Cum inter crimina
Bull establishing the Congregation of the Inquisition and granting it faculties over prohibited books
1 Faculty of the Cardinals of the Sacred Roman Church in the Congregation over the Inquisition of Heretical Depravity to hold and read heretical books or otherwise prohibited books, and to grant to others license to have and read them. Pius, Pope IV, by his own motion, etc. Since among crimes which deserve punishment, and in correcting examples ought to provide instruction to all, heresy is graver and more detestable than others: therefore, since it greatly displeases us, and lest it spread more widely, for the purpose of eradicating it, we must watch over all, even those infected with such crime, and its supporters, lest they fall away to worse things (which God forbid), with no small vigilance on our part. And whereas in past years and even perhaps to the present day in diverse parts of the world, alas! heresies and false doctrines have sprung up, and still spring up, at the instigation of the enemy of mankind, and scarcely cease to spring up, even under the pretext of any correction whatsoever. For this reason we have appointed our beloved sons John Michael of St. Anastasia Saraceni, John Baptist of St. Clement Cicada, John Suavius of St. Prisca Reumanus, Michael of St. Sabina Alexandrinus, Clement Olera of St. Mary of Aracoeli, Ludwig of St. Cyriacus in the Baths Simoneta, Charles of St. Martin in the Mountains Borromaeus, priests, and Vitellius of St. Mary in the Portico, deacon Vitellius, called cardinals, for the purpose of repressing the errors which daily occur on the occasion of any heresies whatsoever, and for eradicating such heresies and their supporters, with the help of our Lord Jesus Christ, we have appointed them as inquisitors or in the congregation of the holy Inquisition, and we have constituted them with full power.
2 § 1. And since it often happens that Catholics and Christians may be affected by the poison of such a sect and its supporters, and also for the dispatch of business and causes occurring from time to time, and for the detection of heretics, who are also at present bound in prisons in our beloved City, and shall be bound from time to time, and for their reduction to true doctrine, they have need of certain or many books composed by the impious heretics themselves and supporters of the Lutheran sect and published into the light and which shall be published and composed in the course of successive time; and also it may sometimes be necessary, for the preservation of religion in the hearts of Catholics, to respond to these same books and the deceptions, frauds and deceits and machinations of heretics, or to have Catholic men and those learned in sacred doctrine respond; and while the constitutions hitherto issued by us stand, and the sacred prohibitions made by the Index of Prohibited Books by our mandate or otherwise, they hesitate to hold and read these same books for the purpose of repressing such errors, and, as obedient sons, they do not dare, as we have learned, to examine these same books.
3 They had need of prohibited books from the causes here expressed, which nevertheless they were not able to hold while the Index stood.
4 to respond to the deceptions, frauds and deceits and machinations of heretics, or to have Catholic men and those learned in sacred doctrine respond; and while the constitutions hitherto issued by us stand, and the sacred prohibitions made by the Index of Prohibited Books by our mandate or otherwise, they hesitate to hold and read these same books for the purpose of repressing such errors, and, as obedient sons, they do not dare, as we have learned, to examine these same books.
5 § 2. Therefore, to remove every matter of hesitation and scruple of conscience in them...
