1 Recenti Decreto Ut debita diei xi mensis Maii MCMIV (2), haec S. Congregatio, varias complexa leges ante iam latas de Missarum oneribus religiose adimplendis, adiectis opportunis declarationibus interpositâque severa sanctione, providere studuit ut res omnium sanctissima summo apud omnes in honore esset, periculumque amoveretur, ne quis ullo modo piis fidelium voluntatibus quidquam detraheret. Hae tamen quum essent Sedis Apostolicae curae et Episcoporum solli- (1) Cfr. Acta S. Sedis, vol. 39, pag. 6o3.

5 At malo radicitus extirpando Emi Patres necessarium insuper censuerunt huc usque praescriptis nova quaedam addere. Itaque re discussa primum in Congregatione diei 23 mensis Martii 1907, ac denuo in sequenti die 27 Aprilis, sub gravi conscientiae vinculo ab omnibus servanda haec statuerunt:

6 I. Ut in posterum quicumque Missas celebrandas committere velit sacerdotibus, sive saecularibus sive regularibus extra dioecesim commorantibus, hoc facere debeat per eorum Ordinarium, aut ipso saltem audito atque annuente (i).

7 II. Ut unusquisque Ordinarius, ubi primum licuerit, suorum sacerdotum catalogum conficiat, déseribatque Missarum numerum, quibus quisque satisfacere tenetur, quo tutius deinceps in assignandis Missis procedat.

8 III.

Letters concerning the satisfaction of Masses.

1 By a recent Decree Ut debita of the 11th day of the month of May, 1904 (2), this S. Congregation, having gathered together various laws already previously enacted concerning the religious fulfillment of the burdens of Masses, and having added opportune declarations and interposed severe sanctions, endeavored to provide that this most holy matter be held in the highest honor by all, and that the danger be removed lest anyone in any way detract anything from the pious intentions of the faithful. Yet although these matters were the concern of the Apostolic See and the solicitude of Bishops— (1) Cfr. Acta S. Sedis, vol. 39, pag. 603.

2 From the S. Congregation of the Council 35 —abuses and violations of the law did not cease to occur, concerning which the same Sacred Congregation judged that the vigilance of the Prelates should be aroused anew.

3 For it is evident that not a few, notwithstanding the most well-known canonical prescriptions, have not hesitated to diminish something from the Masses received by their own hand, retaining for themselves a portion of the money, and committing the Masses themselves to be celebrated by others, perhaps led by the opinion that this was permitted to them either on account of the assent of the priest, receiving it with a mind more or less equitable, or on account of the purpose of aiding some pious work or exercising charity. There were also those who, contrary to laws so often inculcated, especially contrary to no. 3 of the same Decree, adopted this kind of practice for themselves, that they would gather together from everywhere the greatest number of Masses which they could. Whence it has happened more than once that a huge abundance of them has been heaped up in the hands of private individuals; and therefore it has remained exposed to the danger which, indeed, even setting aside human malice, always threatens things committed to private trust.

4 Finally, there have been found those who, departing from the express law of no. 5 of the Decree, have entrusted Masses to be celebrated not only more abundantly than was permitted to distribute to private persons, but also inconsiderately; when they have entrusted them to priests unknown to them, deceived by the appearance of some name or title, or moved by the recommendations of others, who neither knew them plainly, nor had sufficiently understood the gravity of the assumed burden. In order to meet such disturbances of discipline and to ward off as much as possible the most grave damages which the violation of the Decree Ut debita is wont to bring about, this S. Congregation, carrying out the orders of His Holiness Pope Pius X, admonishes all Bishops and other Ordinaries to exercise all care and vigilance in a matter of such importance, and to instruct the clergy and administrators of pious legacies what great dangers arise from the non-observance and contempt of the law; by which burden their conscience may be weighed; how rashly they set their own judgment before the laws 36 From the S. Congregation of the Council which long experience of things has placed for the protection of this most august matter; by what guilt finally they bind themselves; to what penalties they become liable.

5 But in order to root out the evil thoroughly, the Eminent Fathers judged it necessary moreover to add certain new prescriptions to those hitherto laid down. Accordingly, the matter having been discussed first in the Congregation on the 23rd day of the month of March, 1907, and again on the following 27th day of April, under a grave bond of conscience to be observed by all, they have decreed these things:

6 I. That henceforth whoever wishes to entrust Masses to be celebrated to priests, whether secular or regular dwelling outside the diocese, must do this through their Ordinary, or at least with the same being heard and consenting (1).

7 II. That each Ordinary, as soon as it shall be possible, shall make a catalogue of his priests, and shall describe the number of Masses which each is bound to satisfy, so that he may proceed more safely henceforth in assigning Masses.

8 III. Finally, if any, whether Bishops or priests, wish henceforth to send Masses, of which there should be an abundance, to Prelates or priests of churches which are situated in the East (2), they must always and in each case do this through the S. Congregation for the Propagation of the Faith.

9 All these matters having been reported by the undersigned Secretary to His Holiness in an audience on the 28th day of the month of April, His Holiness approved and confirmed the deliberations of the Eminent Fathers, and ordered them to be published, nothing whatsoever to the contrary notwithstanding.

10 Given at Rome on the 22nd day of the month of May, 1907.
