Constitution on the reform of the Apostolic Penitentiary

Constitution of Pope Benedict XII ·

Procurators. — Clauses.

1 Benedict, bishop, servant of the servants of God, for perpetual memory of the matter.

2 In the field of the Lord, constituted as workers and guardians of the universal Church by the Lord, although unworthy, we desire to exercise in it such cultivation, through which the fruits of holy works, a harvest pleasing to God and sincere faith of the faithful, with the thorns and thistles of sins rooted out therefrom, may grow strong. Hence it is, that we, weighing with careful meditation, that to the Apostolic See, the universal mother and teacher of the faithful, as to a singular harbor of salvation for the washing of confession and the remedy of saving penance, especially in cases specially reserved to that See, all Christian faithful when they have need devoutly have recourse, both to us and to the greater and other lesser Penitentiaries of ours, laying bare the wounds of their sins for obtaining spiritual salvation: this we wish for you, this we desire more ardently with all our longings, that the office of our Penitentiary may proceed in all punctuality and sincerity, and that the greater and other lesser Penitentiaries aforesaid, and the writers of the same Penitentiary present and future, and procurators, and other ministers of the said office may strive to exercise brightly, purely and sincerely those things which are incumbent upon them or shall be incumbent upon them by reason of the said office; and that they show themselves solicitous and obsequious toward the salutary and swift dispatch of those who from diverse parts of the world shall have recourse to the same greater and lesser Penitentiaries as physicians of souls, providing for their spiritual salvation, as far as pertains to their office, carefully, discreetly and wholesomely.

3 § I. In order therefore that the said Penitentiaries and writers present and future, and other ministers of the said office, and their procurators, who shall exercise the ministry of procuration concerning those things which pertain to the said office of the Penitentiary, may make straight their steps through most salutary institutions, as it were through certain inviolable paths of commandments, we have deemed it fitting by apostolic authority to make the infrawritten constitutions, to be inviolably observed by the greater and lesser Penitentiaries, writers, ministers and procurators, present and future, in perpetuity for all future times.

4 § 2. First therefore by apostolic authority we establish and also ordain, that for the more speedy dispatch of doubtful cases occurring in the aforesaid office, the greater Penitentiary shall have with him one skilled and experienced doctor in canon law, to be specially appointed by him to examine diligently all and singular petitions, letters of the aforesaid Penitentiary concerning the doubtful cases occurring expressed in the petitions offered: and the same doctor, whenever and as often as such doubtful cases shall occur, shall report them to the greater Penitentiary aforesaid, and shall confer and deliberate upon them with the same: which conference and deliberation having been had beforehand, by the consent and according to the ordinance of the said greater Penitentiary, letters concerning them shall be drawn up and shall obtain swift dispatch.

5 § 5. The same greater Penitentiary shall also appoint one person sufficient and suitable to receive and examine all and singular petitions pertaining to the office of the Penitentiary itself, and to dispatch all petitions according to the common course of the office of the Penitentiary containing no doubt, and which according to the said course have been accustomed to be dispatched without any difficulty: but doubtful ones he shall refer to the greater Penitentiary or the doctor aforesaid.

