IV, Constit. xvii, Inter, pag. 52; in Callisto III, Constit. i, Quae laudabili, pag. 116; Sixto IV, Constit. i, Dispositione, pag. 203; ac Innoc. VIII, Constit. vi, Cum sicut, pag. 614.

Testo inglese
of Spoleto and Terni exempts, — 3. And commits their governance to clerics of the Apostolic Chamber, — 4. Notwithstanding anything whatsoever.
1 Innocent, bishop, servant of the servants of God, for perpetual remembrance of the matter.
2 Although by the solicitude of the pastoral office committed to us, albeit unequal to it, by divine disposition, we are bound to think continually of the salutary and peaceful state of all the Christian faithful, nevertheless the fortresses and places subject to the temporal dominion of the Roman Church, and their inhabitants, we embrace with greater affection, and that they may be governed both in time of peace with prosperous and happy administration, and in the turbulence of wars that may occur, be more easily defended and preserved unharmed by the providence and solicitude of watchful governors together, as the quality of times and places being weighed, and their utility and the state of the same Roman Church in the Lord we perceive to be expedient, we provide the appropriate remedy.
3 (1) Concerning their duty, jurisdiction and privileges you have above in Eugenius IV, Const. xvii, Inter, p. 52; in Callistus III, Const. i, Quae laudabili, p. 116; Sixtus IV, Const. i, Dispositione, p. 203; and Innocent VIII, Const. vi, Cum sicut, p. 614.
4 § 1. Indeed the fortresses of Caesars, Porcaria, Maccastra, Quercino, Puriano, Colliscampi, Masserani, Ficaia, Cisterna, Florenzola, Scoppi, Fogliano, Rappiciano, Palazzo, Aretio, Cordigliano, Magliano, Buellario, Mantrellarum, Balutio, Sterpeto, Apollinacio, Poggio, Appecano, Aquae Palumbae and Valle Perachiae, and other fortresses and places of the lands of the diocese of Spoleto specially committed to the immediate subjection of the Holy Roman Church, or some of them, which from time immemorial have been held and are held as patrimonial and peculiar to the Apostolic See and the Holy Roman Church by special prerogative, as the documents of our predecessors the Roman Pontiffs hitherto testify; and their inhabitants and dwellers, beloved sons, on account of the dissensions, differences, scandals and turbulence of wars, which in previous years have occurred between the beloved sons of the communities of our cities of Spoleto and Terni and others, even on occasion of that governance, have suffered so many slaughters of men, robberies, plunderings and other most grave losses, that unless opportune remedies be applied to these matters, lest similar things happen in the future, it is to be feared with likelihood that these fortresses and places or a great part of them may, not without grave loss to us and the Apostolic Chamber, be destroyed, laid waste, or be abandoned by their inhabitants.
5 § 2. We therefore, who amid various cares by which we are continually pressed, are especially solicitous for that which pertains to the governance of the lands and places subject to the same Roman Church by superior authority of cities, that they may be governed under a state of tranquility and the pleasantness of peace, being willing to provide thereupon, as it is incumbent upon us, the fitting remedy, and to root out entirely, so far as is possible to us, the seeds of such questions, scandals and wars; and considering that if such castles and places were to be subjected to the governance and administration of our beloved sons, the clerics presiding over the aforesaid Camera, to whom the care of all the lands and places of the Holy Roman Church in temporal matters is especially committed, their inhabitants and dwellers aforesaid would rejoice to have received such praiseworthy rulers, with the greatest advantage to themselves, having held mature deliberation upon these matters with our brothers, the cardinals of the same holy Roman Church, and by their counsel, all and singular the aforesaid castles and places, with all and singular their inhabitants and dwellers, their goods and things, and the districts, territories, boundaries, villages, fortresses, fortifications, hamlets, mountains, vineyards, forests, meadows, pastures, groves, waters, water conduits, rivers and river beds, torrents, fisheries, mills, cultivated and uncultivated lands, jurisdictions and all other rights and things of the same, from all superiority, dominion, governance, regime, power of Spoleto and Foligno and any other cities whatsoever and their communities and any other superiors and governors of any kind; as well as from all jurisdiction, superiority, power and burden, inferiority, recommendation and subjection, real and personal of any kind whatsoever, perpetual or temporal, in which the aforesaid castles and places and each of them, to the cities and communities aforesaid and to each of them, even from any causes whatsoever in any manner, were bound and held, by apostolic authority, from our certain knowledge, by the tenor of these presents, we entirely exempt and totally free; and we decree and declare that they are exempted and freed, and that Spoleto and Foligno aforesaid, or any other community and any other governor, in the aforesaid castles and places, or any of them, and their inhabitants and dwellers present or future, and the districts, boundaries, goods, rights and things of the same, can in no way exercise or have any jurisdiction, superiority, governance, arbitrium or other power, from like certain knowledge.
6 § 3. And nevertheless all and singular the castles, places, inhabitants, dwellers, districts, territories, places and things of the same, we subject and will to be subjected to the governance and administration of the clerics of the aforesaid Camera, by like counsel and knowledge, specially, expressly and immediately, saving always the ordinary revenues of the aforesaid Camera due, from which we will that the customary burdens for the custody of the fortress of the said castle of the Caesars be paid. And moreover, to the college of clerics aforesaid by the same tenor we commit and command that they receive and have all and singular the aforesaid castles and places, their inhabitants, goods, rights and things under their governance and regime of this kind, and prudently rule and govern them, and treat them benignly, under the due balance of justice, causing all the aforesaid to be inviolably observed, not permitting them and any of them to be infringed in any way by the aforesaid communities or any others whatsoever, of whatever status, preeminence, dignity, authority and condition they may be, or the places, castles and inhabitants, dwellers aforesaid to be molested in any way contrary to the tenor of these presents. Compelling any contradictors and rebels by ecclesiastical censures and other fitting remedies of law, appeal being set aside.
7 §4. Notwithstanding the aforesaid apostolic constitutions and ordinances, as well as statutes, municipal laws and prescriptions of places, and any privileges, indults, immunities, exemptions, donations, alienations, concessions, dispositions and letters, whether granted by any Roman Pontiffs or by us and the Apostolic See, under whatever forms and clauses of words, even with derogatory clauses derogatory to those, and other stronger, more efficacious and unusual irritant and other decrees; and also by motu proprio and similar knowledge, and from the fullness of apostolic power, and from whatever even the greatest and most urgent reasons and necessities, even with similar counsel, to the same communities, governors and persons and to any others whatsoever commonly or severally heretofore in any manner whatsoever granted and made and confirmed, approved and renewed nominally, specially and expressly, and in the future perhaps to be granted, made, confirmed, approved and renewed. Which also, for their sufficient derogation, and as if concerning them and their whole tenors special, specific, express and individual etc., and word for word were inserted, holding as sufficiently expressed, as far as the aforesaid only, by the tenor of these presents, with the same knowledge specially and expressly we derogate, and we will and decree that they shall benefit no one at any time whatsoever, and all things contrary to these in any way.
8 Given at Rome at St. Peter's, in the year of the Lord's Incarnation 1502, 3 days before the Kalends of May, in the tenth year of our pontificate. Given on 29 April 1502, pontificate year x. vi PP.
