Bolla sui privilegi dei neofiti ebrei e infedeli convertiti
XLI.
3 ROM.wni An.
16 § 11. E poiché difficile sarebbe ecc. Si dia fede al suo sommario.

XLI.
Privileges of neophytes, that is, of Jews and infidels converting to the Catholic faith; and ordinances concerning their manner of living. Paul, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 Desiring that Jews and other infidels of whatever kind be converted to the Catholic faith, and wishing that those converted should not be deterred from the same faith on the pretext of losing the goods previously possessed by them, by our own motion and from certain knowledge, by apostolic authority, by the tenor of these presents, with this constitution to be valid henceforth, we decree that to any one of these Jews and infidels wishing to be converted to the said faith, even if he be under paternal power, all his goods whatsoever, both movable and immovable, shall remain untouched and unharmed. So that even sons of families and those constituted under paternal power, as aforesaid, may not and ought not to be defrauded or deprived of the legitimate and any portion of goods patrimonial or maternal owed to them by right or succession of goods otherwise due to them through their parents, but these shall be owed to them in full, even if they have been converted to the same faith against the will of their parents, even while their parents are living.
2 § 1. And if those goods were acquired from usury or illicit gain, and the persons to whom restitution ought to be made by right are known, restitution must be made to them (because sin is not remitted unless what was wrongly taken away is restored), those goods shall be entirely restored to those same persons; but if the aforesaid persons do not exist, because those goods would be converted through the hands of the Church to pious uses, we freely grant such goods to the same Jews and other infidels, in favor of the baptism received, as to a pious use, and we decree that they remain with those Jews and other infidels thus converted. Forbidding, under the penalty of divine anathema, any ecclesiastical or secular persons whatsoever, that they inflict or permit to be inflicted any molestation upon these goods under any pretext whatsoever; but let them consider themselves to have made great gain, when they shall have gained such persons for Christ.
3 To those who, in favor of the faith they have undertaken through baptism, we freely grant as a pious use, and we decree that these things remain with the same converted Jews and other infidels. We forbid, under the penalty of divine anathema, all persons whatsoever, both ecclesiastical and secular, lest they inflict any molestation upon these goods under any pretext whatsoever, or permit it to be inflicted; but let them consider that they have made great gain, inasmuch as they have gained such persons for Christ.
4 § 2. And since, as it is written, He that hath pity on the poor lendeth to the Lord, and He will repay him, and Whosoever shall give to drink to one of these little ones a cup of cold water only in the name of a disciple, amen I say to you, he shall not lose his reward, if at the time of conversion they be poor or indigent, we exhort all, both ecclesiastical and secular persons, through the bowels of the mercy of our God, to extend helping hands to these converts; and the diocesan bishops themselves should not only exhort Christians to come to their aid, but also, both from the revenues of churches, as they are able, and from those things which are devoted to the use of the poor to be converted by them, should not neglect to sustain such neophytes, and should defend them with paternal affection from detraction and insults.
5 § 3. And since through the grace of baptism they are made fellow citizens of the saints and members of the household of God, and it is far more worthy to reign in spirit than to be born in flesh, by the same constitution we decree that they shall be true citizens of the cities and places in which they are regenerated by holy baptism for the time being, and shall enjoy the privileges, liberties, and immunities which others obtain by reason of nativity and origin alone.
6 § 4. Let priests administering baptism and others receiving them at the sacred font take care, both before baptism and after, that they be diligently instructed in the articles of faith, the precepts of the new law, and the rites of the Catholic Church, and be confirmed in the faith; and let both they themselves and the diocesan bishops take care that they do not associate with other Jews or infidels at least for a long time, lest, as sometimes happens, from the weakness of the newly converted, a slight occasion should effect a relapse into their former damnation.
7 § 5. And since, as experience has shown, it has been found that mutual conversation of these neophytes among themselves keeps them from growing strong in the faith and greatly harms their salvation, we exhort the ordinaries of places that, as far as they shall see expedient for the increase of faith, they take care and strive to join these neophytes in matrimony with native Christians.
8 § 6. And let it be forbidden to them, under grave penalties, that they bury their dead after the manner of Jews, or observe the Sabbath and other solemnities and rites of the ancient sect in any way, but let them frequent churches and sermons as other Catholics do, and render themselves conformable in all Christian customs.
9 § 5. And since, as experience testifies, it has been found that mutual conversation among those neophytes themselves with the original Christians, especially in matrimony, keeps them firm in the faith and greatly benefits their salvation, we exhort the ordinaries of places to take care and strive, insofar as they shall see it expedient for the increase of faith, to join those neophytes in matrimony with the original Christians.
10 § 6. And let them be prohibited, under grave penalties of the ancient Rite, lest they bury the dead after the manner of the Jews, or observe the Sabbath and other solemnities and the rites of the ancient sect in any way whatsoever; but let them frequent churches and sermons, as do other Catholics, and render themselves conformable in all Christian customs.
11 § 7. But those who despise the aforesaid, [being] despised by priests in whose parishes they are found...
12 inquisitors to compel, or others to whom, by law or ancient custom, it pertains to inquire into such matters, or even through any others whatsoever, let them be reported to the diocesans or inquisitors of heretical depravity, and with the invocation, if necessary, of the aid of the secular arm, let them be punished by them in such a way that it may serve as an example to others. And moreover, diligent inquiry shall be made concerning all these matters in provincial and synodal councils, and both concerning bishops and priests negligent in the aforesaid matters, and the aforesaid neophytes and infidels who are contemners, appropriate remedy shall be applied.
13 § 8. If anyone, of whatever rank or eminence, shall have favored or defended such neophytes, lest they embrace the observance of Christian rite and the other aforesaid matters, let them incur by the very fact the penalties promulgated against the favors of heretics; but neophytes, if they shall have neglected to correct themselves after canonical admonition, and shall have been brought to return to their vomit, judaizing, let them be proceeded against by the ordinaries of the places, as perfidious heretics, according to the institutes of the sacred canons.
14 § 9. Notwithstanding apostolic constitutions and ordinances, and any privileges, indults and letters whatsoever, even apostolic, or even royal or imperial ones, granted in any way to the same Jews or infidels, which, insofar as they tend to the detriment of the Catholic faith, or of the Christian name, or of any of the aforesaid matters in any way, and to the effect of the present, we annul and render void, and we decree to be annulled and void, other decrees and apostolic constitutions which have been enacted concerning the aforesaid matters remaining in their force.
15 § 10. And so that the memory of this holy constitution may be perpetual, and lest anyone be able to pretend ignorance of it, we will and decree that it be published once a year, at least, in the individual cathedral and collegiate churches, and other pious places in which there shall be a greater concourse of the faithful, during divine services.
16 § 11. And because it would be difficult etc. Let faith be given to his summary.
17 Given at Rome at St. Peter's, under the Fisherman's Ring, on 21 March, in the year one thousand five hundred and forty-two, in the eighth year of our pontificate. Given on 21 March 1542, pontificate year eight.
