Bolla che istituisce l'Archivio Generale in Roma

Bolla di papa Urbano VIII ·

CLXX.
Istituzione dell'archivio generale in Urbe.

CLXX.
Institution of a General Archive in the City | Urban, Bishop, servant of the servants of God, for perpetual memory of the matter.

1 The care of the pastoral office entrusted to us, Preamble. though we are unworthy of it, by divine disposition, constantly strikes and moves our heart, so that we may direct the attention of our vigilance not only to those things which regard the salvation of souls, but also to those which are known to pertain to the utility, peace, tranquility, and perpetual security of peoples, especially of our beloved City and of those subject to us and to the temporal dominion of the Apostolic See, and especially to those harms which, on account of insufficient and not sufficiently exact diligence in preserving both public and private writings, we understand to arise and flourish frequently among our subjects with grave distress to us and to them, and loss of their fortunes; that we may provide by some suitable means, and, for the happy progress of those things which are therefore ordained by us, commit their care to the prudence of distinguished men, by whose work and zeal they may be happily governed, and disputes may be more easily terminated, as we perceive in the Lord it will be expedient for the fulfillment of justice and the quiet of those same subjects.1 Causes of the § 1. Since therefore (from the multiplicity and diversity of notaries of the City, and the incompetence and negligence of some of them, and from the confusion of instruments and other writings, and careless custody, many losses and inconveniences are inflicted upon our subjects and others, and the greatest detriment to public faith is brought about daily, and the same is placed in no small peril of falsifications and frauds, and conversely from diligent care of those same instruments and writings all falsifications and frauds are avoided, the dominion of things and rights are preserved to each, and other not inconsiderable goods come about, we have sufficiently explored and abundantly perceived; and in most domains and foreign regions, and also by the authority of our Roman Pontiff predecessors in almost all cities and places of our Ecclesiastical State public and general archives, and in our City itself certain particular ones, namely the Capitoline and of the Roman Curia, and perhaps others, have been erected and instituted, yet we observe that some of these have fallen into disuse, others are deficient in many respects, and through them such inconveniences, losses and frauds, and their perils are not sufficiently provided for; and recalling from the annals of sacred history that the Roman Church once had a public archive under the name of the chartulary, and that the office of chartulary was of great dignity and authority in that same Roman Church and Apostolic See; and wishing, as far as in us lies, to meet the aforesaid matters), we judge that our aforesaid subjects and all others could not be better consulted in any other way than through the erection of a public and general archive in the said City, to which public instruments and other writings drawn up by the notaries of that City and others underwritten should be brought for the time being and preserved in it, for the ornament of that City and the Roman Curia, and for the safe and perpetual preservation of instruments and writings, the security of our subjects and others, and the public and private utility of all, we have decreed to proceed to such an erection.

2 Iure.

3 that troubles and misfortunes of theirs we understand to arise and flourish frequently, we should provide for them by some suitable means, and, for the happy progress of those things which are therefore ordained by us, we should entrust their care to the prudence of distinguished men, by whose work and diligence they may be happily governed, and disputes may be more easily terminated, as we perceive it expedient in the Lord to accomplish readily for the fulfillment of justice and the peace of those same subjects. § 1. Since therefore (from the multiplicity and diversity of notaries of the City, and the inexperience and negligence also of some of them, and from the confusion of instruments and other writings, and careless custody, very many losses and inconveniences are inflicted upon our subjects and others, the greatest detriment to public faith is brought about daily, and the same is placed in no small peril from falsifications and frauds, and conversely from the diligent care of those same instruments and writings all falsifications and frauds are avoided, the dominion of things and rights are preserved to each one, and other not inconsiderable goods come about—which we have sufficiently explored and abundantly perceived; and observing that in very many domains and foreign regions, and also by the authority of our predecessors the Roman Pontiffs in almost all cities and places of our Ecclesiastical State public and general archives, and in our City itself certain particular ones, namely the Capitoline and of the Roman Curia, and perhaps others, have been erected and established, yet some of these have fallen into disuse, others are deficient in many respects, and we perceive that through them such inconveniences, losses and frauds, and their perils are not sufficiently provided for; and recalling from the annals of sacred history that the Roman Church once had a public archive under the name of cartophylacium, and that the office of cartophylacium was of great dignity and authority in that same Roman Church and Apostolic See; and wishing, as far as in us lies, to remedy the aforesaid circumstances), we judge that our aforesaid subjects and all others could not be better consulted in no other way than through the erection of a public and general archive in the said City, to which public instruments and other writings requested by the notaries of that City and others written below should be brought for the time being and preserved therein, for the ornament of that City and the Roman Curia, and for the safe and perpetual preservation of instruments and writings, the security of our subjects and others, and the public and private utility of all, we have decreed to proceed to such an erection.

