Bull reserving ecclesiastical benefices to the Apostolic See

Bull of Pope John XXII ·

1 ■10 asses XXIL (year 1316. Avignon,) From the duty of pastoral care, which, although unworthy, has been committed to us by supreme disposition, intending to meet with suitable remedies, as much as is granted to us from on high, the perils of souls and the losses of churches and monasteries, which on account of their prolonged vacancies are wont to befall them more frequently, so that provision may be made more speedily and usefully to the aforesaid churches and monasteries, and so that honor due may be paid to the Roman Church, which by divine providence is known to hold the primacy over these same churches and monasteries, following in the footsteps of our predecessors, the Roman Pontiffs, especially of blessed memory Boniface VIII, who reserved dignities of personatus, churches and other ecclesiastical benefices, and of Clement V, who reserved both such dignities, personatus, churches, benefices, and cathedral churches of any kind, monasteries, priorships, administrations and any offices whatsoever, which might be vacant at the Apostolic See, to apostolic provision under certain terms, we, from causes reasonable, which have moved our mind to this, taking away some things by the counsel of our brethren, declaring some things, and adding certain things anew, episcopal sees and their superior sees, monasteries and regular churches, to which those who are to be placed over them for the time being are also assumed even by canonical election, priorships, offices or administrations of the same, dignities, personatus, prebends, and other ecclesiastical benefices, with cure or without cure, by whatever name they may be called, which are vacant at the aforesaid See at present, and henceforth, (as long as the dignity of Christ shall deign to have us preside over the governance of the universal Church, His spouse,) shall come to be vacant at the same, we reserve to our provision by the counsel of our brethren with apostolic authority. These sees, monasteries, churches and other aforesaid ecclesiastical benefices, through the death or deposition, and privation of those who held them, through the cassation of elections, the rejection or repulsion of provisions, the renunciation of any provision, translation, or through the succession of the office of consecration or blessing formerly bestowed by the said Clement, our predecessor, upon those promoted, unless our predecessor shall have disposed of them, and by us, or by authority against those to be promoted to be bestowed at the same See, or also wherever or in any other manner, canonically vacant, we understand at the aforesaid See. Moreover, episcopal or other dignities, churches, monasteries and other aforesaid of our brethren of the holy Roman Church, cardinals at the said See, through their death, we know to be vacant, whether there or elsewhere, wherever it shall happen that they depart from this life. And this same thing we wish to claim for itself in dignities and benefices of any kind, (as is premised of others) of our officials, namely the Vice-Chancellor, Camerlengo of the same Church, notaries, auditor of contradictions, correctors, writers of letters, and our penitentiaries, as well as abbreviators of the Roman Curia. Again, we have deemed it right to extend this edict of our reservation to the dignities and other aforesaid of our chaplains commensals, and of any others, by reason of office or from legitimate cause dwelling in the said Curia, when they have been sent forth by us for our affairs and those of the same See to be pursued, from the Curia in whatever manner, or some of them have been sent, or have been legates or nuncios, and it shall happen that they are removed anywhere before their return to the aforesaid Curia (during the legation or prosecution of their affairs,) from human affairs. And we wish this same thing also to be in such chaplains commensals: even if, (as is said,) they have now been sent anywhere, and it shall happen that they are removed from human affairs. Moreover, we extend this edict to sees, monasteries, and other aforesaid, which, while the said Clement still lived, our pre- 29) Cardinals, C impr.

Moreover, annual pensions, made and to be made by bishops and their superiors as well as other inferior prelates, and also by whatever chaplains, convents, colleges, or individual persons personally to some of the same cardinals, or to whatever others of the aforesaid persons, and pensions moreover or assignments of whatever sums, upon certain provinces, dioceses, churches, monasteries, or other ecclesiastical places or orders, even made by whatever predecessors of ours Roman pontiffs, to the aforesaid persons, or to any one of them, or monasteries, priories, administrations of whatever kind, regular benefices, or whatever others, by whatever name they may be considered, not customarily assigned from of old to secular clerics, conferred upon such persons or any one of them, or granted in commendam, or by whatever other title by the same predecessors or other bishops, or superior prelates, chapters, or convents, or colleges under the aforesaid edict we do not wish to be comprehended in any way; so that with them ceding or dying, or abandoning them in whatever other manner, the monasteries themselves, priories, administrations, benefices, and places of this kind, may freely revert to the churches and monasteries, or other religious places, or other ecclesiastical ones, and their prelates, or persons, to whom before their disposition pertained, or to whom they are known to be immediately subject: unless something canonical has stood in their way, or we shall have deemed it otherwise to be dispensed concerning them.

1 ■10 assai XXIL (ann. 1316.
