1 Gregory, bishop, servant of the servants of God, to our beloved sons the general and provincial ministers, and custodians, and other brothers of the Order of Minors, greeting and apostolic blessing.
2 Since you have withdrawn from the world, like doves taking up wings in retreat to contemplation, you soar higher above yourselves, and you foresee the arrows of sins more clearly, and you perceive many things through which you see the progress of salvation to be hindered, which the eye of your heart examines. Whence those things which are dark to others, the spirit sometimes manifests in your consciences, but the splendor of spiritual intelligence being obscured by the darkness of human infirmity, the scrupulosity of doubt is sometimes induced, and difficulties as if inextricable are brought upon you. Indeed, when recently there were present before us messengers, whom you, sons of the provinces, sent—the Minors whom you had gathered in general chapter, and you, son, general minister, appearing personally—it was set forth to us that in your rule certain things are contained that are doubtful and obscure, and certain things difficult to understand; but the blessed confessor of Christ of holy memory, Francis, not wishing his rule to be expounded through the interpretations of any brother, commanded about the end of his life, which command is said to be his testament, that the words of his rule should not be glossed, and that we should use the words themselves, which thus, or thus ought to be understood—not that it is doubted. Adding that the brothers should in no way seek any letters from the Apostolic See, and interposing certain other things, which they could not observe without much difficulty. For which reason, hesitating whether you are bound to the observance of the aforesaid testament, you have petitioned that such doubt be removed from your consciences and those of your brothers through us; and since from the long familiarity which the same confessor had with us, we know more fully his intention, and we stood by him in drawing up the aforesaid rule and in obtaining its confirmation through the Apostolic See, while we were still constituted in a lesser office, you have likewise petitioned that the doubtful and obscure matters of the aforesaid rule be declared, and that response be made concerning certain difficult matters. 1 We grant this: although we believe that the aforesaid confessor of Christ had a pious intention in the aforesaid mandate, and you most justly wish and desire to conform in every way to his holy wishes and desires, we nevertheless, attending to the peril of souls and the difficulties which you might incur on account of this, removing the doubt from your hearts, say that you are not bound to that mandate, which without the consent of the brothers, and especially of the ministers whom it affected universally, could not bind, nor did it bind his successor in any way, since he does not have power to command. To these matters, as we understood through the aforesaid messengers, it is doubted by some of your brothers whether they are bound as much to the Counsels as to the precepts of the Gospel, both because in the beginning of your rule it is contained: The rule and life of the Minors is this, namely to observe the holy Gospel of our Lord Jesus Christ by living in obedience without property and in chastity; and because at the end of the same rule these words are contained: Let us observe poverty and humility and the holy Gospel of our Lord Jesus Christ, which we have firmly promised. Whence they desire to know whether they are bound to other Counsels of the Gospel than to those which in the same rule are expressed prescriptively or prohibitively: especially since they themselves do not intend to bind themselves to others, and scarcely or never can all things be observed to the letter. We, however, briefly respond that you are not bound by the rule to other Counsels of the Gospel except to those to which you have bound yourselves in the same. To the rest you are not bound, just as other Christians, and all the more so from the good and equity by which you have offered yourselves as a holocaust to the Lord refined through contempt of all worldly things. Likewise, since in the same Rule it is forbidden that the brothers receive a denarius or money in any way, either through themselves or through others, and they themselves desire to observe this perpetually, they require to be assured whether to some fearing the Lord faithful persons through whom they might be aided in their necessities, they may dare to present without offense to the rule, and to the same faithful ones for their necessities have recourse with secure conscience, since they know that they have received denarii or money. Which denarii or money, however, they do not intend to cause to be kept by their own authority, nor to exact in the name of a deposit from the same. Concerning which we deemed it right to respond: that if the brothers wish to buy something necessary for themselves, or to make payment for something already bought, they can present either the messenger of him from whom the thing is bought, or some other willing to make alms to them, unless the same should prefer to pay through himself or through his own messengers, who thus presented by the brothers is not their messenger, although presented by them, but rather of him whose mandate he makes payment, or of the one receiving it. The same messenger, however, ought to pay immediately, so that nothing of the money remains with him. But if he is presented for other impending necessities, he can deposit the alms committed to him, just as the lord does with a spiritual or familiar friend of the brothers, by him in place and time for their necessities, as he shall see fit, to be dispensed. To whom also the brothers for such necessities will be able to have recourse, especially if he shall have been negligent or shall have been ignorant of their necessities. Furthermore, since in the same rule it is contained expressly that the