Dum suavissimo
Bull on the reform of the Roman Studium
Cardinals appointed as defenders of the Studio; — 11. Commands obedience to the rector to the Executors; — 12. Derogates contrary provisions; — 13. Permits all to hear the laws for understanding the same.
1 Leo, bishop, servant of the servants of God, for perpetual remembrance of the matter.
2 While we contemplate in mind the most sweet and abundant fruits which men endowed with knowledge of letters, producing in the field of the Lord day by day, and while we ponder with careful meditation how useful and necessary is the wholesome use of these same letters for the governance and direction of spiritual and temporal things in this life full of darkness and gloom, among the various cares by which we are pressed on all sides in order to execute prosperously and happily the office of apostolic service enjoined upon us from above, we willingly embrace that care by which to those desiring to devote themselves to the study of letters in the several parts of the world, the occasion and opportunity of pursuing them might be furnished: but that this may obtain the effect we desire in our City, we are urged by so much the more earnest care, inasmuch as the City itself, the royal seat of the vicar of Christ on earth 1, and always placed before his eyes, as the most powerful bulwark of the Apostolic See, is known to hold the primacy over the other cities of the world: and it is fitting that, just as its condition is most excellent, so also its inhabitants and residents should excel others in every kind of virtue, and especially in the discipline of the liberal arts, which is the nurse and foster-mother of virtues.
3 § 1. Formerly indeed of blessed memory etc. 2
4 § 2. We therefore, bearing with difficulty the irreparable loss of such time thus elapsed, and desiring, as it befits a provident father of a household, to provide for future times, inclined by such supplications, and by our certain knowledge, by apostolic authority, by the tenor of the present document, do approve and renew the aforesaid letters of our predecessor, and strengthen them by the protection of this present writing. Decreeing that all and singular things contained in the same letters, especially that which is delivered concerning the exemption of scholars, immunity and other concessions, prerogatives and favours in them, ought to be inviolably observed.
5 § 3. And nevertheless, by this irrefragable and perpetual constitution, valid for all future times, we establish, decree and ordain that from now forthwith, besides others who shall be necessary, in each faculty readers, at least one in canon law, and one in civil law, doctors, and one in philosophy or medicine, a master of eminent learning from anywhere, to teach in the public schools of the said City, at the customary times and days, with just and honest salaries, at the discretion of the rector and reformers of the said Studio existing for the time being, to be moderated and assigned by the same rector and reformers according to the qualities of the same doctors and masters, with the licence of the Roman Pontiff, with common and suitable diligence to be employed, shall be hired annually.
6 The hand of advocacy is forbidden to them;
7 He indicates the duty of readers;
8 diligence is to be employed.
9 § 4. And none of the said two doctors thus to be hired shall meanwhile be able to exercise the office of advocacy or, except at home, if he should wish, consulting, any other office of the Curia or of the aforesaid City.
10 § 5. But both they themselves and all others, hired for the time being to teach in such schools, at the customary times and days and hours appointed for this by the aforesaid rector and reformers, ceasing legitimate impediment, ought to perform the duty of teaching committed to them, and after the lectures are finished, for some convenient space of time, to hold discussions in the same schools. And if any of them, not legitimately impeded, shall cease from teaching, as many times as he shall do this, so many times double of what, for each lecture from the established salary, shall be due to him, is decreed to be withheld; and that, for one, by the beadles or messengers of the said Studio legitimately denouncing it, and three remaining fourth parts of the fabric of the same schools from now we apply, he shall be punished by fine, and to him a note or mandate is to be delivered, to be deducted and denounced and having care of the said fabric, according to the aforesaid application, to be paid.
11 § 6. And because this provision could easily be rendered useless unless there be those who note its transgressors and visit the schools themselves solicitously and frequently, the rector, with at least two of the said reformers, once in a month, and more often, where they shall have learned it to be expedient, on days and hours various and uncertain, shall personally betake themselves to the same schools, and visit the readers of the same while they teach, while they hold discussions; and if they shall see anything worthy of correction or reformation, they shall correct and reform it; and one of the same reformers separately, at least twice in a week, shall undertake the office of such visitation by himself; and transgressions or other things to be corrected or reformed he shall confer with the rector and col-
12 leagues, so that, their labour being thus employed (upon which we burden their and each of their consciences), the aforesaid Studio may advance with the desired increase.
