Brief on the regulation of ricettizie churches
1 To perpetual memory of the matter. The care with which we are pressed concerning the salvation of the Lord's flock entrusted to us impels us to procure those things which we know will redound to the utility and more prosperous governance even of the lesser Churches. With willing mind therefore we have received the petitions which our Dearest Son in Christ Ferdinand the First, King of both Kingdoms of Sicily, caused to be brought before Us, that we might opportunely provide for the more useful administration of the Churches, which are called Receptitiae, existing in his Dominion this side of the Strait. For it was represented to us that these Receptitiae Churches, of which some are called numbered and others unnumbered, according as namely a designated number of Ministers or all the Presbyters of the places generally are received there for performing the sacred rites, have been increased by the piety of the faithful with suitable revenues, which are distributed among them in proportion to each, who are devoted to their service, and especially to the care of souls there usually attached to them: yet that some norm necessarily had to be prescribed by which, all respect of persons being removed, such Presbyters should be aggregated to Receptitiae Churches of this kind; who would receive fixed portions, whether measures or annual stipends, who, commended for piety, learning, and prudence, would excellently discharge the duties entrusted to them for the utility of the faithful: our apostolic authority was therefore sought, that we might establish such a norm and commit it to the Ordinaries of places to be carefully observed. Since therefore we have judged that this most pious King's desire would conduce to the highest utility of souls and to a holier worship of those Churches, we have deemed it right to assent to it without hesitation, and since there was no special provision concerning Receptitiae Churches established in the convention entered into with his Majesty in the year above, we have deemed it right to provide by our Apostolic authority for the more useful administration of the aforesaid Churches in that manner which we have perceived to be more expedient in the Lord. Wherefore from certain knowledge, and mature deliberation of ours, and from the fullness of Apostolic power, by the tenor of these presents we decree and command, that henceforth only those Priests and Clerics shall be admitted to receive portions in Receptitiae Churches who shall have been found more commended for piety and learning by our venerable brothers the Archbishops and Bishops, or the Ordinaries of places. We therefore command that whenever anyone is to be put in possession of the right to obtain a fixed portion in Receptitiae Churches, a test of ability and morals shall first be had in those who desire to be admitted to it, and an examination of the same shall be instituted by that Ordinary himself, or his Vicars General, and at least three of the Synodal examiners, and when this has been duly completed, the Ordinary, according to his faith and integrity, shall select those whom he shall judge more worthy, and put them in possession of the right to obtain the fixed portion. Those thus selected and commended by letters of the Ordinaries, we will to be recognized as aggregated and ascribed to a certain Receptitiae Church, and put in possession of the right to obtain the fixed portion. We have removed from anyone, and especially from unsuccessful competitors, the faculty of interposing an appeal to the Metropolitan, or to the Bishop senior in the Province, for which causes alone we declare the use of such appeals to be forbidden. We are, however, most confident that our venerable brothers the Archbishops and Bishops, and the Ordinaries of places will not only obey these our precepts, which we have issued for the better ministry of such Churches, with great willingness and zeal, but indeed will apply all study, so that ministers of each Church suited to its circumstances may be chosen, who both diligently discharge the parts of their office, and are ready with labor, counsel, and solicitude in instructing the people and directing them in the path of Heaven. Decreeing that these present letters shall always be firm, valid, and effective, and shall obtain and secure their full and complete effects, and shall be inviolably observed by all to whom it pertains, and shall pertain in any way in the future, and thus in the aforesaid matters by any judges ordinary and delegated, even auditors of causes of the Apostolic palace, nuncios of the Apostolic See, and Cardinals of the holy Roman Church, even legates a latere, with the faculty and authority of judging and interpreting otherwise being removed from them and from each of them, it ought to be judged and determined, and if anything contrary to these things shall happen to be attempted by anyone whatsoever with any authority, knowingly or unknowingly, it shall be null and void. Notwithstanding, insofar as it be necessary, the constitutions and ordinances of our Predecessor of happy memory Pope Benedict XIV on the division of matters, and other Apostolic constitutions issued in universal, provincial, and synodal Councils, whether general or special, and also the statutes and customs of the said Churches, even strengthened by oath, Apostolic confirmation, or any other firmness, and privileges granted and letters Apostolic issued in any way to the contrary of the aforesaid, confirmed and renewed, all and each of which, their tenor being held as fully and sufficiently expressed and inserted word for word in these presents, otherwise remaining in their force, we specially and expressly derogate from them for the purpose of the aforesaid, this time only.
2 We will finally that to copies of these letters, or even printed exemplars, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given as would be given to these presents themselves, if they were exhibited or shown.
