Bull on the protection of litigants and officials of the Roman Curia

Bull of Pope Alexander VI ·

cation.
(I) In the same Rome the Pontiffs pronounce sentence of anathema in single years on the day of the bull In coena Domini.
Alexander, bishop, servant of the servants of God, for perpetual memory of the matter.

1 In the eminent seat of the Apostolic See, by divine providence disposing, although unworthy, constituted, among the manifold cares of our solicitude, by which we are continually pressed, we ought to undertake in the first place that which pertains to our pious pastoral office, through which the works of our provision, directed to the Roman Curia (to which, as to the faithful mother and teacher of the faithful, and as the fountain of justice, for the obtaining thereof, a multitude continually flows together from diverse parts of the world) for the handling of their causes, and pursuing those same causes therein, with all impediments removed, they may pursue their rights, and in pursuing those same, in the same Curia freely, safely and peacefully be able to remain personally, as, the condition of persons and times being considered, we perceive in the Lord to be wholesomely expedient. § 1. Indeed, both from the beloved sons, the auditor of the Sacred Palace of the Apostles and those holding office under him, and from others by whatever means trustworthy, as well as from many pursuing their causes in the said Curia, with most grave complaints, not without the greatest disturbance of our mind, we have often received word that, although we, the See of our blessed memory Pope Innocent VIII, our predecessor, as it pleased the Lord, being taken from our midst, have been assumed, by divine favour and clemency, to the summit of the apostolic office, following in the footsteps both of the same Innocent and of other Roman Pontiffs, even our predecessors, each year on the day of the Lord's Supper by our letters, among other things, all those who, by themselves or through another or others, should beat, mutilate or kill any ecclesiastical or secular persons resorting to the same Curia on their causes and business, and pursuing or causing to be pursued those same matters therein, or the managers of business, advocates or procurators of the same, or auditors or judges deputed over the said causes or business, on occasion of causes or business of this kind, or despoil them of their goods; and who, through...

2 ALEXANDER VIII.

3 It is fitting that light be shed on the Pontiff, some who should know of such anathema.

4 themselves or through another or others, directly or indirectly, should not fear to execute the aforesaid or to procure and to provide counsel or favor to the same, of whatever precedence, dignity, order, condition and status they might be, even if they should shine forth with pontifical, royal, regal or any other dignity, we have been accustomed to excommunicate and anathematize publicly, as also the aforesaid other predecessors, even through their letters, in single years, on the said day were accustomed to do; from which sentences indeed, no one, through another than the Roman Pontiff, unless only constituted in the article of death, nor even then, unless under certain modes and forms expressed, is able to be absolved.

5 § 2. Yet, as the wickedness of days has increased, very many children of iniquity, of perdition, making light of sentences of excommunication and anathema and alienation of this kind, with horrible inhumanity and detestable cruelty, thirsting for the death of others, seeing perhaps that they, in cases brought by them or against them in the Curia of the Roman Church for the time being, do not find justice favored, unmindful of the safety, status and honor of their own, with the enemy of mankind procuring it and the fear of God set aside, have not blushed with rash audacity to afflict, invade, beat, mutilate, kill their adversaries in the said cases or those prosecuting or procuring those cases for them in the same Curia, or their advocates or procurators and witnesses and notaries of the aforesaid cases, by various devised threats; or to procure and execute such things through others, even assassins (alas for sorrow), so that very often those pursuing their right in the Curia itself, led by fear and a certain desperation, are forced to abandon their cases, or, not without great prejudice and detriment to themselves, to resort to reconciliation or other dishonest agreements and illicit pacts, contrary to the customary liberty of the said Curia, and to depart from the Curia itself, to the offense of Divine Majesty, to the injury of apostolic jurisdiction and authority, to the peril of souls, and to the pernicious example and scandal of very many. § 3. We therefore, who ought to preserve the same Roman Curia, as the supreme tribunal of justice and the most firm refuge of all the oppressed, free, immune and secure for all, considering carefully that the severity of penalties is wont to restrain from the will of sinning more than the fear of God, and therefore wishing to meet so great a danger to souls, and to strike with the sword of ecclesiastical punishment such nefarious presumers and criminal men, so that fear of penalty may be the fear of such presumption, by the edict of this perpetual irrefragable constitution, with the counsel of our venerable brothers, the cardinals of the holy Roman Church, approving and renewing the aforesaid sentences of excommunication and anathema and all and singular other sentences, censures and ecclesiastical penalties, in such presumers, by canonical sanctions and other apostolic constitutions, howsoever made and promulgated, by apostolic authority, extending and enlarging to all and singular the aforesaid, who perhaps were not comprehended under those, we decree and ordain:

