Testo inglese
1 of God's mercy, for the management of hospitals for the care of the poor sick recently established, under the ordinary correction and Rule of St. Augustine. Pius, bishop, servant of the servants of God, for perpetual remembrance of the matter.
2 Although by the duty of the supreme pontifical office enjoined upon us from above, it behooves us to be attentive to the progress of pious places of any kind whatsoever, nevertheless concerning hospitals and the miserable persons dwelling in them for the time being, for their comfort, utility and assistance, we ought to apply ourselves to such studies with all the greater diligence, inasmuch as, weighing their miserable condition, we perceive it to be salutary in the Lord to expedite.
3 § 1. Indeed, a petition was recently presented to us on behalf of the Hospital by our beloved son Roderigo Seguenza, containing certain matters concerning a confraternity established in the Spains, called the greater confraternity, of the hospital called the Hospital of St. John of God, of the city of Granada, for the care of the sick. And concerning the cancellation of that matter, and the greatest abundance of alms. And around that matter the number of foreigners for its business is accustomed to flow there as an impediment to the transaction of affairs, and one greater one called and eight or ten others were standing. The hospital itself, the confraternity, with the election of a confraternity greater one called, rendering obedience, are found, those who in alms for the same hospital, in which various poor of Christ, namely the incurable, the aged, the mentally afflicted and those weak in limbs, ascending to the number of four hundred and beyond, are continuously cared for in their infirmities, and are nourished, and for whose care and nourishment a sum of sixteen thousand ducats and beyond, arising from alms customarily distributed by pious Christian faithful to the same confraternity, is expended each year, seeking and governing those poor of Christ with their charity they expend their labor, and in the same hospital the number of the aforesaid poor of Christ, on account of the war waged in the kingdom of Granada against the Moors in the year above, has been greatly increased, and alms are made less frequently than before they are accustomed to be made today; and the same confraternity members with the greatest labor and for their undertaken work are by no means to be hindered, but with the greatest fervor they ought to pursue this work so praiseworthy continuously. Nevertheless, with human malice increasing, certain laymen, led by avarice, and setting aside the fear of God, having accepted the habit, called a capotto, of cloth commonly called layal in those parts, which the same confraternity members are accustomed to wear, under a false name, both of the said city and of the city of Córdoba as well as of Madrid, Toledo and of the towns of Lucena of the dioceses of Toledo and Córdoba respectively, of hospitals founded in the manner of the said hospital of Granada, and in which similar works of charity, which are accustomed to be exercised by the confraternity members of the said hospital of Granada, they have dared to seek alms and to convert those alms to wicked and damnable uses of their own, to the greatest detriment of the necessary assistance of poor Christian faithful existing in the same hospitals for the time being.

5 § 2. Since, however, as the same petition set forth, the said Rodericus, in order that the aforesaid obstacles might be more easily removed from the way, desired that to himself and to others, both the provision already made for the hospitals of Granada and Córdoba and of Lucena and of other towns, and those to be erected hereafter in like manner, to the confraternity members, now and for the time being existing, a scapular of the same layal cloth should be worn over the garment or cape customarily worn by them down to the knees, so that they themselves might be more easily recognized by all the Christian faithful offering alms to them for the aforesaid purposes, and distinguished from others among their confraternity members not existing, and from those wickedly and maliciously seeking alms under the false name of the said hospitals or any of them; and also that in each of the same hospitals and others to be erected in like manner, there should be had and retained among them one priest confraternity member in similar habit and scapular, who should celebrate masses and other divine offices therein, and minister the ecclesiastical sacraments both to the confraternity members themselves and to the poor of Christ existing in the same hospitals for the time being, and should instruct and comfort them in piously observing the commandments of God; and also that alms for the support of the poor of Christ in the same hospitals might be sought and received, not only in the cities and towns in which the hospitals themselves are situated, but also throughout the whole district, diocese and province thereof, with the permission of the local ordinary, he humbly caused supplication to be made to us, that we should deign to provide opportunely in the aforesaid matters out of apostolic benignity, to consult the welfare of the said hospitals and the poor of Christ existing in them now and for the time being. § 3. We, who sincerely desire in our affections the consolation and support of the poor of Christ, wishing to cherish Rodericus and his confraternity members in so pious and praiseworthy a purpose, and absolving the same Rodericus from all excommunication, suspension and ecclesiastical interdict and censures and penalties, imposed by law or by any occasion or cause whatsoever, if he is bound by them in any way, solely for the purpose of obtaining the effect of these presents, and holding him absolved, being inclined to these supplications, to the same Rodericus and to all and each of the other confraternity members of the said hospitals now and for the time being existing, provided that they live under the Rule of St. Augustine, we grant and bestow by apostolic authority, by the tenor of these presents, perpetually, the license and faculty that they may have a scapular of the same layal cloth to be continuously worn over their garment or cape customarily worn by them down to the knees, and also that in each of their hospitals there may be a priest who is a confraternity member, wearing a similar habit of the same cloth, yet larger and broader and more befitting sacerdotal dignity, to be designated at the discretion of the local ordinary for the first time; and that they may freely and lawfully seek and receive alms for the aforesaid hospitals and their poor of Christ, both in the cities and towns in which the hospitals themselves are situated, as aforesaid, and throughout their whole districts, dioceses and provinces, from all Christian faithful, and convert the same to the uses and support of the said hospitals and their poor of Christ.
