MOTU PROPRIO

3 II. Sacrae Romanae Congregationes nova Decreta Generalia iamnunc ne ferant, nisi qua gravis Ecclesiae universae necessitas aliud suadeat.

BENEDICT XV, POPE
MOTU PROPRIO
CUM IURIS CANONICI
A COMMISSION IS ESTABLISHED FOR THE AUTHENTIC INTERPRETATION OF THE CODE OF CANONS.

1 Since We have promulgated the Code of Canon Law, compiled by order of Our predecessor of happy memory Pius X, not long ago, fulfilling the expectation of the entire Catholic world, the good of the Church and the very nature of the matter itself certainly demand that We take care, as far as possible, lest the stability of so great a work be ever brought into jeopardy either by uncertain opinions and conjectures of private individuals concerning the true meaning of the canons, or by frequent changes in new laws. Wherefore it is Our purpose to meet both these inconveniences; and in order that We may do this, by Motu Proprio, with certain knowledge and mature deliberation on Our part, We hereby establish and decree the following:

2 I. Following the example of Our predecessors, who entrusted the interpretation of the decrees of the Council of Trent to their own assembly of Cardinal Fathers, We establish a Council or Commission, as it is called, to which alone shall belong the right to interpret authentically the canons of the Code, yet having heard, in matters of greater importance, that Sacred Congregation whose proper concern is the matter proposed for the Council's decision. We will that this same Council consist of several Cardinals of the Holy Roman Church, one of whom shall preside over the assembly, to be chosen by Our Authority and that of Our successors; to these shall be added both a man of proven ability, who shall be Secretary of the sacred Council, and several Consultors from both the secular and regular clergy, experts in canon law, to be designated by the same Authority; but the Council shall have the right to ask also the opinion of Consultors of the Sacred Congregations, each in his own matter.

3 II. The Sacred Roman Congregations shall henceforth issue no new General Decrees unless grave necessity of the universal Church suggest otherwise. Their ordinary function in this matter shall be both to ensure that the prescriptions of the Code are religiously observed, and to issue Instructions, if the matter warrant it, which may bring greater light and efficacy to those same prescriptions of the Code. Documents of this kind shall be drawn up in such a way that they shall not only be, but shall also appear to be, as it were, certain explanations and supplements to the canons, which for this reason shall be most appropriately cited in the context of the documents.

4 III. If ever, in the course of time, the good of the universal Church shall require that a new general decree be issued by some Sacred Congregation, that same Congregation shall draw up the decree, and if it dissent from the prescriptions of the Code, it shall inform the Supreme Pontiff of such discrepancy. The decree, having been approved by the Pontiff, the same Sacred Congregation shall refer it to the Council, whose duty it shall be, according to the tenor of the Decree, to draw up a canon or canons. If the decree dissent from the prescription of the Code, the Council shall indicate which law of the Code the new law is to supplement; if the decree concern a matter on which the Code is silent, the Council shall determine in what place the new canon or new canons are to be inserted into the Code, by repeating the number of the canon which immediately precedes it, thus, ter, etc., lest any canon be moved from its place or the series of numbers be disturbed in any way. All these things shall be reported in the Acta Apostolicae Sedis immediately after the Decree of the Sacred Congregation. All and each of those things which We have seen fit to decree in this matter, We will that they be and remain ratified and firm, just as they have been decreed, and We command this: notwithstanding anything to the contrary whatsoever.

5 Given at Rome at St. Peter's, on 15 September in the year 1917, in the fourth year of Our Pontificate.
