1 LIBER SEXTUS DECRETALIVM D. BONIFACII PAPAE VIII. i)

Testo inglese

1 THE SIXTH BOOK OF THE DECRETALS OF LORD BONIFACE POPE VIII. i)

2 Boniface, bishop, servant of the servants of God, to his beloved sons, the masters and scholars dwelling together at Bologna,2) health and apostolic blessing! Presiding over the government of the most holy Roman Church, which the unfathomable height of divine providence has set before all churches by an unchangeable disposition and willed to hold the principal authority over the whole world, we are occupied with continual cares and urged by assiduous meditation, so that according to the office of the dispensation committed to us, we may apply ourselves with unceasing solicitude, as much as has been granted to us from on high, to the welfare of our subjects, in whose prosperity we ourselves surely prosper. We embrace indeed voluntary labors for their peace, and sometimes we pass sleepless nights,3) so that we may remove scandals from them, and those disputes which human nature, always hastening to bring forth new forms, strives daily to invent, we now by the declaration of ancient laws, now by the enactment of new rights, as much as is possible for us, restrain.

3 Indeed, after the volume of decretals, compiled by our predecessor of happy memory, Pope Gregory IX, both prudently and usefully, certain decretals were issued successively by him and by other Roman pontiffs concerning various matters, and concerning some of these, whether they were decretals and who their authors4) were, was carefully doubted in courts and schools: we, called by divine disposition to the apex of the supreme pontificate, being urgently requested by many concerning this matter to remove and clarify such ambiguity and uncertainty, which was bringing loss to many, desiring entirely, with the aid of divine grace, for public utility, to determine what ought to be held concerning these decretals themselves and what ought to be rejected in the future, through our venerable brothers William, archbishop of Évreux,5) and Berengarius, bishop of Béziers, and our beloved son,

C. de legibus. Otherwise: bringing. f Ebroduensis Tom. n. Kkk magi- Preamble, Master Richard of Siena, vicar-chancellor of the holy Roman Church, a doctor of both laws, we caused these decretals to be reviewed more carefully, and finally, many of them being removed entirely, since they seemed either temporal, or contrary to themselves or to other laws, or altogether superfluous, we ordered the remaining ones, with some of them abbreviated and some changed in whole or in part, with many corrections, deletions, and additions, as seemed expedient to us, to be reduced into one book, together with certain of our constitutions, in which many salutary provisions are established for the correction of morals and the peace of our subjects,6) which will bring forth abundant fruit in the house of the Lord, God being propitious, and many doubts, frequently encountered in courts and outside them, are decided, and to be placed under their proper7) titles.

6 This book, to be annexed to the five other books of the same volume of decretals, we have determined to call the sixth: so that the same volume, comprehending the number of six books, which number is perfect, by the addition of this one, may bestow a perfect form in the conduct of affairs and discipline in morals.

7 Nor without reason have we omitted in this matter to observe the custom of our predecessors, who, when they promulgated certain new constitutions and ordered them to be placed in the series of ancient ones. We did this,9) lest it should be necessary to define infinite books, and others would have to be made anew not without the greatest10) expenditures, labors, and expenses.

8 To your University therefore by apostolic letters we command, that you, receiving with ready affection this book, digested with much care, which we transmit to you under our bull, may henceforth use it in courts and schools, receiving no other decretals or constitutions, except those which are contained in it or specially reserved in it, promulgated by any of our predecessors, the Roman pontiffs, after the publication of the said volume, nor holding them henceforth as decretals.
