OF ST. PAUL IN BRAZIL AND OF CAMPINAS THE DISMEMBERMENT AND ERECTION OF THE DIOCESE OF BRAGANÇA PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 Called to the sacred seat of Peter by divine disposition, we wish to establish in the Lord those things by which divine worship and the spiritual good of the Christian faithful may receive continuous increase, willingly also assenting to the pious petitions of suppliants. Now indeed, the venerable brethren, the Archbishop of St. Paul and the Bishop of Campinas, coming together in like vote for the utility of erecting a new diocese within the boundaries of their dioceses in the city of Bragança, each Ordinary humbly begs that this be done by us.

2 Moreover we, having consulted the venerable brethren, the Cardinals of the Holy Roman Church of the Sacred Congregation of Consistorial Affairs, having also received the favorable vote of the Apostolic Nuncio with the Brazilian Republic, having supplied, insofar as it is necessary, the consent of those whose interest it is or who may presume their interest to be involved, and having also before our eyes those things which were reserved to the Apostolic See in this matter in the Apostolic Letters under lead Ad universas orbis Ecclesias of the twenty-seventh day of the month of April in the year of our Lord one thousand eight hundred and ninety-two; from the fullness of Apostolic power we separate a part from the territory of the aforesaid dioceses of St. Paul in Brazil and of Campinas and within their boundaries we erect a new diocese to be called Bragança in Brazil.

3 The boundaries of which shall be the same as the boundaries of the parishes which are assigned and attributed to it, as follows, namely from the part of the archdiocese of St. Paul, the parishes commonly called Bragança, Piracaia, Atibaia, Joanópolis, Bom Jesus dos Perdões, Nazareth, Juquery (excepting the station of the same name on the railway, in the course of the route which they call the S. Paulo Railway which remains attached to the archdiocese of St. Paul, according to the boundaries of the civil municipality), Jarinu, Itatiba, Tuiuty and from the part of the diocese of Campinas, the parishes commonly called Socorro and Barra Mansa. We erect the seat and cathedral of the new diocese in the city commonly called Bragança and there we elevate into a cathedral church the church dedicated to Mary Most Holy Immaculate in her Original Conception. To this newly erected cathedral church and to its bishops for the time being we grant the honors, insignia, favors, rights and privileges which other cathedral churches and their prelates in Latin America enjoy and possess by common law or legitimate custom; and we constitute the same cathedral church suffragan to the metropolitan church of St. Paul in Brazil, and we subject its bishops for the time being to the metropolitan jurisdiction of the same Archbishop of St. Paul, reserving however to us and to the Apostolic See the faculty freely to decree a new dismemberment of this diocese whenever it shall seem opportune in the Lord. Since however the circumstances of the times prevent the establishment at present of a chapter of canons in this newly erected diocese, we order that, in place of canons, according to the norm of canons 423 and following of the Code of Canon Law, diocesan consultors be elected. We further command that, as soon as it can be done, at least a small diocesan seminary be erected according to the decrees of the Code and the norms of the Sacred Congregation of Seminaries, and that at the expense of this diocese, two chosen young men or at least one at present be sent to the Pontifical Pius Latin American College of the City, without interruption of succession. As to the governance and administration of this diocese, to the election of a Vicar Capitular or Administrator, sede vacante, to the rights and duties of clergy and faithful and other such matters, we order that those things be observed which the sacred canons decree. As to the clergy in particular, we establish that as soon as the erection of the diocese is made, by that very fact presbyters shall be considered ascribed to that church in whose territory they legitimately exist. Moreover all documents and acts concerning the new diocese shall, as soon as it can be done, be handed over by the chancelleries of the archdiocese of St. Paul and of the diocese of Campinas to the chancellery of the diocese of Bragança, that they be preserved in its archive. The episcopal mensa shall be constituted by the emoluments of the Curia and other offerings which are accustomed to be provided by the faithful, for whose good the diocese has been erected, except those things which have already been collected for this purpose.