6 These laws are sacred so that anyone may conduct himself properly in the office of the Penitentiary.

7 Concerning the doctor to be employed in counsel by the Supreme Penitentiary in doubtful cases.

8 Concerning another person to be appointed by the same to dispatch non-doubtful matters.

9 § 4. Moreover, correctors of the letters of the said Penitentiary, from among the writers of the same office, more expert and suitable in the same office, shall be appointed by the said Major Penitentiary for the correction of such letters, who shall be bound to come personally each day to a certain place ordained or to be ordained by the said Major Penitentiary for this purpose, just impediment ceasing, at the hour of Prime or another suitable hour: and there they shall examine diligently all and singular letters of the said Penitentiary, and shall correct and reform them: and thus examined and corrected, they themselves, or one of them, shall deliver them as quickly as possible to the sealer of the said Major Penitentiary, whoever he may be at the time, with their own hands; or for more expeditious dispatch of the said letters by the same correctors or one of them, they shall be placed in one chest in the house of the said Major Penitentiary specially appointed for this, which shall be locked with two similar keys: of which one shall be committed to the custody of the sealer, and the other to one of the said correctors, to be taken from it by the said sealer and sealed and returned, as has been customary hitherto. The said letters, moreover, after they shall have been sealed, until they shall have been restored to those to whom they belong, shall be placed by the said sealer in a chest appointed for their custody: which chest shall be kept in the house of the said Major Penitentiary, and shall have two similar keys, of which one by the distributor of the said letters, and the other by a certain faithful person, whom the said Major Penitentiary shall have deemed fit to appoint for this, ought to be kept, so that thus the dispatch of the poor and the restoration of the same letters may more easily follow.

10 § 5. But declaratory letters and other letters containing ambiguous cases, the said correctors shall assign to the aforesaid doctor for examination and reform, delay of any kind ceasing. The same doctor also, after they shall have been examined and corrected by him, unless doubts should occur to him, concerning which the Major Penitentiary would need to be consulted, shall be bound to deliver them to the sealer manually, or under his seal by his own sworn messenger: and both the doctor and the person appointed by the aforesaid to receive petitions, as is premitted, as well as the doctor and also the other correctors and the aforesaid sealer, shall individually and severally take due oaths in the hands of the same Major Penitentiary concerning the faithful exercise of these matters by them according to the forms which are contained below.

11 § 6. But supplications which are to be read to us, the Pope, or to our successors the Roman Pontiffs, shall be received, arranged and preserved with diligence by the aforesaid doctor: and none shall be placed in the number of those to be read without certain and express knowledge of the said Major Penitentiary; and those which shall have been received, shall be received quickly and examined: and after they shall have been expedited, they shall be restored to those to whom they belong, or to their procurators.

12 § 7. The same thing concerning swift reception for quick and easy dispatch, and undelayed restoration shall be observed concerning other supplications of the aforesaid office: for which nothing whatsoever in any way before or after reception, dispatch and restoration shall be received or given.

13 § 8. We establish moreover, and also ordain, that all and singular minor Penitentiaries on each day on which it is customary for them to reside in the Church for hearing confessions, each morning, namely at the hour when Prime is rung in the greater Church of the city or place where the Curia shall reside, shall go to the Church or place appointed or to be appointed for hearing confessions, and for executing other matters which pertain to their office. And that they shall remain there until Terce shall have been rung in the aforesaid greater church; unless a reasonable cause should prevent the same Penitentiaries, or some or any of them, ought to do so.

14 all fraud and deceit being entirely excluded in this matter.

15 § 9. The same Penitentiaries shall also hear customarily and charitably the sins or confessions of those who shall confess to them, and shall absolve them in cases only conceded or permitted to them: nor shall they disdain to hear the same confessants on account of their poverty or abject state, or any other defect, or to exercise their office toward them; and shall not exasperate the said confessants on account of the enormity or turpitude of sins which they shall have discovered in confession by reproaching them, but shall hear them patiently; and by salutary admonitions shall diligently lead them, so that they may entirely desist from such sins, and abstain from other also whatever offences and sins, explaining to them, at least in general, the punishments of evils and the rewards of goods in a salutary manner.

16 § 10. Moreover, let no one of these lesser Penitentiaries demand, seek, or receive anything for themselves or through another on account of such confessions, faculties, absolutions, or other matters pertaining to their office, whether directly or indirectly, even if freely offered, or even under the title or appearance of alms, or in any other manner whatsoever: and let none of them knowingly absolve or dispense in any case not permitted to them. Let none of them knowingly absolve anyone from sin or sins in any doubtful case, or dispense in the said case with anyone, unless by special mandate of the Roman Pontiff or the Major Penitentiary, to whom they are bound to set forth the said case without any revelation or expression of the person's identity: nor let them impose monetary penances, expressly to be applied to themselves, or to some certain person, or to their Order, or to another. But let them impose and cause to be made satisfaction or monetary or real restitution of any kind that is certain, or to be made by some persons, and let them cause it to be made to those alone to whom, on account of damages inflicted upon them, or things taken away, or other similar cases, restitution or satisfaction ought to be made. Concerning uncertain damages inflicted, or things taken away, when namely the persons or places to whom restitution or satisfaction ought to be made are unknown, let the said lesser Penitentiaries in no way involve themselves; but let them refer these matters to the Major Penitentiary aforesaid: if they do otherwise, they are to be gravely punished.

