Bolla di papa Clemente V ·

tur bona hic enunciata, quae dispositioni Sedis Apost. reservantur. — 4. Occupatoribus dictorum honorum inflictum anathema — 5. Clausulae.

are assigned to the disposition of the Apostolic See. — 4. Anathema inflicted upon occupiers of the said honors — 5. Clauses.

1 Clement, bishop, servant of the servants of God, for perpetual memory of the matter.

2 It pertains to the provident circumspection of Christ's Vicar presiding in the watchtower of apostolic dignity to weigh the vicissitudes of emerging times, to examine the causes of affairs, and to attend to the qualities of persons: so that, directing to individual matters the gaze of necessary consideration and applying the hand of opportune action, he may thus root out the thorns of vices from the Lord's field that he may amplify virtues; thus may he remove the thorns of transgressors, so that by uprooting he may plant more than he destroys, and to the places made empty by the eradication of harmful thorns, transferring plantings devoted to God, he may provide a more fruitful field, from the foreseen and beneficial union and transfer of those places, joy, which true justice, having compassion, would have brought forth, the damage of sorrow to the persons and places of this kind through ruin: for thus by enduring what is fitting, and by substituting what is beneficial, he amplifies the progress of virtues, and by removing from the midst through better substitution he restores.

3 § 1. Whereas indeed the order of the house of the military order of the Temple of Jerusalem, on account of the Master and brothers, and the other persons of the said order existing in whatsoever parts of the world, [was found to be] besmirched with various and diverse errors and abominations of crimes, not so much nefarious as unspeakable (alas for sorrow) depravities, stains and blemishes, which on account of their sad and foul memory we pass over in the present [document], and the state, habit and name of that order, not without bitterness and sorrow of heart, with the sacred council approving, not by way of a definitive sentence, since we could not strike one on this matter according to law, in accordance with the inquiries and proceedings held on these matters, but by way of apostolic provision or ordinance, with an irrefragable and perpetual sanction we have removed, subjecting it to perpetual prohibition, strictly forbidding that anyone should presume henceforth to enter the said order, or to assume or wear its habit, or to conduct himself as a Templar, and if anyone should act contrary to this, he would incur the sentence of excommunication ipso facto. We have also by apostolic authority deemed all the goods of the aforesaid order to be reserved to the ordinance and disposition of the Apostolic See. Strictly forbidding that anyone, of whatsoever condition or status he might be, should in any way intermeddle with the persons or goods of this kind, or should do, renew, or even attempt anything concerning them to the prejudice of the order or of the apostolic disposition to be made by the See itself, as is aforesaid, decreeing from then on null and void, if anything contrary should be attempted by anyone knowingly or unknowingly. And afterwards, lest the said goods, which were formerly given, bequeathed, granted and acquired by the worshippers of Christ for the subsidy of the Holy Land and the impugnation of the enemies of the Christian faith, lacking due governance, should perish as vacant, or be converted to other uses to which they had been appointed by the pious devotion of the faithful, or lest on account of the slowness of this ordinance and disposition their destruction or dissipation should follow, with our brothers the cardinals of the Holy Roman Church, as well as patriarchs, archbishops, bishops, prelates, and also with certain excellent and illustrious persons, and also with the procurators of the other absent prelates and also of chapters and convents, churches and monasteries constituted in the said council, we held arduous, lengthy and diverse counsels and discussions: so that, through the deliberation previously had of such counsels and discussions with diligence, the ordinance and disposition of the said goods might come to the honor of God, the increase of faith, the exaltation of the Church, the subsidy of the said Land, the salvation also of the faithful and the peace of a healthful and beneficial outcome. After which indeed lengthy, premeditated, foreseen and mature counsels, with many just causes persuading, our deliberations and counsels and those of the said brothers, as well as patriarchs, archbishops, bishops and other prelates, and of the excellent and illustrious persons aforesaid then present in the said council, finally came to rest on this, that the aforesaid goods should be transferred in perpetuity to the order of the hospital of St. John of Jerusalem and to the hospital itself, and to our beloved sons the Master and brothers of the same hospital, in the name of the hospital and their order, who, as athletes of the Lord defending the faith, continually exposing themselves to the perils of death, bear most burdensome and dangerous expenses continuously in the overseas regions 2.1

4 § 2. We therefore, among other places in the world in which the observance of regular discipline is known to flourish, pursuing the said order of the hospital and the hospital itself with the fullness of sincere charity, and considering that, as the evidence of the fact shows, in it divine services are fervently pursued, and works of piety and mercy are exercised with vigilant zeal, the brothers of the hospital itself, spurning worldly enticements, rendering devoted service to the Most High, and, for the recovery of the aforesaid Land, as intrepid soldiers of Christ, striving with fervent zeal and desires, regard all human concerns as of little account; considering also that from this great devotion of their master and the brothers of the said order and hospital there will grow their strength,

