CXXIV.
The expulsion of the Jews from all places of the dominion of the Holy Roman Church and its subjects, except from the city of Rome and the city of Ancona i.
Pius, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 The Hebrew people, once alone chosen by God of this age, who, infused with divine utterances, were made partakers of heavenly mysteries, by so much as they excelled all others in grace and dignity, by so much afterwards, by the merit of their unbelief, deserved to be cast down in contempt and neglect, in that, when the fullness of time came, they impiously rejected their perfidious and ungrateful Redeemer by an unworthy death. Having lost the priesthood, deprived of the authority of the law, scattered from their own seats, which the most clement and most benign God had prepared for them from the very first origin of that people, as a land flowing with milk and honey, wandering through the circle of lands now for so many centuries, hated and subjected to all reproaches and insults, they are forced to engage in foul and infamous arts, by which they might endure hunger, no differently than the vilest slaves. But Christian piety, taking pity on this inescapable calamity above all, has suffered them to dwell among us with sufficient humanity, so that, by their frequent sight, the memory of the Lord's Passion might be more often set before the eyes of the faithful, and at the same time by their examples, teaching, and warnings they might be invited more to conversion and salvation, which, by the oracle of the prophet, is to come to the remnant of Israel; from which, if, expelled from Christian dwellings, they should turn to those nations who know not Christ, they will become increasingly estranged. Yet their impiety, instructed in all the worst arts i Concerning the matter of the Jews, see the constitution iv of Paul IV, Cum nimis, vol. vi, p. 498. has proceeded to such a degree that now, for the common salvation of our people, it is expedient to prohibit such a great evil with swift remedy. For, to pass over so many kinds of usury by which the Hebrews have everywhere drained the substance of needy Christians, it seems sufficiently clear to us that they are receivers and sharers of thieves and robbers, who attempt to suppress for a time, or transfer elsewhere, or altogether transform whatever things are stolen and diverted by them, not only profane but also those serving divine worship, lest they be recognized; many also, under the guise of handling a matter convenient to their own occupation, haunting the homes of honest women, precipitate many into the foulest procuring; and what is most pernicious of all, devoted to divinations, incantations, magical superstitions and malefices, they lead very many unwary and infirm persons into the snares of Satan, who believe that future events can be foretold, thefts, treasures, hidden things revealed, and many other things can be known, of which not even the faculty of investigating is permitted to any mortal whatsoever. Finally, we have sufficiently known and ascertained how unworthily this perverse progeny bears the name of Christ, how hostile it is to all who are reckoned by this name, with what deceits it lies in wait for their lives. Moved by these and other most grave matters, and stirred by the weight of crimes daily increasing to the ruin of our cities, considering moreover that the aforesaid people, apart from moderate supplies from the East, is of no use to our commonwealth; and to our peoples, who are especially somewhat remote from us, it would be more conducive to hear of their name, crimes, and miseries reported from elsewhere, than to foster them henceforth in our bosom with any stimulus of charity as heretofore.

2 § 1. By the authority of these presents, we command that all Jews depart from the places of the dominion of the Holy Roman Church, Rome and Ancona excepted, within three months from the day of publication.

3 Penalties for the disobedient.

4 PIUS V commands that all and each of either sex Hebrews, in all our temporal dominion and in the cities, lands and places under it, of lords, barons and other temporal lords, even those having mere and mixed imperium and the power of life and death and any other jurisdiction and exemption, shall altogether depart from those very boundaries, within the space of three months after these letters shall have been published here.