17 § 11. These same Penitentiaries are bound to hear the confessions of women in the place appointed to them for this purpose only, and not elsewhere: unless the infirmity or the elevated status of the said women should require otherwise: but in this latter case let them hear their confessions in some church and in an open place. They are bound to hear the confessions of men in the aforesaid place appointed to them; unless the infirmity of the said men or the status and condition of the confessing person should suggest otherwise.

18 § 12. We also strictly forbid the same Penitentiaries to have letters of absolution or dispensation of those whose confessions they shall hear written by others than by the writers of Our Penitentiary, who have been or shall be appointed to the office of such Writing Office by the Roman Pontiff.

19 § 13. The said Penitentiaries also, loving one another in brotherhood, shall abstain entirely from any detraction and emulation, and shall hold and observe the unity of peace and concord.

20 § 14. We will moreover that if on Sundays or feast days, on which the said Penitentiaries are not accustomed to come to the church or other place appointed to them for this purpose, a multitude of pilgrims should arrive at the Roman Curia to obtain confessions or absolutions or dispensations, the said Penitentiaries, all and each, if they shall know of this, on the same Sundays and feast days, barring just impediment, shall come to the same church or other place appointed for this purpose at the hour of Prime for the easier dispatch of the said pilgrims arriving; and they are bound to hear and dispatch them, insofar as pertains to their office.

21 Letters of absolution or dispensation to be written only by writers appointed for this purpose. Penitentiaries to abstain from detraction, etc.

22 Concerning pilgrims

23 to be dispatched.

24 their common

25 affairs.

26 cede, and they are bound to hear and dispatch them, insofar as pertains to their office.

27 § 15. We also strictly forbid that the said Penitentiaries commit the power of hearing confessions granted to them by reason of their said office, generally or specially within the Roman Curia or outside it, to others; nor let them commit the power of imposing penances or dispensing granted to them, except in cases confessed to them, as in those cases they have been accustomed by the custom of the said office to commit by their letters sealed with the seal of the office from of old. But if perchance a case should arise, that so great a concourse of pilgrims, and so great a multitude or pressure of those flowing together should threaten, that the said Penitentiaries should not be able to suffice for the dispatch of them, let them have recourse to the Major Penitentiary aforesaid, who, during that necessity, shall endeavor to provide suitable confessors who may aid the said Penitentiaries in these matters, as shall seem good to him.

28 § 16. Such confessors and helpers, when admitted to hear confessions, shall absolve, dispense, and impose penances in cases only granted to the same lesser Penitentiaries, and in the place or church appointed for the said Penitentiaries to sit, from whom also the same Major Penitentiary shall receive an oath that they will conduct themselves well and faithfully in this matter, and that they will receive nothing whatsoever from anyone for the aforesaid dispatch.

29 nor admitted. they may dispense, impose penances in those cases only conceded to the minor Penitentiaries, and in the place or church appointed for sitting to those same Penitentiaries, from whom also the same major Penitentiary shall receive an oath that they will conduct themselves well and faithfully in this, and that they will receive nothing whatsoever for the aforesaid matters to be expedited from anyone.

30 § 17. We have moreover also decreed and ordained that each of the said Penitentiaries shall assign his own seal, which he uses for sealing the letters of the said office under his own name and that of the said office, to be held and preserved by two common clerks specially appointed for this purpose, or to be appointed in the future, for sealing the aforesaid letters more quickly; and that by the seals which the said Penitentiaries use in the aforesaid office, no other letters except those of the said office shall be sealed. However, each of them may, if he wishes, have another seal of different impression and form under his own name for sealing his other letters.