4 § 2. By Our own motu proprio, therefore, not at the instance of any petition offered to Us on this matter, but from certain knowledge and mere deliberation of Our own, and from the fullness of apostolic power, We do erect and establish in perpetuity, by apostolic authority, the general archive, to be called the Urbanum, under the protection and supreme superintendence of Our beloved son Francis, deacon cardinal of St. Agatha, named Barberini, Our nephew by the same father's brother, during his lifetime, and, after his death, one of the cardinals of the same holy Roman Church to be specially appointed for this purpose by the Roman Pontiff existing from time to time; in the said City, in a place near the square of the Prince of the Apostles of the City, designated by Us; and, for the good governance and administration of the same general archive, We do erect and establish in perpetuity, with all and singular the privileges, faculties, honors, preeminences and burdens set forth in the chapters subscribed by Our beloved son Anthony, presbyter cardinal of the holy Roman Church, named of St. Honorius, by Our mandate, and others also to be enlarged, moderated and declared at any time by the superintendent cardinal of the general archive existing from time to time, by apostolic authority, one office of conservator of the same general archive for one clerk or layman, a doctor of both laws, endowed with probity and experience of life and morals, and otherwise sufficient and suitable, to be called conservator of the Urbanum archive, to be placed at Our pleasure and that of the Roman Pontiff existing from time to time, to be appointed and removed; and We do apply and appropriate in perpetuity, by the said authority, for its endowment and for the sustenance, salary and emolument of him obtaining it from time to time, a sum to be designated in a particular chirograph, also subscribed by Our hand this very day, from the taxes and all rights, revenues, emoluments and other regalia contained and specified in the said chapters; and We will and declare that it be and is applied and appropriated from now on.

5 § 3. So that it may be lawful for the same conservator existing from time to time, through himself or through another appointed by him for this purpose, to exact, receive and retain the sum thus applied and appropriated from those to whom it shall pertain from time to time, and to convert it to his own uses and benefit, without any license from Us or the Roman Pontiff existing from time to time being required in this regard.

6 § 4. And (so that the aforesaid office thus erected and instituted, and he obtaining it from time to time, may be decorated by Us with more ample favors and graces) We decree that the conservator existing from time to time of the said archive shall be Our true, undoubted and not fictitious familiar and continuous table-companion, and shall be inscribed and aggregated in the number and company of Our other familiars and continuous table-companions by that very fact; and he shall wear garments of violet color in the manner of Our cubicularii called of honor, and shall use them at his discretion; and, as a sign of true and undoubted and not fictitious familiarity of this kind, We decree, and We command that there be given to him daily from the apostolic palace bread of the same quantity and quality as is customarily given to Our beloved sons, the referendaries in both Our signature, and We command that such bread be given to him daily from the said palace.

7 VIII Pope 389 Year G. 1625 of a color in the manner of our chamberlains called men of honor shall wear, and shall use them at his discretion; and, as a sign of true and undoubted and not feigned familiarity of this kind, we decree that on each day from the apostolic palace he shall have bread of the same quantity and quality, as it has been customary to be given to our beloved sons in both our signature office to referendaries, and we command that bread of this kind shall be given to him daily from the said palace.