5 the goods of the same being applied to the soldiers of the hospital of St. John of Jerusalem, the fervor of their souls will be increased and their fortitude will be strengthened, to repel the injuries to our Redeemer and to crush the enemies of the same faith, inasmuch as their power being increased in more abundant resources, the burdens which the necessity of the prosecution of so great an undertaking demands, they will be able to bear more lightly and easily; and for this reason, being made vigilant not unworthily and stirred up by solicitous zeal, so that we may render aid and assistance to the increase of their state, the same sacred council approving, we donate, grant, unite, incorporate, apply and annex in perpetuity to the same order of the hospital of St. John of Jerusalem and to the hospital itself, the house of the Militia of the Temple and the other houses, churches, chapels, oratories, cities, castles, villas, lands, granges and places, possessions, jurisdictions, revenues and rights, and all other goods immovable and movable, or moving of themselves, with all their members, rights and appurtenances, beyond and on this side of the sea, and in all and in whatever parts of the world existing, which the same order and the said master and brothers of the same order of the Militia of the Temple, at the time when the same master and certain of the same brothers of the Militia of the Temple were commonly captured in the kingdom of France, namely in the year of our Lord one thousand three hundred and eight, in the month of October, by themselves or through any others, had, held, possessed, or in any way pertained to the same house and order of the Militia of the Temple and the said master and brothers of the same order of the Militia of the Temple, as well as the names, actions and rights, which at the said time of their capture belonged or could in any way belong to the same house, order or persons of the order of the Militia of the Temple, against any persons of whatever dignity, status or condition, with all the privileges, indulgences, immunities and liberties with which the aforesaid master and brothers of the said house and order of the Militia of the Temple and the same house and order had been legitimately endowed by the Apostolic See, or by Catholic emperors, kings and princes and other faithful, or in any other way, by the fullness of apostolic power.

§ 3. Excepting the goods formerly of the said order of the Militia of the Temple consisting in the kingdoms and lands of our most dear sons in Christ, the illustrious kings of Castile, Aragon, Portugal and Majorca, and outside the kingdom of France, which we have deemed should be specially excepted and also excluded from the aforesaid donation, grant, union, application, incorporation and annexation, nevertheless reserving those to the disposition and ordinance of the Apostolic See, the inhibition formerly made by our other decrees, namely that no one of whatever condition or status should in any way intermeddle with such persons and goods, or concerning them to the prejudice of the ordinance or disposition of the same See to be made concerning them, as well as the interposition of our decree, as regards the persons and goods in the said kingdoms and lands of the same kings next expressed consisting, we will to remain altogether in full force and firmness, until concerning the aforesaid persons and things consisting in the same kingdoms and lands, by the disposition of the same See it shall have been otherwise ordained.

6 § 4. Likewise, occupiers also of the said new goods, or unlawful detainers, of whatever status, condition, excellence or dignity they may be, even if they shine forth with pontifical, imperial, or royal dignity, unless within the space of one month, after they shall have been required concerning this by the said master and brothers of the same hospital, or any one of them, or by their proctor or proctors, they shall have released the said goods, and shall have fully and freely restored them to the order of the same hospital and to the same hospital or to the master, or to the priors or preceptors or brothers of the same hospital, constituted in whatsoever parts and provinces, and to each of them or to the proctor or proctors of the same of the same order of the same hospital by name, even if the said priors, preceptors and brothers of the same hospital and their proctors and any one of them did not have a mandate from the said master of the same hospital concerning this specially, provided that the aforesaid proctors shall have had or shall show a special mandate concerning this from the said priors and preceptors, or from each of them, in the provinces and parts in which such priors and preceptors shall have been appointed, all and each of them, namely the priors and preceptors and brothers to the said master, the proctors aforesaid to the same priors and preceptors, and to each of them, by whom they shall have been appointed concerning these matters, shall be bound to render and give a full account and reckoning concerning all things done, acts received and procured by them in any manner in this part, [[fn:clemens v pp. 229 An. C. 1512]] or the chapters or colleges or convents of churches and monasteries, and likewise all who knowingly shall have given counsel, aid or favour to the aforesaid occupiers and detainers in such occupation or detention, publicly or secretly, are subject to excommunication; but the chapters, colleges, or convents of churches and monasteries, as well as the universities of cities, castles, villages and other places, and the same cities, castles, villages and places, which shall have been culpable in these matters, and also cities, castles and places in which such detainers and occupiers shall have obtained temporal dominion, if such temporal lords shall place an obstacle in releasing the aforesaid goods and restoring them to the master and brothers of the order and of the same hospital, in the name of the same hospital, and shall not desist from such aforesaid matters within the said month, after they shall have been required concerning this, as is premitted, we decree by sentence that they are subject to interdict, from which they cannot be absolved, until they shall have taken care to exhibit full and due satisfaction concerning these matters. And nevertheless such occupiers and detainers, or those furnishing to them, as is premitted, aid, counsel or favour, whether singular persons or chapters, colleges, or universities of cities, castles, lands or other places, besides the penalties prescribed, we decree that they are deprived, ipso facto, of all things which they hold in fief from the Roman or any other Churches whatsoever, whether singular or plural. So that those things may freely revert to the Churches to which they belong without any contradiction, and the prelates or rectors of those Churches may dispose of them according to their will, as they shall see expedient for the utility of the same Churches.