31 § 18. There shall also enter the Penitentiary the said minor Penitentiaries, who now are and shall be for the time being, according to the form noted below. Our intention and will is, however, that the aforesaid greater Penitentiary ought in the said office of the Penitentiary to place and institute the said two clerks, sufficient and suitable and faithful, for holding and preserving the said seals and letters to be sealed; and also to remove them, and to substitute others in place of those removed whenever and as often as it shall seem expedient to him, from whom also the same greater Penitentiary shall receive an oath according to the form which is contained below. These two clerks, moreover, for conducting some clerks suffering a defect or blemish in some member to the presence of some cardinals of the holy Roman Church for inspection and consideration of the aforesaid defect or blemish, or also for conducting other persons to other churches of the city or place in which the Roman Curia shall reside, shall not receive from individuals more than the fees fixed by us on this matter; but where they were notably poor, nothing shall be received from them in the aforesaid cases.

32 § 19. Again we decree and ordain that the scribes of the said Penitentiary shall cause the distributor of petitions, and also of letters, whom they shall have chosen to elect, before he distributes anything, to be presented by the aforesaid correctors, or at least by one of them, to the aforesaid greater Penitentiary: from whom also the same greater Penitentiary shall receive a corporal oath according to the form noted below. Each moreover of the said scribes shall take care to write the letters of the same office distributed to him on good and sufficient parchment and in decent form, in good and not cursive script, without any suspicious erasure, quickly, and nevertheless shall take an oath according to the form which is contained below.

33 § 20. We have also established and do ordain that letters of the said office, to be written by scribes, containing any clarification or dispensation, and similar ones shall have on the upper part and on the other two sides a space of unwritten parchment of the width of three fingers, or thereabouts, and on the lower part such space doubled. Confessional letters in larger or smaller form shall have on the upper part and on either side a space of at least two fingers, or thereabouts; on the lower part they ought to contain three fingers; otherwise by the distributor of petitions and letters of the said office such letters shall not be signed, nor released, nor even sealed; but by the same scribes who shall have written them, freely and speedily with the aforesaid proper spaces they ought to be rewritten: and unless they shall have done this, or if they shall have delayed within the space of one natural day to rewrite them, the impediment ceasing justly, they or those to whom the aforesaid letters are to be rewritten shall provide the necessary expenses up to the expedition of the same letters if they wish to receive them. Let each of the said scribes expedite letters distributed to him quickly, receiving nothing beyond the release for their speedy expedition, or otherwise in any way: and the same scribes shall not exasperate those whose letters they are, or others, nor threaten them through themselves or through another or others, nor offend them by word or deed; but let them treat them benignly and favorably, attaching to the same letters the supplications on which they made those letters, so that fraud may not be committed. Moreover, letters which shall pass under the name even of the lesser Penitentiaries shall similarly be written in good parchment, form and script without any suspected erasure and fraud or deceit quickly by the same scribes, and diligently be examined by the corrector, and also be corrected; and open letters on cords of threads as is done with letters of the said office, which are made under the name of the greater Penitentiary, by deputies appointed for this purpose, clerics shall seal. Furthermore, the said scribes shall betake themselves to the church or place appointed for this well in the morning, namely at the hour when the aforesaid Penitentiaries come to the same church or place. Let each of the said scribes reduce and write the petitions distributed to him according to the proper form in letters: to those recurring to him for the writing of the same letters let him not respond ironically or derisively, nor say any reproaches to them, but let him treat them benignly and charitably; nor shall the said scribes presume to say or have injurious or abusive words with one another, especially in the said church. If they shall have done otherwise, according to the judgment of the greater Penitentiary they shall be punished. The aforesaid scribes shall also obey and attend to the distributor of letters of the said office in the said Church, as regards the writers of them, and in other matters which pertain to his office; those doing otherwise without legitimate cause shall be deprived, without grace of remission, of the emolument of that day on which they shall have thus transgressed, applying it equally to their other fellow-writers. The said scribes going forth outside the Roman Curia, before they depart from the Curia itself, shall notify the aforesaid distributor; and whether they depart from the said Curia with license or without license, they shall receive nothing for that time during which they shall have been absent by reason of the aforesaid office, nor also after their return to the said Curia shall anything be recompensed to them for the time of their absence.

