Regimini Universae

Bull on the dissolution of the union of the dioceses of Brindisi and Oria

Bull of Pope Gregory XIV ·

Gregory, bishop, servant of the servants of God,
for the record of the future.

1 Since we are placed by divine will, though with unequal merits, over the governance of the universal Church, it is fitting that we should concern ourselves, as far as is granted to us from on high, with cathedral and other churches and their pastors, so that the people committed to them may be directed happily in the way of the Lord; and since we recognize that it conduces to this end that a proper pastor should preside over each church, we dissolve the union of these same churches already made long ago, as we perceive it to be salutary in the Lord, when the condition of the times and the nature of affairs are weighed.

2 § 4. Indeed, our most beloved son in Christ, Philip, Catholic King of Spain, to whom the nomination of a suitable person to the underwritten churches, whenever they become vacant, pertains and belongs by reason of the kingdom of Sicily, of which the same Philip is also king, by apostolic privilege, which has not been derogated from in any respect up to now, considering that because of the union of the churches of Brindisi and Otranto made perpetually with one another by apostolic authority long ago, and on account of this union, various grave disputes and discords had arisen and continually persisted among the communities and people of the cities of Brindisi and Otranto, and were increasing daily, to the scandal and damage of many, and to no small perturbation of the status of these cities and churches, committed to the examination of the prefects of the blessed memory of Pope Sixtus 1 and afterwards to be reported to him: who indeed, having heard the agents and procurators of both King Philip and these cities many times, and having seen what was to be seen and considered what was to be considered, judged that the union of these same churches ought to be dissolved. Moreover, the churches themselves and the cities, which had competent dioceses, and each would have its own bishop and pastor, and from this could be better and more conveniently ruled and governed by its own pastor.

3 § 5. Wherefore we, considering that if the aforesaid union were perpetually dissolved, and the aforesaid disputes and discords and the scandals and inconveniences arising therefrom were opportunely prevented, and otherwise the peace and tranquility of the persons of both churches and cities were consulted: we therefore, who long ago among other things willed that there should always be a commission in unions and dismemberments to the parties, with those interested being called, having the tenors of the union, annexation and incorporation and of the other aforesaid matters and those following therefrom and of necessity or otherwise in any way to be expressed, and of the tables of the said churches and the fruits of each of them and their true and annual values, and of the disputes and causes concerning any claims whatsoever, and on account of the union, annexation and incorporation aforesaid moved and pending, and the status and merits thereof, and the names and surnames of the judges and litigants, as well as the rights and claims, held as expressed in these presents, and also all and any causes between the aforesaid communities and people concerning any claims whatsoever, and the pensions reserved to Philip V concerning the right of nominating to both churches, and confirming the pensions reserved.

4 and those of the union, annexation and incorporation aforesaid moved at any time and introduced in any manner and pending indefinitely, calling them to us by the tenor of these presents, and extinguishing those and any disputes, with all and singular their incidents, dependencies, emergencies, annexations and connections, and imposing perpetual silence thereupon on both sides, from the aforesaid and other reasonable causes moving our mind, the aforesaid matter, having been maturely discussed in thought and in fact, by the counsel and assent of our venerable brothers, cardinals of the same holy Roman Church, we dissolve by apostolic authority, by the tenor of these presents, perpetually, the union, annexation and incorporation of the said churches of Brindisi and Otranto, now destitute of pastoral care by the death of Bernardinus of blessed memory, formerly archbishop of Brindisi and Otranto, who paid the debt of nature outside the Roman Curia, made otherwise as is set forth above, the tenor of which we will to be held as expressed, so that from now henceforth these same churches shall no longer be nor be understood to be united, but each by itself, and the church of Brindisi shall remain metropolitan, while that of Otranto shall remain cathedral only.

5 § 4. And nevertheless the increase of the dowry to the same church of Otranto, made by the same community and men of the said city of Otranto, so that it might remain or become metropolitan, as they themselves urged, and with their consent also, and the right of nominating suitable persons to the said churches, thus formerly united, which belonged to the said King Philip by apostolic privilege, which had not hitherto been revoked, shall remain firm and unimpaired to him and his successors respectively in perpetuity; so that henceforth the same King Philip and his successors may nominate suitable persons to each of the aforesaid churches, concerning whose fruits the ancient pension of five hundred ducats or scudi, which We will that be paid on the fruits of both according to each one's share, reserved by apostolic authority aforesaid to be received annually by certain ecclesiastical persons, both at this first time and as often as they shall hereafter become vacant, just as King Philip himself before the dissolution of such union nominated and was able to nominate to the same united churches.

6 § 5. And We constitute and assign the said church of Otranto, remaining as the cathedral church of the church of Taranto and of its archbishop now and for the time being existing, as suffragans thereof.

7 § 6. Moreover to the aforesaid church of Brindisi, for its diocese, beyond that which it previously had, Castra Celini, Guaenani, Salicis Veliae, and Severani, insofar as they are not of the same Brindisi diocese, with the districts, territories, rights and appurtenances of the same castles, and inhabitants and dwellers thereof, being dismembered and separated from the diocese of Otranto, insofar as they exist in it, We likewise grant and assign in perpetuity by the same authority and tenor.

8 § 7. Willing and by the said authority decreeing and commanding that the tithes, which the church of Brundisium in the territory of the church and city of Uritana by force of the donation of Tancred or of any other title whatsoever claimed, shall likewise remain safe to the same church of Brundisium, and that the names and denominations of the castles and places, which to each of the said cities of Brundisium and Uritana after the dissolution of such union, annexation and incorporation remained, be expressed in the letters to be drawn up thereafter and

9 to the church of Brindisi certain castles are added.

10 To each city its own privileges are confirmed.

11 Derogation of contrary provisions.

12 Clauses.

13 GREGORY XIV, POPE.

14 be specified and declared they could and should.

15 § 8. Notwithstanding Our apostolic will, and insofar as it be necessary, not taking away acquired right, and any other apostolic constitutions, as well as those issued in provincial and synodal councils, special and general, constitutions and ordinances; and the statutes of the said churches, even those confirmed by oath, customs; also privileges, indults and apostolic letters, even those, and to their prelates, chapters and any other superiors and persons, under whatever tenors and forms, and with whatever other derogatory clauses of derogations and other more efficacious and unusual clauses, irritant and other decrees, even by Our own motion and from certain knowledge and from the fullness of apostolic power, and by consistorial and otherwise in any way granted, confirmed and renewed to the contrary. All of which, holding the tenors of all and each of them as expressed, We specially and expressly derogate, and to all other things contrary in any way whatsoever.