8 § 5. To the general archive, moreover, all wills, trusts, instruments and legacies, codicils, donations causa mortis and other last wills, received and requested in any manner whatsoever by any public notaries of the City, even those having their offices held by us and the aforesaid See and apostolic chamber at onerous title, as well as by the parish priests of the same City, both within the City itself and outside it, and concerning sales, and resolutions and rescissions of sales, cessions, renunciations, transactions, divisions, payments in lieu, exchanges concerning and upon immovable goods and things made, as well as censuses and their extinctions, fiefs, subfiefs, and concessions in emphyteusis, livery, or under annual census, canon, or other payment, donations between living persons, insinuations, dowries and dotal pacts, acceptances of inheritances, repudiations, and inventories, emancipations, adoptions, arrogations, irrevocable rights of patronage, and mandates to sell and donate, perpetual sureties and other instruments described and noted more fully in the aforesaid chapters, and received and requested in any manner whatsoever, as aforesaid, by any notaries of the aforesaid City, both in the City and outside it, under the manner and form prescribed and ordained in the same chapters, we will, command and likewise mandate that they ought to be brought, and in it respectively received, noted and diligently and perpetually preserved and guarded.

9 § 6. Finally, our beloved son Camillus, a Florentine cleric, doctor of both laws, commended to us for learning, life and honesty of morals, and by other merits of probity and virtues in manifold ways, wishing to follow him with the favour of special grace for these reasons, the same Camillus, in whom we trust greatly in the Lord concerning his faith, learning, prudence, and experience in similar matters, we constitute and appoint as conservator of the said general archive at our and the aforesaid See's pleasure by our own motion and authority. To Francis, however, the cardinal, and to the other superintendents of the said general archive, as aforesaid, entrusted here with the duties of superintendents and governors, we grant the power to publish edicts, bans and proclamations concerning the aforesaid general archive or its affairs in any manner whatsoever for the time being, under his name, and under corporal penalties also pleasing to him, as often as it shall be necessary, and to declare, interpret, enlarge and renew those emanated for the time being, and to cause them to be carried out, as it shall seem more expedient to him; as well as all civil, criminal and mixed cases concerning the aforesaid matters and arising from their occasion for the time being brought, and appeals, reclamations, recourses, and restitutions in full from sentences, decrees and grievances issued, promulgated, or in any manner brought by the aforesaid Camillus and the conservator of the said general archive existing for the time being, with all and singular incidents, dependencies, annexes and connections, and all principal matters, even exclusively as to all others, by royal hand, simply and plainly, without the noise and form of judgment, and with judicial procedure not at all observed, and with all and any appeal, recourse, or restitution in full removed, by himself, or another, or others, to be appointed by Francis the cardinal and the superintendent and governor of the said general archive existing for the time being, to hear, to know, and to terminate and decide with due conclusion; and all other things whatsoever which pertain to the direction of the said general archive and its easy administration and governance, and otherwise which shall be necessary or in any manner opportune concerning the aforesaid matters, we grant and impart full and complete power, authority and faculty to ordain, command, do, conduct, exercise, dispose and execute.

10 § 7. Decreeing that these same present letters, even on the ground that the notaries and their colleges, to whom offices and writings have been found granted by us and by the Roman Pontiffs our predecessors and by the said apostolic chamber on a burdensome title or otherwise, were not called and heard, or on the ground that the aforesaid proceeded without any cause subsisting and even in fact, or on any other however juridical and legitimate cause, even necessarily to be expressed, or under whatever pretext, on account of the vice of surreption or obreption, or nullity, or of our intention, or any other defect, may be impugned, invalidated, retracted, and reduced to the terms of law, or recalled into law or controversy, or any remedy whatsoever of law, grace, or fact be obtained against them, or even by our motion, knowledge and fullness of power similar remedies be granted, or under whatever constitutions and rules of the apostolic chancery issued and to be issued, and apostolic letters issued to the contrary, even by equal motion and consistorially, or whatever other revocations of similar or dissimilar graces, suspensions, limitations, or other contrary dispositions, can in no wise at any time be comprehended. Aff. C. 1625 Clauses for the firmness of the present letters.