34 § 21. The aforesaid distributor shall distribute the petitions of the poor individually and in order through individual scribes singly and by name, nor shall he place in the same petitions 'Let anyone receive freely for God'; but by the proper name of the scribes to whom he distributes them, calling them by name he shall compel them to write them and to place them before other petitions, from which emolument the scribes may live honestly.

35 arises in writing, because it is better to serve God for the poor than men for profit: and let him make such distributions of the poor to each of the said writers in order, as often as it shall be opportune; and if anyone should perhaps refuse to write such letters freely and quickly, let him be deprived of the emolument of that day's office. Each of the said writers shall be bound to write and dispatch the letters distributed to him within one natural day from the hour of reception of such distribution made to him, legitimate impediment ceasing, unless it should happen that he, whose the letters shall be, or his proctor, should grant the writer a longer delay, or unless he should have so many letters that the space of one day should not suffice him for writing the same; or unless perhaps a declaratory letter or otherwise difficult or grave one, which he shall nevertheless be bound to write as quickly as he can; which impediments or causes he shall be bound to declare to the distributor. If any of the said writers should omit to write such letters after reception of such distribution without reasonable cause, as aforesaid, the distributor himself shall cause them to be written quickly by another writer of the said office, excluding him who omitted or refused to write them without legitimate cause from the emolument of that day entirely.

36 § 22. Moreover, no writer of the said office shall keep a concubine or other woman in his house, unless perhaps his mother or sister; but each of them, as is fitting, shall live chastely and honestly, proceeding in honest attire; nor shall he presume to go about with arms or with suspect persons, especially at night time, legitimate cause ceasing: but he who shall do otherwise, if admonished by the corrector or distributor; and also if the said corrector or distributor shall have exceeded or erred in such matters, if admonished by the aforesaid doctor, to whom the other writers who shall know this shall have it intimated, within eight days immediately following such admonitions, if they shall not have amended themselves from such insolencies by desisting entirely, let them from then on lack distribution and emolument of the aforesaid office by that very fact, until the arbitrium and will of the greater Penitentiary aforesaid; correction and amendment having nevertheless preceded in due manner.

37 § 25. Furthermore we establish and ordain that all and singular proctors in the same office of the Penitentiary in making petitions, and in procuring or obtaining letters of the Penitentiary, shall faithfully strive to conduct themselves, committing no fraud, deceit or malice in the aforesaid; and the same proctors shall not presume to exact or receive anything beyond the taxations made by us on this matter, for making petitions and procuring or obtaining letters of the said Penitentiary by reason of salary or labor, or otherwise in any way. But those presuming to do otherwise shall be compelled forthwith by the aforesaid doctor to restitution of double to those from whom they shall have received beyond. But if those to whom such restitution should be made shall not be found, such double shall be distributed to the poor by the said doctor. But if the said proctors, or any of them, shall be found culpable in this twice or thrice, the office of such procuration shall be interdicted to them by the said greater Penitentiary, or by those to be appointed by him. The said proctors also shall be bound to confess and acknowledge their names and surnames, of what diocese and place they exist, before the said greater Penitentiary, or another to whom the same greater Penitentiary shall have deemed it fit to commit this, by their own oath; which also shall be reduced to writing in the house of the said greater Penitentiary, otherwise no petition shall be received, or letter written or distributed or sealed at their instance, and no salary shall be given to them. By these things, however, which have been established above concerning the said proctors and their office, no impediment whatsoever shall be presented to

Form of oath to be taken by officials: oath of the doctor appointed to receive petitions:

Of the correctors:

38 any persons, so that those who shall wish may not be able to obtain such letters for themselves and for their relatives and friends.