6 § 4. Moreover, we place and subject both the said priest and the one called the superior and the other confraternity members of this kind under the jurisdiction, correction, visitation and obedience of the local ordinary, even perpetually; and the same superior and other confraternity members ought to render a lawful account to the local ordinary alone and to no other, in the time approved by him, of the administration of such alms, each year.
7 § 5. Moreover, we perpetually establish and ordain that the aforesaid modern and future confraternity members of the same hospitals, after they have received the aforesaid habit, shall not dare or presume to lay it aside or exhibit it to anyone except with the consent of all the other confraternity members of the hospital in which the habit itself happens to be exhibited, under the penalty of the sentence of major excommunication incurred ipso facto.
8 § 6. Likewise to all and each of the ordinaries of Masonry, of whatever status, grade, order and condition existing in the governance and condition of hospitals, except the ordinaries of the places, we command that it is not to be given; we strictly forbid that they dare or presume in any way to intermeddle in the governance, administration or management of the same hospitals or others to be chosen in like manner, under the said penalty to be incurred in like manner by those contravening, in fact. Decreeing that the greater one called and the other confratres of such hospitals now and for the time being existing, concerning the free administration, governance and management of the said hospitals, by whatever persons, of whatever status, grade, order and condition existing, even under the pretext of their fabrications in whole or in part, even from whatever pious bequest or otherwise made in any way whatsoever, are in no way able to be molested, disturbed, vexed or disquieted.
9 § 7. And these present letters at no time by the vice of surreption or obreption or of our intention or by any other defect are able to be noted, impugned or invalidated, or in law or controversy in any manner or cause to be called, or to be reduced to the terms of law, or any other remedy of law or grace against them to be obtained; and the cause or causes on account of which we have appointed a preservation to this constitution; these same letters have emanated from us, before the ordinary of the place or whatever other judge, even delegated and exercising whatever faculty, are not to be verified, nor on that account to lack force, or to be obtained through obreption; nor less is the said Rodericus bound to verify the aforesaid, and less, under whatever, similar or dissimilar, graces, as much by us as by the Roman Pontiffs our successors, in whatever manner and with whatever, even derogatory clauses with derogations of derogations and other more efficacious and unusual clauses, irritant and other decrees made for the time being, of whatever tenor they exist, to be included, but those notwithstanding, in their force, vigor and efficacy to persist, and as often as those emanate, so often into their pristine and most valid status to be restored and fully reintegrated, and under the date to be chosen by the said Rodericus and for the time being existing greater one called confrer of the said hospital of Granada, anew to be granted, and thus to be of our unchangeable will and intention. And thus by whatever judges and commissioners, exercising whatever authority, taken away from them and from each of them whatever faculty and authority of judging and interpreting otherwise, to be judged and defined; and null and void if otherwise concerning these things by anyone, whatever authority, knowingly or unknowingly, should happen to be attempted.
10 § 8. Wherefore to our venerable brothers in Christ the archbishop of Granada and the bishops of Amerino and Cordoba, by apostolic writings we command that they themselves or two or one of them, by themselves or by another or others, these present letters and whatever is contained in them, where and when it shall be necessary, and as often as for the part of the said Rodericus or the greater one called for the time being existing of the same hospital of Granada confrer they shall have been requested, solemnly publishing, and assisting them in the aforesaid with the protection of effective defense, shall cause by our authority the aforesaid Rodericus and for the time being existing greater one called and the other confratres aforesaid, all and each of the aforesaid, according to the content and tenor of these presents, peacefully to enjoy and to have joy; not permitting them or any one of them to be molested, disturbed or disquieted by anyone in any way indebitably. Contradictors of whatever kind and rebels and those not obeying the aforesaid by censures and ecclesiastical penalties and other appropriate remedies of law, appeal being set aside, to be restrained; and legitimate processes being observed concerning these matters to be had, declaring those to have incurred these censures and penalties, and also aggravating them even by repeated occasions; invoking also for this, if it shall be necessary, the aid of the secular arm.
11 § 9. Notwithstanding the felicitous memory of our predecessor Pope Boniface the Eighth, on the one hand, and of a general council on two matters, provided that no one, by virtue of the present [letters], shall be drawn to judgment on the last three matters, and [notwithstanding] all other apostolic [constitutions] as well as those issued in provincial and synodal councils, general or special constitutions and ordinances; and also [those] strengthened by oath, apostolic confirmation or any other firmness, statutes and customs; also privileges, indults and apostolic letters, [granted] to any Orders and places and their superiors and persons, under whatsoever tenors and forms, and with whatsoever clauses and decrees, even by our own motion and from certain knowledge and from the fullness of apostolic power, in any way whatsoever granted, confirmed and renewed to the contrary; all of which, even if special, specific and express mention of them and of their entire tenors, or any other expression, ought to be had or some other exquisite form to be observed for this, we hold the same to be sufficiently expressed by these presents, and otherwise remaining in their force, on this occasion only, we specially and expressly derogate from them, anything to the contrary notwithstanding; and if to any, commonly or individually, it has been indulged by the same See that they cannot be interdicted, suspended or excommunicated through apostolic letters not making full and express and word-for-word mention of this indult.
12 Let no one therefore [be permitted to infringe this document of our derogation, or to act contrary to it with rash boldness. If anyone shall presume to attempt this, let him know that he will incur the wrath of Almighty God and of the blessed Apostles Peter and Paul].
