6 CPI ex Since someone from home "cna Tià us, who our entire Curia, tempted by the cupidity of many, we strive to turn into a better state, among others its Orders, to the office of our Penitentiary in the first place we have turned, a new faculty to it anew we have determined to prescribe, which alone henceforth in its affairs and matters it ought to use.

7 § 1. Wherefore recently all authority and power to it, both ordinary and delegated, and all privileges, faculties and indults we have entirely removed. Then certain matters concerning the quality, number, functions and offices of ministers, which seemed more fitting, by other letters of ours we have ordained.

8 § 2. Now indeed, lest that also, while we inquire into the other parts of the Curia, be lacking, but also meanwhile and always henceforth be of use to all, with faculties alone again, which are most proper to the penitential office, and accommodated to the remedy of needy faithful, we intend to furnish, by which its prefect, in our stead, to those very ones for whose sake it was founded, may forthwith succor, and the same work us, harassed by so many and such great cares without intermission, may in some way relieve, lest they, by the necessity of our delay in moral guilt, remain longer in debt and filth, and lest anyone be led into graver perils. § 3. We grant therefore to our Major Penitentiary that he may be able to absolve and to mandate absolution, in the forum of conscience only, all and singular ecclesiastical persons, secular and regular, of whatsoever dignity, quality and order, as well as lay persons of either sex, both present and absent, in all cases, even those reserved to the Roman Pontiff and the Apostolic See, and comprehended in apostolic letters, which on the day of Maundy Thursday are promulgated each year, and absolutely from all and whatsoever other crimes, sins, excesses and offenses, however grave and enormous, both hidden and public, as well as excommunication, suspension and interdict and other sentences, censures and ecclesiastical penalties incurred on their occasion or account, with salutary penance enjoined upon them according to the measure of their guilt and other matters which shall be enjoined by law; and also to dispense and to mandate dispensation with whomever it shall seem expedient, even restoring to their former state, but in the said forum of conscience only, concerning whatsoever irregularity, inability, defect and infamy, except those arising from the crime of heresy, homicide voluntary, contracted knowingly simony and other public crimes, concerning which the Roman Pontiff is first to be consulted by the penitentiary himself.

9 To the Major Penitentiary faculties he leaves proper to the penitential office.

10 He can absolve all in the forum of conscience.

11 both present and absent, in all cases, even those reserved to the Roman Pontiff and the Apostolic See, and comprehended in apostolic letters, which on the day of Maundy Thursday are promulgated each year, and absolutely from all and whatsoever other crimes, sins, excesses and offenses, however grave and enormous, both hidden and public, as well as excommunication, suspension and interdict and other sentences, censures and ecclesiastical penalties incurred on their occasion or account, with salutary penance enjoined upon them according to the measure of their guilt and other matters which shall be enjoined by law; and also to dispense and to mandate dispensation with whomever it shall seem expedient, even restoring to their former state, but in the said forum of conscience only, concerning whatsoever irregularity, inability, defect and infamy, except those arising from the crime of heresy, homicide voluntary, contracted knowingly simony and other public crimes, concerning which the Roman Pontiff is first to be consulted by the penitentiary himself.

12 § 4. And so that in the orders undertaken, even sacred orders of the priesthood, he may minister, and ascend to higher orders, and hold dignities, even cathedral and metropolitan, and benefices and ecclesiastical offices canonically obtained and conferred; whatsoever they may be, retain and acquire and have others.

13 § 5. In marriages contracted indeed, if hidden impediments of consanguinity or affinity are present, except in the first degree of consanguinity or the second degree in the unequal line of consanguinity, they may remain; and in a supervening impediment they may demand the debt, the offspring, where it shall be necessary, in the same forum of conscience, declaring it legitimate, with the clause added to the letters of nullity, which is customary to be added to similar cases.

14 § 6. To these things also, he may absolve and mandate absolution of the excommunicated and suspended from a general or special sentence whose jurisdiction has expired; and also those who, bound by excommunication and suspension, whose absolution by the same judges or others has been remitted to the Roman Pontiff and the said See in any way, yet those who, detained by legitimate impediment, cannot approach the presence of the judges or of those who excommunicated or suspended them, or another or others, provided satisfaction or composition has followed.

15 § 7. Likewise to commute whatsoever vows into other works of piety, vows of visiting the Sepulcher of the Lord and the thresholds of the blessed Apostles Peter and Paul of the City alone excepted, and chastity and Religion.

16 § 8. Also to declare doubts in the matter of sins or the penitential forum otherwise in any way concerning, with the counsel of his doctors and theologians. § 9. And concerning badly taken away or retained matters, to mandate that, even with some part remitted to the delinquent poor, if it shall seem good, their quality and necessity being weighed, the remainder to the poor or other pious works, in places, if it can be done, where those things were taken away or extorted or usurped,

Finally we prohibit the aforesaid — over which the major penitentiary may in no cases grant " doen public absolutions for princes and *o"euiere. others having imperial rights, as well as dominions, republics, likewise bishops and other superior prelates by the authority of these presents; but, whenever any of these matters occur, either we or the Roman Pontiff existing at the time must be consulted with haste; nor shall he absolve, even in the most secret cases, the cardinals of the holy Roman Church who, while the R. Pontiff lives, shall have treated in any way concerning some future one to be elected or excluded, or shall have entered into suffrage for themselves or others, or even, the See itself being vacant, shall have engaged in canvassing, or shall have made pacts concerning the same; we decree null and
