Licet in constitutione

Bull regulating the conclave and cardinals' servants and meals

Bull of Pope Clement VI ·

1 Clement, bishop, servant of the servants of God, for perpetual memory of the matter.

2 Although in the constitution of our predecessor Pope Gregory X of happy memory, issued in the Council of Lyons, it was willed that among other things it be expressly provided that if it should happen that the same Pontiff breathe his last in the city in which he with his Curia shall reside, all the cardinals shall assemble in the palace in which the same Pontiff dwelt, and in it each one, with only single attendants, unless to those to whom from evident necessity two are permitted to be had, content with servants, whether clerics or laymen, as they shall choose, one conclave, with no intermediate wall or other covering, shall dwell in common.

3 § 1. And that on certain days, no provision having been made for a shepherd, after the time has elapsed, bread, wine and water only shall be ministered to the same cardinals, until provision shall follow.

4 § 2. Because, however, as we have learned from the frequent assertion of those present in the college of cardinals and from the constitutions themselves...

5 we have perceived that some of the cardinals were gravely burdened in the observance of the constitution itself in other ways; and many of them also had two servants in the said conclave, not without scruple of conscience, on account of the ambiguity of the said words, namely, those by which from evident necessity two are permitted to be had, contained in the said constitution, as is set forth above; we, wishing to provide concerning these matters, from these and certain other reasonable causes which moved our mind to this, have deemed it necessary to temper the rigor of the constitution itself, and also at the supplication of our brothers, we have provided in these matters by apostolic authority, decreeing that the cardinals, after they shall have entered such conclave or closure for celebrating the said election, may have each two servants only, clerics or laymen as they shall deem fit to choose;

6 § 3. And also to each one besides bread, wine and water at dinner and at supper, one dish only, or a course of meats of one kind only, or of fish or eggs with one pottage of meats or fish principally not prepared and becoming sauces, beyond salted meats and raw herbs, and cheese, fruits or electuaries. From which, however, no special dish shall be prepared, unless it were made for seasoning or flavor. But none of them may eat of another's dish.

7 § 4. It shall also be permitted to them from decency in such closure, when they shall wish to rest in beds or to sleep, to have only intermediate or simple coverings of curtains only.

8 § 5. The aforesaid constitutions and those of Clement V, Pope of happy memory, our predecessor, and other apostolic constitutions standing in the way notwithstanding, which in other respects we do not wish to derogate from, any and all things notwithstanding. To no one, etc. Given at Avignon on the 8th day of December, in the 10th year of our pontificate.

9 Given on 6 December 1351, in the 10th year of the pontificate.

4 § 2. Poiché tuttavia, come da frequente asserzione di molti e da quanto abbiamo percepito dai cardinali, alcuni tra i cardinali nell'osservanza della stessa costituzione furono gravati altrimenti eccessivamente; molti inoltre tra gli stessi ebbero due servitori nel detto conclave, non senza scrupolo di coscienza, a causa dell'ambiguità di tali parole, cioè di quelle per cui è permesso averne due per manifesta necessità, contenute nella detta costituzione, come si è premesso;

5 noi desiderando provvedere su questi punti, da queste e da altre cause ragionevoli, che hanno mosso il nostro animo a ciò, il rigore della stessa costituzione, e anche per supplica dei nostri fratelli, in queste cose abbiamo provveduto a temperare, statuendo con autorità apostolica, che i cardinali dopo che in tale conclave o clausura per celebrare la detta elezione saranno entrati, singolarmente due servitori soltanto, chierici o laici secondo che avranno scelto;

A nessuno dunque, ecc.