13 § 7. The beadles or messengers aforesaid shall have with them a copy of the roll duly collated, in which are written the names of all the lecturers and at what hour each is to lecture, and according to that order and arrangement they shall go about the schools. The customary feasts of the Palace they shall announce in the schools before the lectern to the doctors and scholars; and if they find any of the said lecturers absent from his place, having called a witness, they shall note him down, and at the end of each week they shall deliver the record to the notary of the said rector, who shall faithfully bring the matter to the knowledge of the rector himself and the reformers. And if the said beadles shall have been negligent in the aforesaid matters, they shall be punished by the rector of the Studio existing at that time, for the first offense with a fine at the discretion of the same rector; for the second, with the loss of the salary and emoluments of one entire semester, to be converted to the said fabric. But if they fall into a similar negligence a third time, they shall be perpetually deprived of the office of beadle, and shall be rendered incapable of obtaining it further, and it shall be deemed vacant by that very fact, etc.
14 § 8. Moreover, we forbid, under excommunication latae sententiae and double the penalty in case injury is committed, if the assessment varies; we apply the penalty to the party suffering damage or injury from now on, to be incurred by the very fact, as often as it is contravened, to our beloved sons the present and future governors of the said City, the senator, the auditor of the Apostolic Chamber of the Curia of Cases, and the other ordinary and extraordinary judges of the aforesaid Curia and City, that they shall not take action in cases against the said scholars or any of them for the time being; and to the collectors of customs and other taxes of whatever kind, even on account of the gates and bridges of the said City, that in matters and goods belonging to the said scholars for the use of their Studio of this kind, they shall not presume to do or attempt anything against the exemption and immunity aforesaid, in prejudice of the said scholars or any of them, directly or indirectly, under any pretext whatsoever.
15 § 9. Wherefore by apostolic letters we command the aforesaid Dominic, bishop and moderator and reformer, and he who shall be rector of the said Studio of the City for the time being, and the aforesaid moderators and reformers existing for the time being, that they observe all and singular of the aforesaid matters, insofar as it pertains to them; and that what shall be done by others, of whatever status, rank and condition, the rector himself shall cause to be firmly observed by the authority of our said reformers, with the counsel of the said reformers: compelling all transgressors, contumacious and disobedient persons whatsoever, by ecclesiastical censure and other remedies of law which shall seem to him opportune, with all appeal entirely removed.
16 § 10. But to our venerable brother Cardinal Raphael, bishop of Ostia, the present dean of the college of our venerable brothers, the cardinals of the said Roman Church, and to those existing for the time being, the first of the order of cardinal priests, and the first of the order of cardinal deacons of this kind, to the extent that they shall assist the rector and reformers, doctors and scholars aforesaid, when and as often as they shall be requested on the part of them or any of them, with effective aid of defense in the aforesaid matters, and that they cause them and each of them respectively to use, enjoy and possess peacefully the authority, faculty, exemption, immunity and other things aforesaid, not permitting them to be unduly molested, disturbed or disquieted by any. § 11. Also to the Riarello, constables, executors, marshals and others of the Curia and City obedient to the rector; to the said executors whatsoever, present and future, that the mandates of the aforesaid rector against whomsoever, both personally and really, to be executed on the occasion and authority of the aforesaid matters, decreed for the time being with the counsel of the said reformers or at least two of them, they shall execute diligently and faithfully.
17 § 12. Notwithstanding the aforesaid, and contrary constitutions and ordinances apostolic, and statutes and customs of the said City, strengthened by oath, apostolic confirmation or any other firmness, nor yet all those things which the said predecessor in his aforesaid letters willed not to stand in the way, any things whatsoever to the contrary; or if to any, commonly or severally, it has been granted by the said See that they cannot be interdicted, suspended or excommunicated by apostolic letters not making full and express and word for word mention of the indult of this kind.
18 § 15. Moreover, because, on account of the continuous residence of our Curia in the City, there is frequent concourse of ecclesiastical persons in that same City, and in modern times, for clearer understanding of the same canons, knowledge of laws is recognized to be not without purpose, to any archdeacons, deans, parish priests, provosts, cantors and other secular clerics, even those holding personates, and to presbyters, to whom it is prohibited by law to hear laws, under sentence of excommunication and other penalties, in the Studio of this City only, for clearer understanding of the said canons, to hear laws, without incurring any censure or penalty (made by the memorable constitution of Pope Honorius II, likewise our predecessor, and by other apostolic constitutions and ordinances, and other contrary matters notwithstanding), by the authority and tenor aforesaid, we grant full and free license. To no one, therefore, etc.

Cardinali Difensori dello Studio deputati; — 11.
6 Vieta la mano dell'avvocatura;
7 Indica l'ufficio dei lettori;
8 deve usarsi la diligenza.
12 gis, ut, eorum opera sic adhibita (super quo eorum et ipsorum cuiuslibet conscientias oneramus), Studium praedictum votivis proficiat incrementis.
A nessuno dunque ecc.
