1 Ad supremam equidem Apostolicae huius Sanctae Sedis, cuius servituti Pallorum Princeps Gesù Cristo Nos Imbecillitatis nostrae conscios per ineffabilem bonitatem suam mancipare dignatus est, auctoritatem, providentiam que pertinere intelligimus, ut non solum decora & privilegia, praerogativas, immunitate, & exemptiones, quibus alias legitime concedis singuli Ecclesiae pacifice fruuntur, confirmare, & augere dudeamus, verum etiam opportunam, naturamque, ad bene constitutum, Apostolicisque legibus praescriptum Ecclesiasticae Disciplinae ordinem in suo pristino decoro retinendum, conservandumque, si quo pacto per longas temporum vices immutari contigisset, operam nostram conferre satagimus.
2 I. Quoniam autem Cathedralis Ecclesia Papiae, quae olim Ticinum dicta, non tam vetustae antiquitatis, Longobardorum Regum Sedis, & tot Sanctorum Antistium pietate, literis, ac Martyrio insignium splendore, quam ipsa amplitudine, & omnimodae in populos sibi subjectos iurisdictione, inter praecipuas Italiae Ecclesias semper extitit, factum est, ut innumera prope modum privilegia cum latifundiis fortunis, aliisque amplissimis iuribus, Romani Pontifices, Imperatores, Reges Longobardorum, aliique Principes eidem Ecclesiae, eiusque Antistibus indulserint; Eapropter tot sane privilegia cum decoribus, praerogativis, dignitate, auctoritate, immunitatibus, exemptionibusque coniuncta, ac toties comprobata, atque confirmata iisdem Antistibus, qui Apostolicae huic Sanctae Sedi immediate subjecti sunt, Pallii certe usus, ac ius Crucem more Archiepiscoporum ante se gestandi, album equum conscendendi, ius a dextris in Conciliis Generalibus Summo Romano Pontifici assistendi, ius denique, quod etiam admirans refert clar. mem. Caesar Sanctae Romanae Ecclesiae Cardinalis Baronius, ut quotieseumque Ticinen sis Episcopus vocaret ad Synodum Archiepiscopos Mediolanensem, & Ravennatensem, cum Suffraganeis, venire omnino deberent, haec non immerito expostcerent, ut eandem Cathedralem Ecclesiam, exigentibus etiam eximiis Venerabilis Fratris Francisci eiusdem Cathedralis Papiensis Episcopi, in tuendis Ecclesiae Papiensis, ipsi spirituali coniugio iunctae, iuribus egregie meriti virtutibus, in Archiepiscopatum erigeremus.
Rom. Bened. XIV. Tom. I.
4 Ecclesiae Archiepiscopalis in partibus Infide- Anno lium sitae tribuamus, Archiepiscopalemque Ec- 1743 clesiam huiusmodi ipsi Papiensi Ecclesiae uniamus, & incorporemus: Ita enim fiet, ut eidem Episcopo Papiensi eo privilegiis munito, & Archiepiscopali dignitate adaucto, debitus locus, & honor in quibusvis Ecclesiasticis, Saecularibusque Consessibus deferatur.
6 4. Praeterea volumus, & mandamus, ut idem Episcopus Papiensis, & Archiepiscopus Amasiensis, deinceps semper, ut antea, memoratae Apostolicae Sedi immediate subiectus intelligatur, nec iuxta Concilii Tridentini decretum, a Concilii Romani a fel. record. Benedicto PP. XIII. Praedecessore nostro celebrati, praescriptionem, sibi Metropolitanum, quem hactenus non elegit, imposterum eligere teneatur; nec Causae quaecumque Civitatis, & Dioecesis Papiensis ad quemvis, iure appellationis, nisi ad Apostolicam Sedem praedictam, deferantur.

in the regions of the Infidels • and other privileges are confirmed, & respectively granted
POPE BENEDICT XIV.
•To the memory of the petitioner.
