Execrabilis
Bull condemning appeals to a future council
Pius, bishop, servant of the servants of God, for the remembrance of this matter in perpetuity.
1 An execrable and in former times unheard-of abuse has grown up in our own day, so that some, imbued with a spirit of rebellion, presume to appeal from the Roman Pontiff, the vicar of Jesus Christ, to whom it was said in the person of the blessed Peter: "Feed my sheep," and "whatsoever thou shalt bind upon earth shall be bound also in heaven," not from a desire of sounder judgment, but from an evasion of committed sin, to a future council; how much this is contrary to the sacred canons, and how harmful it is to the Christian commonwealth, anyone not ignorant of the laws can understand. (1)
2 Year 1459 BULLARIUM ROMANUM
3 For (to pass over other matters which most manifestly contradict this practice) who would not judge it ridiculous and absurd that an appeal is made to that which does not exist and is not known when it will come to be? The poor are oppressed in manifold ways by the more powerful, crimes remain unpunished, rebellion against the first See is nurtured, freedom to do wrong is granted, and all ecclesiastical discipline and hierarchical order are thrown into confusion.
4 § 1. Wishing therefore to drive far from the Church of Christ this pestilential poison, to provide for the safety of the mandate of the Pope and of the sheep committed to our care, and to remove all matter of scandal from the fold of our Saviour, by the counsel and assent of our venerable brethren the cardinals of the Holy Roman Church and of all prelates and interpreters of divine and human law following the Curia, and by our certain knowledge, we condemn such provocations and reject them as erroneous and detestable, annulling and entirely voiding any that may have been thus interposed heretofore, and we decree and declare that they are null and of no effect, as vain and pestilential. We command henceforth that no one dare, under any pretext whatsoever, to interpose such an appeal from our ordinances, sentences, or any mandates of ours and of our successors, or to adhere to an appeal interposed by another, or to make use of them in any way.
5 § 2. If anyone, however, shall act contrary to this, from the day of publication of these presents in the Chancery, he shall incur the penalty of apostolic excommunication after two months, whatever his status, rank, order, or condition, even if he be resplendent with imperial, royal, or pontifical dignity—he shall by that very fact incur the sentence of excommunication, from which he cannot be absolved except by the Roman Pontiff, and then only at the point of death. Moreover, any university or college shall be subject to ecclesiastical interdict, and nevertheless both colleges and universities and the aforesaid and any other persons whatsoever shall incur those penalties and censures which those who support treason against the majesty of the realm and heretical depravity are known to incur. Furthermore, notaries and witnesses who shall have been present at such acts, and generally all who knowingly give counsel, aid, or favor to such appellants, shall be punished with the same penalty.
6 § 5. Let no man therefore be permitted to infringe this page of our will, condemnation, reprobation, annulment, nullification, decree, declaration, and mandate, or to act against it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed apostles Peter and Paul.
7 Given at Mantua, in the year of our Lord's Incarnation one thousand four hundred fifty-nine, on the eighteenth day before the Kalends of February, in the first year of our pontificate. Given on 18 January 1459, pontifical year 1.

(1) Haec in Edit. Rom, sub numero v (r. t.).
2 An. C. 1459 BULLARIUM ROMANUM
