Ea quae a praedecessoribus
Suole ecc. i.
XXV.
Against those fighting in duels and permitting it everywhere among nations, witnessing, accomplices, etc. 1.
Pius bishop servant of the servants of God, for perpetual remembrance of the matter.
1 Those things which have emanated from our predecessors the Roman Pontiffs, legitimate causes persuading, we willingly strengthen with the protection of approbation and renewal, so that they may endure more firmly inviolate, the more often they have been fortified by apostolic authority, and we establish and enlarge them anew, inasmuch as the use of duels was forbidden in the Ecclesiastical State by Julius II in his constitution xxiv, Regis, vol. v, p. 1170; and then by Leo X in constitution xxxv, Quam Deo, ibid., p. 727; and Clement VII simply confirmed them, and therefore I have not included his bull.
2 tionable causes persuade and we perceive this in the Lord to be salutarily expedient.
3 § 1. Indeed formerly from the blessed memory of Clement Pope VII, our predecessor, there emanated letters, in which certain others are inserted, of the following tenor. Clement bishop servant of the servants of God, for perpetual remembrance of the matter. It has been customary etc. i.
4 § 2. Since, however, as has been made known to us, the cause of consideration. Many dukes, counts, marquises, lords, barons and others who are lords in temporal matters, vicars, communities and universities of cities, lands and places, subject to the same Roman Church mediately or immediately, and some others desiring singular combats and others, even as aforesaid subjects, desiring to see them, unmindful of their status, salvation and honor, do not fear to contravene the letters of such predecessors, and to make light of the censures and penalties contained in them, to the destruction of their own souls and offense of Divine Majesty, and injury to the commonwealth.
5 § 3. We, whose duty it is to repress the wicked with salutary severity, against whom God and the neighbor and the authority of the said See, as enemies of the Catholic profession, rage, lest their presumption be strengthened and their perversity exalted, intend to provide; and lest the aforesaid letters, which emanated from the same predecessors by provident deliberation, be rendered contemptible, but that their transgressors be punished with due severity, willing to provide, by our own motion, not at the instance of any petition offered to us on this matter, but from our mere deliberation and from certain knowledge, the individual letters of Julius, Leo and Clement our aforesaid predecessors, with the statutes, ordinances, additions, decrees, declarations, confiscations, incorporation, application, wills and mandates and all and singular other clauses respectively contained in them, by apostolic authority, by the tenor of the present, we approve and renew, and decree that they subsist with the strength of perpetual firmness, and all and singular whom the said letters concern and shall concern, under the penalties of excommunication, anathema, curse, perpetual infamy, defiance, crime of lèse-majesty, sedition, rebellion, confiscation and privation of their states and dominions and fiefs and vicariates and their other honors, and deposition of them, as well as inability to obtain them and others in the future, and interdict and other ecclesiastical and temporal censures and penalties, and others contained in the same letters, which those contravening incur by that very fact and become intestable, and beyond the aforesaid penalties ought to be consigned to prisons and detained and punished irremissibly with the aforesaid penalties, we decree to be perpetually observed, and that by the executors appointed in the said letters proceedings ought to be taken against the same contrafactors toward the total execution of the said penalties.
6 § 4. And those, both to the fighters thus fighting, and those attempting it and provoking it, or giving or granting a place or field for fighting, and standing and being present in the writings of the chariot and interested, and accompanying the fighters and providing company, and also consulting and adhering and favoring, and also subscribing or affixing or publishing the charters of combat or duel, even if they be of the aforesaid or any other dignity, nobility, status, degree and order, both ecclesiastical and worldly, even so that they, beyond the aforesaid penalties, incur the penalty of major excommunication by sentence already incurred, from which none save we or the Roman Pontiff existing for the time being can absolve them, by that very fact; and if they be ecclesiastical, also by the statutes enacted by Julius II, Leo X and Clement VII.
7 Revocation of all licenses whatsoever.
8 all and singular churches, monasteries, dignities and other ecclesiastical benefices obtained by them, or in which and to which right is competent to them, by that very fact are deprived and become unable to obtain them and others in the future, and we extend and enlarge those as if vacant by such privation and able to be obtained by others.
9 § 5. And nevertheless all and singular the aforesaid matters, as they were established and ordained, forbidden, decreed and commanded by Leo and Clement, the aforesaid predecessors, as aforesaid, We do anew in all things and through all things establish, ordain, forbid, decree, declare and command.
10 § 6. And all concessions of duels of this kind and faculties concerning the same granted to the aforesaid or to any other persons whatsoever by any of Our Roman Pontiff predecessors, under whatsoever forms and expressions of words, perhaps granted and approved and renewed, by this present We revoke, annul and cancel.
11 § 7. And moreover, desiring that those, and so detestable a combat of fighters, and other places for fighting, and otherwise favour shown in the aforesaid matters, and finally the wickedness of the promoters of so great a crime, be repressed and abolished not only in the lands and places subject to the same Roman Church, as aforesaid, but elsewhere everywhere entirely, and to provide against the perils of the souls of individual faithful Christians, through the bowels of Our Lord Jesus Christ We beseech and entreat all and singular emperors and kings of the whole world, dukes, and also commanders of arms, marquises, barons and other Christian princes, as well as dominions, powers, communities of cities, and universities of towns, castles, lands and places whatsoever, and their lords in temporal matters, and also captains and commanders of soldiers, both cavalry and infantry, and also 1 To this you have Concil. Trid., sess. xxv, De Reform., cap. 19.
12 Exhortation to all Christian princes, even those not subject to the R. E., that they prohibit duels and contests 1;
13 rv PP. 85 An. C. 1860 not subject to the temporal dominion of the same Roman Church, of whatsoever state, degree, order, condition, nobility and pre-eminence they may be, that, out of regard for the divine name, and for their devotion and reverence towards Us and this holy Apostolic See, as well as for the cultivation and preservation of the faith, and for the salvation of their souls, who seek such duels, deceived by diabolical fraud, permit not such duels or other singular contests to be held in their kingdoms, duchies, marquisates, baronies, dominions, lands and places, but rather expressly forbid and dissuade that they be held; strictly commanding them that at no time whatsoever they dare or presume to admit such duels or contests, under any pretext or occasion or cause whatsoever, or to incite or provoke anyone to the same or to be present at them, or to suffer or permit that they be held; otherwise We decree and declare that they, and also those making such duels or singular contests outside the lands and places not subject to the dominion of the Church, or defiances concerning the same, and those inciting, provoking, and giving aid, counsel or favour to the same, and those standing by and being present at them, and likewise those subscribing to or publishing the documents concerning the same, or meddling with them, and each and every one of them, being inferior to emperor and kings, shall be subject to the penalties of major excommunication and, beyond that, if they be ecclesiastics, deprivation and disqualification as aforesaid, and shall incur those penalties, and from them, save by Us or by the Roman Pontiff existing for the time being, as aforesaid, they can neither be absolved nor against them be restored or rehabilitated, nor ought they to be.
14 § 8. Notwithstanding the constitutions and clauses of apostolic ordinances, and all those things which the aforesaid predecessors in each of their aforesaid letters wished not to stand in the way, and notwithstanding all other things to the contrary whatsoever. 1 Marchionatibus, Cherub. (r. t.). Let no one therefore...