5 § 2. These matters being set aside, whosoever, whether inhabitants or foreigners, whether present or future, found at any time in whatsoever city, land or place of the said dominion, even of the domicels, barons, lords and other exempted persons aforesaid, shall be despoiled of all things and the proceeds applied to the rights of the treasury, shall become slaves of the Roman Church, and shall be bound into perpetual servitude, and the said Church ought to claim over them the same right which other lords claim over slaves and bondsmen. Rome and Ancona alone being excepted, where we permit those Hebrews alone who now inhabit them to be tolerated, for the purpose of further recalling the aforesaid memory and for conducting business with orientals and mutual commerce with the same; provided, however, that they strive to observe our constitutions and those of our predecessors and other canonical constitutions concerning them; otherwise, they shall incur by that very fact all penalties which are contained in the said constitutions, which we also renew in this matter. For we hope that those, who are especially near to our sight and that of this See, will refrain from misdeeds through fear of harm, and that sometimes some, as has happened to many before through our exhortation as well, will joyfully recognize the light of truth. But let neither depart to the others, nor proceed to any other place of the said dominion at any time, nor receive any of the proscribed persons to themselves, if they wish to avoid the yoke of servitude and punishments. We therefore command all Barons and ... governors and of provinces, cities and places of the said dominion, legates, governors, presidents, praetors and magistrates, and also the ordinaries of places, as well as the domicels, barons, lords and exempted persons aforesaid, and whosoever else it concerns, that each one for himself, awaiting no other command or declaration of our will from us, shall execute all the aforesaid as soon as possible; and let them take careful heed that no Hebrews henceforth approach the same provinces, cities and places, even those of the domicels, barons and other persons aforesaid, for whatsoever cause. But whosoever, even of those who are now in Rome and Ancona, found in any part of the said dominion after the next three months have passed, even in that which is temporally under the dominion of the same domicels, barons, lords and exempted persons, shall immediately be made slaves of the said Church; shall be cast into perpetual servitude, and we signify that heavier punishments are to be inflicted upon their necks, so that others may learn by their example how much it would have been to recklessly neglect this our prohibition.

6 § 3. Notwithstanding the aforesaid and apostolic constitutions and ordinances, common and municipal laws of the aforesaid provinces, cities and places; as well as statutes and customs strengthened by oath, apostolic confirmation or any other firmness of the Apostolic Chamber; and conventions with the universality of the aforesaid Hebrews, even under public faith, pacts; and also privileges, indults, exemptions and apostolic letters, all of which and also the aforesaid domicels, barons and lords, their cities, lands, places and peoples, by whatsoever Roman Pontiffs our predecessors and we and the said See, even of our own motion and from certain knowledge, and from the fullness of apostolic power, and otherwise howsoever and under whatsoever tenors and forms, and from whatsoever causes, even burdensome ones, and with restitutions, preservations, derogations of derogatory clauses and other stronger, most efficacious and unusual clauses, as well as irritant and other decrees, in general and in particular, as often as granted, confirmed and repeatedly renewed. All and singular of which, even if special, specific, express and individual mention, or any other expression of them and their whole tenors, not by general clauses, ought to be made, word for word, we, having the tenors of this kind as if inserted word for word in the present, insofar as the aforesaid might impede or delay or otherwise harm them, by the series of these, from similar fullness of power, specially and expressly revoke and abolish, and render wholly void of force and effect; and whatever otherwise may have been attempted or happened by whosoever, knowingly or unknowingly, we decree to be null and void, and all other things contrary whatsoever.

7 § 4. We will, however, that copies of the present, even printed, be issued, and that they, sealed by the hand of a notary public and the seal of any ecclesiastical curia or prelate, shall have everywhere the same faith which the present themselves would have if they were exhibited or shown.

1 Hebraeorum gens sola quondam a Docaasae huius mino electa, quae divinis eloquiis infusa, constitutionis. . Verumtamen illorum impietas, pessimis omnibus artibus i De materia Iudaeorum vide Pauli IV constitutionem iv, Cum nimis, tom. vi, pag.498. instructa, usque eo processit ut iam, prò communi nostrorum salute , expediat tanti morbi vini celeri remedio prohibere.

Sanzione poe- § 5. A nessuno dunque assolutamente sia lecito...