39 § 24. The forms, however, of the oaths, according to which the aforesaid officials, who now are, and who shall be for the time being, shall swear in the presence of the greater Penitentiary, are these, namely: I.... doctor appointed by the greater Penitentiary of the Lord Pope to examine petitions and letters of the Penitentiary, swear that I shall exercise this office committed to me faithfully and diligently: and that through me or another or others, by occasion of the said office, I shall receive nothing whatsoever, however freely offered or given, even under the guise of a loan, or under any other color sought, from anyone, but I shall exercise my office freely, without depravity and with all purity. So help me God, and these holy Gospels of God.

40 § 25. The person also appointed by the Major Penitentiary to receive petitions shall take a similar oath, namely: I, appointed by the Major Penitentiary of the Lord Pope to receive petitions of the Penitentiary, swear that I shall exercise this office committed to me faithfully and diligently: and that through me or another or others, on account of the aforesaid office, I shall receive nothing whatsoever, however much freely offered or given, even under the guise of a gift, or under any other colour sought, from anyone; but I shall exercise my office freely, without depravity and with all integrity. So help me God, and these holy Gospels of God.

41 § 26. The correctors also shall swear thus, namely: I, appointed by the Major Penitentiary of the Lord Pope to correct letters of the Penitentiary, swear that I shall exercise this office committed to me faithfully and diligently: and that through me, or another, or others, on account of the aforesaid office, I shall receive nothing whatsoever, however much freely offered or given, even under the guise of a gift, or under any other colour sought, from anyone; but I shall exercise my office freely, without depravity and with all integrity. So help me God, and these holy Gospels of God.

42 § 27. The form of the oath of the sealer: I, appointed as sealer to seal letters of the Penitentiary with the seal of the Major Penitentiary, swear that I shall exercise this office committed to me faithfully and diligently: and that I shall seal no letters of the said Penitentiary unless they shall have been first marked with the customary signs of the corrector of letters and the distributor of petitions of the same Penitentiary: and that I shall by no means seal declaratory or other letters containing doubtful law, unless they shall have been signed with the sign of the doctor appointed to examine and correct such letters, and shall have been assigned to me by the same doctor or his sworn messenger, or which the aforesaid Major Penitentiary shall order me to seal specially. The letters sealed by me I shall deliver to the distributor of the same office, or place in the chest appointed for the custody of these letters. For the aforesaid letters to be sealed, or otherwise for those which pertain to the said office of the Penitentiary, I shall receive nothing whatsoever from anyone, except only from the scribes of the said office, from whom for wax beyond the allowances ordained by the Lord Pope Benedict XII; for letters, however, which are written freely, I shall receive nothing whatsoever, but shall seal them freely; nor shall I count them among the others. So help me God, and these holy Gospels of God.

43 § 28. The minor Penitentiaries shall swear under this form: I, Penitentiary of the Lord Pope, from this hour forward shall be faithful to blessed Peter, and to the holy Roman Church, and to my lord the Lord Pope, and to his successors canonically entering: nor shall I be in deed, counsel or consent, that he lose life or limb, or be taken by evil capture. The counsel which shall be entrusted to me through him, or his messenger, or letters, by sign, word or nod, knowing it, I shall reveal to no one to their harm or prejudice. If I shall know that harm to them is being plotted, I shall prevent it as much as I can; and if I could not prevent it through me, I shall take care to signify it to them through a messenger or letters, or to him through whom it may more quickly come to their knowledge. The Papal realm, and the regalia of blessed Peter, and all the rights of the Roman Church, which it has everywhere, I shall maintain with all my strength, and defend: I shall be a helper in holding and defending against every man: and the things also of the Lord Pope himself, and of the Roman Church, which shall be committed to my custody, I shall carefully guard and faithfully restore. Embassies also, and whatever other business shall have been committed to me, I shall carry faithfully and report without fraud; and that for hearing confessions, or making absolutions, or other things which pertain to my office, I shall exact or demand or receive nothing whatsoever through me or another, even under the title or guise of alms, or stipend or loan, or in any other way: and that I shall not absolve or dispense knowingly in any case not permitted to me: nor shall I knowingly absolve anyone from sin or sins in any doubtful case: nor even in such doubtful case shall I knowingly dispense with anyone, unless by special mandate of the Roman Pontiff, or of the Major Penitentiary, to whom I shall express the said case without any revelation or expression of the person: and that I shall not impose pecuniary penances expressly for me or for any certain person, or for my order, or for another: concerning restitutions, however, to be imposed and made, I shall observe, as has been ordained by the Lord Pope Benedict XII: and all and singular the aforesaid things I promise and swear to observe and keep without all deceit and fraud and malice. So help me God, and these holy Gospels of God.

