, not however in the judicial forum; and that the power of the said Major Penitentiary extends to the forum of penance and conscience only and is restricted thereto; and that the same Major Penitentiary, although in cases, according to the faculty granted to him by the aforesaid See, he may dispense and absolve through himself, nevertheless cannot commit to others the power of absolving and dispensing and other faculties granted to him through his letters: they also [say] that it does not appear that the letters which are expedited and have been expedited through the aforesaid office of the Penitentiary have been and are expedited according to the ancient style of the same office, and therefore that their validity ought rightly to be doubted; and by many other and exquisite suggestions and cavils they impugn the power of the aforesaid Major Penitentiary; and nevertheless they do not blush to impede indebitably and unjustly that his letters of this kind be committed to due execution, and that the persons whom they concern may obtain the votive and due effect of them, and to inflict upon the same persons, contrary to the tenor of the aforesaid letters, various other troubles and damages, to the peril of their own souls, and to the contempt and disparagement of the Penitentiary himself, or rather truly of us and the aforesaid See, and no small prejudice and burden to those persons, and a pernicious example and scandal to many.

E le sue lettere in entrambi i fori approva e sostiene, — 7. E impone pene ai disobbedienti. — 8. Deputati gli esecutori di questa cost. — 9.
