Bull on the authority and power of the Supreme Penitentiary

Bull of Pope Julius III ·

Concerning the authority and power of the Supreme Penitentiary, from the indult of Sixtus IV and Paul III. Julius, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 It is fitting and proper that those things which have proceeded from the grace of the Roman Pontiff should, even if his death should supervene before apostolic letters concerning them have been drawn up, obtain their due effect.

2 § 2. Indeed, after letters of the tenor following had been issued by Sixtus, Pope IV, of blessed memory, our predecessor:

3 § 2. Although, as our predecessor Paul, Pope III, of blessed memory, approved, from that time forward the letters of the same Sixtus, our predecessor, without any exception, were observed throughout the whole world, and those things which were known to have emanated from the Apostolic See obtained full force and firmness; nevertheless, since the Roman Pontiff would willingly approve and renew them, so that they might persist more firmly perpetually inviolate, and according to the intention of the Roman Pontiff himself, with all occasions of litigation and calumny removed, might obtain their due effect, and be firmly observed by all, and those things be deemed more firm which were repeatedly strengthened by the protection of apostolic confirmation, the aforesaid Paul, under date of the third day before the Kalends of July, in the fifteenth year of his pontificate, by his own motion, not at the instance of our beloved son, then his, Raymund, of the title of St. Angelo, presbyter cardinal, our, then his, Major Penitentiary, or of any other petition laid before the same predecessor on this matter, but of his mere liberality and from his certain knowledge, and from the fullness of apostolic power, decreed, declared, mandated, willed and established, and with all and singular clauses contained in them, approved and renewed the letters of Sixtus, our predecessor, by this apostolic authority; and that they should obtain the strength of perpetual firmness and should be observed everywhere under the same censures and penalties.

4 § 3. And those not observing them, or in any way:

5 of the aforesaid Raymund, or modern and for the time being existing Major Penitentiary of the said See, concerning the aforesaid matters or any of them, powers or authority or faculty contained in them, calling into doubt, or in any way impeding the execution of the letters of the same Raymund and for the time being existing Major Penitentiary, or preventing the said letters, according to their form and tenor, from being committed to due execution, providing impediment, counsel, aid or favor in any manner whatsoever, the aforesaid and all and singular other sentences, censures and penalties contained and promulgated in the bull which is accustomed to be read annually in Coena Domini against those impeding the execution of apostolic letters, he decreed and declared that they have incurred and ought to incur by that very fact, without any other declaration to be made thereupon.

6 § 4. And nevertheless, for weightier reason, all the aforesaid matters and things, as they had been declared, decreed, mandated and established by the same Sixtus, our predecessor, in the same manner and form, and by similar motion, knowledge and fullness of power, he decreed, declared and established anew, and mandated that they be observed under the same censures and penalties, and under disability, privation and confiscation, the letters of Raymund and for the time being existing Major Penitentiary aforesaid, expedited according to the aforesaid style, which were closed and directed to confessors, in the forum of conscience only; but those which were open and expedited with the seal aforesaid, as is aforesaid, and should be expedited in the future, unless the words "in the forum of conscience only" were appended in them, in both forums, as well penitential as judicial and contentious, should be understood and interpreted, and should avail those to whom they should for the time being be granted.

7 § 5. And thus in all and singular the aforesaid matters by whosoever, exercising any authority, judges and persons, the facility and authority of judging and interpreting otherwise being taken away from them and from each of them, it ought to be judged and interpreted and defined; and likewise, if it should happen that anything otherwise be attempted concerning them by anyone, by whatever authority, knowingly or unknowingly, he decreed and declared it to be null and void.

8 An. C. 1550 Julius

9 In the year 1550, July, [the Pope] similarly decreed and declared that judges and persons exercising [their office], with any facility and authority of judging and interpreting otherwise being taken away from them and from each of them, ought to be judged and interpreted and defined [according to this], and moreover [declared] null and void, if anything contrary to these matters should happen to be attempted by anyone whatsoever, by whatever authority, knowingly or unknowingly.