1 To the supreme authority indeed of the Apostolic See of this Holy See, to whose service the Prince of the Apostles Jesus Christ has deigned to bind Us, conscious of Our weakness, through His ineffable goodness, and to its providence we understand it pertains, that not only the honors & privileges, prerogatives, immunities, & exemptions, which elsewhere are legitimately granted to individual Churches and peacefully enjoyed, we should confirm and augment, but also that we should strive to apply our efforts to retain and preserve in its former dignity the fitting and proper order of ecclesiastical discipline, prescribed by Apostolic laws, if by any chance through long passages of time it should have been changed.
2 I. Since indeed the Cathedral Church of Pavia, which was formerly called Ticinum, not so much by reason of ancient antiquity, the See of the Lombard Kings, & the glory of so many Saints of old, piety, letters, and Martyrdom shining forth, as by its own amplitude, & complete jurisdiction over the peoples subject to it, has always been among the principal Churches of Italy, it has come to pass that innumerable privileges almost beyond number, together with vast lands, fortunes, and most ample rights, the Roman Pontiffs, Emperors, Kings of the Lombards, and other Princes have granted to the same Church and its Archbishops; For this reason so many privileges joined with honors, prerogatives, dignity, authority, immunities, exemptions, and so often approved and confirmed to the same Archbishops, who are immediately subject to this Apostolic Holy See, certainly the use of the Pallium, and the right to bear the Cross in the manner of Archbishops before oneself, to mount a white horse, the right to sit on the right hand in General Councils beside the Supreme Roman Pontiff, and finally the right, which also the illustrious of blessed memory, Cardinal Baronius of the Holy Roman Church, reports with admiration, that whenever the Bishop of Ticinum called the Archbishops of Milan and Ravenna to a Synod, with their Suffragans, they were absolutely bound to come; these not without reason demanded, that we should raise the same Cathedral Church, also at the exigent merits of the Venerable Brother Francis, Bishop of the same Cathedral Church of Pavia, distinguished in protecting the rights of the Church of Pavia, joined to him in spiritual union, to the Archiepiscopate.
3 2. But We, to whom nothing is more ancient than to preserve stable the venerable antiquity of Churches, judge it to be equitable and not new, if to the same Cathedral Church of Pavia, and to its Archbishop existing for the time being, we should grant some title of Archbishop Bullar. Rom. Bened. XIV. Tom. I.
4 of an Archiepiscopal Church situated in the regions of the Infidels, and unite and incorporate an Archiepiscopal Church of this kind to the Church of Pavia: thus indeed it shall be, that to the same Bishop of Pavia, furnished with these privileges, and elevated to Archiepiscopal dignity, due place and honor shall be shown in any ecclesiastical and secular assemblies.
5 3. Hence it is, that We, by Our own motion, by certain knowledge, and mature deliberation of Ours, and from the fullness of Apostolic power, by the tenor of these presents, the Archiepiscopal Church of Amaseia, which is the Metropolis of Helenopolis under the Tyranny of the Turks, as it deserves to be preserved at least in the honor of its name, we unite and incorporate to the same Cathedral Church of Pavia, and declare, give, decree, and ordain that it be and shall be united and incorporated in perpetuity for future times, so that not only the same Venerable Brother Francis, Bishop of Pavia, but whoever shall succeed him for the time being in the Episcopal Chair of Pavia, shall be called, inscribed, and be Archbishop of Amaseia, and Bishop of Pavia, with all and singular rights pertaining respectively to him both by reason of the Episcopal Church of Pavia and of the Archiepiscopal Church of Amaseia; Nor is the same Archbishop and Bishop on this account bound to proceed to the aforesaid Archiepiscopal Church of Amaseia, as long as it shall be held by the Infidels, and to reside there personally.
6 4. Furthermore we will and command, that the same Bishop of Pavia and Archbishop of Amaseia, henceforth always, as before, be understood to be immediately subject to the Apostolic See, nor according to the decree of the Council of Trent, and the prescription of the Council of Rome celebrated by Our Predecessor of blessed memory Pope Benedict XIII, shall he be bound to elect for himself a Metropolitan, whom he has not had hitherto, henceforth; nor shall any cases whatsoever of the City and Diocese of Pavia be brought to anyone by right of appeal, except to the aforesaid Apostolic See.