6 to him the faculty of removing, by a similar motion and from our certain (of which in the matter) conscience, and from the fullness of apostolic power, having singular knowledge and confidence both in the faith, probity and constancy of those same cardinals John Michael, John the Baptist, John Suavius, Michael, Clement, Louis, Charles and Vitellius, we grant to the same cardinals, that during their office, and so long as they shall preside over such an inquisition, whatsoever, whatsoever, howsoever and of whatsoever kind, of whosoever, both of ancient and modern and future infidels and heretics, or of those condemned or suspected of heresy and of whatsoever impiety or superstition or reprobated reading, and also of uncertain or concealed authors and writers, and also of Huguenots, commentaries, treatises, books, collections, expositions, annotations, interpretations, versions and other works of whatsoever inscription and argument, by whatsoever name called, in Latin, Greek, Hebrew or whatsoever other, even vernacular, in whatsoever language of whatsoever region composed, both manuscript and by whatsoever printers, and in whatsoever places, even nominally prohibited or suspect, or even without the title of printers and places and times, and without the licence and approbation of the ordinaries of places and inquisitors of heretical depravity or others deputed to this, printed, even expressly against us and the Roman Pontiff existing for the time and the holy Roman Church and the Apostolic See aforesaid composed and written and also divulged; and also containing heresies and errors, or reprobated and condemned disciplines; and also bearing the memory and names of condemned printers and authors and other men of this kind, both through the office of the holy Roman and universal Inquisition, and otherwise howsoever and in whatsoever manner, in general or in particular, prohibited for the time, in whatsoever parts of the world, to which it shall happen that they have access, especially in our beloved City and the Roman Curia, to have, hold, read, without any scruple of conscience, and without incurring any suspicion or infamy or ecclesiastical censures, freely and lawfully may and are able to do. So that in future in no way concerning the retention of books, writings, extracts and explanations and commentaries of this kind may they be hindered, troubled or argued or inquired into, full and free licence, faculty and authority we grant and impart, and thereupon with them we indulge.
§ 3. Strictly forbidding to any
7 And we prohibit to others, both ecclesiastical and secular, books for the persons, even any authority, excellence and dignity holding, by virtue of any cardinal honour adorned, lest they dare the same books, extracts or writings of the same card. and commentaries of this kind, even, as is said, specified, by any sought colour, Faculty to the same inquisitors granted, such licences to give.
8 An. C. 1564 PIUS also of any privilege from us and from our predecessors or from the office of the holy Inquisition itself hitherto granted under pretext, to retain or hold with themselves, read and explain, without the new faculty and licence of the aforesaid cardinals, under the penalty of excommunication major and latae sententiae, which by this very fact in these writings we inflict, and other penalties inflicted by the constitutions and sacred canons and contained in this index, dare or presume. And decreeing it null etc.
§ 4. And nevertheless to the same aforesaid cardinals, our beloved sons, when it shall seem good to them or to their greater part, if it please them, in full congregation only, to grant a similar licence to whatsoever persons, of whatsoever dignity, grade, order and pre-eminence existing, the aforesaid books, even of whatsoever condemned reading, to hold, have, read and interpret or explain for a time or in perpetuity, and the granted to revoke, similarly licence and faculty we grant and impart by special grace.
§ 5. Notwithstanding the Lateran and whatsoever councils and other apostolic, as well as in provincial and synodal councils issued, general or special, constitutions and ordinances, statutes etc., even fortified by oath, privileges also, indults and apostolic letters for the time existing of the holy Inquisition of this kind to the greater inquisitors and to any, even of the S.R.E. cardinals, and others to the said office in the said City and elsewhere deputed, and otherwise, in general or in particular, even with the incurring of censures and penalties, and other decrees and clauses, under whatsoever tenors and forms, even by motu proprio etc. or even consistorially and otherwise howsoever granted, all which, even if of them etc. the tenors etc., this time Clauses derogatory.
9 iv rr. 303 An. C. 1564 most fully, specially and expressly we derogate, and sufficiently derogated we decree, and to all other things contrary whatsoever, with clauses opportune.
10 Let it be done, by our own motion. I.
§ 6. And concerning grants, distributions, indults, prohibitions, individual decrees, derogations, declarations, and for all and singular the foregoing matters, as above, to be extended most broadly. And with suitable, if it shall seem good, appointment of executors, etc., even under censures, etc., with power of aggravation, etc., invoking to this end, if need be, the aid of the secular arm, and with derogations, constitutions of one and of two diets, not however beyond three, and of the foregoing and of whatsoever others in any way contrary, to the effect, etc., to be extended most broadly; and that the signature of this our own motion alone shall suffice and shall everywhere have credence, in judgment and outside, no contrary rule notwithstanding, or, if it shall seem good, letters may be expedited through our brief with the fullest and truest specification and expression of all and singular the foregoing matters, even the qualities and names and surnames of such counsellors.
11 Given at Rome at St. Mark's, on the sixth day before the Kalends of September, in the fifth year of our pontificate.
12 Dated 27 August 1564, fifth year of the pontificate.