6 § 4. That henceforth, for perpetual future times, all and singular ecclesiastical and secular persons, of whatsoever quality, dignity, status, degree, order and preeminence they may be, who, in their cases, whether beneficiary or lay and criminal or mixed, pending in the said Curia now and for the time being (even concerning those matters for which letters executorial have already been decreed and have not obtained their due effect), shall presume in any way to afflict, invade, beat, mutilate and kill their adversaries or those prosecuting and procuring those cases for them, or their advocates or procurators, or auditors and any other judges whatsoever, witnesses and the aforesaid notaries by threats, or to procure and execute such things through others, although mutilation or death perhaps may not follow from this, shall incur the sentences of excommunication and anathema and alienation aforesaid, and all other sentences, censures and ecclesiastical penalties aforesaid, even if they shall knowingly have received such persons.

7 of the Roman Church. In the year of Christ 1302. counsel, aid or favor, publicly or secretly, directly or indirectly, to those who perpetrate it; or those who have made promises, even for others, in any manner whatsoever, beyond the sentences, decrees and penalties pronounced (which they themselves are said to have incurred in like manner), if it should come to pass. Let them lose completely and annul the cause itself and all right, both in the matter of possession and in the possessory, and in regard to the thing, by reason of this cause or occasion, in whatever manner it may be competent, by that very fact; but if there shall be others, from the Curia itself and from all the lands of the same Roman Church, perpetual exile, with all hope of restoration taken away; and if mutilation of a limb or death (which God avert) should follow, beyond the loss of cause and right and the penalty of exile of this kind, both they themselves and those executing the aforesaid on their behalf and all others aforesaid shall incur the sentences of deposition from dignity, honor, order, office and benefice, and of the crime of lèse-majesté by that very fact. And we decree that their offices, even of the same Roman Curia, and whatever benefices from that time forth by that very right shall be vacant, and which, as is aforesaid, shall be vacant to our and the aforesaid See's collation and disposition, by like counsel of the brethren themselves, we reserve, to be freely conferred on others by us and the aforesaid See alone; forbidding that anyone, except the Roman Pontiff, armed with whatever authority over this matter, presume to dispose of them or to alter them in any way by way of exchange or otherwise. Decreeing from now on null and void, if otherwise concerning these things, by anyone whatsoever, with whatever authority, knowingly or unknowingly should happen to be attempted. And let them also be in all their goods perpetually distrusted by all and banned, and held as infamous and incapable. And after it shall be established by probable arguments that someone has committed such an execrable crime, in no way shall any other sentence of excommunication and anathema, deprivation, deposition or distrust and ban of this kind be required against him. And, so that these wicked perpetrators

8 and perpetrators and criminal men may be more easily and frequently restrained from such an execrable crime, to all and each ecclesiastical and secular persons, even of whatever dignity, status, grade, order and condition they may be, in virtue of holy obedience and under the like penalty of excommunication and anathema of a sentence pronounced, from which they can be absolved in no other way than as is aforesaid, we strictly enjoin that all, whom they shall know to have committed the aforesaid, procured it or been mediators of it, to the Roman Pontiff existing for the time being or to another through whom it can easily come to his knowledge, by themselves or through others, as quickly as possible do not omit to reveal, and for this revelation they shall obtain grace and, if they have been accomplices, pardon.

9 § 5. Notwithstanding the constitutions and ordinances of the Canons and apostolic ordinances, and all those which the aforesaid predecessors in their and we in our aforesaid letters wished not to stand in the way, and all other things contrary whatsoever.

10 § 6. But so that the present may be brought to the common knowledge of all, we will and command that they be published in the Apostolic Chancery and the audience of the contradicted letters (which we decree to bind from that time forward anyone whatsoever) and then each year on the first day on which the audience is held by the aforesaid auditors and locumtenentes, in the place of the said audience, and in the said Chancery, among other extravagantes and also among the constitutions of the said auditors, be written, so that those to whom it may happen that it did not come to their knowledge, or they were ignorant of them, may be able to put forward no excuse or allege ignorance, since it is not likely that it should remain unknown to them that which was published so openly.

11 § 7. Let no one therefore etc.

12 If anyone however etc.

13 Given at Rome at St. Peter's, in the year of the Lord's Incarnation one thousand three hundred and two, on the Ides of April, in the tenth year of our pontificate.

7 DELLA CHIESA ROMANA An.