4 But those things which by these Letters, by Apostolic authority, have been decreed by Us, it is permitted to no man, at no time whatsoever, to infringe, or to oppose them, or in any way to contravene them. If anyone, which God forbid, shall presume to attempt this, let him know that he will incur the penalties established by the sacred canons against those who resist the exercise of ecclesiastical jurisdiction. Moreover, for the execution of these things, We appoint the venerable brother Henry Gasparri, Archbishop with the title of Sebastea, Apostolic Nuncio in the Brazilian Republic, granting to him the necessary and opportune faculties, even of subdelegating, for the purpose in question, another man constituted in ecclesiastical dignity, and of pronouncing a definitive sentence concerning any difficulty or opposition that may occur, with the burden imposed of transmitting to the Sacred Consistorial Congregation, within six months to be reckoned from the date of these presents, an authentic copy drawn up in proper form, of the absolute execution of this Our mandate.

Mandamus insuper ut, quamprimum fieri poterit, saltem parvum Seminarium dioecesanum, iuxta Codicis decreta ac Sacrae Congregationis de Seminariis normas erigatur utque ipsius dioecesis sumptibus, duo delecti iuvenes aut saltem unus in praesenti, in Pontificium Collegium Pium Latinum Americanum de Urbe, non intermissa vice, mittantur. Quod vero attinet ad huius dioecesis regimen et administrationem, ad Vicarii Capitularis seu Administratoris, sede vacante, electionem, ad clericorum et fidelium iura et onera aliaque huiusmodi servanda iubemus quae sacri canones decernunt. Quod autem ad clerum in particulari spectat, statuimus ut simul ac dioecesis erectio facta fuerit, eo ipso presbyteri censeantur adscripti Ecclesiae illi, in cuius territorio legitime exstant. Omnia insuper documenta et acta novam dioecesim respicientia, quamprimum fieri poterit, a cancellariis archidioecesis Sancti Pauli et dioecesis Campinensis tradantur cancellariae dioecesis Brigantiensis, ut in eius archivo serventur. Episcopalem mensam constituent Curiae emolumenta et ceterae oblationes, quae a fidelibus, in quorum bonum dioecesis erecta est, praeberi solent, praeter ea, quae ad hoc iam collecta sunt.

4 Quae autem hisce Litteris, Apostolica auctoritate, a Nobis decreta sunt, nulli hominum, nullo unquam tempore, infringere, aut iis repugnare, vel quomodolibet contraire liceat. Si quis, quod Deus avertat, hoc attentare praesumpserit, sciat obnoxium se evasurum esse poenis a sacris canonibus contra obsistentes exercitio ecclesiasticae iurisdictionis statutis. Ad haec autem exsecutioni mandanda deputamus venerabilem fratrem Henricum Gasparri, Archiepiscopum titularem Sebastensem, in Brasiliana Republica Apostolicum Nuntium, tribuentes ei necessarias et opportunas facultates, etiam subdelegandi, ad effectum de quo agitur, alium virum,, in ecclesiastica dignitate constitutum, ac definitive sententiam dicendi de quavis occurrente difficultate vel oppositione, imposito onere ad Sacram Congregationem Consistorialem intra sex menses a data praesentium computandos, fidem authentica forma exaratam, absolutae exsecutionis huius Nostri mandati transmittendi.

1 Alla sacra sede di Pietro, a cui siamo stati chiamati dalla divina disposizione, vogliamo stabilire nel Signore quelle cose per le quali il culto divino e il bene spirituale dei cristiani ricevano continuo incremento, volentieri anche accogliendo le pie suppliche dei ricorrenti. Ora, poiché i venerabili fratelli, l'odierno Arcivescovo di San Paolo e il Vescovo di Campinas, concordi nel voto dell'utilità di erigere nei confini delle loro diocesi una nuova diocesi nella città di Braganza, ciascuno dei due Ordinari supplice preghiera a Noi chiedono che questo sia fatto da Noi.

2 Inoltre Noi, di concerto con i venerabili fratelli Cardinali della Santa Romana Chiesa della Sacra Congregazione Concistoriale, avuto anche il favorevole voto del Nunzio Apostolico presso la Repubblica Brasiliana, supplito, per quanto sia necessario, il consenso di coloro il cui intervento sia richiesto o si presuma che sia loro interesse, e avendo inoltre presente ciò che nelle Lettere Apostoliche munite di piombo Ad universas orbis Ecclesias del ventisettesimo giorno del mese di aprile dell'anno del Signore milleottocentonovantadue fu riservato alla Sede Apostolica in questa materia; dalla pienezza della potestà apostolica Noi dal territorio delle predette diocesi di San Paolo in Brasile e di Campinas una parte separiamo e entro i loro confini una nuova diocesi di Braganza in Brasile da nominarsi erigiamo.