brothers appropriate nothing to themselves, neither house nor place nor any thing, and they fear that in the course of time the poverty of the order may be contaminated, especially since some have already said that the property of movables pertains to the whole Order in common: it was humbly petitioned of us that in this we should deign to provide for the perils of souls and the purity of the whole Order. We say that neither in common nor in particular should the property of any thing remain with the order, but the property of utensils and books and their movables, which it is permitted to have, the Order has the use, and the brothers, according as the general minister or the provincials shall have deemed fit to dispose, use them, saving the dominion of places and houses to those to whom it is known to pertain: nor should movables be sold or exchanged outside the order or alienated in any way, unless the cardinal of the Roman Church, who shall be the governor of the Order, shall have given authority to the general or provincial ministers over this, or shall have approved it. Since, however, in a certain chapter of the same rule it is contained that if any of the brothers, instigated by the enemy of the human race, shall have sinned mortally, for those sins concerning which it shall have been ordained that recourse be had to the provincial ministers alone, the brothers are bound to have recourse to them as quickly as they can, without delay: they piously doubt whether this ought to be understood of public sins only, or of public sins equally and private ones. We respond therefore that the aforesaid chapter pertains to manifest and public matters only, willing that the general minister constitute, or cause to be constituted, throughout the provinces as many as their ministers shall see fit, of the more mature and discreet priests, who over private matters hear penitents, unless the brothers, declining to their places with their ministers or custodians, should prefer to confess. Moreover, since the rule forbids that it be permitted to any of the brothers to preach to the people, unless he shall have been examined and approved by the general minister, and the office of preaching shall have been granted to him by the same; you have petitioned to be assured whether for the labors of the brothers and to avoid dangerous journeys the general minister can commit the said examination, approval, and commission of the office of preaching to certain discreet persons to examine generally those who are stationed in the provinces, or specially for certain ones. To which we give such a response, that the general minister can commit these to no one absent; but those who are believed to need examination should be sent to him, or should meet with the provincial ministers for this purpose in the general chapter; if any, however, do not need to be examined for the reason that they are instructed in the theological faculty and the office of preaching, if mature age and other things which are required in such matters are fitting in the same, they can, unless the general minister shall have contradicted them, and in the manner as has been said, preach to the people. Concerning that which the brothers and vicars of the provincial ministers, whom they themselves elect and substitute, doubt, when they come to the general chapter, whether they can receive coming into the order or cast out those already received, we say that they cannot, because neither is this permitted to the ministers themselves, unless special permission over this be granted to them, to whom also the general minister, just as he can grant, so can deny the aforesaid permission; and since according to the same rule, the reception of brothers is not valid except by the provincial ministers in common; much less do the provincial ministers have the power to commit this to others, to whom it, and not to others, has been committed. Furthermore, doubting with you whether for the reason that in the rule it is said that when the general minister dies, by the provincial ministers and custodians in the chapter of Pentecost the election of a successor be made, it is necessary that the multitude of all custodians come together to the general chapter, or so that all things may be treated with greater tranquility, it may suffice that some from each province, who have a voice, attend; we respond thus, that the custodians of each province constitute one from among themselves, whom with their provincial minister they send for them to the chapter, committing their voices to the same. Which also, since you have established it among yourselves, we deemed this statute worthy of approval.
3 Concerning what is to be understood about what is contained in the rule above regarding entry into the diet, namely that brothers shall not enter the monasteries of nuns, except those to whom special license shall have been granted by the Apostolic See, although brothers have hitherto believed this concerning the monasteries of poor enclosed nuns, since the Apostolic See has special care of them, and such understanding is believed to have been declared in the general chapter by provincial ministers through a certain constitution given at the time when the rule was given, while blessed Francis still lived; you have nevertheless requested certification whether this is prohibited generally for all, since the rule makes no exception; or whether it ought to be understood only of the monasteries of the aforesaid nuns. We indeed respond that it is generally prohibited concerning the convents of any nuns whatsoever, and by the name of monastery we wish to be understood the cloister, houses, and interior workshops, for the reason that to other places, where even secular men gather, those brothers may go for the sake of preaching, or seeking alms, to which it shall have been granted them by their superiors according to their maturity or suitability, always excepting the aforesaid enclosed monasteries, to which no one is given the faculty of approaching without license