11 1 Edit. Main. has superintendentes (r. t.). but always to be excepted by them, and as often as those shall emanate, so often to be restored to their pristine and the state in which they were, most valid, replaced and fully reintegrated, and anew also under whatever later date by the cardinal superintendent and conservator of the said general archive existing for the time being whenever to be elected granted, valid and effective, even though in the said apostolic chamber at no time whatever they should be presented or registered, to be and to be;

12 § 8. Thus, and not otherwise, by whosoever judges, even auditors of causes of the apostolic palace, and presidents of the apostolic chamber clerics, and also the camerlengo of the same holy Roman Church, and other cardinals, taken away from them and from each of them whatever facility of judging and interpreting otherwise, to be judged and defined, also null and void, if otherwise concerning these things by anyone, whatever authority, knowingly or unknowingly, should happen to be attempted. Designation § 9. Wherefore to our beloved sons the governor of our City, and the general auditor of causes of the said court of the chamber, and our beloved son in the same City, and its district vicar general in spiritual matters locum tenens in civil causes by equal motion through apostolic writings we command, that they, or two, or one of them, through themselves, or another, or others, the present letters, and whatever things contained in them, where and when it shall be necessary, and as often as for the part of Cardinal Francis and Camillus aforesaid, and for the time being existing protector and conservator of the said archive, they shall have been requested, solemnly publishing, and assisting them with the protection of effective defense, may cause the same present letters, and the things contained in them thus, by all to whom it pertains and for the time being shall pertain, firmly and inviolably to be observed; and Cardinal Francis and Camillus, and for the time being the executors.

13 VIII PP. 391 An. C. 1625 existing protector and conservator thus, them peacefully to enjoy and to rejoice, not permitting them to be molested thereupon by whosoever in any way indebitably; whatever contradictors and rebels through censures and ecclesiastical penalties, and other opportune remedies of law and fact, appeal being set aside, to be restrained, and the sentences, censures and penalties themselves, the form of the Council of Trent being observed, even by repeated times to be aggravated, invoked also for this, if it shall be necessary, the aid of the secular arm.

14 § 10. Notwithstanding the aforesaid, and, insofar as it has been necessary up to now, our right of not taking away sought, and of happy memory Pope Pius IV, also our predecessor, under the date namely eight days before the Ides of August, in the sixth year of his pontificate issued, among other things providing, that all grants whatsoever concerning the chamber should be presented and registered in the same chamber within a certain time expressed there, and by other constitutions and apostolic ordinances, and of the City and of other whatsoever cities, places, towns, districts, and also of colleges, monasteries, churches and other pious and non-pious places, even by oath, apostolic confirmation, or any other firmness, strengthened, statutes, reforms, decrees and customs, privileges also, indults and apostolic letters, exemptions, immunities and concessions of offices and notariates, even by title of payment, both by us, and by the Roman Pontiffs our predecessors and the aforesaid chamber, even by way of contract, or otherwise in any manner, both the aforesaid all and singular, and also judges, officials, writers, notaries, and their colleges and superiors, and the said chamber, and its causes-1 This frequently cited constitution is read in vol. vii, p. 375 (r. t.).

15 to the auditor general and fiscal procurator, and also to other persons, under whatsoever tenors and forms, and with whatsoever clauses and decrees, even by similar motion, even in consistory, and otherwise, granted, approved and renewed in any way to the contrary, and to be granted, approved, confirmed and renewed in the future: all of which, even if special, specific, express and individual mention of them and their entire tenors, and not by general clauses importing the same, or some other exquisite form to be observed for this, should have been made, we, holding the tenors of these things as sufficiently expressed herein, which would otherwise remain in their force, do on this occasion also by this similar motion specially and expressly derogate, and will and command that they be derogated, notwithstanding anything to the contrary: or if to any, commonly or severally, it has been granted by the same See that they cannot be interdicted, suspended, or excommunicated by apostolic letters not making full and express and word-for-word mention of this indult. We will moreover that these same things to be done, together with the chapters, as aforesaid, to be made, so that all may know of them, be published and affixed at the doors of the basilica of the Prince of the Apostles of the same City and at the aforesaid apostolic chancery and in the place of the Campus Florae, copies being left there, which shall bind all equally, as if they had been intimated to each personally; and to the transumpts and copies, even printed, of these same presents and of the chapters, as aforesaid, to be made, and subscribed by the hand of some public notary, and furnished with the seal of some person constituted in ecclesiastical dignity, that faith be given entirely, as much in judgment as outside, as would be given to these same presents, if they were exhibited or shown.

16 § 13. Let no one whatsoever be permitted to infringe this page of our erection, institution, application, appropriation, precept, constitution, deputation, impartition, decrees, derogation, mandates and will, or to contravene it by rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God, and of the blessed Apostles Peter and Paul, his.