3 I cui confini saranno gli stessi confini delle parrocchie, che ad essa, come di seguito, si assegnano e si attribuiscono, cioè dalla parte dell'arcidiocesi di San Paolo, le parrocchie volgarmente Braganza, Piracaia, Atibaia, Giannopoli, Bom Jesus dos Perdões, Nazareth, Juquery (eccettuata la stazione ferroviaria dello stesso nome, nel percorso della ferrovia che chiamano S. Paulo Railway che rimane annessa all'arcidiocesi di San Paolo, secondo i confini del municipio civile), Jarinu, Itatiba, Tuiuty e dalla parte della diocesi di Campinas, le parrocchie volgarmente Socorro e Barra Mansa. La sede e la cattedra della neo-diocesi erigiamo nella città volgarmente Braganza e lì in chiesa cattedrale eleviamo la chiesa di Maria Santissima Immacolata nel suo Concepimento dedicata. Alla quale chiesa cattedrale novellamente eretta e ai suoi Vescovi pro tempore attribuiamo gli onori, gli insegni, i favori, i diritti e i privilegi, di cui le altre chiese cattedrali e i loro Presuli in America Latina per diritto comune, o per legittima consuetudine godono e fruiscono; la medesima chiesa cattedrale costituiamo suffraganea della chiesa metropolitana di San Paolo in Brasile, e i suoi Vescovi pro tempore sottoponiamo al diritto metropolitico dello stesso Arcivescovo di San Paolo, riservata tuttavia a Noi e alla Sede Apostolica la facoltà di liberamente decernere una nuova dismembrazione di questa diocesi, tutte le volte che ciò nel Signore opportuno fosse sembrato. Poiché però le circostanze dei tempi impediscono che al presente un Capitolo di canonici in questa diocesi novellamente eretta si istituisca, ordiniamo che, in luogo dei canonici, secondo la norma dei canoni 423 e seguenti del Codice di diritto canonico, si eleggano i Consultori diocesani. Inoltre ordiniamo che, al più presto che sia possibile, almeno un piccolo Seminario diocesano, secondo i decreti del Codice e le norme della Sacra Congregazione dei Seminari, si erga e che a spese della medesima diocesi, due giovani scelti o almeno uno al presente, nel Pontificio Collegio Pio Latino Americano dell'Urbe, senza interruzione, si mandino. Per quanto riguarda il governo e l'amministrazione di questa diocesi, l'elezione del Vicario Capitolare o dell'Amministratore, sede vacante, i diritti e gli oneri dei chierici e dei fedeli e altre cose di tal genere, ordiniamo che si osservino quelle cose che i sacri canoni decernono. Per quanto riguarda il clero in particolare, stabiliamo che non appena la diocesi sia eretta, per ciò stesso i presbiteri si considerino ascritti a quella Chiesa, nel cui territorio legittimamente esistono. Inoltre tutti i documenti e gli atti riguardanti la nuova diocesi, al più presto che sia possibile, dai cancellieri dell'arcidiocesi di San Paolo e della diocesi di Campinas si consegnino alla cancelleria della diocesi di Braganza, affinché nel suo archivio si conservino. La mensa episcopale costituiranno i proventi della Curia e le altre oblazioni, che dai fedeli, per il cui bene la diocesi è eretta, si suole offrire, eccettuate quelle che a questo scopo già sono state raccolte.

4 Quanto poi è stato da Noi decretato con queste Lettere, per autorità Apostolica, a nessun uomo, in nessun tempo mai, è lecito infrangere, o contrastare, o in alcun modo opporsi. Se qualcuno, che Dio non voglia, osasse tentare ciò, sappia che incorrerà nelle pene stabilite dai sacri canoni contro coloro che si oppongono all'esercizio della giurisdizione ecclesiastica. Per l'esecuzione di quanto sopra, deputiamo il venerabile fratello Enrico Gasparri, Arcivescovo titolare di Sebastea, Nunzio Apostolico nella Repubblica Brasiliana, conferendogli le facoltà necessarie e opportune, anche di subdelegare, allo scopo di cui si tratta, un altro uomo costituito in dignità ecclesiastica, e di pronunciare sentenza definitiva su qualsiasi difficoltà o opposizione che si presenti, con l'obbligo di trasmettere alla Sacra Congregazione Concistoriale, entro sei mesi dal presente computati, autentica copia in forma legale, dell'assoluta esecuzione di questo Nostro mandato.
