Bull appointing a general auditor of the causes of the Apostolic Camera

Bull of Pope Innocent VIII ·

to appoint for the hearing thereof, — 10. Derogation of contrary provisions. — 11. The auditor's oath to exercise his office faithfully. — 12. Admonition to administer it well. Innocent, Pope VIII, to our beloved son Master Peter of Vicenza, Doctor of both Laws, our chaplain, and general auditor of the causes of the Apostolic Chamber's Curia, greeting and apostolic blessing.

1 Chiefly on account of the devotion which you are proved to bear towards us and the Roman Church with steadfast faith and sincerity of heart, as well as the excellence of your learning and the dignity of your life and the honesty of your morals and other merits of your probity and many virtues, by which we perceive your person to be commended by the testimony of worthy men, directing the gaze of our consideration thereto, and therefore cherishing the undoubted hope that those things which we shall decide to entrust to you, you will execute with the greatest care and exact diligence in a praiseworthy manner, we deem it fitting, nay rather due, that we should favour and benefit your same person with appropriate favours and graces.

2 § 1. Since therefore the office of general auditor of the hearing of causes of the Curia of the Apostolic Chamber, which John Prioris, general auditor of the causes of the said Curia, while he lived, exercised, has become vacant at the Apostolic See and remains vacant at present by the death of the said John, who ended his days at the Apostolic See.

3 § 2. We, relying upon your learning, probity and singular prudence and other such virtues, which in you, divine clemency protecting, we place in special confidence; and hoping that you will be able, willing and capable of exercising well, happily and laudably the aforesaid office of auditor of the causes of the Curia of the Chamber, by our own motion, not at your instance or that of another made to us through you in this matter, but of our mere deliberation, and from our certain knowledge, do by apostolic authority, by the tenor of these presents, confer, grant and assign to you the aforesaid office of general auditor of the causes of the Curia, thus vacant as aforesaid, with all the honours and burdens, privileges, rights and emoluments customary thereto; and by the same authority we make, constitute, create and appoint you our and of our beloved son Raphael Sancii of St. George at the Golden Veil, deacon cardinal, our present and for the time being camerlengo, and general auditor of the causes of the Curia aforesaid.

4 § 3. And to you, through yourself or another or others suitable as your lieutenant or lieutenants and vicars, whom for the time being, as often as it shall please you, you shall decide to assume or appoint, concerning all and singular crimes, excesses and offences, in the Roman Curia or outside it, perpetrated and to be perpetrated by whomsoever, whether officials of the Apostolic See or other curialists following the Roman Curia, of whatsoever ecclesiastical or worldly dignity, status, degree, order or condition, both by the denunciation and accusation of our fiscal for the time being present and also ex mero officio, to inquire; and upon those, both by such inquisition and by accusation or denunciation, to proceed, those found culpable, according to the exigency of the excesses perpetrated by them, to punish.

5 § 4. Likewise all and singular, both civil and criminal and mixed, spiritual, ecclesiastical and lay and other whatsoever causes, in which mutilation of limb or effusion of blood and condemnation are not intended, jointly or severally, howsoever and in whatsoever manner moved and to be moved in the same Curia; or howsoever, now and hereafter, pending between whatsoever parties, even by way of inquisition ex officio. And faculty is given to the same to know criminal causes by lieutenant. And causes both civil and criminal moved in the Curia, etc.

9 § 5. And those matters which, whether by appeal made from grievances inflicted and unjust sentences, even those pronounced by our beloved son in Christ, the Marshal, and in his Court, and by any other judges whatsoever, ordinary or delegated, or arbiters or arbitrators in lands subject to the Roman Church mediately or immediately, even in those granted in fief or vicariate; or otherwise to the Apostolic See, even by way of judicial or extrajudicial reclamation or otherwise by way of nullity, have been or shall be brought forward; namely those in which there is no question of a sum greater than twenty-five ducats of the Camera, or exceeding the true value of that sum, to be decided summarily, simply and plainly, and without the formality and appearance of judgment, with only the truth of the matter and fact examined, no terms being observed, even those which are customarily observed from the style or ordinance of the Apostolic Palace and otherwise, but otherwise to be heard, examined and decided in the usual manner, and to be terminated with proper conclusion.

