Apostolic Constitution transferring the episcopal see of Lead to Rapid City
APOSTOLIC CONSTITUTION: THE EPISCOPAL SEE OF THE DIOCESE OF LEAD IS TRANSFERRED TO THE CITY OF RAPID CITY, WITH THE TITLE OF THE DIOCESE AND CATHEDRAL CHURCH REMAINING UNCHANGED. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THIS MATTER
1 By Apostolic Letters given by our predecessor Pope Leo the Thirteenth on the fourth day of August in the year nineteen hundred and two, the Diocese of Lead was erected, which took its name from the city of Lead, and its episcopal see and cathedral were established in that same city, since it, although small, excelled other places of the diocese at that time. However, as time progressed, this see appeared less suitable, chiefly on account of the difficult access to it. Meanwhile, another city, named Rapid City, began gradually to flourish both in inhabitants and in works, so much so that it seemed that the salutary governance of the diocese and the increase of the faith would be better served if the episcopal see were established there. When therefore our venerable brother John Jeremiah Lawler, the present Bishop of Lead, presented humble petitions to us, that we deign to transfer the episcopal see from the city of Lead to Rapid City, and accordingly to change the title of the diocese and the cathedral church: We, having obtained the favorable vote of our venerable brother Peter Fumasoni Biondi, Archbishop of Doclea, Apostolic Delegate in the United States of North America, having carefully considered all matters, deemed it right to grant the petitions offered. Wherefore, having supplied, insofar as it is necessary, the consent of those to whom it pertains or those who presume their interest to be involved, with certain knowledge and from the fullness of Apostolic power, we suppress the episcopal rights of the city of Lead and erect and constitute Rapid City as an episcopal city,
2 ACTA, vol. XXIII, n. 4.
3 ActaApostolicaeSedis-CommentariumOfficiale and we decree that the same diocese shall henceforth be called not Lead but Rapid City;
4 and to the same city of Rapid City we grant all the rights, privileges, honors and prerogatives which the other episcopal sees in North America enjoy. The cathedral status of the Church of St. Patrick in the city of Lead being suppressed, we elevate the Church dedicated to the Immaculate Conception of the Blessed Virgin Mary existing in the city of Rapid City to the rank and dignity of a Cathedral Church, we establish in it the seat of the Bishop, and accordingly we grant to it all rights and privileges pertaining to it by common law. To carry these matters into execution we appoint the aforesaid venerable brother, the Apostolic Delegate in the United States of North America, and we grant to him all necessary and opportune faculties, even to subdelegate, for the purpose in question, any man constituted in ecclesiastical dignity, with the obligation within six months of transmitting to the Sacred Consistorial Congregation an authentic copy of the acts of execution performed. We will, however, that to copies of these Letters, even printed ones, but subscribed by the hand of some public Notary and furnished with the seal of some man constituted in ecclesiastical dignity or office, the same faith be given as would be given to these presents, if they were exhibited or shown. Notwithstanding, insofar as it is necessary, the rules in synodal, provincial and general constitutions and apostolic ordinances and any other dispositions of our Predecessors the Roman Pontiffs and any other matters to the contrary, even those worthy of special mention. Let no one, however, presume to infringe what is decreed by these our Letters or to act contrary to them; and if anyone should presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul, his Apostles.
5 Given at Rome at St. Peter's, in the year of the Lord nineteen hundred and thirty, on the first day of the month of August, in the ninth year of our Pontificate:

CONSTITUTIO APOSTOLICA SEDES EPISCOPALIS DIOECESIS LEADENSIS IN URBEM RAPID OPOLITANAM TRANSFERTUR, IMMUTATIS TITULO DIOECESIS ET ECCLESIA CATHEDRALI. PIUS EPISCOPUS SERVUS SERVORUM DEI AD PERPETUAM REI MEMORIAM
1 Apostolicis Litteris a ei. me.

2 ACTA, vol. XXIII, n. 4.
3 ActaApostolicaeSedis-CommentariumOfficiale costituiamo, e la diocesi stessa non più di Lead, ma Rapidopolitana in avvenire decerniamo di chiamarsi;
