Decretal on the prohibition of new religious orders and mendicants

Decretal of Pope Gregory X ·

1 Reg. Reg. 1 v s X. in concilio generali Lugdun. (ann. 1274.) the excessive diversity of religions, (lest it should introduce confusion,) the general council, with consultation, prohibited 86 c. H. adds: that they be subject to the bishop.

2 983 Sexti Decret. Lib. III. Tit. XVII. - XX.

3 On religions etc. also On the chapels of monasteries, also On the right of patronage, also On rents, etc.

4 prohibited 87 a. But because not only the importunate eagerness of those petitioning afterwards extorted their multiplication, but also the presumptuous rashness of some of diverse orders, especially of Mendicants, (whose beginning had not yet merited approbation,) invented an unrestrained multitude as it were: with the constitution repeated and more strictly inhibiting 88, that no one henceforth invent a new order or religion 89, or assume the habit of a new religion, we subject to perpetual prohibition all religions 90 and mendicant orders invented after the said council, which have merited no confirmation from the apostolic see, and insofar as they have proceeded 91 c, we revoke.

5 Mendicant religious, approved and instituted by the pope after the council, cannot receive anyone to profession, acquire a house or place anew, nor alienate what has been acquired without licence, nor preach to outsiders, hear their confessions, or admit them to burial. And contrary to this does not hold, and he who acts contrary is excommunicated. H. d. Dominic. § 1. But those confirmed by the same see 93, instituted nevertheless by the same council, to whom any profession or rule whatsoever forbids having income or possessions for adequate sustenance, but uncertain mendicancy is accustomed to be supplied through public begging, we now decree shall subsist in the manner written below, namely that it shall be lawful for the professed of those same orders to remain in them thus, if they wish, provided that they admit no one henceforth to their profession, nor acquire a new house or any place, nor shall they be able to alienate the houses or places which they have without special licence of the same see. For we reserve those to the disposition of the apostolic see, to be converted for the aid of the Holy Land, or for the poor or other pious uses by the ordinaries of places, or those to whom the see itself shall have committed them. But if otherwise it shall be presumed: neither the reception of persons, nor the acquisition of houses or places 95 or the alienation of them and of other goods shall avail, and nevertheless those acting contrary shall incur the sentence of excommunication. We also wholly forbid to the persons of their orders, as regards outsiders, the office of preaching and hearing confession, or 94 even burial.

6 The revocation of mendicant orders, the Eradicators, Minors, Hermits, and Carmelites does not comprehend. This Dominicus says. § 2. Namely, to the orders of Preachers and Minors, (whom evident utility proceeding to the universal Church is said to have approved,) we do not permit the present constitution to extend. Moreover, the orders of Hermits of St. Augustine and of Carmelites, whose institution preceded the said general council, we will to remain in solid state.

7 One existing from the revoked orders, not collegially but individually, can pass to other orders. H. d. Dominic.

8 3. To these persons of the orders to which the present constitution extends, we grant general licence to pass to the remaining approved orders, so that no order to another, or convent to convent shall transfer itself and its places wholly, the special permission of the same see not having been obtained thereon.

2 983 Sexti Decret. Lib. III. Tit.XVII. - XX.

3 De religiosis etc. it. De capellis monasteriorum, it. De iure patronatus, it. De censibus, etc.

4 vietò 87) a.
