Apostolic Letter on the canonical erection of the Catholic University of Toulouse
institution.
1 He recalls what he himself accomplished from the beginning of his pontificate for theological studies.
2 That the city of Toulouse has flourished with the highest praise of sacred disciplines, and has obtained singular commendation of them before the Apostolic See, can easily be inferred even from this reason: that Our predecessor Urban V ordered the mortal remains of the Angelic Doctor to be transferred to Toulouse; which reason that blessed Pontiff thus signified: "because there is a new University in theology, which I wish to be founded in the solid and firm doctrine of that saint." That such a University, which indeed stands as a monument where the sacred ashes of so great a man are laid and is celebrated in a singular manner by memory, has in these our times been restored and renewed through the care and work especially of the Archbishop of Toulouse and of the Bishops of the three neighboring dioceses, We are exceedingly pleased. Following in the footsteps of Our predecessors, who have always been not only custodians but also patrons of sacred doctrines, from the very beginning of Our pontificate We have diligently devoted Ourselves to recalling theology, the prince and leader of all sciences, exiled from civil Athens, to its former glory among Catholic institutions of learning. Indeed, in so many shadows of errors, it has seemed to Us useful and most expedient that the studies of this most brilliant discipline be advanced, since it has such importance for illuminating minds with the light of divine truth, for defending the Catholic faith, and for the advancement of all sciences, that nothing excellent and distinguished is brought forth without it. Moreover, in order that more abundant fruits might be gathered from it, We have more than once commanded that the professorships of theology be increased, and that studies be directed according to that method which has been proposed by the greatest of the scholastics. All these things We both know and rejoice have been diligently and faithfully accomplished in the Catholic University of Toulouse, and We consider this a great source of praise, from which that illustrious seat of sciences may receive no small accession of glory and renown. From those matters which have more than once been brought to this Apostolic See, it is sufficiently established that the administrators and teachers of the same University have devoted assiduous labor so that the theological faculty might make progress before all others, as was fitting, and now it is so constituted that it appears to merit the honor of canonical erection. Wherefore, when from Our beloved son Julian Florian, Cardinal Desprez, Presbyter of the Holy Roman Church, by dispensation of the Roman Apostolic See Archbishop of Toulouse, prayers have been presented to Us that We confirm the more recent constitutions of the University and strengthen the aforesaid theological faculty with the protection of Apostolic authority, and enrich it with graces and privileges which are more abundantly reserved for institutions especially approved by the Apostolic See, We, having sought the opinion of the Sacred Congregation for the direction of studies, have deemed it right to accede benignly to these wishes. Therefore, in order that Our benevolence toward the founders, administrators, teachers, and the studious youth of the Catholic University of Toulouse may be known and perceived more clearly, wishing to treat all and each whom these Our solemn letters favor with particular beneficence, and absolving from any excommunication and interdict and other ecclesiastical censures, sentences and penalties imposed in any manner or for any reason, if perchance they have incurred any, for this reason alone, and holding them to be absolved, by Our Apostolic authority, by virtue of these presents We grant that the constitutions of the aforesaid University, provided they be amended according to the observations added by the aforesaid Sacred Congregation, shall be ratified and confirmed, and to the privileges already previously conceded there shall be added the canonical erection of the theological faculty. Therefore We will that henceforth the Toulouse theological faculty, with the right of the Academy, namely of baccalaureate, of licentiate, and of the degree of Doctor of Laws, by privilege of the Apostolic See and to the degrees, with the approval of the See itself, may rightly and validly confer and be able to confer, the prescriptions and rules contained in the statutes being carefully and diligently observed, of which statutes We have ordered an exemplar to be kept with the statutes by the same Sacred Congregation for the direction of studies. Decreeing that these present letters shall always be firm, valid and effective, and shall obtain and secure their full and complete effects, and shall most fully avail in all respects for those to whom it pertains and shall pertain in any manner for the time being, and that it shall be null and void if anything to the contrary should be attempted by anyone, by whatever authority, knowingly or unknowingly. Notwithstanding the Constitutions and ordinances of the Apostles, as well as the statutes of the said University even confirmed by oath, by Apostolic confirmation, or by any other firmness, customs, and all other things to the contrary whatsoever.
3 Given at Rome at St. Peter's under the Fisherman's Ring on 20 December 1889, in the twelfth year of Our pontificate.