10 § 6. Notwithstanding the foregoing and any apostolic constitutions whatsoever, as well as those issued in provincial and synodal councils, general or special constitutions and ordinances, and also statutes and customs strengthened by oath, apostolic confirmation or any other firmness, and the pragmatic sanctions of those regions, privileges also, indults and apostolic letters granted to any persons whatsoever, under whatsoever tenors and forms, and with whatsoever derogatory clauses and other more efficacious, most efficacious and unusual clauses, irritant and other decrees approved, and also renewed several times, all of which, even if for their sufficient derogation special, specific and express mention of them and their entire tenors ought to be made, or some other exquisite form observed for this purpose, the aforesaid Paul our predecessor, holding these tenors as if they had been inserted word for word, as sufficiently expressed and inserted, which would otherwise remain in their force, derogated from them on this occasion specially and expressly, and decreed that they could in no way avail against the foregoing; and also from all those things which the aforesaid Sixtus our predecessor willed not to stand in the way in the said letters, and from all other things contrary whatsoever.

11 § 7. And moreover, because it would be difficult to carry letters to be made out concerning this to each and every place in which faith might perhaps be given concerning them, the aforesaid Paul our predecessor willed, and by motu proprio, knowledge and fullness of power likewise decreed that to the copies of the same letters to be made out concerning this, subscribed by a public notary and furnished with the impression of the seal of some person constituted in ecclesiastical dignity, in court and elsewhere where it should be necessary, the same faith altogether should be given as would be given to the same letters to be made out concerning this, if they were exhibited or shown.

12 § 8. But lest there be any hesitation whatsoever concerning the approval, innovation, decrees, declarations, new grant, statute, mandate and will of Paul our predecessor on this matter, for the reason that letters of the aforesaid Paul our predecessor were not made out concerning these upon his death supervening, and those to whom it concerns or shall concern in any way in the future be deprived of their effect, we will and likewise by apostolic authority decree that the approval, innovation, decrees, declarations, will, new grant, statute and mandate of Paul our predecessor shall have their effect from the said third day before the Kalends of July just as if letters of the aforesaid predecessor made out under the date of the same day had been made out concerning them, as is set forth above; and that these present letters shall suffice everywhere to prove the approval, innovation, decrees, declarations, new grant, statute, mandate and will of Paul our predecessor, nor shall any other aid of proof be required for this.

13 § 9. Wherefore to all and each of our venerable brothers the archbishops and bishops and beloved sons the abbots and other persons constituted in ecclesiastical dignity, as well as the canons of the metropolitan and other cathedral churches, and to the present and for the time being existing auditors of the causes of the Apostolic Chamber and our vicar in the Curia and its district, and to the vicars or officials in spiritual matters general of the same archbishops and bishops, by apostolic writ we command that they themselves or two or one of them, by themselves or through another or others, these present letters and whatsoever is contained in them, where and when it shall be necessary, and for the part of those or any of them whom the same letters concern and shall concern, solemnly publishing, and assisting them and each of them in the foregoing with the protection of efficacious defense, shall cause by our authority all and each whom these present letters concern in any way and shall concern, as aforesaid, to enjoy and possess peacefully those things and whatsoever is contained in them. Not permitting any of them to be improperly molested, hindered and disquieted concerning this by the ordinaries of places or any others whatsoever in any way; compelling whatever contradictors and rebels by the aforesaid and any other sentences, censures and ecclesiastical penalties, and also pecuniary ones, to be moderated and applied at their discretion, and other appropriate remedies of law, appeal being set aside, aggravating even the aforesaid censures and penalties several times, with legitimate processes to be observed concerning these, invoking also the aid of the secular arm for this if it should be necessary.

14 § 10. Notwithstanding all the aforesaid decrees, or if to any persons, collectively or individually, it has been granted by the same See that they cannot be interdicted, suspended or excommunicated by apostolic letters not making full and express mention, word for word, of this indult.

15 Let no one therefore...

16 Given at Rome at St. Peter's, in the year of Our Lord's Incarnation one thousand five hundred and fifty, on the eighth day before the Kalends of March, in the first year of Our pontificate. Given on 12 February 1550, in the first year of the pontificate.

8 An. C. 1550 GIULIO

9 An.

15 Nulli ergo eie.
