Ut sacra
Bull on the separation of the Observant Franciscans from the Conventuals
To the perpetual memory of the matter.
1 That the sacred religion of the Order of Minors, whose sincere zeal, shining forth from its praiseworthy works, f. 154: "Likewise a similar bull word for word, except that where above is this word witramontanis in another [1007] ee commendably continues to bestow no small increase upon the Catholic faith, may be rendered, insofar as the Most High shall permit, secure from all adversity, We hold within Our heart an affection implanted by sincere wishes, that with the removal of what hinders and the substitution of what profits, nothing may remain which might perhaps deter the brothers from the begun salutary purpose or in any way break the strength of sacred religion. Indeed, since our beloved son Anthony of Rusconibus, professor of sacred theology and general minister of the Order of Minors, at Our urging and also with the approval and assent of certain professors of sacred theology and worthy men of that religion praising and assenting to Our proposal and consulting thereupon, has instituted two vicars, namely our beloved sons John of Capistrano in and over all in the parts on this side of the mountains and John of Mauberto in and over all in the parts beyond the mountains of the same order, brothers called of the observance, professors with full power of their office granted to each individually, as appears clearly from Our letters inserted herein. Since therefore from the aforesaid institution peace of status, with the matter of wandering put to flight, attention to sacred study, increase of persons and many goods, as we have learned from certain experience, have come to those brothers called of the observance and to Christian religion from their exemplary life, and it is hoped that more will come in the future with the Lord granting, if the same institution shall persevere in future times, We, who desire with intense longing the peace and salvation of individuals, especially those devoted to regular observance, adhering to the constitutions and statutes issued upon such dispositions by the sacred Council of Constance and by our predecessor of happy memory, Pope Martin V, by Our own motion, not at anyone's instance, but from certain knowledge by apostolic authority with the counsel and assent of Our venerable brothers the cardinals of the Roman Church, do establish, decree and ordain, that henceforth the vicar general of those brothers of the observance beyond the mountains, around the end of the triennium from which he shall have been elected to the office of vicar, may and ought to convoke the vicars and discretes having a voice in the congregation appointed from any of the vicariates and provinces subject to him in a place to be appointed by the same vicar general around the end of the same triennium to make a congregational gathering: of whom, if any detained by infirmity or legitimate impediment could not be present, their presence shall be supplied by messengers appointed by them or by supplementation of their voice according to their custom, who thus congregated shall have the faculty of doing, ordaining and disposing all and singular things which by law, custom and from privileges the brothers of the same order can do when congregated in their general chapter and especially (?) of electing; and they shall be bound to elect one religious of the same order as their similar vicar general. Which election, if it be celebrated by the greater part of those electing, as soon as it can conveniently be done, let them present to the general minister of the whole order; he indeed the general minister within three days from the presentation made to him shall be bound to confirm the aforesaid elected one, granting and committing to him fully his vicarial powers, as above, namely giving to him free authority and power and full faculty of his over all and singular brothers called of the observance and, if any of them be named by another name, dwelling and about to dwell in the parts beyond the mountains both in the heads and in the members, to visit publicly and privately, to call, to cite, to inquire, to examine, to proceed, to judge, to remove, to terminate, to decide, to pronounce sentence, to approve, to disapprove, to correct, to restrict, to detain, to punish, to imprison and to free from prisons, to restore to legitimate acts, to place and to transfer the brothers of the vicariates and provinces of this kind and to expel and to revoke, to receive brothers from the parts beyond the mountains coming with good permission, to reduce and to accept all apostates willing to return to the order with the penance which shall seem to the same vicar to be imposed, to receive brothers of the conventional life, provided they are not rebellious to their ministers and have sought permission from them and do not evade penance for their offences, truly desiring to turn themselves to better fruit and to live regularly, to deprive, to absolve, to depose and to restore or to substitute others in their place with the consent however of the brothers of those same places in which such officials or prelates exist, or at least of the greater part of them

Graces or letters whatsoever granted or sent by the aforesaid minister general to the same brothers or to be granted hereafter, if such they were, by which the brothers of this sort should be drawn away from regular observance, or which should appear as scandal in the governance committed to the same vicar, shall be held as null.