44 § 29. Moreover, the clerks appointed to hold and preserve the seals of the minor Penitentiaries shall take an oath in the following form: I, a clerk, shall faithfully guard the seals of the minor Penitentiaries together with the clerk appointed with me for this purpose; and with them, namely with the seal of each Penitentiary, letters granted and to be granted by that Penitentiary, written however by the true scribes of the said office, or by one of them, and corrected by the distributor appointed and signed with his mark, and no other letters, I shall seal without delay and shall return the sealed letters to those to whom they belong, or to their procurators: and that beyond the rates fixed by the lord Pope Benedict XII, for letters to be sealed and returned I shall receive nothing from anyone; but for letters which are written freely, I shall receive nothing whatsoever, but shall seal them freely: and that from clerks suffering from a defect or blemish in any member, I shall not receive anything beyond the rates fixed by the said lord Pope Benedict XII, when they are brought to the presence of some of the lord cardinals for inspection and consideration of the aforesaid defect or blemish, or also for other persons to be brought to other churches of the city or place in which the Roman Curia shall reside: but from the poor, who are unable to pay, I shall receive nothing whatsoever. So help me God, and these holy Gospels of God.

45 § 30. Moreover, the distributor shall take an oath in this form: I, the distributor, swear that I shall faithfully exercise my office, and the petitions delivered to me pertaining to the said office, as much as I am able, I shall distribute equally to the scribes: and the letters made from the said petitions according to the rates ordained by the lord Pope Benedict XII, the twelfth, I shall faithfully rate, the said rates being known to the clerks appointed for the custody of seals:

46 in no way exceeding. So help me God, and these holy Gospels of God.

47 § 31. Moreover, each of the scribes of the Penitentiary shall take an oath in this form: I, a scribe of the Penitentiary of the lord Pope, swear that I shall faithfully exercise my office, and that beyond the rates ordained by the lord Pope Benedict XII, the twelfth, I shall demand or receive nothing through myself or through another; nor shall I commit any fraud or deceit in this matter: and that I shall not be a procurator for the same letters which I write, or for other letters of the same office, through myself or through another or others for money or any gift. So help me God, and these holy Gospels of God.

48 § 32. Moreover, each of the procurators of letters of the said Penitentiary shall take an oath in this form: I, the procurator of letters of the Penitentiary of the lord Pope, swear that I shall faithfully and without any deceit and fraud exercise the office of such procurator: and that I shall diligently and faithfully inquire into the business, concerning which I shall have to form a petition, and shall dictate or cause to be dictated, as I shall be informed by those to whom the business belongs, or by their procurators, adding nothing to the substance of the matter, or also subtracting or changing: and that for arranging and procuring petitions and these letters I shall receive nothing whatsoever beyond the rates ordained by the lord Pope Benedict XII, the twelfth. So help me God, and these holy Gospels of God. Let no one whatsoever be permitted to infringe this page of our constitutions, ordinances, prohibitions, intention and will, etc.

Procuratori. — Clausole.
