Testo inglese

1 Celestine, etc. to our most beloved son in Christ Charles, illustrious King of Sicily. Formerly, when you were staying with us at Aquila and several cardinals of the holy Roman Church, residing at Perugia, deferred to come into our presence, you excusably put forward certain reasons and causes why they feared to enter your kingdom, and through your beloved son Master William Agarui, canon of Fregellae, your proctor in the Roman curia, specially constituted by you for this purpose, you caused an oath to be taken by them upon your soul, that if it should happen that you were removed from human affairs in the aforesaid kingdom, you would neither compel them to remain in the said kingdom, nor would you cause them to be compelled; but rather you would grant them free and unimpeded return and exit from the same according to the judgment of their own will. Since, however, we wish to maintain in full force the Constitution of Gregory, Pope of happy memory, made in the Council of Lyons concerning the confinement of cardinals after the death of the Supreme Pontiff, just as the Constitution was issued, with the suspension of the same made by Hadrian V of pious memory and John XXI, our predecessors, entirely removed; and if the case of the death of the said Pontiff should occur in the same kingdom, the said confinement would pertain to you according to the form of the same Constitution, we, absolving you in the aforesaid case from the bond of the said oath through the same proctor in your soul, do not wish you to be bound to the observance of the Constitution itself according to the manner and form set forth in the same. Given at St. Germain on the 17th day before the Kalends of November, in the first year of our Pontificate.