10 § 6. Likewise your sentences and those of your lieutenants and others whatsoever in proceedings delegated by you through any delegated or subdelegated judges of those sentences; and of any general processes by the Roman Pontiff, as much on the day of the Lord's Supper as otherwise, which are customarily carried out with the fulminance of ecclesiastical censures and penalties; and also of any others whatsoever, both by us and by the Roman Pontiff existing for the time being, whether in specific cases or in general and otherwise in any manner whatsoever of those sentences to be rendered, the execution of which, even if to the delegated judges themselves or subdelegated or any others whatsoever it should perhaps be specially committed by us or the aforesaid See or should be committed for the time being, we decree and declare to be committed to you and your lieutenants cumulatively, but not exclusively, to be done; committing those to proper termination, even with invocation of the aid of the secular arm, if it should be necessary.

11 § 7. And the aforesaid and others, even those living outside the Roman Court, yet subject to your jurisdiction by reason of salary in the Roman Court, to be known by any judges whatsoever, of debts or expenses of mutual loan or contract made in the same Court, or otherwise in any manner voluntarily submitted and to be submitted, Universities, colleges and persons of any degree and status, even of pontifical preeminence and otherwise persons living in the said Court, at the instance of those to whom it shall concern, even for expenses, damages and interest, in any causes whatsoever or contracts, as often as it shall be expedient, to be cited, admonished, required, suspended, and specially to be interdicted, excommunicated and aggravated repeatedly; those, as it shall be expedient, to be arrested, imprisoned and detained; penalties and fines, according to the quality of their offences, excesses and crimes, to be inflicted and imposed upon them; and those same and any of them, which we decree can be absolved by no one, even with the consent of the parties and specially delegated for that purpose, except by you and your lieutenant, to be imputed to collusions and frauds, and from the same individual penalties and fines, spiritually or temporally, to be absolved and released.

12 § 8. And generally, all and singular things whatsoever to be done, established, disposed, commanded, ordered and exercised, which to such an office of auditor pertain by right or custom, which we approve by these presents, in any manner whatsoever, and which the auditors of causes of the said Court, who existed for the time being, and from the faculty granted to them by the aforesaid See, were able to do and perform, establish and dispose, receive, command, order, exercise, ordain and execute in any manner whatsoever, or even ought or were accustomed to do, to perform, establish, dispose, receive, order, exercise, ordain and accomplish.

13 § 9. And one or more to exercise the aforesaid office of auditor of causes of the Court, as often as it shall please you, in your place to substitute and to revoke the substituted, and those or others again to substitute and depute, full and free power and authority, by the said apostolic authority, we grant and concede. The processes and sentences which you shall make, establish and render against any contradictors and rebels, we shall hold as ratified and approved, and those we shall cause, with the Lord as author, to be inviolably observed even unto condign satisfaction.

14 § 10. Notwithstanding the constitutions and ordinances apostolic, and privileges, concessions and indults whatsoever to communities and universities of lands subject to the Apostolic See mediately or immediately, by us or our predecessors the Roman Pontiffs, under whatsoever forms of words, even if special, specific and express mention ought to be made of them, granted, to the contrary whatsoever.

15 §11. We will, however, that before you, Auditor, begin to exercise faithfully the office of auditor of cases of the Roman Curia, you shall take an oath in the customary form in the hands of our aforesaid camerlengo or his deputy, concerning the faithful exercise of such office.

16 exercising it, in the hands of the aforesaid camerlengo of ours or his deputy you shall take an oath in the customary form.

17 § 12. You therefore shall undertake the aforesaid auditorship with prompt devotion, and shall execute it with such diligent study, care, moderation and integrity, that your work may redound to the praise and glory of God, and to the good and honour of the same Church and Curia, and to the advantage and laudable example of private persons, and may commend you the more deservedly to us and the aforesaid See, as we hope.

18 Given at Rome, etc., in the year of our Lord one thousand four hundred eighty-five, on the eleventh day before the Kalends of January, in the second year of our pontificate.

cognizione da deputarsi, — 10. Deroga dei contrari. — 11. Giuramento dell'Auditore di esercitare fedelmente l'ufficio. — 12.
