1 since all precedence pertains to the cardinal bishop who is senior in the Curia at the time of vacancy, or who is absent for public cause and designated outside it by the Supreme Pontiff.
Paul, bishop, servant of the servants of God, for perpetual remembrance of the matter.
2 § 1. Since our venerable brothers, the cardinals of the holy Roman Church, are called to assist the reigning Roman Pontiff and therefore ought to reside in the Curia, and those residing are preferred to the absent in the selection of titles and six cathedral churches.
3 This Pontiff at the time of his creation was dean of the cardinals, and thereafter the dean of the cardinals Bellay was declared by him.
PAUL
4 of solicitude are called to assist the reigning Roman Pontiff for the time being, and the Roman Pontiff himself arranges matters by their counsel, and these same cardinals are part of the body and members of the Roman Pontiff himself, and are placed in charge of the various parochial churches of our beloved City for their cardinal title or designation, and have episcopal jurisdiction in them, and for this reason ought to reside in the Roman Curia; and those present in the said Curia are more worthy and privileged than the absent, and in the selection of titles and six cathedral churches, to which cardinals are accustomed to be placed in charge for their cardinal title, they are preferred to the absent, even to those assumed into the cardinalate before them; and if they have been placed in charge of one of the said cathedral churches, they always thereafter precede other non-bishop cardinals in all acts and sessions.
5 § 2. We, moved by the foregoing and various other causes affecting our mind and, among other things, so that we might attract these same absent cardinals to reside in the Curia by certain more abundant favors and prerogatives, the deanship of the college of cardinals of this kind, which we, while constituted in minor orders, held, and to which, on account of our continuous residence in the same Curia, we came before other cardinals senior to us in the cardinalate, then absent from the Curia itself, becoming vacant by our assumption to the summit of the apostolic office, having held mature deliberation upon these matters with our brothers in our secret consistory, by their counsel and unanimous assent, have declared our venerable brother John, bishop of Ostia, cardinal of the holy Roman Church called de Bellay, well deserving of us and the Apostolic See, dean of this college, and have called him dean of the same college, and have granted him this deanship, as also by these presents we declare, call and grant.
6 § 3. And moreover, lest in the future the aforesaid deanship, upon its vacancy occurring, should devolve upon some cardinal absent by his own will and not for public cause, and on account of this absence sometimes less informed about the affairs of the said See, to the injury of other cardinals then present and assisting the Roman Pontiff, and therefore better informed about the aforesaid affairs, or lest some controversies or dissensions among the cardinals themselves should arise concerning the same deanship, wishing to provide, by our own motion and from certain knowledge, and from the fullness of apostolic power, by this our constitution to endure perpetually, we decree that this deanship henceforth, for all perpetual future times, can devolve only upon the cardinal bishop who is senior in the Curia and present, or absent for public cause and designated outside the Curia by the Roman Pontiff.
7 § 4. And that the cardinal bishop who is senior in the Curia and present, or, as is aforesaid, absent and designated outside the Curia, after this deanship has devolved upon him, shall always precede all other cardinals, even those senior, in all sessions and other public acts, and cannot be hindered or molested by other cardinal bishops, even those senior, then absent, even if they should afterwards immediately betake themselves to the same Curia and continuously reside in it, concerning the same deanship or its sessions or other acts or matters pertaining to it.
8 § 5. Decreeing thus and not otherwise, in all and singular the foregoing matters, by whatever judges, commissioners, exercising any authority whatsoever, even apostolic, also auditors of causes of the Apostolic Palace, and the college of the same cardinals, in any cause and instance, authority and facility of judging and interpreting otherwise being taken away from them and from each of them, ought to be judged and decided; and null and void, if otherwise anything concerning these matters should happen to be attempted by anyone whatsoever, by whatever authority, knowingly or unknowingly.
9 § 6. Notwithstanding the constitutions and apostolic ordinances, and the style of our consistory, as well as of the same college, even those strengthened by oath, apostolic confirmation or any other firmness whatsoever, statutes and customs, and all other things whatsoever to the contrary.
10 Let no one therefore, etc. If anyone, etc.