7 5. Finally we have decided and declared by the tenor of these presents, without any other declaration or expedition of Apostolic Letters, that the same Francis, the present Bishop of Pavia, is in fact and shall be Archbishop of Amaseia, and can and ought to be called by that name; and that his successors, whoever shall preside over the Church of Pavia for the time being, shall have the title of Archbishop of Amaseia conferred upon them by the same Apostolic Letters under Lead to be expedited for the Church of Pavia, as often as it shall happen that they are appointed, with mention always being made of this union and incorporation. We will and command that this title of Archbishop of Amaseia, thus united and incorporated, shall be so bound to the Bishop of Pavia for the time being, that whenever a Bishop of Pavia shall happen to be transferred from the Episcopal Church of Pavia to another Episcopal Church, leaving behind the title of Archbishop of Amaseia, he ought to obtain and acquire from the Apostolic See aforesaid another title of a different Archiepiscopal Church. 6. Decreeing that these same present letters and whatever is contained in them, even from the fact that anyone of whatever rank, order,

9 condition, preeminence, or dignity, or otherwise requiring specific and individual mention and expression, in the premises in whatever manner, or having or claiming to have interest in the same, should not agree with the same premises, nor having been called, cited, intimated, or heard; nevertheless, by the force of their indults or privileges, they ought to have consented, or been called, cited, intimated, and heard once or several times in whatever manner, or from any other juridical, privileged, and reasonable cause, occasion, color, pretext, title, even burdensome, and even in a chapter closed in the body of law, even of enormous, most enormous, and total loss, at no time whatsoever on account of the vice of subreptiousness or obreption, or nullity, or the dissent of those having intention or interest, or any other whatsoever even maximum, substantial, essential, formal, or unforeseen defect to be noted, impugned, infringed, invalidated, retracted, rescinded, brought into controversy, reduced to the terms of law, or against them the remedy of opening of the mouth, restitution in full, or any other whatsoever remedy of law, fact, or grace to be attempted or obtained, or even by motu proprio, knowledge, and fullness of power granted equally in judgment or outside it to be used or to avail oneself in no way; but these same present letters and whatever is contained in them shall always remain firm, valid, and efficacious, and shall obtain and secure their full and complete effects, and shall most fully suffice for the same Francis as Archbishop and Bishop, and for his successors for the time being in all things and through all things; and thus, and not otherwise in the premises by whatever Ordinary Judges and Delegates, even Auditors of Cases of the Apostolic Palace and Cardinals of the Holy Roman Church, even Legates a Latere and Nuncios of the Apostolic See, or any others whatsoever exercising and about to exercise any preeminence and power, being subtracted from them and from each of them any faculty and authority of judging and interpreting otherwise, it ought to be judged and determined; and if anything contrary to this should be attempted by anyone whatsoever with any authority, knowingly or unknowingly, it shall be null and void.
10 7. Notwithstanding the premises, and insofar as it is necessary, any rule of Our and the Apostolic Chancery made to the contrary of the premises in whatever manner, and other Apostolic and in Universal, Provincial, and Synodal Councils issued general or special Constitutions, Ordinances, as well as prerogatives of the said Churches even confirmed by oath, Apostolic confirmation, or any other firmness, statutes and customs, privileges also granted and Apostolic Letters in whatever manner granted, confirmed, and renewed to the contrary of the premises. All and singular of which, even if for their sufficient derogation, of them and their whole tenors, special, specific, express, and individual mention, or any other expression, or some other exquisite form to be observed for this would be necessary, the tenors of all and singular of them being held as fully and sufficiently expressed in these presents, and inserted word for word, otherwise remaining in their force, for the effect of the premises on this occasion only specially and expressly, and most fully and most amply we derogate, and will that they be derogated, and to all other things contrary whatsoever.
